Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion Nancy Kann, 900 Jackson Street, represented the applicant, noting the changing technology available for ATMs today and the changing way in which people use banks, namely that visits to physical banks are declining. She stated that her client is hoping to serve the market by addressing those changes and offering standalone ATMs to benefit their customers. She also noted this use can take advantage of parking lots that may be underutilized. Staff detailed the request noting that the City of Dubuque currently permits this type of use as a permitted use in the industrial districts, as a conditional use in the CR district and as an accessory use to an active bank use on the same property. Staff noted the current conditions for the conditional use and stated that the proposed signage limitation of 75 square feet and 20' in height is recommended to avoid these becoming small billboards. Staff noted that placement of any such facilities would be subject to site plan review. Staff summarized the proposed text amendment and noted that it would ultimately: 1. Allow Drive-up Automated Bank Teller as a permitted use in the C-3, LI, HI, and MHI zoning districts. 2. Allow Drive-up Automated Bank Teller as a Conditional Use in the C-4 and CR zoning districts. 3. The Zoning Advisory Commission discussed the request finding it appropriate. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. The COVID-19 pandemic further expedited an already wide trend by banks to invest in technology that serves people where they are. This has ranged from mobile apps to stand alone ATMs. For many years, a small ATM in a vestibule or corner of a retail or food and beverage facility has been commonplace in order to serve the patrons visiting the business. In more recent years,the concept of the standalone, drive-up,ATM has begin to expand this role. Rather than benefiting a single business, stand alone ATMs are typically located in retail parking lots, offering patrons the opportunity to utilize a full range of banking services safely from their own cars. Similar to a fast food drive through,there is typically a small queuing space sperate from the parking lot drive lane, a canopy over the patrons using the machine, and identifying signage. Rather than an encumbrance to the use of the parking lot, it serves as an asset of a typically underutilized space. Benefits to Patrons As mentioned above,the patrons that visit the standalone ATM are looking for convenience and proximity as well as comfort. The trend of the standalone ATM is intended to meet all of these requirements and do so with as little negative and as much positive impact on the adjacent uses as possible. Benefits to Businesses A standalone ATM offers banks, especially smaller banks,the opportunity to serve their customers, as well as the employees in the best possible way. Rather than requiring 1-2 employees to man a small branch ofFice,the ATM serves as a full service teller and allows staff work collaboratively in a single location. This also reduces the burden of adding staff, especially when most patrons would prefer a contact-less process. Impact on surrounding Uses Similar to the ATM in a vestibule or the corner of the room, a standalone, drive-up, ATM offers surrounding businesses the opportunity for more trafFic and visibility. Patrons may be more willing to visit their businesses if they are already in the parking lot. Businesses also are able to convert underutilized parking into a more advantageous and active use. Maintaining the scale and signage in accordance with already adopted zoning regulations, would ensure any perceived negative impact be minimized. INTRODUCTION This memo transmits an application and an ordinance for a proposed Text Amendment to the Unified Development Code (UDC) zoning regulations to add Drive-up Automated Bank Teller to the list of Permitted Uses in the C-3 zoning district and to the list of Conditional Uses in the C-4 zoning district. The UDC notes that "Text amendments are intended for wholesale changes to the zoning regulations, as a means for the City to respond to changing conditions and emerging trends in the community. Text amendments are not property specific." BACKGROUND The applicant, Capra Bank, has submitted an application to amend the zoning requirements for Standalone Drive-thru Automated Teller Machines (ATM). Standalone Drive-thru ATMs, as described by the applicant, are currently included as `Drive-up Automated Bank Teller' (DABT) in the Unified Development Code (UDC). The UDC currently lists DABTs as a Permitted Use in all three Industrial districts and also lists them as a Conditional Use in the CR Commercial Recreational zoning district. Capra Bank has requested an amendment to the UDC to include DABTs as a permitted use in the C-3 zoning district. Staff additionally recommends listing DABTs as a conditional use in the C-4 zoning district and adding DABT signage regulations to the signage table within Chapter 15 of the UDC. DISCUSSION Capra Bank has submitted conceptual proposals to construct a DABT in commercial districts where they do not have an active bank branch. Currently, a DABT is listed as a permitted use in the three Industrial zoning districts and listed as a conditional use in the CR Commercial Recreation zoning district. DABTs are otherwise allowed as an accessory use only. If the proposal was to place a DABT on a lot along with a bank Drive-up Automated Bank Teller Memo Page 2 branch, it would be permitted as an accessory use and allowed. Since the applicant proposed DABT is `standalone' and not accessory to a principal bank use on the same site and it is not currently a permitted principal use, a text amendment is being requested. Drive-up Automated Bank Teller as a Permitted Use Currently, DABTs are listed as a permitted use in all three Industrial districts. The proposed amendment would list DABTs as a permitted use in the C-3 zoning district along with the three Industrial districts. Drive-up Automated Bank Teller as a Conditional Use The UDC lists DABT as a conditional use in the CR district. Conditional uses are reviewed and approved by the Zoning Board of Adjustment (ZBA). Each listed Conditional Use in the UDC has specific conditions that need to be met to commence with the use on a property. Currently, the Conditional Use Permit (CUP) condition for Drive-up Automated Bank Teller is stated as: "A drive-up automated bank teller may be allowed in the CR district in accordance with the conditions established by the zoning board of adjustment." This requirement effectively means that the ZBA would review the project and place any conditions they deem would mitigate any impact on adjacent properties and the neighborhood. A site plan is required to review a CUP and would need to meet all codes and ordinances in addition to any conditions placed by the ZBA. The proposed text amendment would list DABTs as a conditional use in the C-4 zoning district along with the CR district and staff further recommends the following language be adopted for the DABTs requiring a Conditional Use Permit. Chapter 8-5-10: LIST OF COND/TIONAL USES: Drive-up Automated Bank Teller: A. A Drive-up Automated Bank Teller may be allowed in the C-4 and CR districts in accordance with the following conditions: 1. Opaque screening shall be provided to screen the use from adjacent residential uses in conformance with the landscaping requirements of chapter 13 of this title. The recommendation to require screening from adjacent residential properties would be in addition to any site-specific conditions required by the Zoning Board of Adjustment. Drive-up Automated Bank Teller Siqnaqe Requlations Signage for a DABT is currently regulated as a freestanding sign and would allow for a 40' tall, 200 sq. ft. freestanding sign. Consequently, staff recommends an amendment to the signage table to incorporate specific limits to signage for DABTs. Allow Drive-up Automated Bank Teller as a permitted use in the C-3, LI, HI, and MHI zoning districts. 2. Allow Drive-up Automated Bank Teller as a Conditional Use in the C-4 and CR zoning districts. 3. Adopt a new condition for the establishment of a Drive-up Automated Bank Teller as a Conditional Use; and 4. Amend the relevant zoning district signage tables to limit the size and scale of Drive-up Automated Bank Teller signage. The text amendment could be adopted as proposed by the applicant, with staff and/or Commission recommendations, or not adopted at all. If adopted, any form of the amendment would not limit the ability of financial institutions to incorporate Drive-up Automated Bank Tellers on a property as an accessory use. Additionally, to construct a DABT anywhere in the city, the UDC requires an approved site plan with review by the city's Development Review Team. Review would focus on traffic queuing, traffic circulation, signage, site lighting, landscaping, interaction with public infrastructure, and more. The overall impact of this use on any particular site would be mitigated through that process. RECOMMENDATION In conclusion, Planning staff recommends that the Zoning Advisory Commission review the information in this packet, and then make a recommendation to the City Council on the proposed text amendment.
