Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report, and related materials are attached for your review. Discussion Richard Sova, Landover Corporation, spoke on behalf of the application, stating that they request to rezone to OC in order to construct a 48-unit apartment building for which they've received funding from the lowa Finance Authority. He stated this is like their previous project nearby, Gardens of Dubuque. There was no public input. Staff detailed the staff report noting they are proposing to rezone part of the parcel and leave the other with the existing PC district designation. Staff described the land uses in the area. Staff highlighted that the development would include 48-units and approximately 100 parking spaces, and would be subject to the city's site plan review process. Staff explained that Radford Road is designed to accommodate a large volume of traffic, so this development shouldn't negatively impact traffic in the area and noted the comprehensive plan promotes a mix of uses. The Commission discussed the request and noted the close proximity to the schools is a benefit of this location and that the project will serve as a transition between commercial areas along Radford Road and lower-density residential areas to the north and east. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the rezoning request as submitted. The City's Future Land Use Map identifies the property as Park and Open Space. Impact of Request on: Utilities: The area is adequately served by both city water and sanitary sewer. These existing utilities are adequate to serve the site. Traffic Patterns/Counts: The 2021 lowa Department of Transportation traffic counts indicate an average annual daily traffic count of 6,900 vehicles along this section of Radford Road, which is classified as a major collector street, which is designed to accommodate large volumes of traffic. Consequently, it is not anticipated that the proposed rezoning would negatively impact traffic along Radford Road. Public Services: Existing public services are adequate to serve the site regardless of how it may be utilized or redeveloped. Environment: The subject site is currently unimproved and any development on the property would be required review and approval by the city's Development Review Team (DRT) to ensure the project meets all the required development standards, including but not limited to, adequate green space, landscaping, parking, site access, utility connections, and stormwater management. If the requested rezoning is approved, any future development would be required to be in compliance with the approved rezoning ordinance. Effects on the environment would be mitigated through appropriate site development. Adjacent Properties: The subject site is surrounded by R-3 Moderate Density Multiple- Family Residential to the east, R-4 Multiple-Family Residential to the northeast and north, PC— Planned Commercial to the north, PC— Planned Commercial and R-1 Single-Family Residential to the west, and PC— Planned Commercial and C-2 Neighborhood Shopping Center to the south. Surrounding development is diverse and includes single- and multi- family residences, Pizza Ranch, Cozy Corner Adult Day Services, Eleanor Roosevelt Middle School, Carver Elementary School, and multiple multi-tenant commercial buildings. If rezoned, the permitted uses within the OC Office Commercial district are not anticipated to negatively impact the mix of adjacent uses in the area. CIP Investments: None proposed. Staff Analysis: The applicant is proposing to rezone property from PC — Planned Commercial to OC Office Commercial. The subject site is currently part of a 4.34-acre lot that would be subdivided into two lots. The subject site would be approximately 2.91 acres and would have frontage/access on Radford Road. The applicant is requesting the rezoning in order to develop the property with a three-story 48-unit low to moderate income residential building with 100 surface parking spaces. Although a conceptual plan is not required for the proposed rezoning, the applicant has shared the attached a conceptual subdivision and site plan for the project site. As requested, the rezoning would change from PC — Planned Commercial to OC Office Commercial. The existing PC district currently allows for 47 permitted principal uses that primarily allow for commercial uses (see Ordinance No. 82-04 attached). The proposed OC district would allow for a total of 16 permitted principal uses which include a mix of commercial and residential uses (see OC district regulations attached). Existing utilities and street capacity are sufficient to serve any development on the subject site. Any proposed alteration to the subject site would require an approved site plan which is reviewed by the city's Development Review Team (DRT). The DRT is comprised of multiple city departments including Engineering, Planning, Water Distribution, Fire, Police, Housing & Community Development, and Leisure Services. Development plans are reviewed by all relevant departments regarding access, parking, grading, screening, paving, park land, stormwater management, water connection, sanitary sewer connection, fire safety, and more. Staff does not anticipate any adverse effects on the environment as any potential impacts should be mitigated through the review processes above. The Comprehensive Plan goals promote a mix of housing and mixed-use development. The goals also recommend multi-family development in proximity to jobs to minimize transportation costs. Finally, the Comprehensive Plan recommends buffering incompatible uses from one another. Given the permitted uses in the OC district are comprised of generally low-intensity office uses and residential uses, establishment of the OC district will allow the development of multi-family housing which will serve as a buffer development between the commercial uses to the north, west, and south and the residential properties to the east and north. The Future Land Use Map identifies the subject site as Park & Open Space. Planning staff recommends that the Zoning Advisory Commission review the information provided and make a recommendation on the requested rezoning to the City Council in accordance with section 9-5 of the Unified Development Code and the criteria established for granting a zoning reclassification. That Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code, is hereby amended by reclassifying the hereinafter described property from Planned Unit Development with PC -Planned Commercial designation to OC Office Commercial, to wit: The eastern portion of Lot 2 of Pizza Ranch Place and to the centerline of the adjoining public right-of-way, all in the City of Dubuque, Iowa as shown in Exhibit A. Section 2. That the foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa.
