City Engineer Gus Psihoyos is recommending City Council adopt a resolution approving
the Plat of Survey for Lot 1-2 and Lot 2-2 of Block 2 in River Front Subdivision No. 3, in
the City of Dubuque, lowa pursuant to a Development Agreement with Union at the
Marina, LP.
In accordance with the Development Agreement, the existing City property at Hawthorne
Street and Kerper Boulevard (former Bowling and Beyond Site in the Kerper Boulevard
Industrial Park) needs to be divided via a simple division plat. The platting of the lot area
has been coordinated with the Union at the Marina, LP and their representatives.
The City of Dubuque Engineering Department has prepared the attached simple division
plat. Lot 1-2 of Block 2 of River Front Subdivision No. 3 will be conveyed to Union at the
Marina, LP pursuant to said Development Agreement. Per the Development Agreement,
the plat includes the reservation of the water main, storm sewer, public utility, storm
drainage, and flood levee easements as shown on and described in said plat.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This memorandum is a request for approval of the Plat of Survey for Lot 1-2 and Lot 2-2
of Block 2 in River Front Subdivision No. 3, in the City of Dubuque, lowa pursuant to a
Development Agreement with Union at the Marina, LP.
BACKGROUND
On October 16, 2023 the City Council will hold a public hearing on a proposed
Development Agreement by and between the City of Dubuque, lowa and Union at the
Marina, LP and the City of Dubuque providing for the sale of City-owned real estate in
Greater powntown Urban Renewal District to Union at the Marina, LP and the issuance
of Urban Renewal Tax Increment Revenue Grant Obligations. Union at the Marina, LP
is a subsidiary of The Annex Group. The Annex Group is an Indiana based multifamily
housing developer that creates market-rate, workforce, affordable, and student housing
communities. The Group has successfully completed housing creation projects across
the Midwest and is currently constructing a 216-unit development in Des Moines.
The Annex Group began communication with City staff in September 2022, expressing
interest in developing a multi-residential project in Dubuque with the assistance of the
State of lowa 4% Low Income Housing Tax Credit program. The Group identified 1860
Hawthorne Street — the former Bowling and Beyond site — as a prime location for their
project. The project will create 201 affordable rental units in the North End of the
Greater powntown Area. Subject to State of lowa and City of Dubuque approval, Union
at the Marina, LP is proposing to purchase from the City of Dubuque the property
located at 1860 Hawthorne Street as a site to construct its latest housing development.
The project is anticipated to begin in August of 2024.
The key elements of the Development Agreement include the following:
1. Developer must purchase property located at 1860 Hawthorne Street for
$777,546 per acre for a total purchase price of approximately $4,082,116.
2. Developer must construct 201 rental units on the property.
3. Developer will receive a Land Acquisition Grant in an amount of $20,000
per unit created but not to exceed the purchase price.
4. Developer will receive 15 years of tax increment financing incentives in the
form of semi-annual rebates. Tax increment financing incentives are
estimated to not exceed $10,261,927.
5. City of Dubuque will survey, plat and sell approximately 5.25 acres of
property to Developer.
6. City of Dubuque will amend the Greater powntown Urban Renewal District
Plan to accommodate the issuance of tax increment financing incentives.
The City will also need to invest just over one million dollars to replace an aging and
undersized sanitary sewer lift station and these funds will be budgeted through the
FY25 City budget process.
DISCUSSION
In accordance with the Development Agreement, the existing City property at
Hawthorne Street and Kerper Boulevard (former Bowling and Beyond Site in the Kerper
Boulevard Industrial Park) needs to be divided via a simple division plat. The platting of
the lot area has been coordinated with the Union at the Marina, LP and their
representatives.

RECOMMENDATION
It is recommended that the Plat of Survey of Lot 1-2 and Lot 2-2 of Block 2 in River
Front Subdivision No. 3, in the City of Dubuque, lowa be approved and signed by the
Mayor and City Clerk to create a lot division for the purposes described above.
ACTION TO BE TAKEN
I respectfully request approval of the Plat of Survey of Lot 1-2 and Lot 2-2 of Block 2 in
River Front Subdivision No. 3, in the City of Dubuque, lowa through the adoption of the
enclosed resolution.

Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated the 251r day of September 2023, prepared by The City of Dubuque
Engineering Department, re -platting Lot 2 of Block 2 of in River Front Subdivision No.
3., in the City of Dubuque, Iowa, to be hereinafter known as Lot 1-2 and Lot 2-2 of Block
2 in River Front Subdivision No. 3, in the City of Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the plat dated the 251h day of September 2023, prepared by The
City of Dubuque Engineering Department relative to the real estate hereinabove
described be and the same is hereby approved, and the Mayor and City Clerk be and
they are hereby authorized and directed to execute said plat for and on behalf of the
City of Dubuque, Iowa.
Section 2. The City hereby reserves the water main, storm sewer, public utility,
storm drainage, and flood levee easements as shown on and described in said plat.
Section 3. That the City Clerk be and is hereby authorized and directed to file
said plat and certified copy of this resolution in the office of the Recorder in and for

