The application, staff report and related materials are attached for your review. Discussion Bob Schiesl, Assistant City Engineer, spoke on behalf of the application. He stated that this is the same process as the previous request, and this plat is along the Westside Drive frontage road in front of Menards. He noted that the replatting will create right-of-way for the City of Dubuque and Iowa Department of Transportation, and some land is excess and will be sold. Staff detailed the staff report, noting the submitted Plat of Survey of Weber Acres 2nd Addition is similar to the previous application and is a land cleanup effort following the completion of the Southwest Arterial. He explained that the plans are color coded to show what property the City will retain along westside drive, the property the IDOT will retain along the east, and the remaining lots which would be sold off as excess right of way. There were no public comments. The Zoning Advisory Commission discussed the request finding it appropriate. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the simple subdivision as submitted. A simple majority vote is needed for the City Council to approve the request. Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified as a Minor Subdivision' and therefore requires review by the Zoning Advisory Commission and City Council. DISCUSSION As proposed, the Plat of Survey of Weber Acres 2nd Addition would reorganize property lines along the existing frontage road, Westside Drive, and would result in the reallocation of ownership of portions of some of the lots to either the City of Dubuque, Iowa Department of Transportation (IDOT), or private property owners. The plat will create six (6) new lots that will include the following: ■ Lot 1 will be retained by the IDOT; ■ Lots 2, 3 and 4 will be excess properties that are currently owned by the State of Iowa but will be sold off. ■ Lot 5 will be owned by the IDOT; and ■ Lot A will be owned by the City of Dubuque and dedicated as city right-of-way. As proposed, the plat of survey is in substantial conformance with the Unified Development Code. Additionally, the proposed plat is in conformance with the Comprehensive Plan which identifies transportation as a vital link within Dubuque's economic fabric. The Zoning Advisory Commission shall review the submitted plat to determine whether it is in substantial conformance with the Unified Development Code and the Comprehensive Plan. RECOMMENDATION Planning staff requests that the Zoning Advisory Commission review the Plat of Survey of Weber Acres 2nd Addition and recommends approval. UDC Chapter 16-11-6 defines a Minor Subdivision as "Any subdivision or consolidation of property in which no new streets, public or private, are proposed and which does not require the construction of any public improvements and which creates three (3) or more lots."
