Housing & Community Development Director Alexis Steger is recommending City
Council approve the attached CDBG Subrecipient Agreement to assist Catholic
Charities for an additional $245,000 for the replacement of two elevators in Ecumenical
Tower and authorize the Mayor to execute the agreement on behalf of the City.
On Wednesday, August 16, Catholic Charities requested to the Community
Development Advisory Commission (CDAC) an additional $245,000 to the already
approved $135,000 CDBG funds to assist with construction costs of a complete
renovation and modernization of the two elevators in Ecumenical Tower. CDAC
approved the additional funding, totaling $380,000. The $380,000 will be funded in
CDBG's Annual Action Plan FY24 Amendment #1 using reallocated dollars.

Introduction
The attached memorandum transmits the subrecipient agreement for CDBG funds to
assist Catholic Charities for the replacement of two elevators in Ecumenical Tower.
Background
On Wednesday, August 16, Catholic Charities requested to the Community
Development Advisory Commission (CDAC) an additional $245,000 to the already
approved $135,000 CDBG funds to assist with construction costs of a complete
renovation and modernization of the two elevators in Ecumenical Tower. CDAC
approved the additional funding, totaling $380,000. The $380,000 will be funded in
CDBG's Annual Action Plan FY24 Amendment #1 using reallocated dollars.
Discussion
Catholic Charities manages Ecumenical Tower which provides 88 units of affordable
housing for seniors and disabled adults, most at 30% or below of the area median
income. Ecumenical Tower's greatest need is to replace the elevator cars. In the past
few months, the elevators have been showing more signs of failure, including trapping
residents inside cars. It is becoming more difficult to put quick fixes on the elevators.
Providing the full request of $380,000 will also allow Catholic Charities to continue to
keep rent low for residents.
The Ecumenical Tower Elevator Replacement project meets the National Objective of
Low/Mod-Income Housing, and the Eligible Activity of 14B — Rehab; Multi-Unit
Residential. The project budget for this agreement is $380,000.
Recommendation
I respectfully request the City Council approve the attached CDBG Subrecipient
Agreement with Catholic Charities and authorize the Mayor to execute the agreement
on behalf of the City.

RESOLUTION AUTHORIZING EXECUTION OF CDBG SUBRECIPIENT AGREEMENT
WITH CATHOLIC CHARITIES
Whereas, Catholic Charities prepared a request to improve the quality of existing
affordable rental housing at Ecumenical Tower utilizing Community Development Block
Grant funds; and
Whereas, the City Council approved the CDBG Fiscal Year 2024/Program Year
2023 Amendment #1 budget that included an increased budget for Ecumenical Tower to
accommodate this request; and
Whereas, a Categorically Excluded Subject to Review with 24 CFR Part 58.5
Environmental Review has been completed, and no compliance or consultation with
regulatory authorities were found to be required; therefore, converting the project to
exempt; and
Whereas, all services provided will be to a minimum of 51% low/moderate income
residents, meeting the CDBG National Objective of Low/Mod-Income Housing benefit,
and eligible activity of 14B: Rehab, Multi-Unit Residential.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the subrecipient agreement with Catholic Charities, beginning no
sooner than September 18, 2023 be approved.
Section 2. That the Mayor of the City of Dubuque is hereby authorized and directed
to execute said Agreement and related documents on behalf of the City of Dubuque, Iowa.

SUBRECIPIENT AGREEMENT BETWEEN
THE CITY OF DUBUQUE
AND
CATHOLIC CHARITIES OF THE ARCHDIOCESE OF DUBUQUE
THIS SUBRECIPIENT AGREEMENT is entered into by and between the City of
Qubuque (herein called the "City") and Catholic Charities of the Archdiocese of
Dubuque (herein called the "SubrecipienY'), efFective upon thp date last signed below.
WHEREAS, the City has applied for and received Community Development
Block Grant (CDBG) funds from the United States Government through the Department
of Housing and Urban Development under Title I of the Housing and Community
Development Act of 1974, Public Law 93-383 and has received approval of activities
under Federal Award Identifier Number B-23-MC-19-0004 which was awarded to the
City on 2/27/2023 for the purpose of replacing the existing elevator system to meet
CDBG's National Objective of service a Low to Mod-income Housing Benefit, and the
Eligible Activity is 14B:Rehab Multi-Unit Residential at 250 W. 6t" Street, Dubuque, IA
52001; and
WHEREAS, the City wishes to engage Subrecipient to assist the City in utilizing
such CDBG funds to assist Subrecipient with rehabilitation of a multi-family housing
complex,
WHEREAS, both the City and the Subrecipient desire to make a written
agreement with respect to said funds and the implementation of the project to which
they pertain; and
WHEREAS, Developer will agree to rent to low or moderate-income families,
inciuding those with Housing Choice Vouchers; and
WHEREAS, both the City and the Subrecipient certify that the activity will meet
the CDBG National Objective of benefit to low- and moderate-income persons,
NOW, THEREFORE, in consideration of the mutual promises of the parties, it is
agreed as follows:
A. S7ATEMENT OF WORK
1. Activities
The Subrecipient will be responsible for administering a CDBG Program Year 23
multi-family residential rehabilitation project, detailed in Exhibit A, in a manner
satisfactory to the City and consistent with any standards required as a condition
of providing these funds. The scope of activities to be rendered by the
Subrecipient as a condition of receiving funds for the Project/Activity pursuant to
this Contract is attached as Exhibit A hereto and made a part of this Contract.
2. NationalObiectives
The Subrecipient will carry out the activities funded under this Agreement that
meet the CDBG program's National Objective of:
C7 Assisting low and moderate-income persons, said income guidelines
found in Exhibit B
❑ Aid in the prevention or elimination of slums or blight
❑ Meet community development needs having a particular urgency, as
defined in 24 CFR 570.208.

3. Project Budyet
The City agrees, subject to the terms and conditions of this Agreement, to
compensate the Subrecipient for the Statement of Work outlined in Exhibit A, not
to exceed $380,000.00.
If indirect costs are charged, the Subrecipient will develop an indirect cost
allocation plan for determining the appropriate SubrecipienYs share of
administrative costs and shall submit such plan to the City for approval, in a form
specified by the Gity.
4. Reallocations I
The Subrecipient may reallocate up to ten percent (10%) of the total grant
amount received to an eligible activity cost. Such reallocation will be referred to
as a revision. The Subrecipient must, prior to the drawdown reflecting the
change, contact the City to discuss the reallocation. Any change that results in a
cumulative reallocation of ten percent (10%) or more of the total grant, any
inclusion of a new activity, deletion of an approved activity, any change in the
implementation schedule, or any change in grant terms will require an
amendment and prior City approval per Section E (7) of this Agreement. Such
reallocation will be referred to as an amendment. Requests for revisions nr
amendments are due no later than March 31 of the program year. Budget
revisions or amendments requested during the final ninety (90) days of the
agreement period will be approved by the City only if it determines that the

revisions are necessary to complete project activities.

5. Retainaqe
Five percent (5%) of the total grant amount may be retained from payment until
such report of audit referenced in Section B (7) of this Agreement, has been
provided to, and accepted by the City. No audit fees will be reimbursed by the
City.
6. Term and Time of Pertormance
Services of the Subrecipient shall start on September 18, 2023 and end on June
30, 2024. All the required activities and services, except for audit, will be
completed by or before this date. The City may grant extensions at its sole
discretion. Only a valid written Amendment to the Agreement shall alter this
completion date. The term of this Agreement and the provisions herein shall be
extended to cover any additional time period during which the Subrecipient
remains in control of CDBG funds or other assets, including program income.
7. Performance Measures and Monitorina
In compliance with the Department of Housing & Urban DevelopmenYs Outcome
Performance measurement system (24CFR 91.220(e))
The City will monitor the performance of the Subrecipient against goals and
required performance standards. Substandard performance as determined by
the City wiil constitute non-compliance with this Agreement. If action to correct
such substandard pertormance is not taken by the Subrecipient within a
reasonable period after being notified by the City, agreement suspension or
termination procedures will be initiated.

The Subrecipient shall be subject to site visits, desktop monitoring, or other
methods of monitoring as deemed necessary by personnel of the City, or a
designee of the City or duly authorized officials of federal government, for the
purpose of monitoring the SubrecipienYs delivery of services and compliance
with terms of the agreement and federal standards that pertain to federally
funded grant activities. Review may include but are not limited to: agency and
program policies, procedures, standards, handbooks and operational documents;
accounting books and records for financial management and documentation of
program costs such as time sheets and mileage logs; verification records of the
persons to participate or benefit from grant funded activities; documentation of
report data and other program progress; and records demonstrating procurement
v a cess to and
procedures and property management. The reviewers will ha e c
the right to examine, audiY, duplicate, excerpt and/or transcribe any of the
5ubrecipienYs records pertaining to all matters covered by this Agreement. The
Subrecipient shali be subject to subsequent site visits to review correction of any
deficiencies.
B. RECORDS AND REPOR7S
1. Maintenance
The Subrecipient shall maintain all records required by the federal regulations
specified in 24 CFR Part 570.506 and by the City that are pertinent to the
activities to be funded under this Agreement. Such records shall include but not
be limited to:
a) Records providing a full description of each activity undertaken;
b) Records demnnstrating that each activity undertaken meets one of the
National Objectives of the CDBG program;
c) Records required to determine the eligibility of activi#ies, individuals, or
' households;
d) Records required to document the acquisition, improvement, use or
disposition of real property acquired or improved with CDBG assistance;
e) Records documenting compliance with the fair housing and equal
opportunity components of the CDBG program, such as
f) Financial records as required by 24 CFR Part 570.502, and 24 CFR
84.21-28;
g) Other records necessary to document compliance with Subpart K of 24
CFR 570;
h) A list of current board members, calendar of upcoming board meetings
and minutes of all board meetings; and
i) Equity metrics on race, income, and head of household.

The Subrecipient agrees to keep the records required by this Agreement. The
Subrecipient shall retain all records for a period of five (5) years. The retention
period begins on the date of submission of the City's annual performance and
evaluation report to HUD in which activities assisted under this agreement are
reported for the final time. Records for non-expendable property acquired with
funds under this Agreement shall be retained for five (5) years after final
disposition of such property. Properties retained shall continue to meet eligibility
criteria and shall conform with the "reversion of assets" restrictions specified in
Section G of this Agreement. Records for any displaced person must be kept for
five (5) years after he/she has received final payment. Notwithstanding the
above, if there is litigation, claims, audits, negotiations or other actions that
involve any of the records cited and that have starYed before the expiration of the
five (5) year period, then such records must be retained until completion of the
actions and resolution of all issues, or the expiration of the five (5) year period,
whichever occurs later.
The list of current board members and minutes of all board meetings will be kept
on file and maintained at the SubrecipienYs main business office as public
records. The minutes and board member list shall be available for the public to
view during the SubrecipienYs normal working hours. Copies may be provided
according to the 5ubrecipienYs policy.
3. Client Data.
Subrecipient shall maintain Client Data demonstrating client eligibility for services
provided. Such data shall include, but not be limited to: client name, address,
income level or other basis for determining eligibility, and description of service
provided, racial and ethnic data and single head-of-household data, and any
other records pertaining to CDBG funds as required by 2 CFR Part 200. In
addition, data will be retained for affordability and income targefiing for each
household. Such information shall be made available to City monitors or their
designees for review upon request.
4. Disclosure.
The Subrecipient understands that client information collected under this contract
is private and the use or disclosure of such information, when not directly
connected with the administration of the city's or SubrecipienYs responsibilities
with respect to services provided under this contract may be prohibited by federal
or state law unless written consent is obtained from such person receiving
service and in the case of a minor, that of a responsible parenUguardian.

