nent exemption from the smoke ordi-
nance presented and read. On motion
of Ald. Wallis the petition was re-
ferred to the smoke abatement com-
mission to report back to the council.
Petition of Mary B. Hancock, by
Brown, Lacy & Clewell, her attorneys,
asking the city council to cancel the
assessment of $25,000 levied against
her in the year 1913 presented and
read. On motion of Ald. Wallis the
prayer of the petition was granted
and the city treasurer instructed ac-
cordingly.
Bond of Wm. A. McClain as mem-
ber of the water works trustees pre-
sented and read. On motion of Ald.
Wallis the bond was referred to the
city attorney.
Original notice of suit of George
Dieterich, minor by Herman O. Diet -
erich his next best friend in the suns
of $528.05 for personal injuries sus-
tained presented. On motion of Ald.

tric Co. from the decision of the board

Cou:
Gentlemen: In the matter of the
bills of ncil James F. Lee for interest on
warrants for Louisa street and Madi-
son street assessments referred to
me, I would report as follows: Lou -
ist street assessment, was isued on
October 7th, 1915, and bonds dated
November 7th, 1915. The warrants
amounted to $5,734.32. interest on this
amount from October 7th to November
20, date of payment, amounts to
$41.11; interest from November 7th to
November 20 amounts to $12.43. Mad-
ison street assessment levied on Oc-
tober 22, 1915, and bonds issued on
November 22, 1915. The warrants
amounted to $3,463.32 of which
$2,500.00 were paid on December 1,
1915, and the balance, $963.32, on De-
celnber 13, 1915. The date September
16 in Mr. Lee's bill refers to date
of acceptance of the work.

report of defective lights Tor the
months of November and December,
1915. I find from the report of the
police department that the total hours
that 21 lamps failed to burn would
equal 1 lamp burning for one month
or $5.62.

To the Honorable Mayor and Council
of the City of Dubuque:
Gentlemen: At the last regular
meeting your honorable body referred
to me the report of John Mahoney,
street commissioner, and the treasur-
er's receipt attached thereto, for the
sum of ninety -seven and 52 -100
($97.52) dollars, which was paid by
the waterworks trustees for repairing
West Third street. There seemed to

be some question in your minds into
what fund this money should be
placed, since it had been taken from
a fund which was created by a special
appropriation. I beg to advise you
that from a consideration of all the
circumstances surrounding this trans-
action, it is my opinion that this
money should be returned to the fund
out of which it was originally taken,
and should not be put into the gen-
eral expense fund.

pert of the city attorney was approved
and the city auditor instructed ac-

To the Honorable Mayor and Council
of the City of Dubuque:
Gentlemen: Your committee of the
whole referred to me the claim of
Frank I ilger, asking to be recom-
pensed for damage sustained by him
arising out of the destruction of a
stop -box in the alley adjoining his
property, at 1073 White street, the
damage having been done at the
time the alley was being improved.
The amount of Mr. Hilger's claim is
seventeen and 50 -100 ($17.50) dollars.
I beg to state that we have investi-
gated this claim and find the same
to be a true and correct statement
of the claimant's damages, and would
therefore, respectfully recommend
that his claim be allowed, and a war-
rant be drawn in his favor in the sum
of seventeen and 50 -100 ($17.50) dol-
lars.

City Engineer Blake presented Pro-
file No. 898 showing the grade of Al-
gona avenue from West Fourteenth
street to Dexter avenue. On motion
of Ald. Wallis the profile was adopted
and the ordinance committee instruct-
ed to draft an ordinance covering the
same.
City Engineer Blake presented profile
No. 905 showing the grade of St. Jos-
eph street from Freemont avenue to
a point 600 feet westerly. On motion
of Ald. Clancy the profile was adopt-
ed and the ordinance committee in-
structed to draft an ordinance cover-
ing the same.

Alderman Wallis offered the follow-

Whereas, The contract heretofore
entered into by the City of Dubuque
for the improvement of West Third
street hereinafter described has been
completed, and the city engineer has
computed that the cost and expense
of said improvement amount to $15,-
527.64.
Therefore, Be it Resolved by the
City Council of the City of Du-
buque, That to provide for the
cost of improving West Third
street from the westerly curb line of
Burch street to the westerly lot line
of Alpine street the mayor be and he
is hereby required to execute and de-
liver to the city recorder, to be by
him registered and countersigned
sixty -one bonds for Two Hundred and
fifty dollars .each and one for Two
Hundred Seventy -seven and 64 -100
dollars numbered 4400 to 4461 in-
elusive, dated February 5, 1916, pay-
able on cr before seven years after
the date thereof, and bearing inter-
est at the rate of five per cent per
annum, payable semi- annually,
Ald. Wallis moved the adoption of
• the resolution. Carried by the fol-
lowing vote:

