Mayor Saul in the chair.

Ald Callahan moved to appoint
Cyril D. Lagen Recorder Pro Tem.
Carried.
Mayor Saul stated that this meeting
is called for the purpose of appoint-
ing a City Carpenter and acting on
any other business that might proper-
ly come before a regular session of
the City Council.
Ald.Strobel nominated Bart Cain as
City Carpenter,
Ald. Wallis nominated Mike Mel -
choir,
Ald. Leist moved to adjourn.

Petition 'of Mary M. Langdon, et al,
asking the city council to install an
electric street light at Cooper's barn
on West Fifth street at the turn of
said street, presented and read. On
motion of Ald. McLaughlin the pray-
er of petitioners was granted and the
city electrician instructed accordingly.
Communication of the Mississippi
Valley Waterways association, asking
the city council to appropriate the
sum of $250.00 as their share toward
the cost of meeting the expenses of
the association, presented and read.
On motion of Ald. Strobel the com-
munication was referred to the com-
mittee of the whole.
Original notice of George A. Eul-
berg vs. John Trexler, ffosephine Trex-
ler, his wife, Dubuque county and City
of Dubuque, relative to a certain real
estate mcptgage covering the south
middle 1 -5 of out lot Number 453, pre-
sented and read. On motion of Ald.
Strobel the notice was referred to the
city attorney.
City Recorder Shea presented and
read the notice, certified to by the
publishers, of the city council's inten-
tion to construct an eight -inch tile
pipe sanitary sewer in West Sixteenth
street from the manhole at Montrose
Terrace to the alley first west of Fair-
view Place. On motion of Ald. Wallis
the notice was received and filed.

may be passed. I would suggest,
however, that you get a little more
evidence in the case so that you may
be satisfied of the truth of the state-
ments contained in the petition in
order that no injustice be done to any
person.

for the improvement of North street
hereinafter described has been com-
pleted, and the city engineer has com-
puted that the cost and expense of
said improvement amount to $3,-
328.37.
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That • to provide for the cost of im-
proving North street from the end of
the present improvement to the east
line of Louisa street, the mayor be
and he is hereby required to execute
and deliver to the city recorder, to be
by him registered and countersigned,
thirteen bonds for Two Hundred and
Fifty Dolars each and one for Seven-
ty- eight and 37 -100 dollars, number-
ed 5330 to 5343 inclusive, dated No-
vember 3rd, 1917, payable on or be-
fore seven years after the date there-
of, and bearing interest at the rate
of five per cent per annum, payable
semi - annually.

avenue, hereinafter described has
been completed, and the city engineer
has computed that the cost and ex-
pense of said improvement amount to
$3,123.48.
Therefore, Be it Resolved by the-
City Council of the City of Dubuque,
That to provide for the cost of im-
proving Delaware avenue from Avoca
avenue to Audubon avenue, except
where already improved, the mayor
be and he is hereby required to exe-
cute and deliver to the city recorder,
to be by him registered and counter-
signed, twelve bolds for Two Hundred
and Fifty dollars each and one for
One Hundred and Twenty -three and
48 -100 dollars, numbered 5344 to 5356
inclusive, dated November 3rd, 1917,
payable on or before seven years after
the date thereof, and bearing interest
at the rate of five per cent per an-
num, payable semi- annually.

Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of im-
proving Seventeenth street from the
alley between Clay street and White
street to the westerly rail of the Chi-
cago Great Western Railroad Com-
pany's tracks, the mayor be and he
is hereby required to execute and de-
liver to the city recorder, to be by
him registered and countersigned,
fifty -seven bonds for Two Hundred
and Fifty Dollars each and one for
One Hundred and Forty -two and 67-
100 dollars, numbered 5357 to 5414,
inclusive, dated November 3rd, 1917,
payable on or before seven years after
the date thereof, and bearing interest
at the rate of five per cent per annum,
payable semi - annually.

the resolution. Carried by the follow-
ing vote:

Your committee on streets would
respectfully report that we have ex-
amined the improvement of the Bee
Branch sewer from Twenty- eighth
street north and would respectfully
recommend that the same be accept-
ed, N. J. Staner, contractor, and that
a warrant be drawn to pay for the
same.

tions of said sewer prepared by the
city engineer and now on file in the
office of the city recorder, and be it
further
Resolved, that said sewer shall be
completed on or before the first day
of 'December, 1917, and shall be paid
for at the time and in the manner
prescribed by Chapter XXXIV of the
Revised Ordinances , of 1901 of the
City of Dubuque for the payment of
the cost of constructing sewers. The
proposals for doing such work will be
acted upon by the council on the 18th
day of October, 1917, and the city re-
corder is hereby ordered to give ten
days notice by publication asking for
proposals as provided by ordinance.

