12 04 23 CityCouncil Proceedings Official_Special and Regular1 CITY OF DUBUQUE, IOWA CITY COUNCIL PROCEEDINGS SPECIAL SESSION OFFICIAL The Dubuque City Council met in special session at 5:30 p.m. on December 4, 2023, in the second-floor Council Chambers of the Historic Federal Building, 350 W. 6th Street. Present: Mayor Pro Tem Wethal; Mayor Cavanagh (attended virtually); Council Members Farber, Jones, Resnick, Roussell, Sprank; City Manager Van Milligen, City Attorney Brumwell. Mayor Pro Tem Wethal read the call and stated this is a special session of the City Council called for the purpose of conducting a work session on the Railroad Quiet Zone Study. WORK SESSION Railroad Quiet Zone Study Project Manager Steve Sampson Brown introduced Project Manager Bryan Janssen and Project Engineer Jacob Sprengeler, both of Anderson-Bogert, who gave a presentation on the Railroad Quiet Zone Study progress to date and next steps. Responding to questions from the City Council, the consultants stated that railroad companies are required to maintain all the city’s railroad equipment. The consultants further stated that Muscatine is an example of an Iowa city along the Mississippi river that has implemented railroad quiet zones and provided the timeframes to apply for federal funding. Mr. Brown responded to a question regarding the public input process, stating that written notice will be sent to those residing near the train tracks and that direct engagement will be important to communicate necessary information. Responding to a question from the City Council regarding next steps, City Manager Van Milligen stated that the project has been overseen by the Dubuque Metropolitan Area Transportation Study (DMATS) up until this point, therefore DMATS representatives could share next steps. Chandra Ravada, Director of Transportation, Planning, and Transit Services for the East Central Inter- governmental Association (ECIA), who oversees DMATS, stated that discussions have oc- curred with Director of Strategic Partnerships Teri Goodmann and determinations are being made on applying for grant funding as a region. Mr. Ravada further stated that the Consolidated Rail Infrastructure and Safety Improvements (CRISI) Program grant deadline is in the spring of 2024 and that award recipients will be announced in the late fall. Disposition of Claims: City Attorney advised that the following claims have been referred to Public Entity Risk Services of Iowa, the agent for the Iowa Communities Assurance Pool: Mary LeGrand and David Smith for property damage; Dennis Noel for vehicle damage; Donovan Tann for property damage. Upon motion the documents were received, filed, and concurred. 3. Approval of City Expenditures: Upon motion the documents were received and filed, and Resolution No. 392-23 Authorizing the Chief Financial Officer/City Treasurer to make certain payments of bills that must be paid and approved for payment in accordance with City proce- dures was adopted. RESOLUTION NO. 392-23 AUTHORIZING THE CHIEF FINANCIAL OFFICER / CITY TREASURER TO MAKE CERTAIN PAYMENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR PAYMENT IN AC- CORDANCE WITH CITY PROCEDURES Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that the Finance Director-City Treasurer shall keep an accurate account of all disbursements, money, or property, specifying date, to whom, and from what fund paid; and 3 Whereas, the invoices, presented by those firms and persons providing such goods and ser- vices have been pre-audited by Finance Department personnel in accordance with generally accepted internal control procedures and have been determined to have been requ isitioned for a lawful municipal purpose; and Whereas, the Chief Financial Officer-City Treasurer has provided a list of Expenditures at- tached hereto, and by this reference made a part hereof, to be drawn to pay for goods and services provided for City purposes; and Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142 -18 adopted May 7, 2018, authorized the Chief Financial Officer -City Treasurer to issue checks in payment of certain expenditures known as Exception Expenditures prior to Cit y Council ap- proval and such list is attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU- QUE, IOWA THAT: Section 1. The Chief Financial Officer-City Treasurer is hereby authorized to issue payment for goods and services provided for City purposes in response to the purchase orders and con- tracts issued in compliance with state and municipal code requirements as requested by desig- nated requisitioning authorities in accordance with approved budget appropriations. Section 2. In accordance with Iowa Code Section 372.13(6), the City Clerk and Chief Finan- cial Officer are hereby authorized and directed to provide the statement of receipts and dis- bursements to the City Council, and to publish a summary thereof. Fiscal Year 2025 Annual Tax Increment Financing Report : Upon motion the documents were received and filed. 