INTRODUCTION
This memorandum provides a status update on the H & W project at 3000 Jackson Street.
BACKGROUND
Steve Emerson owns the building at 3000 and 3040 Jackson Street locally known as the
H&W Brewing and Malting Building. This building has been deteriorating at an exponential
rate since the collapse of the mid -section of 3000 Jackson Street in 2015. The city has
taken several actions to try to stop the deterioration of the building. Specifically in the past
five years the city required a structural and stability review in 2018 following a $1,015,154
investment from the owner to deconstruct the collapsed materials and unstable areas of
the building from the 2015 collapse.
In 2021, as the building continued to deteriorate, the City issued orders to repair and
stabilize exterior brick that was falling from the building. This work was completed by
October 22, 2021, as per the order. At the same time, the city ordered a structural
assessment of all steel beams and columns.
In June 2023, the city received complaints that a window fell from one of the towers at
3000 Jackson Street. This window had fallen within the temporary fencing that was in
place at this time to prevent the public from entering the property. At the same time, it
was reported that squatters were entering the building through a window using a pallet
as a ladder for access. The city issued the owner additional orders to Vacate and
Demolish or Repair the structure. In this notice the owner was required to secure the
building from unauthorized entry, properly board all windows, resecure or remove
additional loose appurtenances or pediments that may become dislodged, provide a
structural assessment of the southwest building and demolish or repair the building within
180 days.
Additionally, on June 16t", 2023, the city ordered a permanent fence with barb wire at the
top be erected immediately to protect the public.
Due to a lack of communication and action from the owner regarding the structural
assessment of the building in June the city hired WHKS & Co to perform the structural
assessment. Upon receipt of the report from WHKS & Co in August 2023, the city issued
emergency orders to address the areas of concern listed in the report, and closed the
roads in the fall zone areas identified by the Engineer.
The owner complied with the emergency orders and within 14 days provided a detailed
plan to address each area of concern. Within 30 days the proper permits were issued,
and construction began shortly after by Zinser, a construction company hired by the
owner.
At the beginning of November, it was noted that the public was ignoring the road closures
and continuously moving the road closed barriers. Concrete barriers were erected to re -
enforce the road closure to keep the public away from the fall zone.
All properties within the fall zone were sent a letter and received a visit from the Housing
and Community Development Department explaining that their home sat in a fall zone
and the city will continue to work with the owner to try to stabilize or deconstruct the
building.
DISCUSSION
Zinser has removed the south wall of the building that was an area of concern. After
removal of this wall and some of the roofing elements, Zinser stopped construction due
to concern that the building would become too unstable if they removed the roof and
parapets. Zinser required an engineered bracing of the building be provided prior to any
further deconstruction. The owner has an engineer working on this bracing system
currently.
The city does not want further deconstruction to continue until all parties have reviewed
the bracing system and agreed that deconstruction efforts can continue. This includes a
review by WHKS & Co hired by the city. The fall zone (road closure area) remains an
area of danger to the public until the building can be stabilized, deconstructed in some
areas, and then reviewed by a structural engineer to deem the building safe for the public.

December 3, 2023, will mark 180 days since the first demolition/repair order was issued.
If the city does not agree to provide the owner with any additional time to complete the
demolition work, the city would have the ability to move forward with the demolition work.
The cost would be assessed back to the property; however, the city would bear the cost
of demolition until that assessment was paid. Per Iowa Code 364.12:
"a city may perform the required action and assess the costs against
the property for collection in the same manner as property tax"

The building official has found the building/structure intended as a commercial building on the above -
mentioned lot to be dangerous based on the following conditions:
• a portion of the building has been damaged by fire, earthquake, wind, flood or by any other
cause, to such an extent that the structural strength or stability thereof is materially less than it
was before such catastrophe and is less than the minimum requirements of the building code for
new buildings of similar structure, purpose or location.
• a portion or member or appurtenance thereof is likely to fail, or to become detached or dislodged,
or to collapse and thereby injure persons or damage property.
• A portion of the building has wracked, warped, buckled, or settled to such an extent that walls or
other structural portions have materially less resistance to winds than is required in the case of
similar new construction.
• The building or structure, or any portion thereof, because of, 1) dilapidation, deterioration or
decay; 2) faulty construction; 3) the removal, movement or instability of any portion of the
ground necessary for the purpose of supporting such building; 4) the deterioration, decay or
inadequacy of its foundation; or 5) any other cause, is likely to partially or completely collapse.
The building must remain vacated and continuously secured from unauthorized entry.
All windows must be properly boarded by June 1511, 2023.
Any loose appurtenances or pediments which may become dislodged must be removed or secured.
A structural assessment on the southwest building, south facing wall is required.
The building shall be demolished or repaired. All permits must be secured for demolition or
repair within sixty (60) days from the date of this order. Demolition must be completed within
ninety (180) days from the date of this order.

If required permits and demolition or repair work is not completed within the timeframes noted, the
building official may proceed to cause the work to be done and charge the costs thereof against the
property or its owner.
This work has been deemed necessary on an emergency basis, and therefore an appeal of these orders
will not stay work deadlines or alter the timelines required herein.

Within (7) days, a minimum eight feet tall (8'-0") chain link fence, with 3 strand barbed wire arms
at each post, must be permanently installed around the perimeter of the property to prohibit
unauthorized entry. See attached Exibit A — "Fence Location" for extents. One 36" (minimum)
wide gate with a secure lock, must be installed at the west side of the property. One 72" wide gate
with a secure lock must be installed on the south side of the property, aligned with the utility
easement. One min. 120" wide gate with a secure lock shall be installed at the courtyard entrance
to provide emergency vehicle access if required. All secure locks shall be keyed alike. A key box
(Knox or equal) is required to be installed adjacent to the 96" wide gate for access in case of
emergency.