The Subrecipient shall provide progress reports to the City in the form, content,
and frequency as required by the City. The Subrecipient shall provide information
upon request for preparation of the Consolidated Plan, the CAPER, and any
other reports or plans required by the City or HUD.
6. Close-out
The Subrecipient's obligation to the City shall not end until all close-out
requirements are completed. Activities during this close-out period shall include
but are not limited to: making final payments, disposing of program assets
(including the return of all unused materials, equipment, unspent cash advances,
program income balances, and accounts receivable to the City), and determining
the custodianship of records. Notwithstanding the foregoing, the terms of this

control over CDBG funds, including program income.
7. Audits & Inspections
All Subrecipient records with respect to any matters covered by this Agreement
shall be made available to the City, its designees or the federal government, at
any time during normai business hours, as often as the City or federal
government deems necessary to audit, examine, and duplicate or make excerpts
or transcripts of all relevant data. Any deficiencies noted in audit reports must be
fully cleared by the Subrecipient within timeframe stipulated by the City. Failure
of the Subrecipient to comply with the above audit requirements will constitute a
violation of this Agreement and may result in the withholding of future payments.
The Subrecipient hereby agrees to have an annual agency audit conducted by a
certified accountant according to Generally Accepted Government Auditing
Standards. Agencies that had total expenses less than $150,000 on the audit for
the most recently audited fiscal year and had no deficiencies or findings on that
audit or subsequent monitoring visits may be eligible to submit an audit every
other year subject to written approval from the City. Additionally, if the agency
meets the thresholds established in 2 CFR Part 200, the Uniform Administrative
Requirements, Cost Principles, and Audit Requirements for Federal Awards
Subpart F the audit will be performed as a Single Audit. The subrecipient agrees
to follow any other audit procedures as established by the City. The completed
audit, audited financial statemenks, schedule of findings, all related reports, the
management letter from the auditor to the Subrecipient, and the Subrecipient's
response(s) to the auditor (if required by the audit) must be provided to the City
', within six (6) months of the SubrecipienYs fiscai year-end. No audit fees will be
reimbursed under this CDBG agreement by the City.
i8. Pavment
� a. Maximum Amount and Drawdowns

It is expressly agreed and understood that the total amount to be paid by the City
under this Agreement shall not exceed the amount stipulated in Section 3 of this
Agreement. Drawdowns for the payment of eligible expenses are reimbursement
only and shall be made against the line item budgets specified in Exhibit C herein
and in accordance with any City policy concerning payments.
b. Financial Manaqement Svstem Certification
Payments may be contingent upon certification of the SubrecipienYs financial
management system in accordance with the standards specified in 2 CFR Part
200, the Uniform Administrative Requirements, Cost Principles, and Audit
Requirements for Federal Awards. The entire amount of allowable grant
expenses (including those to be paid with program income) shall be supported by
source documentation (e.g., invoices, time sheets, receipts, etc.). The City
reserves the right to request any additional documentation, as it deems
necessary.
c. Reimbursement Schedule
The Subrecipient may requisition a reimbursement of expenses for project costs.
Such reimbursement requests must include proof of payment of the requested
expense. Request for salary reimbursement must be within 30 days from end of
pay period. Other requests dated within 60 days from dafie of service/purchase
wiil be accepted. Final request must be submitted by June 15, 2024.
C. PROGRAM INCOME
The Subrecipient shall report all program income (as defined at 24 CFR
570.500(a)) generated by activities carried out with CDBG funds. The
documentation, reporting and use of program income by the Subrecipient shall
comply with the requirements set forth at 24 CFR 570.504 and 2 CFR Part 200
for activities permitted under this agreement. Requests for funds shall be
reduced by the amount of any such program income balances on hand. Any
program income on hand when this Agreement expires, or received after this
AgreemenYs expiration, shall, at the City's discretion, be returned to the City or
used by the Subrecipient for eligible activities as identified in an agreement that
becomes effective upon expiration af this Agreement. Any interest earned from
funds heid in a revolving fund account is not program income and shall be
remitted to the City which will, in turn, remit it to HUD.
D. UNIFORM ADMINISTRATIVE REQUIREMENTS
1. Accountinq Standards

The Subrecipient agrees to comply with 2 CFR Part 200, Uniform Administrative
Requirements, Cost Principles, and Audit Requirements for Federal Awards, and
agrees to adhere to the accounting principles and procedures required therein,
use adequate internal controls, and maintain necessary source documentation
for all costs incurred.
2. Cost Principles
The Subrecipient shall administer its program in conformance with 2 CFR Part
200, the Uniform Administrative Requirements, Cost Principles, and Audit
Requirements for Federal Awards, as applicable. These principles shall be
applied for all costs incurred.
3. Procurement
The Subrecipient shall have its own procurement policies and procedures. Said
policies shall meet the requirements of 2 CFR Part 200 Subpart D Procurement
Standards. The Subrecipient shall follow Management Standards as modified by
24 CFR 570.502.
4. Copvriqht
If this Agreement results in any copyrightable material ar inventions, the City
and/or federal government reserves the right to royalty-free, non-exclusive and
irrevocable license to reproduce, publish or otherwise use and to authorize
others to use the work or materials for government purposes.
T ER P O M RE U R MENTS
E. O H R GRA Q I E
1. General Com liance
p
The Subrecipient agrees to comply with the requirements of 24 CFR 570. The
Subrecipient also agrees to comply with all other applicable federal, state and
local laws, regulations, and policies governing its operations and the funds
provided under this Agreement. The Subrecipient agrees to remain current on all
applicable taxes, assessments and other governmental charges and to maintain
all Subrecipient owned property(ies) in compliance with all applicable City Codes.
The Subrecipient further agrees to use funds available under this Agreement to
supplement rather than supplant funds otherwise available.
2. Independent Contractor

Nothing contained in this Agreement is intended to, or shall be construed in any
manner, as creating or establishing the relationship of employer/employee
between the parties. The Subrecipient shall at all times remain an "independent
contractor" with respect to the services to be perFormed under this Agreement.
Except for the benefits and stipulated amounts indicated under this Agreement,
the City shall be exempt from payment of all Unemployment Compensation,
FICA, retirement, life and/or medical insurance and Workers' Compensation
Insurance as the Subrecipient is an independent contractor.
The Subrecipient shall be responsible for hiring all program personnel. All such
personnel shall be considered to be employees of the Subrecipient.
3. Hold Harmless and Indemnification
The Subrecipient, its agents and any assignees shall agree to hold harmless and
indemnify the City and its agents, ofFicials and employees against alI suits,
claims, damages, and losses, including attorney fees that may be based on any
injury to person or property due to negligent acts, errors or omissions of the
Subrecipient.
4. Worker's Com�ensation
The Subrecipient shall provide Worker's Compensation Insurance coverage per
lowa State Code, Chapter 85.
5. Insurance & Bondinq
TYie Subrecipient shall carry sufficient insurance coverage to protect contract
assets from loss due to theft, fraud and/or physical damage and as a minimum
shall purchase a blanket fidelity bond covering all employees in an amount equal
to cash advances from the City.
The Subrecipient shall comply with the bonding and insurance requirements of
24 CFR 200 and any applicable state and local requirements for insurance and
bonding. Subrecipient shall meet the strictest standard for bonding and
j insurance coverage.
6. Citv Recoqnition
The Subrecipient shall insure recognition of the role of the City in providing
services through this Agreement. All activities, facilities, and items used
pursuant to this Agreement shail be prominently labeled as to funding source. In
the event that a program funded through CDBG is described in literature,
newspaper articles, TV reports and other public medium, the Subrecipient must
i give credit to the City and the CDBG program.

7. Amendments
The City or Subrecipient may amend this Agreement at any time provided that
such amendments make specific reference tn this Agreement and are executed
in writing and signed by a duly authorized representative of both organizations.
The deadline for amendments in any program year is March 31, unless extended
at the sole discretion of the City in extraordinary circumstances. Such
amendments shall not invalidate this Agreement, nor relieve or release the City
or Subrecipient from its obligations under this Agreement,
The City may amend this Agreement to conform with federai, state or local
governmental guidelines, policies and available funding amounts, or for other
reasons. If such amendment results in a change in the funding, the scope of
services, or schedule of the activities to be undertaken as part of this Agreement,
such modifications wiil be incorporated only by written amendment signed by
both City and Subrecipient.
8. RELOCATION, PROPERTY ACQUISITION AND ONE-FOR-ONE HOUSING
REPLACEMENT
The Subrecipient agrees to comply with (a) the Uniform Relocation Assistance and
Real Property Acquisition Policies Act of 1970, as amended (URA), and
implementing regulations at 49 CFR Part 24 and 24 CFR 570.606(b); (b) the
requirements of 24 CFR 570.606(c) governing the Residenkial Anti-displacement and
Relocation Assistance Plan under section 104(d) of the HCD Act; and (c) the
requirements in 24 CFR 570.606(d) governing optional relocation policies. The
Subrecipient shall provide relocation assistance to displaced persons as defined by
24 CFR 570.606(b)(2) that are displaced as a direct result of acquisition,
rehabilitation, demolition or conversion for a CDBG-assisted project. The
Subrecipient also agrees to comply with applicable Recipient ordinances, resolutions
and policies concerning the displacement of persons from their residences.
9. Federal State, and Local Law Applicabilitv
By virtue of the federal funding provided for under this agreement, the parties hereto
shall be bound by and adhere to all applicable federal, state, and local laws, rules,
policies, orders and directions, including by way of specification but not limited to the
followin :

- Title VI of the Civil Rights Act of 1964, as amended;
- The Fair Housing Act—Title VIII of the Civil Rights Act of 1968, as amended;
- Section 104(b) of Title I of the Housing and Community Development Act of
1974, as amended;
- Section 109 of Title I of the Housing and Community Development Act of
1974, as amended;
- Section 504 of the Rehabilitation Act of 1973,
- The Americans with Disabilities Act of 1990, as amended;

- Section 3 of the Housing & Community Development Act of 1968 (12 U.S.C.
1701 u);
- The Age Discrimination Act of 1975, as amended;
- Executive Order 11063, as amended by Executive Order 12259 (implemented
in 24 CFR Part 107);

12.Land Covenants

This contract is subject to the requirements of Title VI of the Civil Rights Act of 1964
and 24 CFR 570.601 and 570.602. In regard to the sale, lease, or other transfer of
land acquired, cleared or improved with assistance provided under this contract, the
Subrecipient shall cause or require a covenant running with the land to be inserted in
the deed or lease for such transfer, prohibiting discrimination as herein defined, in
the sale, lease or rental, or in the use or occupancy of such land, or in any
improvements erected or to be erected thereon, providing that the Recipient and the
United States are beneficiaries of and entitied to enforce such covenants. The
Subrecipient, in undertaking its obligation tn carry out the program assisted
hereunder, agrees to take such measures as are necessary to enforce such
covenant, and will not itself so discriminate.
13.Assiqnabilitv
The Subrecipient shali not assign or transfer any interest in this Agreement
without the prior written consent of the City thereto; provided, however, that

claims for money due or to become due from to the subrecipient from the C ty
under this Agreement may be assigned to a bank, trust cnmpany, or other
financial institution without such approval. Notice of any such assignment or
transfer shall be furnished promptly to the City. No real property acquired,
improved or otherwise invested in with CDBG funds, including loan portfolios
attributabie to the use of CDBG funds, may be assigned, transferred or sold
without the prior written consent of the City thereto.
14.Conflict of Interest
The Subrecipient agrees to abide by the provisions of 24 CFR 570.611 and 2
CFR Part 200 with respect to conflicts of interest. Requests for exceptions, as
permitted by federal regulations, must be made in the manner prescribed by the
City.
15.Hatch Act
The Subrecipient agrees that no funds provided, nor personnel employed under
this Agreement, shall be in any way or to any extent engaged in the conduct of political
activities in violation of Chapter 15 of Title V of the U.S.C.

making of any federal loan, the entering into of any cooperative agreement, and
the extension, continuation; renewal, amendment, or modification of any federal
contract, grant, loan or cooperative agreement;
b. If any funds other than federal appropriated funds have besn paid or will be
paid to any person for influencing or attempting to influence an officer or
employee of any agency, a Member of Congress, an officer or employee of

agreements) and that all Subrecipients shall certify and disclose accordingly;
d. This certification is a material representation of fact upon which reliance was
placed when this transaction was made or entered into. Submission of this
certification is a prerequisite for making or entering into this transaction imposed
by section 1352, title 31, U.S,C. Any person who fails to file the required
certification shall be subject to a civil penalty of not less than $10,000 and not
more than $100,000 for such failure.
17. Restrictions
The Subrecipient is prohibited from using CDBG funds or personnel employed in
the administration of the program for political purposes, or to engage in other
partisan political activities, sectarian, or religious activities or nepotism activities.
18. Environmental Standards
24 CFR Part 58; 24 CFR 570.604; and Section 104(g) HCD
The Subrecipient agrees to comply with the policies of the National
Environmental Policy Act of 1969. The purpose of this Act is to attain the widest
use of the environment without degradation, risk to health or safety or other
undesirable and unintended consequences.
19.Air, Water and Solid Waste

