Van Milligen, City Manager Chestnut Street (Highland to Cox) Reconstruction Project On Thursday, October 23, 2003, members of the Engineering Division met with the City of Dubuque Historic Preservation Commission in regard to the Chestnut Street reconstruction issues that were discussed at the Monday, October 20 Council meeting. The Histodc Preservation Commission requests the installation of four bdck crosswalks for $13,500. The Commission recommends that this cost increase the cost of the project, which would mean that approximately 80% of this cost would be paid by the City and 20% assessed to the homeowners. The Commission also recommends the City allow property owners the opportunity to enter into a legal agreement with the City assuming liability for street trees that were to be removed as part of the project. Bethany Golombski has requested that the City install limestone curb and gutter in front of her property along that portion of Chestnut Street at her expense. The cost quoted by the City's contractor is $16,000. She is requesting permission to use an alternate contractor. Public Works Director Mike Koch recommends award of the Chestnut Street (Highland to Cox) Reconstruction Project to WC Stewart Construction in the amount of $471,823.04, and requests the City Council provide direction on the brick crosswalks and limestone curb and gutter. Should the City Council incorporate these changes into the project, under current City practice, a public headng would be required. I concur with Public Works Director Mike Kochs' recommendation and respectfully request Mayor and City Council approval, including offedng property owners the opportunity to enter into a legal agreement with the City to assume liability for street trees that were to be removed. Koch, Public Works Director/¢~. ~'/~_~ Chestnut Street (Highland to Cox) Reconstruction Project On Thursday, October 23, 2003, members of the Engineering Division met with the City of Dubuque Historic Preservation Committee in regard to the Chestnut Street reconstruction issues that were discussed at the Monday, October 20 Council meeting. Street Replacement A packet was presented to the Committee on the cost estimates of brick street replacements in other cities, recommendations of brick versus colored crosswalks, and the installation factors of limestone versus buff-colored curb and gutter. Based on the provided research, the Committee recommended the installation of four brick crosswalks---one at Highland Street, two at Prairie Street, and one at Walnut Street--at an additional cost of $13,500. They have also asked that this additional cost be incorporated into the project and to be part of the overall assessment. Based on this recommendation, the City would assume approximately 80 percent of the cost and the property owners would assume the remaining 20 percent. Once a cost has been established between the City and the contractor, an amendment to the assessments would be prepared and a public hearing would need to be held for these additional assessment amounts. Tree Preservation The City of Dubuque Historic Preservation Committee asked that Engineering Division contact the property owners that would be impacted by tree removal in front of their properties. Since the trees have been determined to be in extremely poor condition by the City Forester, the City will ask the property owners that wish to retain the tree in front of their property to sign a lien waiver holding the City harmless from any damage resulting from the continued existence of the tree. If the tree ultimately falls, the City would remove and replace the tree. Limestone Curb and Gutter at 1295 Prairie Bethany Golombski has requested that the City install limestone curb and gutter in front of her property along that portion of Chestnut Street at her expense. On October 24, the City advised Ms. Golombski that the cost of the limestone curb and gutter would be $16,000. She would like the City Council's consideration to allow her to continue her efforts to have the limestone curb and gutter installed in front of her property along Chestnut Street as part of the project, but to reserve the right to use an alternate contractor. The City Council's approval is necessary to change this item from the original design of the reconstruction project. Once a cost has been established between the property owner and the contractor, an amendment to this assessment would be prepared and a public hearing would be held for this additional assessment. ACTION TO BE TAKEN I recommend that the City Council award the contract to WC Stewart Construction in the original amount of $471,823.04 and request the City Council to provide direction on the brick crosswalks and the limestone curb and gutter. One of the duties of the Historic Preservation Commission as stated in the City's Historic Preservation Ordinance (Chapter 25 of the City Code) is: "To serve as an advisory design review body to the City Council for review of public works projects which have historic preservation implications in historic districts, or for alteration of landmarks, landmark sites or structures, that would result in a matedal change in appearance or be visible from the public right-of-way." The Histodc Preservation Commission's role is to review the proposed plans for the Chestnut Street Reconstruction Project