STIPULATION AND AGREEMENT.
Whereas, The contract for the im-
provenient of Windsor Ave. from the
end of the previous brick improvement
to the south line of Lot One (No. 1)
of Burden & Lawther's Addition to
the City of Dubuque, has been com-
pleted, and the special assessment to
pay for said improvement was levied
by the City Council of the City of Du-
buque, upon all property subject to
assessment on January 22, 1917; and
Whereas, An appeal was taken by
the undersigned from the action of
said Council in levying said assess-.
ment to the District Court of Da-
Buque County, Iowa, which appeal is
still pending and has not been dis-
posed of; and
Whereas, It is deemed advisable by
the undersigned on the one hand, and
the City of Dubuque on the other
hand, to adjust all questions raised by
the appeal out of court; and
Whereas, The undersigned, being all
of the persons whose property is ef-
fected by said assessment, have sig-
nified their intention and willingness
to pay their respective assessments
for said improvement in full, provid—
ing the City of Dubuque will remit the
interest which has accumulated upon
the unpaid assessment from the date
of levy up to September 1st, 1917; and
Whereas, it is agreeable to the City
Council of the City of Dubuque to re-
mit the interest which has accrued
upon the unpaid assessments of the
undersigned from the date of levy up
to September lst, 1917, upon the ex-
press condition that the undersigned,
being all of the persons affected by
this assessment, do pay their respec-
tive assessments in full or in deferred
payments without delay, and do also
immediately dismiss the appeal
which is now pending in court and pay
whatever court costs have been made;

Therefore, In consideration of the
remission of the interest upon the
special assessments which have been
levied for the improvement of Wind-
sor Avenue as above described from
the property of the undersigned from
the date of levy to September lst,
1917, the undersigned do hereby agree
to pay such assessments in full with-
out delay or to pay the same in de-
ferred payments as provided by law,
the interest to begin and run from
September 1st, 1917; they do further
agree to dismiss the appeal which has
been taken from the action of the
City Council in levying said assess-
ment and now pending in the District
Court of Dubuuqe County, Iowa; they
do further waive any and all rights
which they may have at law or in
equity, to question the assessment as
levied for any purpose whatsoever,
whether such objections relate to jur-
isdictional questions or not, the inten-
tion being to release and relinquish
every right which we may have to re-
ject to refuse to pay our assessment
for any purpose whatsoever.
The City of Dubuque does hereby
agree to remit the interest upon all
assessments of the undersigned for the
improvement of Windsor Ave. as
stated from the date of levy up to
September lst, 1917, providing the un-
dersigned represent all of the persons
who are _affected by the assessment
for said improvement and they do
perform all of the conditions agreed
to be performed by them herein.

Council of the City of Dubuque:
Gentlemen: The case of James H.
Hahn vs. City of Dubuque, Law No.
19145, was called for trial at the
present term of the District Court.
This was a personal injury action for
which damages were sought to the
extent of Ten Thousand ($10,000.00)
Dollars. On Jan. llth, 1917, the
plaintiff fell on Johnson avenue near
Eagle Point avenue and sustained a
broken hip. The claim was baaed
upon the fact that the sidewalk at
that point was permitted to be dang-
erous because of accumulations of ice
and snow thereon. When the case
was called for trial the plaintiff sub-
mitted a proposition of settlement to
the undersigned which appealed to us
as being fair and reasonable. The
proposition was that the city pay the
plaintiff the sum of Two Hundred
Thirty -five ($235.00) Dollars, where-
upon the plaintiff would dismiss his
suit and pay all costs made in court.
In view of all the circumstances it
was deemed advisable by the under-
signed to effect a settlement of the
case for the above amount.
We, therefore, recommend that our
action in effecting this settlement be
approved by you and that a warrant
be drawn in favor of Walter Koerner,
attorney for the plaintiff, in the sum
of Two Hundred Thirty -five ($235.00)
Dollars and the treasurer be instruct-
ed accordingly.