The Subrecipient agrees to comply with the fiollowing requirements insofar as
they apply to the performance of fihis Agreement:
- The Clean Air Act, 42 U.S.C. 7401, et seq., as amended.
- Federal Water Pollution Control Act, as amended, 33 U.S.C. 1251, et seq., as
amended, 1318 relating to inspection, monitoring, entry, reports, and
information, as well other requirements specified in ,said Section 114 and
Section 308, and all regulations and guidelines issued thereunder.
- Environmental Protection Agency (EPA) regulations pursuant to 40 CFR Part
50, as amended.
- The 5afe Drinking Water Act of 1974 (42 U.S.C. 201, 300 (f) et seq., and 21
U.S.C. 349) as amended; '
- 42, U.S.C. 6901 et seq., as amended. '
20.Flood Disaster Protection
In accordance with the requirements of the Flood Disaster Protectiori Act of 1973,
the Subrecipient shall assure that for activities located in an area identified by the
Federal Emergency Management Agency (FEMA) as having special flood nazards,
flood insurance under the National Flood Insurance Program is obtained and
maintained as a condition of financial assistance for acquisition or construction
purposes, including rehabilitation.
21.Lead-Based Paint
The Subreci ient a rees that an construction or rehabilitation of residential

structures with assistance provided under this Agreement shall be subject to HUD
Lead-Based Paint Regulations. Such regulations pertain to all CDBG-assisted
housing and require that all owners, prospective owners, and tenants of properties
constructed prior to 1978 be properly notified that such properties may include lead-
based paint. Such notification shall point out the hazards of lead-based paint and
explain the symptoms, treatment and precautions that should be taken when dealing
with lead-based paint poisoning and the advisability and availability of blood lead
level screening for children under seven (7). The notice should also point out that if
lead-based paint is found on the property, abatement measures may be undertaken.
The regulations further require that, depending on the amount of federal funds
applied to a property, paint testing, risk assessment, treatment and/or abatement
may be conducted.
22.Historic Preservation

The Subrecipient agrees to comply with the Historic Preservation requirements set
forth in the National Historic Preservation Act of 1966, as amended and the
procedures set forth by the Advisory Council on Historic Preservation Procedures for
Protection of Historic Properties, insofar as they apply to the performance of this
agreement.
In general, this requires concurrence from the State Historic Preservation Office for
all rehabilitation and demolition of historic properties that are fifty (50) years old or
older or that are included on a federal, state, or local historic property list.
F. REMEDIES FOR NON-COMPLIANCE AND TERMINATION
1. F2emedies for Noncompliance
If the City at any time determines the Subrecipient materially fails to comply with
any term of this Agreement, or with any of the rules, regulations, or provisions
referred to herein, the City may use any or all of the remedies allowed under 2
CFR Part 200.338 and 200.339 to ensure compliance. The City may also impose
additional specific award conditions as needed at any time to ensure compliance
in accordance with 2 CFR Part 200.207. Possible remedies include:
a. Warninq
Issuance of a written warning citing the violation that has occurred, and a
deadline when the violation must be remedied if it is still occurring.
b. Withholdinq Pavment
Withholding of funds by the City until the Subrecipient is found to be in
compiiance by the City.
a Grant Adlustment
Adjustment in the payment method or reduction of the grant to the Subrecipient
when there is noncompliance and the violation cited has not been remedied as
specified.
d. Reimbursement
Reimbursement by the Subrecipient with non-CDBG funds for CDBG funds
which have not been spent in accordance with this Agreement.
e. Termination

Termination of funds in whole or in part by the City if the Subrecipient materially
fails to comply with any term or condition of this Agreement or with any of the
rules, regulations or provisions referred to herein, or for cause as allowed in 2
CFR Part 200.339. In the event of termination of this award, in accordance with 2
CFR Part 200.340(c), the information required under the Federal Funding
Accountability and Transparency Act (FFATA) must be provided to the Federal
Web site established to fulfill the requirements of FFATA, and update or
notification must be provided to any other relevant governmentwide systems or
entities of any indications of poor performance as required by 41 U.S.C. 417b
and 31 U.S.C. 3321 and implementing guidance at 2 CFR Part 77. Additionally,
the requirements for Suspension and Debarment at 2 CFR Part 180 may apply.
f. Nonparticipation
Prohibition of the Subrecipient from future participation in the CDBG program if
the Subrecipient has not complied with the action administered by the City.
g. Termination for Convenience
This Agreement may be terminated in whole or in part by either party upon '
providing the other party a written, ninety (90) day notice, in which case the City ,
and Subrecipient shall agree upon the termination conditions, including the
effective date, the disposition of agreement amounts, and in the case of partial
termination the portion to be terminated. However, if, in the case of partial
termination the Cit determines that the remainin ortion of the award will not '

accomplish the purposes for which the award was made, and the award is
terminated in its entirety, Subrecipient shall promptly repay to the City the full
grant amount or that portion of the amount which has been disbursed to
Subrecipient prior to such termination.
h. Termination due to Loss of Funds
This Agreement will terminate in full or in part, at the discretion of the City, in the
event the City sufFers a loss of funding or termination of the federal funds which
permits it to fund this grant. In the event the City suffers such a loss of funding,
the City will give the Subrecipient as much written notice as possible which will
set forth the effective date of full or partial termination, or if a change in funding is
required, setting forth the change in funding and the changes in approved
budget.
G. REVERSION OF ASSETS

Upon the expiration of this Agreement, the Subrecipient shall transfer to the City
any CDBG funds on hand at the time of expiration and any accounts receivable
attributable to the use of CDBG funds. All program assets (unexpended program
income, property, equipment, etc.) shall revert to the City upon termination of this
Agreement, unless addressed under another agreement as provided in Section
C.
2. Real PropertY Reversion
Any real property under the SubrecipienYs control that was acquired or improved
in whole or in part with CDBG funds (including CDBG funds provided to the
Subrecipient in the form of a loan) in excess of $25,000 shall comply with either
of the following:
a. National Obiective Compliance
Used to meet one of the national objectives in 24 CFR 570.208 until fiue
years after expiration of this Agreement, or for such longer period of time as
determined to be appropriate by the City; or
b. National Obiective Noncompliance
Not used in accordance with Section G (2) (a) of this Agre2ment, in which
event the Subrscipient shall pay to the City an amount equal to the current
market value of the property less any portion of the value attributable to
expenditures of non-CDBG funds for the acquisition of, or improvement to,
the property. The payment is program income to the City. (No payment is
required after the period of time specified in Section G (2) (a) of this
Agreement.)
H. MISCELLANEOUS
1. Subrecipient Leqal Authority
By using this Agreement, the Subrecipient warrants and represents that it has the
requisite authority and capacity to perform all terms and conditions on SubrecipienYs
part to be performed hereunder.
2. Waiver
a. No conditions or provisions of this Agreement can be waived unless
approved by the City in writing.
b. The City's failure to insist upon the strict performance of any provision
of this Agreement or to exercise any right based upon breach will not
constitute a waiver of any rights under this Agreement.

3. Desiqnation of Officials
City designates the City Manager or the City Manager's designee as its
authorized representative with respect to the work to be pertormed under this
Agreement including, but not limited to, the ability to execute any changes in the
terms, conditions, or amounts specified in this Agreement .
The Board Chair of the Subrecipient or designee is the official authorized to
execute any changes in the terms, conditions or amounts specified in this
Agreement.
4. Saecial Conditions for Release of Funds
Funding of the amount stipulated in Section of this Agreement wiil not be
released to the Subrecipient by the City until the Subrecipient dernonstrates
compliance with the Section D (1).
5. Code of Conduct
The City expects that Subrecipients and any subcontractors of Subrecipients
to demonstrate courtesy, consideration and promptness in dealing with the
public, program participants, the City, and other governmental agencies.
6. Aqreement Coveraae
This instrument along with any Exhibits and the grant application corrtain the
entire agreement between the parties, Any statements, inducements or
promises not contained will not be binding upon the parties. This Agreement will
be binding upon the successors in office of the respective parties.
7. Severabilitv
If any provision of this Agreement is held invalid, the remainder of the
Agreement shall not be affected thereby and all other parts of this Agreement
shall nevartheless be in full force and effect.
8. Notice to Proceed
The City will issue a Notice to Proceed to the Subrecipient to incur costs relative
to the program implementation.
9. Exhibits.
All Exhibits are hereby incorporated into this Agreement.

10. Notices
Notices required by this Agreement shall be in writing and delivered via mail,
commercial courier, or personal delivery or sent by facsimile or other electronic
means. Any notice delivered or sent as aforesaid shall be effective on the date
of delivery or sending. All notices and other written communications under this
Agreement shall be addressed to the individuals in the capacities indicated
below, unless otherwise modified by subsequent written notice.

construed under the laws of the State of lowa. Any legal action arising out of or
related to this Lease shall be brought in a court of competent jurisdiction in

induded for convenience only and shall not limit or otherwise affect the terms of
this Agreement.
14. CONTRACTOR WARRANTIES/GUARANTEES Contractors shall
guarantee and warranty the work done pursuant to a CDBG project for a period
of two (2) years. In addition, Contractor shall furnish property owners with all
manufacturers' and suppliers' written guarantees and warranties covering
materials and equipment furnished under the contract.

Catholic Charities will be responsible for the Rehabilitation of a Multi-Family Residential
Structure by:
- Replacing the existing elevator systems including the complete replacement
and modernization of two electric traction passenger elevators. Replacement
will be done by creating an access panel in the existing elevator room on the
roof of the building. The new equipment will be placed by crane and an
access door will be put in place after the new equipment is installed and the
old equipment is removed.
- This contract ensures all work is done incompliance with plans in Exhibit D.
CDBG Eligibility: This project meets the National Objective of Low/Mod Housing
Benefit, under eligible activity 14B: Rehab; Multi-Unit Residential.

B. As a preface to bidding this modernization project, it shall be understood that:
1. The ECUMENICAL TOWERS is a fully occupied building.
2. The Elevator Modernization Contractor shall be responsible for the coordination of
all wark essential to maintaining continuous elevator operation throughout the
contract period and to maintain safe and arderly conditions in the construction site.
3. All work at the site shall be accomplished Monday through Friday with no on-
site work permitted on nationally recognized holidays
4. All wark shall be completed within three hundred sixty-five (365) consecutive
calendar days of issuance of a Notice to Proceed. A notice to proceed will be
issued as soon as contract,bond and insurance requirements are met.
Installation time for individual elevators shall be as follows:
a. First elevator shall be completed in twelve (12)weeks from the date when
the elevator is taken out of service.
b. Second elevator shall be completed in ten (10)weeks from the date when
the elevator is taken out of service.
5. Efforts shall be made to limit the noise levels during the early morning hours. The
Contractor shall cooperate with the Owner's representative to determine the best
times and opportunities to perform the work needed for completion of the project that
produce or warrant excessive noise.
6. Bids must be presented with one (1)Point of Contact.
7. Bids must be Turnkey and include all applicable General Contractor work.
8. Bids must represent a comprehensive and code compliant installation that is ready to
operate upon completion.

