The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Terry Koelker, Buesing &Associates, 1212 Locust Street, spoke on behalf of the property
owners, stating the owners have cottages on the rear of the property that are leased out,
and they are planning to sell the property to one of the lessors. He stated that Lot 2 does
not have street frontage and requires a waiver.
Staff Member Duba detailed the staff report, noting the submitted Plat of Survey of Buelow
Place subdivides an approximately 21-acre parcel into two parcels of approximately 12
and 8.7 acres. As Lot 2 does not have street frontage, it requires a waiver. He also stated
that this property is in a conservation easement that restricts activity and development of
the property.
The Zoning Advisory Commission discussed the request finding it appropriate.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the simple subdivision as submitted subject to waiving the bulk regulations for
lot area, lot coverage, and rear yard setbacks for the property at 1363 lowa Street.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The subject property is an approximately 21-acre parcel that is irregular in shape. The
property is improved with two existing single-family residences and seven smaller cabins.
Pursuant to the Unified Development Code (UDC) the proposed subdivision is classified
as a Simple Subdivision'. The proposed plat of survey would create two lots, one of which
would not have frontage along a public or private street and therefore the Simple
Subdivision requires review by the Zoning Advisory Commission.
DISCUSSION
As proposed, the Plat of Survey of Buelow Place would subdivide an existing
approximately 21-acre parcel into two new lots. The subdivision is being proposed so Lot
2 can be sold.
The following is a description of each proposed lot:
■ Lot 1 (12.195 acres) is a parcel abutting the right-of-way along Edmore Lane. The
lot would contain an existing single-family residence and detached garage.
■ Lot 2 (8.737 acres) would be comprised of a single-family home with attached
garage and seven cabins. This lot would not have frontage along a public or private
street, but an access easement is platted across Lot 1 and the property at 954
Edmore Laned to provide access to Lot 2.
Pursuant to the Unified Development Code (UDC) Chapter 11-14, all lots shall have
frontage along a public street or an approved private street. Because the proposed Lot 2
will not have the required street frontage, the applicant is requesting a waiver of this bulk
regulation requirement for Lot 2. The proposed lots are otherwise in substantial
conformance with the Unified Development Code
' UDC Chapter 16-11-6 defines a Simple Subdivision as "Any subdivision or consolidation of property in
which no new streets, public or private, are proposed, which does not require the construction of any public
improvements, and which creates fewer than three lots."
Staff Memo — Plat of Survey of Buelow Place
The UDC categorizes the proposed plat as a Simple Subdivision. Pursuant to UDC
Chapter 11-7.3, the Zoning Advisory Commission and City Council are the reviewing
authorities for a Simple Subdivision that requires a waiver of bulk regulations. The Zoning
Advisory Commission shall review the plat to determine whether it is in substantial
conformance with the Unified Development Code and shall consider the waiver of the
street frontage requirement.
This property resides in a larger conservation easement that is held by lowa Natural
Heritage Foundation and Four Mounds Foundation. This easement severely restricts
types of activities, new development, rebuilding and other named issues. The easement
is not enforceable by the City of Dubuque's code but is enforced privately by the holders
and the legal system.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Plat of Survey
of Buelow Place and recommends approval subject to waiving the street frontage
requirement for Lot 2.

RESOLUTION APPROVING THE SIMPLE SUBDIVISION PLAT BUELOW PLACE,
DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Simple Subdivision Plat Buelow
Place, Dubuque, Iowa; and
Whereas, said Simple Subdivision Plat has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Simple Subdivision Plat has been examined by the City Council and
they find that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage for Lot 2 on
a public street or an approved private street.
Section 2. That the Simple Subdivision Buelow Place, Dubuque, Iowa is hereby
approved, and the Mayor and City Clerk are hereby authorized and directed to endorse
the approval of the City of Dubuque, Iowa upon said Plat of Survey.