desirous of receiving permission from
the City Council to place two gasoline
tanks under the sidewalk at 5th
street. between White and Clay
streets, and connect a curb pump with
said tanks at said place:
Now, therefore, in consideration of
the permission granted by the City
Council to place said gasoline tanks
under the sidewalk at 5th street, be-
tween White and Clay streets, and
also the curb pump, as above speci-
fied, Albert Fluckiger, agrees, and by
these presents does agree, to main-
tain said gasoline tanks and curb
pump in a careful and safe manner;
and
IT IS FURTHER STIPULATED
AND AGREED that Albert Fluckiger
shall alone be responsible for and pay
any and all damages that may grow
out of any injuries sustained by any
person or which may happen to any
property by reason of the mainte-
nance of said gasoline tanks and curb
pump as the same may be adjudged
by any court of Law or Equity.
The signing of this Stipulation shall
be deemed an acceptance of the con-
ditions thereof.

end of the present improvement to
Rosedale avenue, and would respect-
fully recommend that the same be ac-
cepted, Wilmer Cook, contractor.
We would further recommend that
the city engineer be and he is hereby
instructed to prepare a special assess-
ment against the lots or parcels of
real estate subject to assessment for
said improvement and file the same
in the office of the city recorder who
will thereupon publish the notice of
said assessment as required by ordi-
nance.

committee of the whole the bids for
improving Klingenberg Terrace, front
North Main street to Klein street,
and act on the same in the council

to award the contract for the im-
provement of Klingenberg Terrace,
from North Main street to Klein
street, to Even & Ulrich, they being
the lowest bidders, and their bond
placed at one - fourth the amount of
the contract. Carried.
Ald. Plamondon moved to take
from the committee of the whole the
bids for improving Cora street, from
the east property line of Grandview
avenue to the south curb line of Curt-
is street, and act on the same in the
council meeting. Carried. Ald. Pla-
mondon moved to award the contract
for the improvement of Cora street,
from the east property line of Grand-
view avenue to the south curb line of
Curtis street, to John Tibey, he being
the lowest bidder, and his bond plac-
ed at one - fourth the amount of the
contract. Carried.
Ald. Frith niovecl that the city en-
gineer be instructed to notify the Du-
buque Electric company and C. B.
McNamara & Co. to make necessary
repairs on the improvement of Wind-
sor avenue, work to be done under the
supervision of the city engineer. Car-

Ald. Frith moved that the city at-
torney be instructed to notify the
bonding companies for the following
improvements: C ay street, Eigh-
teenth street and Couler avenue; Lo-
cust street, from Jones street south,
and Rhomberg avenue, to repair said
streets, work to be commenced with-

To the Electors of the City of Du-
buque, Iowa:
Notice is hereby given that there
will he a special election on the 15th
day of October, 1917, at which elec-
tion the following question will be
submitted for decision by the electors
of the City of Dubuque, Iowa, viz:
SHALL THE FOLLOWING AMEND-
MENT TO THE CONSTITUTION
BE ADOPTED?
"To add thereto following section
twenty -six (26) thereof and as section
twenty -seven (27) of article one (1)-
of said constitution the following, to
wit: -
"Sec. 27. The manufacture, sale, or
keeping for sale, as a beverage, of in-
toxicating liquors, including ale, wine
and beer, shall be forever prohibited
within this state. The General As-
sembly shall by law prescribe regula-
tions for the enforcement of the pro-
hibition herein contained, and shall
provide suitable penalties for the vio-
lation of the provision hereof."

and register only such voters as were
absent from the city during the pre-
ceding days that the board was in
session, also such voters as did not
become citizens until Monday, October
15th, 1915.

Fourth Precinct — F. Roesner's
place, 2703 Jackson Street.
All qualified voters of said city are
hereby notified that unless they voted
at the last fall election they must pre-
sent themselves at the places and time
herein above stated for registration or
they will be debarred of the privilege
of voting at said election.