C. General Scope
1. The elevator modernization project consists of a comprehensive,turnkey,and code
compliant installation of two (2)traction elevators.
2. The Elevator Contractor shall be the "prime contractor" and responsible for the
management and cost of all wark necessary to complete the project,unless otherwise
specified.
3. The prime contractor shall include any and all General Contractar work in their base bid.
4. Contractor shall provide an engineering report from a certified engineer, on each
elevatar. This report shall detail the reaction force increase with increasing the
elevatar speed,changing from geared to gearless and any cab weight modifications.
Any structural modifications or reinforcement required within that report shall be the
responsibility of the elevator contractor.
5. Any modifications ar changes to structural supports shall be reviewed and verified by
a certified ProfessionaUStructural Engineer. A copy of the engineering analysis shall
be provided to the Owner for review and approval as part of the submittal package.
6. When cutting into existing structures, each Contractor shall take special care to avoid
personal injury or property damage which might result from interception or
interruption of electrical,telephone, television, sewer,water, gas or other services
which may be shown on the Drawings or described elsewhere. Neither the Owner
nor Consultant warrants the accuracy of the location shown or described.
Responsibility for determining the actual on-site location of utility lines and services,
the presence of which the Contractor could reasonably anticipate, shall rest solely
with the Contractor. Each Contractor shall verify the location of lines and services
before commencing work by any means necessary including x-ray or sonar
7. In all cases where a device or part of the equipment is herein referred to in the
singular number, it is intended that such reference shall apply to as many such
devices as are required to complete the installation.
8. The traction elevator work is hereby defined to include,but not by ways of limitation,
the replacement of ftrst floor hatch doors, car doors,hatch door interlocks, hanger
tracks, door rollers, controller, hoist machines, drive system, governor, car safeties,
hoist and governor cables,traveling cable,wiring, door operator complete, cabs, and
deflector sheaves, all operating fixtures and signals and related equipment complete.
9. A11 equipment and component parts installed, supplied ar provided under this
contract shall be nonproprietary and must be manufactured and distributed by a third-
party,non-installer company that supplies the vertical transportation industry.
a. Manufacturers of the apparatus shall provide technical support and parts
replacements for their equipment and component systems for a minimum of ten
(10) years, and issue such guarantee of support to the purchaser with written
certification naming the final Owner of their product(s)to ensure the apparatus or
systems remain maintainable regardless of who may be selected for future service.
10. With the exception of items specifically identified as being performed by others,the
Specifications are intended to include all engineering,material, labor,testing, and
inspections needed to comply with Contract documents.

12. Examination of Site and Documents
a. Bidders are urged to attend a pre-bid conference to visit the site and examine all
existing conditions of elevator equipment and machine rooms.
b. In submitting a bid and accepting a Contract award, the contractor represents they
have examined the site, existing conditions as well as the entire set of documents,
in accardance with the Contract and agrees to be bound by all conditions of the site,
existing conditions and all documents,without additional cost.
c. Bidders must report discrepancies or ambiguities occurring in the Specifications to
the Consultant for resolution ten (10) days prior to the bidding deadline, otherwise
the Specifications shall be deemed acceptable in their exiting form. Any such
reporting should be done in writing via email to the Consultant and Owner.
d. It is understood, the entire system shall be designed, fabricated, modified and/or
upgraded in full compliance with applicable locallaws and code standards. The absence
of a particular item or requirement in the specification shall not relieve the Contractor
of its responsibility for such equipment, features and/or procedures.
e. With the exception of only those items specially identified as being performed by
others, the Specifications are intended to include all engineering, material, labor,
testing, and inspections needed to achieve wark specified by the Contract
Documents. Inasmuch as it is understood that any incidental wark necessary to

unusual,unforeseen, and unsatisfactory conditions.
2. Definitions in ASME A17.1 as amended or modified by the AHJ apply to all wark of
this Section.
D. Submittals
1. Prior to beginning the work, the Contractor shall submit and have approved copies of
layout drawings, shop drawings and equipment cut sheets. These items shall include:
a. A plan view of the hoistway and machine room.
b. Detailed shop drawings for all fixtures and accessories on a per-elevator basis.
c. Detailed shop drawings reflecting the new cab interiors.
d. Electrical and heat load requirements.
e. Hoist machine, governor and safeties.
£ Hoist and governor ropes.
g. Traveling cables.
h. Roller guides.
i. Controllers.
2. Approved filing and submittal requirements must be completed before equipment and
related materials are ordered.
3. Copies of"Department of Buildings"permits and/or governing authority's documents
shall be posted at the job site with copies issued to the Owner's Agent, Owner's
Representative and Consultant.
4. Samples of wood, metal, plastic,paint or other architectural finish materials pertinent
to this project shall be submitted for approval by the Owner's designee.
5. The approval of drawings and cut sheets by Consultant, Owners Representative, and
or Architect shall be for general purpose only and does not include measurements.
Measurements are the Contractor's responsibility.AHJ approval of any variations from
the contract documents are required.
6. The Contractor shall prepare a record log and maintain all submittals, shop drawings,
equipment cut sheets and samples.
E. Measurements and Drawings
1. Measurements and Drawings provided in this document are for the bidder's
convenience. It is the Contractors ultimate responsibility to verify a11 measurements

for accuracy and before any parts or equipment is ordered.
2. The Owner and/or Owner's Representatives will not be responsible for absence of
wiring diagrams of existing equipment or any detail the Contractor may require.
3. In the execution of the work on the job, the Contractar shall verify all dimensions
with the actual conditions.
F. Keys
1. Upon acceptance of the wark specified in the Contract Documents for each unit, the
Contractor shall deliver three (3) keys for each new general group one key-operated
device to the Owner.
2. All other keying of access or operation shall be provided in a black trimmed Elevator
Personnel Only(EPO)box,this box shall be attached to the wall of the machine room.
3. New key switches,tumblers and security devices shall all be coordinated to match
CCAD standards. New firefighter's key switches shall be keyed to match FEOK1
national standard.
4. Provide and install one new EPO key box in machine room.
5. Provide and install one new fire fighters key box in lobby.
G. Diagnostic Tools
1. Prior to seeking final acceptance of the completed project as specified by the
Contract Documents, the Contractor shall deliver to the Owner any specialized
tool(s) that may be required to perform diagnostic evaluations, adjustments, and/or
programmable software changes on any unit of microprocessor-based elevator
control equipment installed by the Contractor. Any and all such tool(s) shall become
the property of the Owner.
a. Any diagnostic tool provided to the Owner by the Contractor shall be configured
to perform all levels of diagnostics, systems adjustment and software program
changes which are available to the Contractor.
b. In those cases where diagnostic tools provided to the Owner require periodic
recalibration and/or re-initiation, the Contractor shall perform such tasks at no
additional cost to the Owner for a period equal to the term of the maintenance
agreement from the date of final acceptance of the completed project.
c. During those intervals in which the Owner might find it necessary to surrender a
diagnostic tool for recalibration,re-initiation or repair,the Contractor shall
provide a temporary replacement for the tool at no additional cost to the Owner.
2. The Contractor shall deliver to the Owner,printed instructions for the proper use of
any tool that may be necessary to perform diagnostic evaluations, systems
adjustment, and/or programmable software changes on any unit of microprocessor-
based elevator control equipment installed by the Contractor. Accompanying the
printed instructions shall be any and all access codes,passwords, or other proprietary
information that is necessary to interface with the microprocessor-control equipment.
H. Operating Manuals, Wiring Diagrams, and Maintenance Instructions
1. Comply with the requirements of Division O1.

2. Contractor shall deliver to the Owner, three (3) identical volumes of printed
information organized into neatly bound manuals prior to seeking final acceptance of
the proj ect.
3. The manuals shall also be submitted in electronic PDF format.
4. Manuals, as well as electronic copies, shall contain the following:
a. Step-by-step adjusting, programming and troubleshooting procedures that pertain
to the solid-state microprocessor-control and motor drive equipment.
b. Passwords ar identification codes required to gain access to each software program
in order to perform diagnostics or program changes.
c. A composite listing of the individual settings chosen for variable software
parameters stored in the software programs of both the motion and dispatch
controllers.
d. Method of control and operation.
5. Contractor shall provide three (3) sets (One (1) set laminated and located within the
elevatar machine room, One (1) set submitted to Owner, and One(1) set,electronic
PDF format file(s), for viewing electronically and making additional prints. of"As-
built/As-installed" elevatar circuit wiring diagrams with location index and
component function descriptions per the following requirements:
a. Display name and symbol of each relay, switch or other electrical component
utilized including identification of each wiring terminal.
b. Electrical circuits depicted shall include all those which are hard wired in both
the machine room and hoistway.
c. Supplemental wiring changes performed in the field shall be incorporated into the
diagrams in order to accurately replicate the completed installation.
6. Contractor shall furnish three (3) complete and bound copies of: 1.)maintenance and
adjustment instructions,including tolerances to be maintained and 2.)lubricating
instructions,including recommended grade of lubricants.
7. Contractor shall furnish three (3) complete bound copies of warranties, approved
submittals and test results.
8. Contractor shall provide training on the new elevator equipment features,security,key
switches and emergency operation.
1.3 DELIVERY, STORAGE, HANDLING AND COORDINATION
A. Delivery and Storage of Materials and Tools
1. Comply with the General Conditions included with the bid package.
B. Related Work/Coordination
1. Coordinate installation of sleeves, block outs, equipment with integral anchors, and
other items that are embedded in concrete or masonry for the applicable equipment.
Furnish templates, sleeves, equipment with integral anchors, and installation
instructions and deliver to Project site in time for installation.
2. Coordinate sequence of installation with other work to avoid delaying the Wark.
3. Coordinate locations and dimensions of other work relating to elevators including pit

ladders, sumps, entrance sub-sills; machine beams; and electrical service, electrical
outlets, lights, and switches in pits and machine rooms, overhead sheave rooms and
hoistways.
4. The elevator contractor shall provide all necessary labar required to assist related work
contractors with access to elevator spaces, including the elevator pits, hoistways, and
machine rooms. All labor required to remove elevatars from service,operate elevatars
for other trades and for coordination of related wark shall be included in the base bid.
5. Contractor shall limit use of the exisring building to the areas to be remodeled and
areas designated by Owner. Contractor's tools,equipment and materials shall be stared
within areas authorized by Owner's Representative only if the Owner determines that
such areas are available for this purpose.
6. Employees of the Contractor and of his subcontractors shall wear badges or other form
of continuously visible identification at all times while warking on this project.
C. Related Work by the Elevator Contractor Included in the Base Bid
1. For bidding purposes, all bidders.
a. Non-elevator equipment located in the elevator machine room
1) Existing non-elevator electrical devices in the elevator machine room may
remain provided all equipment is installed properly and labeled.
2. The following requirements shall be applicable based on prevailing conditions at the
site of wark and/or mandated modifications for code compliance, subject to the
variances noted above.
a. Reuse and modify the existing power supplies as required far code compliance.
Install grounding conductors in accordance with local code and elevator control
system manufacturer requirements.
b. Provide auxiliary power feeds with required distribution load center (circuit
breaker panel) for intercommunication, CCTV systems, cab lighting or other
specialty devices existing or to be provided by the Elevator Contractor.
1) Voltage shall be 110 V AC with one 15 Amp circuit breaker or fuse for lighting
of each individual elevator car enclosure.
2) Circuit breakers and/or fused disconnects shall be lockable in the "OFF"
position in accordance with applicable code.
3) All circuits must be labeled identifying what it controls on the load side of the
circuit.
c. Installation of new electrical conduit and power feeders between the load side of
existing and new main line disconnect switches and new elevator control
equipment.
d. Provide any rigging, hoisting and crane work required to remove existing
equipment from the building and install new equipment into the building.
e. Provide cut outs in machine room/penthouse wall or roof to facilitate craning in
the new equipment.A11 wa11 cutting required for removal of old equipment and the
craning of the new equipment must be brought back to original condition after the
hoisting is completed. In some cases, a larger door and or roof hatch could be
installed to fill the cut-out area. This is of the contractor's option but is subject to