Alderman Wallis offered the follow-
ing:
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a cement side-
walk hereinafter described has been
completed, and the City Engineer has
computed that tht cost and expense
of said improvement amount to $50.70.
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
that to provide for the cost of con-
structing a cement sidewalk abutting
Lot 16 O'Neill's Riverview addition,
the mayor be and he is hereby re-
quired to execute and deliver to the
City Recorder, to be by him regis-
tered and countersigned, one side-
walk certificate for fifty and 70 -100
dollars, numbered 149, dated February
5, 1916, payable on or before seven
years after the date thereof, and bear-
ing interest at the rate of six per cent
per annum, payable semi-annually.

for the construction of a cement side-
walk hereinafter described has been
completed, and the city engineer has
computed that the cost and expense
of said improvement amount to $58.40.
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of con-
structing a cement sidewalk abutting
Lot 60 O'Neill's Riverview addition,
the mayor be and he is hereby re-
quired to execute and deliver to the
city recorder, to be by him registerd
and countersigned, one sidewalk cer-
tificate for fifty -eight and 40 -100 dol-
lars, numbered 150, dated February
5, 1916, payable on or before seven
years after the date thereof, and
bearing interest at the rate of six
per cent per annum, payable semi -an-
nually.
Ahi. Wallis moved the adoption of
the resolution. Carried by the fol-
lowing vote:

Alderman Wallis offered the follow-
ing:
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Second street
hereinafter described has been com-
pleted, and the City Engineer has
computed that the cost and expense
of said improvement amount to
$4,644.13.
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of im-
proving Second street from the west
rail of the Chicago, Milwaukee & St.
Paul Railway Co.'s track to the east-
erly line of Main street, the mayor be
and he is hereby required to execute
and deliver to the city recorder, to
be by him registered and counter-
signed, eighteen bonds for two hun-
dred and fifty dollars each and one
for one hundred forty -four and 13 -100
dollars, numbered 4381 to 4399 in-
clusive, dated February 5, 1916, pay-
able on or before seven years after
the date thereof, and bearing interest
at the rate of five per cent per an-
um, payable semi - annually.
Ald. Wallis moved the adoption of
the resolution. Carried by the fol-
lowing vote:

Be it' Ordained by the City Council of
the City of Dubuque:
Section 1: That a grade on Cox
Street from Angella Street to the
alley first northwest of said Angella
Street be and the same is hereby
established and adopted as shown by
the profile of said street and grade,
prepared by the City Engineer, being
profile No. 903. B. M. end of stone
curb between Lots 17 and 18, Quig-
ley's Sub., elevation 155.52. Said
grade begins at the northwesterly
curb line of Angella Street, north-
easterly curb elevation 165.00, south-
westerly curb elevation 166.00; (thence
to station 1+28 southeasterly line of
alley, northeasterly curb elevation
177.70, southwesterly curb elevation
177.70.
Section 2. This ordinance 'shall be
in force and take effect from and

Alderman Singrin moved that Coin -
mittee Clerk Lawlor he appointed re-

Mayor Saul stated that the meeting
was called for the purpose of adopt-
ing a set of resolutions in coldolence
with the death of the late Judge O.
P. Shiras, and any other matter that
may come before a regular meeting of
the council.
Alderman Wallis offered the follow-
ing:
Whereas, It has pleased Almighty
God to remove from among us our
beloved friend and fellow- citizen and
associate in public service, Judge Ol-
iver P. Shiras, and
Whereas, In the death of Judge
Shiras the city of Dubuque loses one
of its most loyal, most respected citi-
zens, one whose services to this city
and its people have been faithful and
unselfish and productive of great
good, and
Whereas, We are desirous of ex-
pressing our sorrow at his loss and
our sympathy for his bereaved, there-
fore,
Be it resolved by the city council of
the city of Dubuque, That a copy of
these resolutions be transmitted to
his family as an expression of our
sympathy and grief, and be it further
Resolved, That these resolutions be
spread upon the official record of the
council proceedings.

Mayor Saul stated that this ro9eting
is called for the purpose of canvass-
ing the vote cast at the special muni-
cipal election held January 10th, 1916,
for the establishing of a municipal
court and acting on any other busi-
ness that might properly come before
a regular meeting of the 4i.ty council.
Ald. Singrin moved that the mayor
appoint a committee of three to can-
vass the vote. Carried.