The foregoing Plat of Survey of: Lot 1-2 and Lot 2-2 of Block 2 in River Front Subdivision No. 3, in
the City of Dubuque, Iowa, is made with the free consent and in accordance with the desires of the
undersigned owners and proprietors of said real estate.
All water main and storm sewer utility easements as stated and as shown on this plat are hereby
dedicated to the City of Dubuque, and its agents and contractors, for the purpose of constructing and
maintaining said utilities, along with the right, privilege, and authority to construct, reconstruct, maintain,
operate, repair, patrol, and remove said improvements. Said easement shall also include the right to
cut, trim, or remove trees, bushes, and roots as may be required. City shall restore the disturbed
surface areas due to the construction maintenance, or repair of said utilities and appurtenances to
equal conditions. Lot owners shall not erect or install any trees, landscaping, paving, or structure over
or within the easement areas without obtaining the prior written approval of the City Engineer. Lot
owners shall not change the grade, elevation, and contour, or perform any construction or any
excavation that will diminish the lateral support or integrity of said utility improvements without obtaining
the prior written consent of the City Engineer.
All public utility easements and storm drainage easements as stated and as shown on this plat are
hereby dedicated to the Public. Lot owners shall not erect any structure, fence, planting or other
obstructions over or within the public utility or storm drainage easement areas without obtaining the
prior written approval of the City Engineer. Lot owners shall not change the grade, elevation, and
contour or perform any construction or any excavation that would hinder the orderly flow of storm water
runoff or diminish the lateral support or integrity of said utilities and improvements without obtaining the
prior written consent of the City Engineer.
All flood levee easements as stated and as shown on this plat are hereby dedicated to the City of
Dubuque for flood protection works. Said easements shall be perpetual in and to the lands for the
purpose of entering thereon to construct, maintain, repair, operate, patrol, and replace a flood
protection levee and road, including all appurtenances thereto and further including the right to clear,
cut, fell, remove, and dispose of any timber, trees, underbrush, buildings, improvements, and/or other
obstructions therefrom.

Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated the 2511 day of September 2023, prepared by The City of Dubuque
Engineering Department, re -platting Lot 2 of Block 2 of in River Front Subdivision No.
3., in the City of Dubuque, Iowa, to be hereinafter known as Lot 1-2 and Lot 2-2 of Block
2 in River Front Subdivision No. 3, in the City of Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

The foregoing Plat of Survey of: Lot 1-2 and Lot 2-2 of Block 2 in River Front Subdivision No. 3, in
the City of Dubuque, Iowa, is made with the free consent and in accordance with the desires of the
undersigned owners and proprietors of said real estate.
All water main and storm sewer utility easements as stated and as shown on this plat are hereby
dedicated to the City of Dubuque, and its agents and contractors, for the purpose of constructing and
maintaining said utilities, along with the right, privilege, and authority to construct, reconstruct, maintain,
operate, repair, patrol, and remove said improvements. Said easement shall also include the right to
cut, trim, or remove trees, bushes, and roots as may be required. City shall restore the disturbed
surface areas due to the construction maintenance, or repair of said utilities and appurtenances to
equal conditions. Lot owners shall not erect or install any trees, landscaping, paving, or structure over
or within the easement areas without obtaining the prior written approval of the City Engineer. Lot
owners shall not change the grade, elevation, and contour, or perform any construction or any
excavation that will diminish the lateral support or integrity of said utility improvements without obtaining
the prior written consent of the City Engineer.
All public utility easements and storm drainage easements as stated and as shown on this plat are
hereby dedicated to the Public. Lot owners shall not erect any structure, fence, planting or other
obstructions over or within the public utility or storm drainage easement areas without obtaining the
prior written approval of the City Engineer. Lot owners shall not change the grade, elevation, and
contour or perform any construction or any excavation that would hinder the orderly flow of storm water
runoff or diminish the lateral support or integrity of said utilities and improvements without obtaining the
prior written consent of the City Engineer.
All flood levee easements as stated and as shown on this plat are hereby dedicated to the City of
Dubuque for flood protection works. Said easements shall be perpetual in and to the lands for the
purpose of entering thereon to construct, maintain, repair, operate, patrol, and replace a flood
protection levee and road, including all appurtenances thereto and further including the right to clear,
cut, fell, remove, and dispose of any timber, trees, underbrush, buildings, improvements, and/or other
obstructions therefrom.

IN RIVER FRONT SUBDIVISION NO. 3, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated the 25th day of September 2023, prepared by The City of Dubuque
Engineering Department, re -platting Lot 2 of Block 2 of in River Front Subdivision No.
3., in the City of Dubuque, Iowa, to be hereinafter known as Lot 1-2 and Lot 2-2 of Block
2 in River Front Subdivision No. 3, in the City of Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

undersigned owners and praprietors of said real estate.
A!I water main and storm sewer utility easements as stated and as shown on this plat are hereby
dedicated to the City of Dubuque, and its agents and contrac#ors, for the purpose of constructing and
maintaining said utilities, along with the right, privilege, and authority to construct, reconstruct, maintain,
operate, repair, patrol, and remo�e said improvements. Said easement shall also include the right to
cut, trim, or remove trees, bushes, and roots as rnay be required. City sha11 restore the dssturbed
surface areas due to the construction maintenance, or repair of said utilities and appurtenances to
equal canditions. Lot owners shalE not erect or install any trees, landscaping, pa�ing, or structure o�er

the prior written consent of the City Engineer.

hereby dedicated to the Public. Lo� owners shall not erect any structure, fence, planting or other
obstruc#ions over ar within the public utility or storm drainage easement areas withou# obtaining the
prior written approva! of the City Engineer. Lot owners shall not change the grade, ele�ation, and
co�tour or perForm any construction or any exca�ation that would hinder t�e orderly flow of storm water
runoff or diminish the lateral support or integrity of said t�tilities and improvements without obtai�ing the
prior written consent of the City Engineer.