review and approval by the owner.
£ Provide an engineering report for review on any wall, door, or window
modifications or enlargements.
g. Provide a code-compliant machine room. This work shall include but not be
limited to upgrading machine room doors, locks, closers,removal of combustible
materials,fire rating any openings or penetrations,removal of non-elevator wiring
and materials, provide guarding around the exposed roof water drain line.
h. Provide hoist rope guards at the car and counterweight drop side of the hoisting
machine sheave to prevent accidental contact with the hoisting ropes.
i. The top surface of any setback ar projection in the hoistway that measures 4" ar
more in width shall be beveled at an angle of not less than 75 degrees from
horizontal. Each bevel plate shall be constructed from prime painted 14 gauge
cold-rolled steel.
j. Installation of new permanent lighting fixtures with protective guards and 110-volt
duplex GFI receptacles inside the machine room.Illumination shall be no less than
30 foot-candles at floor level.
k. Provide each elevator pit with a 110-volt GFI duplex receptacle and a permanent
lighting fixture equipped with protective guard. Illumination shall be no less than
10 foot-candles at pit floor level.
1. Provide the following signage,plates and tags:
1) Provide all access doors from the elevator lobby area to the machine room with
signs that read"ELEVATOR MACHINE ROOM ACCESS"and the machine
room doar shall have signage applied which reads "ELEVATOR MACHINE
ROOM". Letters shall not be less than 2"high
2) Provide all required manufacturer data plates, code data plates,hoist rope and
governor rope data tags, crosshead, and safety plank data tags.
m. Where the pit extends mare than 3 feet below the sill,provide new ar modify the
existing pit ladder,this is at the contractor's option.
1) Ladder shall extend no less than 48" above the sill of the access door.
Handgrips shall extend from the ladder to a point no less than 48" above the
si11 of the access door where the ladder does not comply.
2) The rungs shall be a minimum of 12" wide. Where prevailing conditions
prevent a 12"wide rung.
3) The rungs shall be spaced 12"on center.
4) A clear distance of no less than 4 '/z" from the centerline of the rungs and
handgrips to the nearest permanent object in back of the ladder shall be
provided.
a) Where prevailing conditions prohibit the installation of the required ladder
as specified above, the Elevator Contractor shall coordinate requirements
necessary for compliance with the Authority Having Jurisdiction.
n. Modify the pit floor and/or pit enclosure as required to:
1) Provide a smooth and 1eve1 pit floor suitable for installation of elevator
equipment specified herein.Paint pit floor,pit structures as needed.

o. Provide 2 spare twisted pairs or one coax for a future security card reader in the
traveling cable.
p. Provide necessary patching, repairing and installation of masonry and/or drywall
for smooth and legal elevator hoistways, including installation of new fixtures and
operating devices specified herein.
q. All hoistway smoke ventilation provisions, including duct work, dampers, fans,
fire control interfaces, smoke detectors, control switches and indicators, in
accordance with local codes, shall be reviewed,repaired and modified as required
to provide for code compliance (where applicable) for proper operation and
compliance with any applicable codes.
r. HVAC — Service or replace the existing HVAC equipment associated with the
machine room to maintain ambient temperature and humidity levels that are within
the range specified by the microprocessor control equipment manufacturers. 50 to
90 degrees F with no less than 85%humidity.
s. Reuse, modify,replace ar provide new as needed fire smoke detectors,provide
one detector in each elevator lobby and one detectar in the machine room. Where
sprinklers are present heat detectors and shut trip breakers shall be utilized
emergency control interface provisions for automatic recall of the elevator(s)
through operation of the fire detection system. Provisions shall be made for
alternate designated fire recall landing with connection contingent on Codes
recognized by the local governing authority. The interfacing contacts shall be
wired to an electrical junction box located inside each elevator machine room far
connection to the elevatar control systems. Each wire shall be clearly labeled
with its control function. Coordinate the type of interface required for the specific
elevator control apparatus.
t. Provide emergency communication means from the machine room to the cab as
required by ASME A17.1 ar local code. The interface point shall be an electrical
junction box located in the elevator machine room.
u. Provide two-way life safety communication from the elevator machine room to
each elevator cab to life safety communications means from the Lobby panel
and/or fire command room to the elevator cabs and/or machine room as required
by ASME A17.1 or local code. Contractor shall provide all wiring, conducts and
related electrical equipment necessary between the elevator machine room,
hoistway and building fire command room if present.
v. Provide safe and convenient access to the machine space.Provide a ship ladder
with full treads and handrails,this ladder shall not exceed 60% grade.
w. Subsequent to the contract execution,the Contractor shall perform the following
procedures and engineering tasks relative to balance loading of system and cab
work included under base specification:
1) Once the new cabs and equipment has been installed, the Contractor shall
balance the weight or load between the car and counterweight. The
percentage of counter balance sha11 be of the machine manufactures
recommendation, any increase or decrease in cab weight over or under 5%+
or—shall have supporting engineering documentation. The load shall be
balanced by adding or subtracting counterweight filler weights as required.
2) Perform balance load testing to determine existing conditions and

requirements applicable to new/modified equipment.
3) Provide data far Purchaser and/or their agents to evaluate any limitations that
may be placed on design/finish options due to prevailing conditions or total
suspended loading.
1.4 QUALITY ASSURANCE
A. Materials and Quality of Work
1. All materials are to be new and of the finest quality.
2. Installation of these materials shall be accomplished in an orderly fashion and be of
the finest quality.
a. Should the Contractor receive written notification from the Owner stating the
presence of inferior, improper, or unreliable materials or inferior quality of
installation, the Contractor shall remove the work or materials and make good all
other work or materials damaged within twenty-four(24)hours of written notice.
B. Materials, Painting and Finishes
1. Two (2) coats of rust inhibiting enamel shall be applied to exposed ferrous metal
surfaces in the pit that do not have a galvanized, anodized, baked enamel, or special
architectural finishes.
2. Thoroughly clean hoistway,divider beams,facia,rail brackets,doar panels,cross head,
rails, sills and platforms. Two (2) coats of rust inhibiting enamel paint color shall be
applied to the crosshead, platform, and inside of door panels, as required and to the
machinery located within the machine room and secondary level(where applicable)as
well as to the pit floors. If the machine room floor under the machine is uneven patch
and smooth out to match the machine room floor.
3. Architectural metal surfaces of bronze or similar non-ferrous materials which are
specified to be refinished, re-clad and/or provided new, shall be sufficiently clear
coated so as to resist tarnishing during normal usage for a period of not less than twelve
(12)months after final acceptance by the Owner.
4. Identify all equipment including buffers, crosshead, safery plank, machine, controller,
drive, governor, disconnect switch, etc., with 4" high numerals that contrast with the
background to which they are applied. The identification shall be either decal-type or
stencil type.
5. Identify each elevator at the designated landing by affixing permanently fastened cast
metal numerals adjacent to the hoistway entrance.Fina1 design, location and mounting
to be approved by the Owner. Gurney/Stretcher compliant elevators shall also be
identified with a code compliant symbol or signage.
6. Paint or provide decal-type floor designation not less than six (6) inches high on
hoistway doors (hoistway side), fascia's and/or walls as required by Code at intervals
not exceeding 7'-0". The color of paint used shall contrast with the color of the surface
to which it is applied.
C. Asbestos
1. If asbestos is discovered,or a material encountered that is suspected to contain asbestos

by the Contractar during this project, the Contractor should immediately notify the
Owner's Representative for containment/abatement direction. Abatement, mitigation
and/or control of asbestos are the responsibility of the Owner.
D. Handicapped Requirements(ADAAG)
1. Locate doar reopening devices at 5" and 29" above the finish floor when individual
contact projection apparatus is employed.
2. Locate the alarm button and emergency stop switch at 35", and floar and control
buttons not more than 48" above the finished floor. The alarm button shall illuminate
when pressed for visual acknowledgement to user.
3. Provide raised markings in the panel to the left of the car call and other control buttons.
Letters and numbers shall be a minimum of 5/8" and raised .03" and shall be in
contrasting color to the call buttons and cover plate.
4. The centerline of the hall push button shall be 42"above the finished floor.
5. The hall arrival lanterns, or cab direction lantern provided shall sound once for the
"up" direction and twice for the "down" direction. Design and locate fixtures per
Federal standards.
6. Provide floor designations at each entrance on both sides of jamb at a height of 60"
above the floor. Designations shall be 2" high, raised .03" on a contrasting color
background as selected by the Owner.
a. Use cast metal plates and polished numbers secured with tamper-proof hardware.
7. Provide an audible signal to tell passenger that the car is stopping or passing a floor
served by the elevator.
8. Provide a verbal annunciator that announces the floor at which the car is about to stop
in accordance with ANSI A117.1, section 407.4.9.2.
a. The signal shall be an automatic verbal annunciator that announces the floor at
which the car is about to stop using a female voice in English
b. The verbal announcement indicating the floor shall be completed prior to the
initiation of the door opening.
c. The verbal annunciatar shall be 10 dB minimum above ambient, but sha11 not
exceed 80 dB,measured at the annunciatar.
d. The verbal annunciator shall have a frequency of 300 Hz minimum to 3,000 Hz
maximum.
9. Provide signal controls for passenger entry/exit transitions per Federal standards.
10. Ensure sill-to-sill running clearances do not exceed 1-1/4" at all landings served.
11. Provide visual call acknowledgment signal for cab emergency intercommunication
device.
1.5 WARRANTY AND MAINTENANCE SERVICES
A. Contract Close-Out Guarantee and Warranties
L The Contractor agrees to certify that wark performed in accordance with the Contract
Documents shall remain free of defects in materials and quality of work for a period of

one (1) year after final acceptance of the completed project, or acceptance thereof by
beneficial use. The warranty period for all units shall commence simultaneously upon
final acceptance of the last elevator in the project.
2. The sole duty of the Contractor under this warranty is to correct any non-conformance
or defect and all damages caused by such defect without any additional cost to the
Owner and within fifteen(15) days of notification.
3. The express warranty contained herein is in lieu of all other warranties, express or
implied,including any warranty of inerchantability or fitness far a particular purpose.
4. In the event the Contractor fails to fulfill its obligations defined herein,the Owner shall
have the express right to perform the contractor's obligations and to charge the
Contractor the cost of such performance ar deduct an equal amount from any monies
due the Contractor.
B. Maintenance Coverage
1. The following maintenance coverage applies:
a. Interim Maintenance
1) Provide full protective maintenance services and equipment coverage from
notice to proceed (prior to the commencement of work) and during the work
implementation procedure,until final acceptance of the finished project.
2) Interim full comprehensive maintenance services shall be provided in
accordance with the Owner's Farm of Agreement issued with the
modernization documents for subsequent services.
3) Costs related to interim maintenance shall be included in the base bid.
C. Guarantee Maintenance
1) Provide full comprehensive preventative maintenance services for a period of
twelve(12)months after the final completion and acceptance of the project.
2) Guarantee maintenance and related services shall be provided in accordance
with the Owner's Form of Agreement issued with the modernization
documents for subsequent services.
3) Costs related to guarantee maintenance shall be indicated on the bid form in
the space provided.

2.3 SYSTEMS AND COMPONENTS
A. Control Equipment(New)
1. Provide a microprocessor-based elevator control system.
2. Closed-loop distance and velocity feedback shall monitor the actual performance of
the elevator car with the desired speed profile.
3. System operating software sha11 be stored in non-volatile, electrically programmable
read only memory (EPROM), electrically erasable and programmable read only
memory(EEPROM), or flash read only memory(flash ROM).
a. Each wiring terminal shall be clearly identified according to the nomenclature used

on the "as built"wiring diagrams.
b. Spare wires shall be tagged according to their point of termination, bundled, and
placed at the bottom of the control equipment cabinet.
c. Control equipment shall comply with the requirements of all applicable Sections
of the ASME A17.1 Code as approved and adopted by the AHJ.
d. The manufacturer's standard on-board"LCD"display shall be incorporated on the
main processar board and/or otherwise incorporated in the controller cabinet.
1) Where the "LCD" is not an integral part of the controller and
troubleshooting/reprogramming requires the use of a separate tool, the tool
shall be maintained in the machine room and accessible to service personnel.
This tool,along with all technical documentation far the correct use of the tool,
shall remain the property of the Owner.
2) Password protection of critical programming features is required to prevent
accidental changes to life-safety and other non-typical control settings.
3) Where a separate dispatch or group control panel is provided, a separate
"LCD"display shall be provided to view group functions.
B. Gearless Elevator Hoisting Machine(New)
1. Provide VVVF A/C gearless traction machines.
2. Provide rope grippers
3. Provide 14-gauge hoist cable guards at the car and counterweight drop side of the
hoisting machine sheave to prevent accidental contact with the hoisting cable. The
guard shall extend from the point where the hoisting cable penetrates the machine room
floor slab to a point beyond where the cable contacts the traction and deflectar sheaves.
4. Design and construct the hoisting machine based on passenger elevator cab enclosure
and counterweight weights, including all modifications and component upgrades
specified herein.
C. WVF AC Drive(New)
1. Provide a solid-state, variable voltage, variable frequency (WVF), 3-phase AC hoist
motor drive system as part of the microprocessor-based equipment.
2. Protective Features:
a. Motor overspeed.
b. Adjustable current limit.
c. Isolated control circuitry.
d. Digital display for fault conditions.
e. Selectable automatic restart at momentary power loss.