and provide a recommendation to the City Council. Discussion The Histodc Preservation Commission held a special meeting on October 23, 2003 to review the Chestnut Street Reconstruction Project. Public Works Director Mike Koch and Civil Engineer Mike Felderman discussed the cost differences for installing a bdck street and limestone curb compared to installing a concrete street and concrete curb. Mr. Felderman noted that he has contacted other city departments as well as the contractors that were reference in the submitted newspaper articles. He explained the cost of limestone curbs and if the property owners along Prairie Street would like one to remain that they could pay for the increase in cost to install limestone. He discussed the possibility of adding color concrete to the curbs in order to give them a limestone appearance. He also noted costs for installing color concrete and bdck crosswalks at Walnut, Praide, and Highland Streets. Mr. Felderman noted that he has contacted the Legal Department about giving the property owners the opportunity to assume liability for existing street trees located next to their property. They noted that in future they would like to be aware of public works projects in the public right-of-way early in the design phase. They noted that the City Engineering Department should submit a list of public works projects located in histodc districts that have been identified in the 5 year Capital Improvement Program to the Planning Services Department to identify which projects need HPC design review. The Commission discussed allowing property owners the ability to take responsibility of the street trees. They indicated that they would like to see bdck crosswalks installed. They indicated that they would like to work with the Engineering Department to save the existing brick streets and to reseamh a cost effective way to install brick streets. Recommendation By a vote of 6 to 0, the Historic Preservation Commission recommends that the City Council award the contract, allow property owners the opportunity to enter into a legal agreement with City about liability for street trees, allow property owners along Prairie Street to pay for installation of limestone curb, and increase the cost of the project to include the installation of brick crosswalks at Walnut, Praide and Highland Streets. Koch, Public Works Director Chestnut Street (Highland to Cox) Reconstruction Project INTRODUCTION The enclosed resolution provides for the award of the Chestnut Stree{ (Highland to Cox) Recodstruction Project. DISCUSSION The Chestnut Street project will involve the complete reconstruction of the existing base and pavement surface that is 29 foot in width, from back-of-curb to back-of-curb from Highland to Walnut and 20 foot in width from Walnut to Cox. The pavement will be concrete, with new curb and gutter and sidewalks on both sides from Highland to Walnut. The City Council, however, at the public hearing on the project removed the sidewalk on the southeast corner of Chestnut and Highland. The area from Walnut to Cox will have sidewalks only on the north side due to the minimal width of the right-of- way. The project will include: storm sewer improvements; sanitary manhole replacement; sanitary sewer main repairs; water valve improvements; replacement of 15 lead water services; and 21 sanitary sewer lateral replacements. Sealed bids were received on the project on October 9, 2003. WC Stewart Construction Co. of Dubuque, Iowa, submitted the Iow bid in the amount of $471,823.09. This amount is 2.24% under the engineer's estimate. A summary of the bids received is as follows: WC Stewart Construction Co. Tschiggfrie Excavating Co. Portzen Construction, Inc. Whereas, said sealed proposals were opened and read on the 9th day of October, 2003, and it has been determined that the bid of WC Stewart Construction Co. of Dubuque, Iowa, in the amount of $471,823.09 was the lowest bid for the furnishings of all labor and materials and performing the work as provided for in the plans and specifications. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the contract for the above improvement be awarded to WC Stewart Construction Co. and the Manager be and is hereby directed to execute a contract on behalf of the City of Dubuque for the complete performance of the work. Koch, Public Works Director,;.~'[;~ Chestnut Street (Highland to Cox) Reconstruction Project INTRODUCTION The enclosed resolutions authorize the public bidding procedure for the Chestnut Street (Highland to Cox) Reconstruction Project. DISCUSSION Chestnut Street from Highland to Walnut was built in 1898 with macadam stone; and in 1918, brick was placed over the stone. Chestnut Street from Walnut Street to Cox was built in 1915 with macadam stone and replaced in 1935 with concrete. The Chestnut Street project involves a complete reconstruction of the existing base and pavement surface that is 31 foot in width, from back-of-curb to back-of- curb from Highland to Walnut and 20 foot in width from Walnut to Cox. The pavement will be concrete, with new curb and gutter and sidewalks from Highland to Walnut. The section from Walnut to Cox will be concrete with curb and sidewalk on the north side. Since there is one property which does not have a sidewalk, a new sidewalk will be installed at the property owner's expense.
