Leist moved to suspend the rules for
the purpose of allowing any one pres-
ent in the council room to address the

Mr. Hanson addressed the council,
remonstrating against the proposed
sewer in Heeb street, also the differ-
ent representatives of fire hose com-
panies addressed the council. On

to an error being made on his assess-

Petition of Thos. J. Mulgrew, ask-
ing the city council for permission to
use Charter street and Water street
for the filling of the same until such
time as the city may desire to open
Charter street and Water street for
public travel with the understanding
that when Charter street and Water
street are opened that the city will
pay them for such filling that they
may place in the streets, presented

Petition of Jno. F. Stemm, et al,
asking the city council to stand part
of assessment for the improvement of
West Third street, on account of the
same being a natural waterway, pre-
sented and read. On motion of Ald.
McLaughlin, the petition was referred
to the committee of the whole.
Petition of E. Langworthy 'Estate,
by John G. Chalmers, asking the city
council to reduce the assessment lev-
ied against Lot 88 in East Dubuque
Add., for the improvement of Seven-
teenth street on account of said street
being a natural waterway, presented
and read. On motion of Ald. Frith,
the petition was referred to the com-
mittee of the whole.
Petition of Mrs. Florence M. Hay-
den, protesting against the special as-
sessments levied against Sub. 1 of City
Lot 609, Lot 2 for the improvements
of West Third street and Bluff street
and South Bluff street, presented and
read. On motion of Ald. Wallis, the
petition was referred to the city en-
gineer.
Petition of John O'Hern, asking the
city council to accept the sum of
$25.00 in full settlement of the spe-
cial assessment levied against Lot 69,
Union Add4tion, in the year 1893, pre-
sented and read. On motion of Ala.
Strobel, the petition was referred to
the city treasurer and city attorney to
report back to the council.
Petition of John Rumple, asking
the city council to reduce the valua-
tion on the north niney -five feet of
Lot 2 of the Sub. of Lot 3 of the Sub.
of Mineral Lot 172, presented and
read. On motion of Ald. Frith the
petition was referred to the board of
equalization.
Petition. of John Rumple, guardian
of Maud, Grant, Kenneth and Vincent
Elliott, owners of Lots 1 and 9,
Griggs' Sub., asking the city council
to allow the taxes for the year 1916
to remain a lien without interest
against the property, presented and
read. On motion of Ald. Wallis, the
prayer of the petitioner was granted
and the city treasurer instructed ac-
cordingly.
City Recorder Shea presented and
read the notice, certified to by the
publishers, of the City Council's inten-
tion to construct an eight -inch tile
pipe sanitary sewer in Heeb street,
from the end of the present sewer to
the south line of Lot 5, Marsh's Addi-
tion. On motion of Ald. Frith, the
notice was received and filed.

Gentlemen: Herewith return letter
of American Surety Co., relative to
Iowa Telephone Co. bond for work
done on Rhomberg Ave. during the
year of 1916. I would recommend
that this bond be held to the spring
of 1918 as there is some question
about the condition of one walk that
was replaced by the telephone com-
pany. The party owning the lot is
not satisfied because of a few cracks
in same.

Whereas, The contract heretofore
entered into by the City of Dubuque
for the improvement of Wood street,
hereinafter described has been com-
pleted, and the city engineer has com-
puted that the cost and expense of
said improvement amount to $1,370.12
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of im-
proving Wood street, from the north
end of the present improvement north,
to Rosedale avenue, the mayor be and
he is hereby required to execute and
deliver to the city recorder, to be by
him registered and countersigned, five
bonds for Two Hundred and Fifty
Dollars each and one for One Hun-
dred Twenty and 12 -100 Dollars, num-
bered 5415 to 5420, dated December
1st, 1917, payable on or before seven
years after the date thereof, and
bearing interest at the rate of five per
cent per annum, payable semi -annu-
ally.
Ald. Wallis moved the adoption of
the resolution. Carried by the fol-
lowing vote:

Your committee on streets would
respectfully report that we have ex-
amined the improvement of the alley
first south of Delhi street, from Louisa
street to Hall street, and would rec-
ommend that the same be accepted,

the city engineer be and he is hereby
instructed to prepare a special as-
sessment against the lots or parcels of
real estate subject to assessment for
said improvement and file the same
in the office of the city recorder, who
will thereupon publish the notice of
said assessment as required by ordi-
nance.

amined the sewer in Seventh Street
Extension, from the end of the pres-
ent sewer in said street to a point
about three hundred feet east, John
Tibey, 'contractor.' We would further
recommend that the city engineer be
and he is hereby instructed to pre-
. pare a special assessment against the
lots or parcels of real estate subject to
assessment for said sewer and file the
same in the office of the city record-
er, who will thereupon publish the
notice of said assessment as required
by ordinance.

E. R. Barr, relative to the unsanitary
condition of the vacant land on the
north side of Dodge street between
South Bluff and Peabody street and
asking to have the same investigated,
presented and read. On motion of
Ald. Leist, the communication was
received and filed.
On motion of Ald. Leist, the follow-

of the Board 'of Health was adopted.
Ald. Frith offered the following:
Be it Resolved by the City Council
of the City of Dubuque, That a sani-
tary sewer of eight -inch tile pipe be
constructed in Heeb street, from the
end of the present sewer to the south
line of Lot 5, Marsh's Addition, ac-
cording to the plans and specifications
of said sewer prepared by the city
engineer and now on file in the offiice
of the city recorder, and be it further
Resolved, that said sewer shall be
completed on or before the first day
of January, 1918, and shall be paid
for at the time and in the manner
prescribed by Chapter XXXIV of the
Revised Ordinances of 1901 of the
City of Dubuque for the payment of
the cost of constructing sewers. The
proposals for doing such work will be
acted upon by the council on the 15th
day of November, 1917, and the city
recorder is hereby ordered to give ten
days notice by publication asking for
proposals as provided by ordinance.