D. Deflector Sheave (New)
1. Provide new overhead and/or machine room wire rope cable deflector sheave with
related apparatus and structural mounting supports.
2. Locate and size new sheave to maximize use of available clearances maintaining the
present car and counterweight hitch drops.
3. Required mounting beams and structural supports shall be interfaced with existing
building structures modified under the terms of this contract for the new design rated
and located loading.
4. Provide sheave guard for all apparatus and secure same to supporting building
elements.
E. Overspeed Governor(New)
1. The existing overhead speed governor shall be replaced.
a. The governor shall be provided with a manually reset electrical safety switch,
conforming to the ASME A17.1 code.
b. Following the replacement, the overspeed governar shall be tested in accordance
with the ASME A17.1 Code.
c. Seal and tag the governor with the running speed, tripping speed and date last
tested.
F. Automatic Leveling/Releveling and Positioning Device(New)
1. Equip the elevator with a floor leveling device which shall automatically bring the car
to a stop within 1/4"of any floor for which a stop has been initiated regardless of load
or direction of travel.
G. Load Weighing Device(New)
1. Provide means to measure the load in the car within an accuracy of�4%of the elevator
capacity.
2. Provide one of the following types of devices:
a. A device consisting of four strain gauge load cells located at each corner of the car
platform and supporting a free-floating car platform and cab with summing circuits
to calculate the actual load under varying conditions of eccentric loading.
b. A device consisting of four strain gauge load cells.
c. A device to measure the tension in the elevator hoist ropes.
3. Provide audible and visual signals in connection with the load weighing device when
used as an"overload"device.
H. Ascending Car Overspeed Protection Device (New)
1. Provide a device designed to prevent an ascending elevator from striking the hoistway
overhead structure.
2. The device shall decelerate the car with any load up to the rated capacity by applying
an emergency brake.
L Unintended Car Movement Protection Device (New)

1. Provide a device to prevent unintended car movement away from the landing when the
car and hoistway doars are not in the closed and locked position.
a. The device shall prevent operation of the car until the device is manually reset.
b. The device shall meet the requirements of the ASME A17.1 Safety Code.
J. Emergency Brake (New)
1. Provide a mechanical device, independent of the normal braking system that will stop
the elevator should it overspeed ar move in an unintended manner.
2. The device used may be arranged to apply force to the car or counterweight rails.
2.4 MECHANICAL COMPONENTS AND MISCELLANEOUS EQUIPMENT
A. Machine Beams (Modify Existing)
1. Provide additional support beams, angles, plates, bearing plates, blocking steel
members, etc., to support new machines, governors, dead end hitches, deflector and
overhead sheaves from existing machine beams where applicable.
2. Contractor shall verify adequacy of all existing supports scheduled to be reused and
report same to the Owner.
3. Provide new machine beams, blocking and related supports as required based on
equipment modifications specified herein.
a. Any modifications or changes to structural supports shall be reviewed and verified
by a certified Professional/Structural Engineer.A copy of the engineering analysis
shall be provided to the Owner for review and approval as part of the submittal
package.
B. Governor Rope Tension Assembly(New)
L The tension sheave assembly shall be replaced.
C. Car and Counterweight Buffer(Retain)
1. Provide buffer with necessary blocking and horizontal steel braces under the car and
counterweight.
2. Provide a permanent buffer marking plate which indicates the manufacturer's name,
identification number,rated impact speed and stroke.
3. Provide a permanent data plate in the vicinity of the counterweight buffer indicating
the maximum designed counterweight run-by in accordance with ASME A17.1.
D. Counterweight Assembly(Reuse)
1. The existing counterweight assembly shall be refurbished to an as new condition.
a. Filler weights shall be held securely in place at all times with tie rods passing
through holes in both the weights and the counterweight frame with tie rods
secured on each end with double lock nut and a cotter pin arrangement. Shim
induvial weights as required to eliminate rattles.
E. Hoist Ropes(New)

1. New pre-formed traction steel wire rope shall be of a grade and design recommended
by the hoist machine manufacturer.
F. Governor Rope(New)
1. New governor ropes shall be of the grade and design required by the governor and
safety plank manufacturer.
G. Guide Rails (Reuse)
1. Each stack of guide rails shall be realigned so that total deviation from plumb in any
direction does not exceed 1/8" over the entire length of the hoistway and that DBG
measurements never vary more than .030".
2. As required,car guide rails joints shall be individually filled, filed and sanded in order
to eliminate minor variations in adjoining machined surfaces.
H. Roller Guides(New)
1. The existing roller guide assemblies shall be replaced with new.
I. Car Frame(Reuse)
1. The existing car frame assembly shall be refurbished to a as new condition andreused.
2. Individual car frame members, platform isolation framewark, door operator support
structure,related bracing and hardware shall be inspected for any indication of damage
or distortion.
3. The elevator car shall undergo static balancing upon substantial completion of all work
described in the project specifications and subsequent to any car interior refinishing or
cab replacement work performed in conjunction with the project.
J. Platform(Reuse)
1. The existing platform sha11 be modified to accommodate the new apparatus specified
herein.
a. The existing subfloor shall be removed,provide and install new marine grade plywood
subflooring of the same nominal thickness as the original. Provide for a smooth
underlayment per manufactures instructions to accept the installation of the new
rubberized�nished flooring
b. Existing toe guard apron shall be modified to meet code and painted.
K. Safeties(Replace with New)
1. The existing car safety device shall be replaced.
L. Designation and Data Plates, Labeling and Signage(New)
1. Provide floor designation plates at each elevatar entrance, on both sides of the jamb at
a height of 60 inches to center line of plate.
a. Designations shall be 2"high, 0.03"raised and stud mounted.
2. Identify the designated medical emergency services elevator with 3"high international
symbol at each elevator entrance on both sides of the jamb.

3. Provide elevators with data and marking plates, labels, signage and refuge space
markings complying with A17.1 Elevator Safety Code as may be adopted and/or
otherwise modified by the AHJ.
M. Top-of-Car Operating Station(New)
1. A new operating station shall be provided on top of the elevator car. This station shall
be installed so that the controls are plainly visible and readily accessible from the
hoistway entrance without stepping on the car.
a. An indicator light and warning buzzer that are subject to activation under Phase I
-Fire Emergency Recall Operation.
N. Car Enclosure Wark Light and Receptacle(New)
1. The top and bottom of each car shall be provided with a permanent lighting fixture and
110-volt receptacle. Light control switches shall be located for easy accessibility from
the hoistway entrance.
O. Top-of-Car Handrail
1. Provide a permanently fastened handrail system on the elevator car top.
2.5 WIRING AND ELECTRICAL SAFETY DEVICES
A. Electrical Conduit, Wiring and Traveling Cable (New)
1. Electrical wiring shall be provided.
a. Each run of electrical conduit or duct shall contain no less than 10% spare wires
and,in any case,no fewer than two(2) spare wires.
2. Traveling cables shall be replaced.
a. Each traveling cable shall be provided with a flame-and water-resistant polyvinyl
chloride jacket.
b. Each traveling cable shall be arranged to provide no fewer than eight (8)
individually shielded pairs of 20-gauge wire and arranged to contain no less than
one(1)RG6 coaxial cable for future CCTV remote monitoring.
1) Wire or plastic wire ty-raps shall not constitute an acceptable means of
fastening.
c. The use of flexible metal conduit shall be limited to runs not greater than 3" in
length.
d. All abandoned or unused electrical conduit sha11 be removed from the hoistway.
e. Existing conduit and wiring duct may be reused if UL listed and suitable for the
application.
B. Normal and Final Terminal Stopping Devices (New)
1. Terminal stopping devices that are not mechanically operated (i.e., magnetic
proximity) shall be provided by the manufacturer of the control equipment, intended
for use as a terminal limit, and designed for reliable operation in the hoistway
environment.

2. Final terminal limits shall be pinned so as to prevent movement after final adjustment.

2.6 OPERATING SYSTEMS AND OPERATION
A. Automatic Group Duplex Selective Collective Operation (New)
1. Provide duplex selective collective operation with the two cars arranged to operate
from a single riser of hall push buttons.
2. In the event the supervisory control system should malfunction so that neither elevator
is assigned calls within a predetermined interval and in accordance with the conditions
of the operating strategy in effect, the system shall automatically assume a back-up
mode of operation whereby the elevators shall be arranged to provide continuous
service to each landing in a predetermined pattern without regard to actual corridor call
demands.
B. Motion Control (New)
1. Smooth stepless acceleration and deceleration of the elevatar car shall be provided in
either direction of travel during both single and multiple floor runs.
2. Use digital logic to calculate optimum acceleration and deceleration patterns during
each run.
C. Independent Service Operation (New)
L The car operating station shall be equipped with a key-operated switch labeled"IND
SER".
D. Inspection Service Operation(New)
1. Provide a key operated switch in the main car operating panel that, when turned to the
"ON"position,shall cause the elevator to be removed from service and placed in Inspection
Service Operation.
E. Hoistway Access Operation(New)
1. Provisions shall be made to allow access to the hoistway through the use of hoistway
access switches.
F. Battery Lowering
1. Provide battery lower for each elevator, during a power failure the battery lowering
shall be capable of lowering the elevatar to the next available landing, open its
doars to let the passengers out,and then take itself out of service until the building
power is restored.
G. Fire Emergency Operation(New)
1. Phase I - Emergency Reca11 Operation shall be provided for each car in accordance
with current provisions of ASME A171 code as modified under the applicable 1oca1

or State law.
2. Each main or auxiliary car operating station shall be provided with an indicator light
and warning buzzer,each of which shall become activated whenever Phase I Operation
is engaged.
3. Phase II - Emergency Recall In-Car Operation shall be provided far each car in
accordance with the current provisions of ASME A17.1 code as modified under local
or State law.
4. Each main or auxiliary car operating station shall be equipped with a three-position,
key-operated switch to engage Phase II Operation on elevators which have completed
the Phase I recall sequence, and which are parked at the designated recall landing or
alternate floor landing. Subsequent to activating Phase II operation on any elevatar,
that elevator must be returned to the designated recall landing in order to discontinue
that service mode.
5. All firefighter service operating devices shall be keyed to match FEOK1 National
Standard.
H. Load Weighing(New)
1. A positive means shall be provided to continuously monitor the amount of load being
transported by the elevator car.
2. The anti-nuisance feature shall operate at loads not exceeding 200 lbs., whereas load
dispatch and load non-stop shall be set to function at 65%of the rated loading capacity
for the initial set up and adjustment procedure.
3. Crosshead deflection device sensors for load weighing are prohibited.
I. Anti-Nuisance Operation(New)
1. In the event car loading or operation is not commensurate with the number of car calls
registered, all car calls shall be canceled.
J. Car to Lobby Operation(Duplicate Existing)
1. The existing control panel shall be replaced with new, oversizing the cover plate is
acceptable to reduce wall patching.
2. The Car-to-Lobby operating feature shall be overridden by Phase I - Fire Emergency
Operation and inoperative during Phase II -Fire Emergency Operation.