Ald. Singrin moved that the council
having canvassed vote and found the
result as follows: Yes, 683; No, 2224,
that the proposition be declared re-
jected according to the vote. Car-

Ald. Wallis moved that the city
attorney and city treasurer be in-
structed to prepare the proper reso-
lution and bond for the floating of
$96,000.00 of refunding bonds bearing
interest at 4 per cent for a term of
twenty years. Carried.
Ald. Wallis moved to take from the
committee of the whole all bills of
Jas. F. Lee which were formerly re-
ferred and act on them in the coun-
cil meeting. Carried.
Ald. Wallis moved that the bill of
Jas. F. Lee in the sum of $9.00 for
Special Session,
raising and adjusting manholes on
6th and 7th streets, between Locust
street and Bluff street, be paid and
a warrant drawn accordingly. Car-

Ald. McLaughlin moved that the
bill of Jas. F. Lee in the sum of
$180.50 for overhaul on West 8th and
Hill streets and for raising and ad-
justing manholes on West 8th and
Hill streets, be paid and a warrant
drawn accordingly.
Ald. McLaughlin moved that the bill
of Jas. F. Lee in the sum of $53.00
for furnishing and placing asphalt at
the intersection of Alpine and West
3rd streets and adjusting and raiding
manholes on West 3rd street be paid

berg avenue be referred to the city

Ald. McIntosh moved that the bill

for 5 per cent retained for the im-

paid and warrants drawn accordingly.

Ald. Wallis moved that the city
treasurer be instructed to advertise
for bids for the sale of 4 per cent re-
funding bonds in the sum of $9,600.00
incorporating the form prepared by
th.e city attorney, bids to be received
January 28th, 1916, till 10:00 a. m.

Ald. Clancy moved that warrants be
ordered drawn in favor of Jas. F. Lee
for all interest bills due him. Car-
ried.
Ald. McIntosh moved that the city
council reconsider their action in al-
lowing different bills at the meeting
of January 13th, 1916. Carried.
Ald. Clancy moved that all bills of
Jas. F. Lee relating to grading below
sub -grade be referred to the city at-
torney and city engineer. Carried.
Ald. Callahan moved that all bills
of Jas. F. Lee relating to overhaul be
referred to the city engineer to meas-
ure on grounds and to report at the
next meeting of the city council. Car-

Ald. Heim moved that all bills of
Jas. F. Lee for extra work on man-
holes be allowed and warrants order-
ed drawn to cover the same. Car-

Ald -McIntosh moved that the mayor
appoint a committee of three with

tions for all work by February 3rd,

Gentlemen: At a recent meeting
of your Honorable Body several days
for extra grading claimed to have
been done upon various street im-
provemenes by James Lee, contractor,
were referred to the undersigned for
a report upon the question whether
or not, under the contract and speci-
fications, said contractor was entitled
to recover from the city. We beg
to state that we have made a careful
and complete investigation of the
specifications and find that there ex-
ists no liabality upon which the con-
tractor can base a recovery. The
specifications specifically provide that
where a street is to be re -paved the
contractor must submit his bid for
the completed work, which includes
the grading and the laying of the pave-
ment as a completed job. The con-
tractor is also instructed that before
he submits his bid for the work he
must inform himself what work must
oe done under his contract and base
his bid for the work upon such infor-
mation. By his contract the con-
tractor agrees to complete the work
and not only a portion thereof. If it
happens that extra grading must be
done to niakE the pavement conform
to the established grade, the con-
tractor must do this at his own risk,
which risk he assumes when he bids
upon the work. This being the situa-
tion we, arrive at the conclusion that
whatever extra grading was done by
the contractor upon the several im-
provements, was done at the contract-
or's own risk, and for which the city
has no legal obligations to pay,

