The application, staff report and related materials are attached for your review. nicr,iccinn Samantha Humke, 1045 Hiawatha Drive, East Dubuque, explained that they are looking to reconfigure two long, narrow properties which are not optimal for development. They would like to divide them so the second lot would potentially be buildable in the future. She stated that access to Lot 2 would be across Lot 1. Staff detailed the staff report noting the size of the proposed lots and displayed maps of the current and proposed lot configurations. Staff explained that this is a Simple Subdivision and requires Commission review because it is creating a lot without street frontage. Staff noted the subdivision play includes an easement for access and utilities across Lot 1 for Lot 2. There were no public comments. The Zoning Advisory Commission discussed the request, finding it appropriate. Recommendation By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council approve the Simple Subdivision as submitted subject to waiving the street frontage requirement for Lot 2. A simple majority vote is needed for the City Council to approve the request. The property at 869 Ramona Street (PIN 1036153019) is improved with a single-family residence and a detached garage and the other lot (PIN 1036153023) is currently undeveloped. The property owner proposes to reconfigure the lots, and, pursuant to the Unified Development Code (UDC), the proposed subdivision is classified as a Simple Subdivision'. The proposed plat of survey would create two lots, one of which would not have frontage along a public or private street, and therefore the Simple Subdivision requires review by the Zoning Advisory Commission. DISCUSSION As proposed, the Plat of Survey of Humke Place would reconfigure two existing parcels into two new parcels. The following is a description of each proposed parcel: Lot 1 (0.514 acres) would abut the right-of-way along Ramona Street. The lot would contain an existing single-family residence and detached garage. Lot 2 (0.503 acres) would be undeveloped and lack street frontage. An access and utility easement is platted from Ramona Street across Lot 1 for Lot 2. See property view on next page. UDC Chapter 16-11-6 defines a Simple Subdivision as "Any subdivision or consolidation of property in which no new streets, public or private, are proposed, which does not require the construction of any public improvements, and which creates fewer than three lots." Because the proposed Lot 2 will not have the required street frontage, the applicant is requesting a waiver of this bulk regulation requirement for Lot 2. The proposed lots are otherwise in substantial conformance with the Unified Development Code. The UDC categorizes the proposed plat as a Simple Subdivision. Pursuant to UDC Chapter 11-7.3, the Zoning Advisory Commission and City Council are the reviewing authorities for a Simple Subdivision that requires a waiver of bulk regulations. The Zoning Advisory Commission shall review the plat to determine whether it is in substantial conformance with the Unified Development Code and shall consider the waiver of the street frontage requirement. RECOMMENDATION Planning staff requests that the Zoning Advisory Commission review the Plat of Survey of Humke Place and recommends approval subject to waiving the street frontage requirement for Lot 2.