2.7 DOOR DEVICES AND OPERATION
A. Car/Hoistway Door Operation
1. Car and hoistway doars shall be arranged to operate in unison without excessive noise
or slamming in either direction of travel.
a. Door opening speeds of two (2) feet per second shall be provided in conjunction
with closing speeds of 1.0 feet per second in accordance with governing code.
b. Door operation shall be arranged to commence as the car enters its final leveling
approach to a landing. In no case shall the door opening cycle conclude before the
car comes to a complete stop at floor level.
2. When responding to either a car or corridor call, the amount of time that the elevator
door remains stationary in the open position shall be adjustable up to sixty(60)seconds.
3. The operation of the door protective device by physical contact (mechanical safety-
edge)or the interruption of one or more infrared light beams (dual or multi-beam non-
contact) during the close cycle shall cause the immediate reversing of the doors to the
fully open position.
4. Each car operating station shall be provided with a"door open"and"door close"push
button.
a. The "door open" buttons shall also control the open cycle during Phase II -
Emergency In-car Operation.
b. The "door close" push button shall function on Independent Service, Attendant
Service or Phase II - Emergency In-car Operation as well as during normal
automatic operations.
B. Master poor Power Operator System—NEW VVVF/AC
1. Provide a heavy-duty master door operator on top of the elevatar car enclosure for
power opening and closing of the cab and hoistway entrance door panels.
2. Operator shall utilize an alternating current motor, controlled by a variable voltage,
variable frequency (WVF) drive and a closed-loop control with programmable
operating parameters.
3. The type of system shall be designated as a high-speed operator, designed for door
panel opening at an average speed of 2.0 feet per second and closing at approximately
1.0 foot per second.
a. Provide nudging to limit speed and torque in conjunction with door close
signaling/closing and timing devices as permitted by ASME A17.1 as may be
adopted and/or otherwise modified by the AHJ. Nudging shall be initiated by the
signal control system and not from the door protective device.
C. Car poors (New)
1. Provide standard 1"thick, 14-gauge hollow metal flush construction panels,reinforced
for power operation and insulated for sound deadening.
2. Provide each new car door panel with stainless steel.
3. Drill and reinforce panels for installation of door operator hardware, door protective
device, door gibs, etc.

a. Provide each door panel with two (2) removable laminated plastic composition
guides.
D. Door Reopening Device—New
1. Provide a combination infrared curtain and door protection system.
2. The door shall be prevented from closing and will reopen when closing if a person
interrupts any one of the curtain light rays or enters the detection zone.
3. The door shall start to close when the protection system is free of any obstruction.
4. The infrared curtain and zone protective system shall provide:
a. Self-contained, selectable zone timeout feature to allow for closing at nudging
speed with audible signal.
b. Automatic turning-off of the zone in the event of three (3) consecutive triggers.
1) Light curtain shall continue to operate after system timeout.
2.8 FINISH AND MATERIALS
A. Car Interior Finishes
1. Car interior finishes shall be as selected by Owner.
2. Contractor shall provide samples of finishes as required for approval prior to
fabrication.
3. Refer to specifications for other design requirements.
4. Special attention shall be given to flooring materials and suitability for intended duty.
2.9 CAR ENCLOSURES AND ACCESSORIES
A. Elevator Cab—(New)
1. Wall Panels: Existing stainless-steel front return panels, strike jambs and transom shall
be replaced
a. Provide new steel shell cab, Corian and stainless-steel wall panels shall be
provided. Wall panel construction shall include backing as required to provide a
3/4" finished paneL The end reveals of the wall panels shall match the surface of
the panel. Wall base and reveal material shall be stainless steel with satin No. 4
finish. Ventilation openings shall be provided in base as required per Code.
b. Upper wall panel material to be Corian, price group E or lower, final material to
be selected by Owner.
c. Lower wall panel material shall be 20-gauge, rigidized stainless steel with 3-ND
finish.
d. Rigidized stainless-steel covering sha11 be turned to provide edge protection of the
panels without any seams.
e. Panels shall be demountable from within the car. Panel mounting shall not be
removable with common hand tools.
£ Existing car sills shall be replaced with nickel silver sills

g. The new cab height shall be increased. Note: Measure the distance between the
crosshead to the existing car top.Increase new cab height for maximum headroom
in elevator cab
1) When increasing cab height make sure we have adequate
clearance far shackle rope adjustment nuts, locking nuts and
movement of the shackle rods during flight.
2) Shackle rods shall not impact canopy during full load full speed
drop test.
2. Flooring: New, all elevator subflooring shall be replaced as specified.
a. Cab flooring shall be Nara Rubber Flooring. Final design and color to be selected
by Owner.
3. Ceiling: Provide new with cab.
a. Install the new ceiling panel system with new low voltage,low heat,recessed down
lights in the suspended panel designed to maximize inside floar-to-ceiling
clearance. Ceiling panel finish shall be No.4 stainless steel with 1/8"black reveals
between the panels. The ceiling panel substrate shall be made of inetal, wood
products or chip board will not be accepted
b. Provide LED lighting samples during cab shop approvals,the customer would like
to pick a higher lumen for the cab light. A minimum of six (6) lighting fixtures
with clear Halo lens trim and Lexan shields shall be provided in evenly spaced
ceiling panel with one light fixture perpanel.
c. Arrange lighting fixtures and ceiling assembly to provide even illumination
without hot spots and shadows. Provide additional lighting fixtures as required.
d. Design and configure lighting system to facilitate maintenance of the fixtures
without disassembly of the ceiling system.
4. Handrails: (New) All attachment hardware shall match the selected handrail and shall
permit handrail removal from within the cab.
a. Provide code compliant 1 '/�" diameter stainless steel tube handrails at side walls
for the front and rear opening elevators, and handrails at the side and rear walls of
the front opening elevators.
b. Provide a 10-gauge(minimum)plate at the hatch side of the shell, aligned with the
handrail attachment points to assure secure handrail mounting.
c. Design handrail attachment system to support 250 lbs. without any deflection and
damage to the handrail, cab panel and she11.
5. Car poors: Provide new heavy-duty car door panels designed to coordinate with all
new equipment specified herein. The surface of the new car doors shall be covered
with new, as approved by the Owner.
6. All cab materials shall conform to the code prescribed flame spread rating and smoke
development requirements.
7. Installation of protection pads for all walls and returns (floor to ceiling) using pad
buttons permanently attached at top and ring or snap hardware at bottom to maintain
hanging tension.

B. Elevator Cab Enclosure Fan(New)
1. Provide an exhaust type two-speed fan unit with cover grill.
C. Car Enclosure Work Light and Receptacle(New)
L The top and bottom of each car shall be provided with a permanent lighting fixture and
110-volt receptacle.
2. Light bulbs shall be guarded so as to prevent breakage or accidental contact.
2.10 HOISTWAY ENTRANCES
A. Hoistway Entrances(Reuse)
1. Hoistway entrance sills, sill supports, entrance frames, headers and header supports
shall be reused and refurbished.
a. Tharoughly clean hoistway, divider beams, facia,rail brackets, door panels, cross
head,rails, sills and platforms.
b. Hoistway entrances that have become distorted or bent shall be straightened,
plumbed,reset to the proper width dimension and reinforced as necessary.
c. Reclad the first floar door entrances with#4 Brushed SS
d. Door frame painting is by the owner
B. Door Panels(Reuse) all
1. Hoistway entrance door panels shall be reused and refurbished except for the main
floor door panels, these panels shall be replaced with#4 Stainless Steel door panels.
a. Provide each door panel with two removable laminated plastic composition guides,
arranged to run in existing sill grooves with a minimum clearance.
1) The guide mounting shall permit their replacement without removing the door
from the hangers.
2) A steel fire stop shall be enclosed in each guide.
2. Hoistway landing door non-vision wings shall be repaired if loose. New vision wings
shall be designed with material and finish to match hall side of door panels.
3. Owner to paint the existing door panels.
C. Tracks,Hangers and Related Equipment(New)
1. Formed or extruded steel landing door hanger tracks shall be provided.
2. Each landing door panel shall be suspended from a pair of door hanger assemblies that
are compatible with the hanger tracks. Shim as required between the door hanger
assembly and the existing door panels to provide a maximum of 3/8"between the sill
and the lower part of the sliding door panel.
D. Interlocks and Unlocking Devices
1. Each set of landing doors sha11 be provided with a complete electromechanical
interlock assembly.
2. The existing interlocks shall be discarded and replaced with new.

3. Each hoistway door interlock assembly shall be provided with an emergency release
mechanism utilizing a drop-leaf type of access key at all landings served.
E. Closers (New)
1. Closers at each entrance shall be replaced. Sill mounted spring closers or spirator
closers are acceptable.
F. Bottom Guides and Safety Retainers(New)
1. The bottom of each side sliding type hoistway door panel shall be equipped with a
minimum of two (2) guiding members.
a. Each guide assembly shall incorporate a steel fire stop and be so designed to permit
sliding member replacements without removal of door panel(s) from top hanger
devices.
b. Panels shall be hung with a maximum vertical clearance of 3/8 inch between top
of sill and bottom of panel and the guide shall engage the sill groove by not less
than 1/4 inch.
2. The bottom of each side sliding type hoistway door panel shall be equipped with a
guiding member safety retainer to prevent displacement in the event of primary guide
means failure.
a. A metal reinforcement (12 gauge stainless or galvanized steel) shall be installed
between the two(2)primary guiding members(a.k.a. "Z"bracket).
2.11 SIGNAL EQUIPMENT
A. General
1. The design and location of the hall and car operating and signaling fixtures shall
comply with ADAAG.
2. The operating fixtures shall be selected from the manufacturer's premium line of vandal
resistant fixtures.
3. The layout of the fixtures including all associated signage and engraving shall be as
approved by the consultant.
4. Refer to drawings for other design requirements.Where no special design is shown the
faceplates shall be as follows:
5. Provide a verbal voice annunciator in accordance with ADAAG standards as further
specified herein.
6. All caution signs, code mandated instructions and directives shall be engraved and
�lled with epoxy.
B. Main Car Operating Pane1(New)
1. Provide a vandal resistant main car operating push button panel on the inside front
return panel of the car.
2. Provide LED ca11 registration lights.
3. The operating panel shall include:

a. A call button for each floor served.
b. "Door open"/"Door close"/buttons.

feature and A.D.A. design provisions.
£ Locked Firemen's Service cabinet, keyed in accardance with local Code,
containing required devices and signals in accardance with ASME A17.1
Standards.
g. Provide a locked service cabinet flush mounted and containing the key switches
required to operate and maintain the elevator,including,but not limited to:
1) Independent/Attendant service toggle switch with associated operating buttons
and signal indicators.
2) Light toggle switch.
3) Fan toggle switch.
4) G. F. I. duplex receptacle.
5) Emergency light test button and indicatar.
6) Inspection Service Operation key switch.
4. Car operating panel shall be flush mounted with swing type, one-piece faceplate with
heavy-duty concealed hinges.
a. Mount all key switches that are required to operate and maintain the elevators
exposed on the car station except those specified within a locked service cabinet.
5. Car operating panel shall incorporate a 2" high, ten segments digital L.E.D. floar
position indicator,emergency light lens unit and black-filled engraved unit ID number
or other nomenclature, as approved by Owner, with the rated passenger load capacity.
C. Emergency Lighting Fixture and Battery Powered Alarm(New)
1. Provide a self-powered emergency light unit in the elevator car operating panel,
consisting of a light fixture, alarm bell and a power pack unit.
a. Unit shall provide continuous illumination for at least four (4) hours and one (1)
hour alarm bell operation.
2. The operation shall be completely automatic upon failure of normal power supply.
3. Provide a 6" diameter alarm bell with a sound output of between 80-90 dB (measured
from a distance of 10')mounted on top of the elevator car.
a. Activation of this bell shall be controlled by the ALARM button in the car
operating station which shall illuminate when pressed.
4. The car lighting and emergency alarm equipment sha11 be incorporated into the car
operating panel specified herein.
D. Emergency Voice Communication(Telephone)
1. A hands-free emergency voice communication system shall be furnished in each car
mounted as an integral part of the car operating panel. Each elevator shall be provided
with its own dedicated telephone land line circuit.