Gentlemen: We have investigated
the special assessment against Mrs.
Hannig for the improvement-of North
Booth street and find same is correct.
Mrs. Hannig has an idea that they
were never paid for the piece of
ground taken from their property to
put through this street. I looked up
this matter and find that a jury made
an award for, this land, the report was
accepted. The warrant drawn cover-
ing the amount allowed was redeem-
ed.
We can find no errors in the assess-
ments against these people, also they
have the required amount of ground
according to recorded plats.

'Waiver and Agreement.
WHEREAS, resolutions have been
passed and adopted by the City of
Dubuque for the improvement of Pine
street, from Thirty -first street to Thlr-
'ty- second street, and a contract has
been entered into with James Street
for the improvement of said street;
and
WHEREAS, a grade has been
adopted on said street; and
WHEREAS, the property owners
fronting on said street have petition-
ed the City Council not to have the
two feet along the east property line
of said street graded, due to the fact
that the buildings are so close to said
line; and it is the intention of the City
Council to grant said request;
THEREFORE, We, the undersign-
ed, property owners abutting upon
and adjacent to said Pine street, do
hereby agree that the City of Du-
buque shall have the right to improve
said Pine street, according to the
grade established and by leaving in
two feet of the grading along the east
property line of said street.
AND WE DO FURTHER AGREE
not to object to the levying of any
special assessment or to pay said as-
sessment when due because said grad-
ing was not done or because of any
error, irregularity or illegality in any
of the proceedings or manner of con-
structing the street, and to waive any
and all right we may have, at law or
equity, to object to the payment of
any special assessments levied for the
improvement of said street because
of any error, mistake, irregularity, il-
legality or non - conformity with any
law or Ordinance in the construction
of said street, and consent to pay our
assessments when the same become
due in the manner provided by law,
it being specifically understood that
we intend hereby to consent to the
improvement of said Pine street, as
above described, and that We will not
object for any reason whatsoever to
the improvement of said street in the
manner stated, and waive every right
we may have to object.

AN ORDINANCE PROHIBITING
THE RUNNING AT LARGE OF
CHICKENS, DUCK S, GEESE,
TURKEYS AND OTHER POUL-
TRY WITHIN THE LIMITS OP
THE CITY OF DUBUQUE, AND
PROVIDING A PENALTY OF THE
VIOLATION HEREOF.
Be it ordained by the City Council
of the City of Dubuque:
Sec. 1. That it shall be unlawful
for any person or persons owning
chickens, ducks, geese, turkeys and
other poultry within the limits of the
City of Dubuque to permit the same
to run at large, but said chickens,
ducks, geese, turkeys and other poul-
try shall be confined upon the prem-
. ises, lot or lots of the owner thereof.
Sec. 2. The term "running at
large" shall be taken to mean any
wandering by said chickens, ducks,
geese, turkeys and other poultry off of
the premises, lot or lots of the owner
or owners thereof into, upon or over
any street, alley; avenue or public
place, or upon the property and
premises of persons other than the
owner or owners of said chickens,
ducks, geese, turkeys and other poul-
try.
Sec. 3. Any person or persons per-
mitting their chickens, ducks, geese,
turkeys and other poultry to run at
large, as herein defined, shall be guil-
ty of a misdemeanor and upon con-
viction shall be fined not more than
Five ($5.00) Dollars nor less than
One ($1.00) Dollar, and costs of
prosecution.
Sec. 4. This Ordinance shall be in
force and effect from and after its
passage by the City Council and pub-
lication as provided by law.

Notice is hereby given to all con-
cerned that a special assessment as
provided by law will be levied at a
session of the City Council of the City
of Dubuque, Iowa, to be held Thurs-
day, November 15th, 1917, to pay for
improving the alley first south of
Delhi street, from Louisa street, to
Hall street. John Tibey, contractor.
Amount of Special Assessment,
$1,843.14, same to be assessed against
the property legally subject to assess-
ment upon and along said alley.
And that there is a plat and sched-
ule on file in the office of the City Re-
corder of said City of Dubuque, show-
ing the street in which said sewer
was constructed and the separate lots
and parcels of ground or specified
portions thereof subject to assessment
for such improvement, the name of
the owner thereof as far as prac-

Thursday, November 15, 1917, to be
acted on by the City Council on said
date, for the construction of an eight -
inch tile pipe sanitary sewer in Heeb
Street, from the end of the present
sewer, to the south line of Lot 5,
Marsh's Addition, in accordance with
the plans and specifications prepared
by the City Ehgineer and now on file
in the office of the City Recorder.
It is estimated by the City Engineer
that said improvement will require:
180 lineal feet of eight -inch tile
pipe.

The work to be paid for when said
work is completed and as prescribed
by Chapter XXXIV and amendments
thereto of the Revised Ordinances of