City Treasurer Wybrant reported as
follows:
Kissel - Kinnicutt & Co., of Chicago,
Illinois, have submitted the highest
bid namely par and accrued interest
to day of delivery plus a premium of
$260.00 and will furnish blank bonds
ready for signature without charge
subject to an allowance of a sum of
$960.00 for legal and other expenses.
Ald. Wallis moved that the report of
the city treasurer be approved and the
bid of Kissel - Kinnicutt Co. of Chi-
cago, Illinois, be accepted. Carried.
A resolution to provide for the is-
suance of Refunding Bonds on the
City of Dubuque, Iowa, for the pur-
pose of refunding certain outstanding
and maturing bonds.
Whereas, The City of Dubuque,
Iowa, is justly and legally indebted on
its certain valid outstanding bonds
to the amount of Ninety -six Thousand
Dollars, which outstanding bonds
were heretofore legally issued by the
said city under a resolution duly and
legally passed by the City Council
thereof in the years 1871, and 1896,
and which outstanding bonds bear in-
terest at the rate of four per cent
per annum, payable semi - annually,
and become due and payable on the
first day of February, A. D. 1916, and
said outstanding bonds have been is-
sued to refund and pay certain other
outstanding bonds of the said city
theretofore issued to pay valid in-
debtedness of the said city contracted
and incurred prior to the adoption of
the present constitution of the said
State of Iowa; and
Whereas, The said outstanding
bonds which so become due on Feb-
Special Session, January 28th, 1916
ruary 1st, 1916, are in all respects
regular, legal and valid, and the in-
terest thereon having been regularly
paid by the said city during all the
time they have been so outstanding;
and
Whereas, It being deemed for the
public interest to refund said bonds;
and,
Whereas, The city has full power
and authority under the laws of said
state of Iowa to issue bonds as here-
inafter provided to refund the said
outstanding bonds so due, now there-
fore,
Be it resolved by the City Council
of the City of Dubuque, Iowa:
Section 1. That there are hereby
authorized and directed to be issued
by and in behalf of the said City of
Dubuque its refunding bonds accord-
ing to and of the form hereinafter
contained, to the amount of Ninety -six
Thousand Dollars ($96,000.00), under
date of February 1st, 1916, in denomi-
nations of One Thousand Dollars each,
payable twenty years from date, bear-
ing interest at the rate of four per
cent per annum payable semi -annu-
ally on the first day of August and
February during said term, to be evi-
denced by interest coupons attached
.to the said bonds. Both interest and
principle of the said bonds to be made
payable in lawful money of the Unit-
ed States of America, at the Conti-
nental and Commercial National
bank of Chicago, Illinois. The said
bonds shall be signed by the Mayor
and attested by the Recorder of the
said City under its corporate seal, and
the interest coupons thereto attached
shall be signed by the mayor and at-
tested by the recorder of said city,
with the seal of the city affixed, said
bonds being numbered from One to
Ninety -Six, both inclusive, and said
interest coupons being numbered
from One to forty, both inclusive.
Section 2. That said bond shall
be substantially in the following form
subject to the necessary changes as
to the numbers, maturity of coupons
and other necessary variations there-

This bond is issued by the city of
Dubuque, Iowa, pursuant to the provi-
sions of Sections 905 to 911, inclu-
sive, of Chapter XII, Title V, of the
code of Iowa, and in conformity to a
resolution of the council of said city,
duly passed, a true and complete
copy of which. is printed on the back
hereof, as a part hereof. And it is
hereby certified and recited that all
acts, conditions and things required
by the laws and constitution of the
state of Iowa to be done precedent
to and in the issue of this bond have
been properly done, happened and
been performed in regular and due
form as required by law, and that the
indebtedness of said city, including
this bond, does not exceed the con-
stitutional or statutory limitations.
In testimony whereof, said city of
Dubuque by its council has caused
this bond to be signed by its mayor
and attested by iti recorder with
the seal of said city attached, this
first day of February, 1916.

being the highest bidder, said bonds

Ald. Clancy moved that the council
proceedings for the month of Decem-
ber, 1915, be approved as printed.

Ald. Singrin the contract was award-

Ald. Wallis moved that the bids for
the improvement of \Vest Locust
street from the end of the present
brick improvement to Hodgdon ave-
nue be referred to the committee of
the whole unopened. Carried.

eight -inch tile pipe sanitary sewer
in the unnamed street north of Met -
tel's sub. half way between Queen
street and Windsor avenue and on
Burden avenue from the unnamed
street to O'Neill avenue and easterly

Petition of Mary F. Miller asking
city council to cancel her taxes for
the years 1913, 1914 and 1915 on the
remainder of the west half of lot 3
of mineral lot 149, presented and read.
On motion of Ald. M "Laughlin the
petition was referred to the commit-
tee of the whole.
Petition of Geo. Zollicoffer asking
the city council to grant him a reduc-
tion in taxes for the years 1914 and
1915 on his property situated on Lin-
coln avenue and Rhomberg avenue,
presented and read. On motion of
Ald. McIntosh the petition was re-
ferred to the committee of the whole
to view the grounds.
Petition of E. M. Healey asking the
city council to cancel the tax for the
years 1915 in the sum of $2,500.00
against the estate of Geo. W. Healey,
presented and read. On motion of
Ald. Singrin the petition was referred
to the city assessor to report back to
the city council.
Petition of Louisa Lange relative
to being granted a reduction in the
assessment of her real estate, present-
ed and read. On motion of Ald. Wal-
lis the petition was referred to the
committee of the whole to view the
grounds.
Petition of Francis L. Weinberg
relative to the valuation placed on
lot 1 in Reeder Langworthy sub. of
mineral lots 73 and 149, presented
and read. On motion of Ald. Mc-
Laughlin the petition was referred to
the committee of the whole to view
the grounds.
Petition of Ida M. Warst asking the
city council to instruct the city treas-
urer to accept the sum of $9.10 for
payment of taxes on the -north 24
feet of lot 40, Stafford's add., pre-
sented and read. On motion of Ald.
Singrin the petition was referred to
the delinquent tax committee.

city council to cancel his taxes for