2. The owner will provide 2 (two) detected analog phone lines one per elevator.
3. The system shall be capable of serving as the audio output far an external voice
annunciation system.
a. Each device shall be provided with a self-diagnostic capability in arder to
automatically alert building personnel should an operational problem be detected.
4. The phone system equipment shall be incorporated into the car operating panel
specified herein.
5. All connections from the junction box to the telephone system shall be done by the
Elevator Contractor where existing provisions can be reused.
E. Emergency Alarm/Battery Back-up and Common Alarm Bell
1. Provide a code compliant, car-mounted battery unit including solid-state charger and
testing means enclosed in common metal container.
2. Provide a common alarm bell located in the elevator pit.
a. The bell shall be configured to operate when the alarm or stop switch of any
elevator.
F. Firefighters"Two-Way Telephone Communications System(New)
1. Provide a code compliant complete two-way telephone communications system for
point-to-point communications between authorized personnel and elevator car.
2. Provide firefighter telephones,telephone jacks and speakers in the car operating panel,
fire command room panel,hall fixtures and/or machine room in accordance with local
code.
3. New phones, connection devices and all associated wiring shall be provided by the
elevator Contractor as part of the base bid.
4. The handsets shall be self-powered and not require an external power source for
operation.
5. Provide all necessary wiring,conduits and interfacing between the elevator system and
the Building Life Safety System as required.
G. Car Position Indicator(New)
L The position of the car in the hoistway shall be indicated by the illumination of the
position indicator numeral corresponding to the floor at which the car has stopped or
is passing.
2. The position indicator equipment shall be incorporated into the car operating panel
specified herein or if installed separately, designed to provide an equivalent level of
protection.
a. Provide 2" high, 10-segment LED type position indicator with direction arrows,
integral with the car operating panel.
b. Provide audible floor passing signal per ADA standards where not provided by the
elevator signal control.
c. Flush mount fixture with cover to match selected car front or car operating panel
finish as directed by the Owner.

H. Car Direction Lantern(New)
L The car traveling lantern shall be replaced with new.
a. Provide LED type bulbs with audible electronic signal.
2. Car lantern shall indicate the direction of car travel and sound the chime.
3. The unit shall sound once for the "up" direction and twice for the"down"direction.
4. The car lantern direction of travel arrows shall be visible from the hall call station.
I. Voice Annunciator(New)
1. Provide a voice annunciatar in each elevator.
2. The voice annunciator equipment shall be incorporated into the car operating panel
specified herein or if installed separately, designed to provide an equivalent level of
protection.
3. Coordinate size, shape and design with Designer and other trades.
4. The system shall include, but not limited to:
a. Solid state digital speech annunciator with female voice in English.
b. Built-in voice amplif'ier.
c. Master volume control.
d. A speaker located in the elevatar cab.
e. Audible indication far selected floor, floor status or position, direction of travel
and nudging. Additional audible notices shall be supplied as required per local
code.
5. Locate all associated equipment in a single, clearly labeled enclosure located in the
machine room.
6. Remove all old "In Case of Fire Use Exits" signage plates, patch and finish wall as
required,paint to match existing wall colar.
J. Hall Call Station(new)
1. Provide all new hall call stations per the equipment specified herein and required per
code.
a. All firefighter's key switches shall be keyed to FEOK1 National Standard and
identified with proper markings.
b. Provide a new faceplate with engraved signage and fire advisory(Appendix O).
2. A11 cutting, patching, grouting and/or plastering of masonry wa11s resulting from the
removal or installation of corridor fixtures shall be performed by the Contractor so as
to maintain the fire rating of the hoistway.
3. Finished painting, decorating, or wallpaper of wall surfaces shall be by the elevator
contractor ar the elevator contractors subs.
4. A11 painting and patchwork should be included in this contract to the satisfaction of the
owner. If the entire wall has to be painted or wall papered then this shall be included
in the bid.
5. Oversized fixture plate covers can be utilized to reduce wall patching. Limit to '/z"per

K. Car and Hall Call Buttons (New)
1. Provide stainless steel convex type button as selected by the Owner from the
manufacturer's premium line of vandal-resistant push buttons. Innovation bruiser line
—button style of owner's choice.
L. Hoistway Access Switch(New)
1. Install a cylindrical type keyed switch at top terminal in order to permit the car to be
moved at slow speed with the doors open to allow authorized persons to obtain access
to the pit or car top.
2. This switch is to be of the continuous pressure spring-return type.
M. Floor Position Indicator(New)
1. Provide a new combination 2" digital ten segment LED type floor position indicator
and directional lanterns at the main egress lobby only.
2. New plate shall completely cover the present cutout and provide 2"numerals located
on center.
PART3 -EXECUTION
3.1 EXAMINATION
A. Inspection
1. Study the Contract Documents with regard to the work as specified and required so as
to ensure its completeness.
2. Examine surface and conditions to which this work is to be attached or applied and
notify the Owner in writing if conditions or surfaces are detrimental to the proper and
expeditious installation of the work. Starting the work shall imply acceptance of the
surfaces and conditions to perform the work as specified.
3. Verify, by measurements at the job site, dimensions affecting the work. Bring field
dimensions which are at variance with those on the accepted shop drawings to the
attention of the Owner. Obtain the decision regarding corrective measures before the
start of fabrication of items affected.
4. Cooperate in the coordination and scheduling of the work of this section with the work
of other sections so as not to delay job progress.
3.2 1NSTALLATION/PROJECT PHASING
B. Installation
1. Modernize the elevators, using skilled personnel in strict accordance with the final
accepted shop drawings and other submittals.
2. Comply with the code,manufacturer's instructions and recommendations.
3. Coordinate work with the work of other building functions for proper time and

sequence to avoid delays and to ensure right-of-way of system.Use lines and levels to
ensure dimensional coordination of the work.
4. Pre-hang traveling cables for at least 24 hours with ends suitably weighted to eliminate
twisting after installation.
5. After installation, touch up in the field, any equipment and controller cabinet surfaces
which have become scratched or damaged.
6. Lubricate operating parts of system as recommended by the manufacturer.
C. Project Phasing
1. Phase I - Final design development and contractors" preliminary work procedures to
be completed within two (2)weeks from date of contract award.
a. Prevailing conditions review and layout.
b. Selection meeting for aesthetic design and finishes with Owners"designee.
c. Filing for required permits or other governing authorities work procedure
requirements.
2. Phase II - Submittal approvals and confirmations shall be completed within six (6)
weeks from date of contract award.
a. Selection confirmations.
b. Manufacturer's shop drawings applicable,i.e.,fixtures,cab,machine room layouts,
doors, etc.
c. Engineering data acknowledgment applicable,i.e.,power,heat, structuralloads.
d. Delivery dates for major component suppliers, i.e., controls, machinery, fixtures,
cabs, etc.
e. Posting of permits or other governing agency authorizations to proceed.
£ Proposed wark implementation schedule.
3. Phase III-Mobilization of Final Design Approvals and Implementation
a. Revision confirmations, preliminary work procedures and confirmed schedule
shall be provided as required under Division 1.
D. Removal of Elevators from Service
1. If extenuating circumstances (i.e., separating controller interconnections, inspection,
testing, etc.), require that multiple cars of a single elevator group be removed from
service simultaneously, the work shall be performed outside of the normal business
hours at a time mutually agreed to by the Owner and Contractor.
2. A minimum of five (5) days advance written notice shall be given to the Owner and
Elevator Consultant by the Contractor detailing the reasons far the simultaneous
removal of the elevators from service along with the estimated out-of-service time.
3. The request shall be subject to review by the Elevator Consultant and approved by the
Owner prior to the commencement of the work.
4. Costs for this work in addition to associated expenses shall be included as part of the
Base Bid pricing.
3.3 FIELD QUALITY CONTROL

A. Inspection and Testing
1. Upon completion of each work phase or individual elevator specified herein, the
Contractor shall, at its own expense, arrange and assist with inspection and testing as
may be required by the State and municipal governing authorities and or the elevator
consultant in arder to secure a Certificate of Operation.
B. Substantial Completion
1. The work shall be deemed"Substantially Complete"for an individual unit or group of
units when, in the opinion of the Consultant, the unit is complete, such that there are
no material and substantial variations from the Contract Documents, and the unit is fit
for its intended purpose.
2. Governing authority testing shall be completed and approved in conjunction with
inspection for operation of the unit; a certificate of operation or other required
documentation issued; and remaining items mandated for final acceptance completion
are limited to minor punch list work not incorporating any life safety deficiencies.
3. The issuance of a substantial completion notification shall not relieve the Contractor
from its obligations hereunder to complete the work.
4. Final completion cannot be achieved until all deliverables,including but not limited to
training, spare parts, manuals, and other documentation requirements, have been
completed.
3.4 WORK AREA CONDITIONS & SAFETY
A. Protection& Cleaning Requirements
1. See General Conditions and Special Conditions provided in bid documents.
B. Barricades and Hoistway Screening Requirements
1. The Contractor shall provide barricades necessary to maintain adequate protection of
areas in which work is being performed, including open hoistway entrances, pits,
machine spaces, and control room. Fabrication and erection of all barricades shall be
in compliance with applicable OSHA Regulations.
2. Contractor shall provide temporary wire mesh screening in the hoistway and on any
elevator undergoing wark specified in the Contract Documents. This screening shall
be installed in such a manner as to completely segregate the hoistway from that of
adjacent elevators. Screening shall be constructed per OSHA Standards.The screening
shall be removed once the modernization project is completed.
3.5 DEMONSTRATION
A. Performance and Operating Requirements
1. Passenger elevators shall be adjusted to meet the following performance
requirements:
a. Speed: within 2% of rated speed under any loading condition.
b. Leveling: within 1/4"under any loading condition.

2. Maintain the following ride quality requirements for the passenger elevators:
a. Noise levels inside the car shall not exceed the following:
1) Car at rest with doors closed and fan off-40 dba.
2) Car at rest with doors closed, fan running - 55 dba.
3) Car running at high speed,fan off- 50 dba.
4) Door in operation - 60 dba.
b. Vertical accelerations shall not exceed 20 milli-g
1) The accelerometer used far this testing shall be capable of ineasuring and
recording acceleration to nearest 0.01 m/s�(1 milli-g)in the range of 0-2 m/s�
over a frequency range from 0-80 Hz with ISO 8041 filter weights applied.
Accelerometer should provide contact with the floor similar to foot pressure,
60 KPA(8.7psi).
c. Amplitude of acceleration and deceleration shall not exceed 4.0 ft/sec�.
d. A sustained jerk shall not be more than twice the acceleration.
e. The rate of change in the acceleration/deceleration rate shall not be greater than
8.0 ft/sec3.
B. Acceptance Testing
1. Comply with the requirements of Division O1.
2. The Contractor shall provide at least five (5) days prior written notice to the Owner
and Consultant regarding the exact date on which wark specified in the Contract
Documents will reach completion on any single unit of vertical transportation
equipment.
3. In addition to conducting whatever testing procedures may be required by local
inspecting authorities in order to gain approval of the completed work, and before
seeking approval of said work by the Owner,the Contractor shall perform certain other
tests in the presence of the Consultant.

4. The Contractor shall provide test instruments,test weights, and qualified field labor as
required to safely operate the elevator under load conditions that vary from empty to
full rated load and,in so doing,to successfully demonstrate compliance with applicable
performance standards set forth in the project specifications with regard to:
a. Operation of safety devices.
b. Sustained high-speed velocity of the elevatar in either direction of travel.
c. Brake-to-brake running time and floor-to-floor time between adjacent floors.
d. Floor leveling accuracy.
e. Door opening/closing and dwell times.
£ Ride quality inside the elevator car.
g. Communication system.
h. Load settings at which anti-nuisance,load dispatch,and load non-stop features are
activated.
5. Upon completion of work specified in the Contract Documents on the last car in any
group of elevators, and in conjunction with the aforementioned testing procedures,the
Contractor shall carry out additional testing of group dispatch/supervisory control
features in the presence of the Consultant.
6. The Contractor shall provide test instruments and qualified field labor as required to
successfully demonstrate:
a. The back-up operating mode for group dispatch failure
b. Simulated and actual emergency power operation
c. Firefighter, attendant and independent service operations
d. Restricted access security features and card reader controls
e. Up/down peak operation
7. After hour tests of systems such as emergency generators, fire service, and security
systems shall be conducted at no extra cost to the Owner.