I am writing to provide you with a crucial update resulting from an ongoing structural condition
assessment of the Dubuque Brewing and Malting Building at 3000 Jackson street as ordered by the City
in the interest of public safety. The assessment, performed by WHKS & Co, has uncovered areas of
critical concern that demand swift and decisive action.
The ten areas of concern identified in the attached structural assessment report update letter require
immediate corrective action.
Within 14 days from the date of this letter, provide to our office a detailed plan to address each of the
areas of concern.
Within 30 Days from the date of this letter, procure permits for work required to address each of the
areas of concern.
Within 60 Days from the date of this letter, complete corrective actions for each of the areas of concern.
Your immediate attention to this matter is required. A failure in this building would be catastrophic
and could endanger life, limb, and property. We anticipate a prompt resolution to address these
critical concerns. Failure to adhere to the deadlines in this letter or to otherwise take prompt corrective
action will result in legal action from the City.

Dear Resident/Property Owner:
On August 11, 2023, the City of Dubuque received a report from a structural engineering firm hired
by the City to assess the structural integrity of the Dubuque Malting & Brewing building (old H&W
building) at 3000 Jackson Street. That report identified significant concerns regarding several
portions of the building, including the 80' tall brick wall at the front of the building along Jackson
Street, the two 110' tall towers along the same portion of the building, and the exterior walls along E
30`h Street. The City has declared the building to be a Dangerous Building under the City Code, and
the City Manager has ordered the immediate implementation of several precautionary measures, one
of which is this notification to you.
The City has no information indicating that a structural collapse is imminent. However, if a
collapse were to occur, ,your property is within the potential fall zone as identified by the structural
engineers. Due to the uncertainty of the situation, the City is unable to provide additional
instructions/advice but encourages you to take whatever steps you believe to be appropriate to
protect yourself, your guests, and your property while the City works to resolve this issue as quickly
as possible.
The City has notified the building's owner and demanded immediate corrective action. Several
weeks ago, the City closed the portion of E 30' Street along the side of the building. Out of an
abundance of caution, the City is also now closing the portion of Jackson Street along the front of
the building, including the sidewalks on both sides of the street. Both streets will remain closed and
traffic rerouted until the threat to public safety has been eliminated. Residents should avoid these
areas until further notice.
Additional information will be provided when available. Please take this notice seriously and be
cautious in the area. For additional information, please call the Housing & Community

The building official has found the building/structure intended as a commercial building on the above
mentioned lot to be dangerous based on the following conditions:
• A portion of the building has been damaged by fire, earthquake, wind, flood or by any
other cause, to such an extent that the structural strength or stability thereof is materially
less than it was before such catastrophe and is less than the minimum requirements of
the building code for new buildings of similar structure, purpose or location
• A portion or member or appurtenance thereof is likely to fail, or to become detached or
dislodged, or to collapse and thereby injure persons or damage property
• A portion of the building has wracked, warped, buckled or settled to such an extent that
walls or other structural portions have materially less resistance to winds than is required
in the case of similar new construction.
• The building or structure, or any portion thereof, because of: 1) dilapidation, deterioration
or decay; 2) faulty construction; 3) the removal, movement or instability of any portion of
the ground necessary for the purpose of supporting such building; 4) the deterioration,
decay or inadequacy of its foundation; or 5) any other cause, is likely to partially or
completely collapse.
• The building or structure, or any portion thereof, is manifestly unsafe for the purpose for
which it is being used
Work scheduled to be completed under the permit pulled by RW Restoration must commence
by Friday October 221d, 2021. If the contractor is unable to meet this deadline, they must
contact the Code Official at the City of Dubuque directly with this information.
Steel beams and columns must be evaluated per the Structural Assessment, immediately. By
Friday October 22Id, 2021 identify the vendor/contractor providing this service and when they
will provide this evaluation.

Windows exposed with glass remaining in the opening must be properly boarded by Monday
October 25th, 2021.
Per the Structural Assessment, the mason contracted to conduct emergency repairs will need to
identify areas of deficiency that cannot be visually evaluated. A bi-weekly report of findings by
the mason is required to be submitted to the Code Official starting November 1, 2021. Any
deficiencies found that may pose an immediate threat to the public, or the structural integrity
of the building, will be report to the Code Official immediately upon discovery.
Insurance documents will be updated and provided to All Connors at the City of Dubuque by
Monday October 25`h, 2021.
If the orders above are not completed within the timeframes noted, the building official may proceed
to cause the work to be done and charge the costs thereof against the property or its owner.
This work has been deemed necessary on an emergency basis, and therefore an appeal of these orders
will not stay work/timelines required herein.

This letter is an update of our structural evaluation work of the building at 3000 Jackson Street in
Dubuque. Last week we continued our evaluation of the structure by inspecting accessible interior
areas and the courtyard walls (northwest wall). In addition, we performed additional survey
scanning to supplement previous scans. We are continuing to work on our report but want to
make you aware of some critical areas of concern.
Critical Areas
Ten areas of concern have been identified at this time. These areas are labeled and shown in
Table 1 and Figure 1 below. Each area is discussed briefly below and summary photos with notes
are included in Appendix A.