5. Fiscal Year 2023 Iowa Urban Renewal Annual Report: Upon motion the documents were received and filed, and Resolution No. 393 -23 Approving the Fiscal Year 2023 Urban Renewal Report for the City of Dubuque was adopted. RESOLUTION NO. 393-23 APPROVING THE FISCAL YEAR 2023 URBAN RENEWAL REPORT FOR THE CITY OF DUBUQUE Whereas, the Iowa Legislature approved HF 2460 in the 2012 Legislative Session, amending the current law pertaining to urban renewal districts; and Whereas, HF 2460, otherwise known as the Urban Renewal Reporting Act of 2012, aims to increase transparency in the utilization of tax increment financing; and Whereas, HF 2460 requires an annual urban renewal report be approved by the majority of a local governing body that had an active urban renewal plan anytime during the most recently ended fiscal year; and Whereas, City staff have fulfilled the requirements outlined in the Act through a web -based reporting tool hosted by the Iowa Department of Management. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU- QUE, IOWA: Section 1. That the Fiscal Year 2023 Urban Renewal Report for the City of Dubuque be approved. Section 2. Wilbricht Lane Detention Basin Project - CIP# 7202722: Upon motion the documents were received and filed, and Resolution No. 395 -23 Accepting the Wilbricht Lane Detention Basin Project and authorizing the payment of the contract amount to the contractor was adopted. RESOLUTION NO. 395-23 ACCEPTING THE WILBRICHT LANE DETENTION BASIN PROJECT AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR Whereas, the Public Improvement Contract for the Wilbricht Lane Detention Basin Project (the Project) has been completed by the Contractor, McDermott Excavating, (Contractor) and the City Engineer has examined the work and that the Project be accepted; and Whereas, the final contract amount for the Project is $338,860.71; and Whereas, the Contractor has previously been paid $321,917.67, leaving a balance of $16,943.04; and Whereas, the City Council finds that the recommendation of the City Engineer should be accepted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU- QUE, IOWA: Section 1. The recommendation of the City Engineer is approved and the Project is hereby accepted. Section 2. The Chief Financial Officer is hereby directed to pay to the Contractor the balance of the retainage of $16,943.04 as provided in Iowa Chapter 573, and to pay such retainage only in accordance with the provisions of Iowa Code Chapter 573 or Iowa Code Chapter 26.13. Lower Bee Branch Creek Trail Extension – Dubuque Metropolitan Area Transportation Study Transportation Alternatives Program Multi-Use Trail Grant Application Approval: Upon motion the documents were received and filed, and Resolution No. 396 -23 Authorizing the filing of a grant application with the Dubuque Metropolitan Area Transportation Study Transportation Alternatives Program Grant to assist with funding the Bee Branch Multi -Use Trail Extension Project was adopted. RESOLUTION NO. 396-23 AUTHORIZING THE FILING OF A GRANT APPLICATION WITH THE DUBUQUE METRO- POLITAN AREA TRANSPORTATION STUDY TRANSPORTATION ALTERNATIVES PRO- GRAM GRANT TO ASSIST WITH FUNDING THE BEE BRANCH MULTI-USE TRAIL EXTEN- SION PROJECT Whereas, the Dubuque Metropolitan Area Transportation Study (DMATS)has allocated Transportation Alternatives Program (TAP) funds to be used on trail facilities; and Whereas, the City of Dubuque is interested in connecting the Lower Bee Branch Trail with the Historic Millwork District; and Whereas, the planned 10-foot-wide multi-use trail connection will be located along the High- way 61/151 on ramp between 12th Street and 11th Street, and then adjacent to the Jule Oper- ations and Training Center between 11th Street and 9th Street and the proposed project will also include on-street bike lanes on 11th Street and 9th Streets starting at Pine Street and going west to their intersections with Elm Street; and Whereas, the project is planned to be part of a multi-phase trail network that will extend con- nections to two regional trails -- Dubuque Heritage Trail and Mississippi River Trail – as well as to the citywide trail system; and Whereas, the City is seeking funding through the DMATS Transportation Alternatives Pro- gram Grant to assist the cost of constructing the described multi -use trail and bike lanes. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU- QUE, IOWA THAT: Section 1. The City is hereby authorized to file the grant application with the Dubuque Met- ropolitan Area Alternatives Study for the Federal Fiscal Year 2024 -2027 Funding Cycle Trans- portation Alternatives Program Grant to assist with funding the extension of the Bee Branch Multi-Use Trail between 12th Street and 9th Street and funding on-street bike lane connections from the 11th Street and 9th Streets intersections with Pine Street heading west to their inter- sections with Elm Street. RESOLUTION NO. 397-23 APPROVING A SECOND AMENDMENT TO DEVELOPMENT AGREEMENT BY AND BE- TWEEN THE CITY OF DUBUQUE, IOWA AND 799 MAIN, LLC 8 Whereas, the City of Dubuque, Iowa (City) and 799 Main, LLC entered into a Development Agreement, dated for reference the 17th day of July, 2023, as amended, providing for a Façade Grant, Planning & Design Grant, a Financial Consultant Grant, a Housing Creation G rant, and Urban Renewal Tax Increment Revenue Obligations; and Whereas, the City and 799 Main, LLC desire to further amend the Agreement; and Whereas, it is the determination of the City Council that approval of the Second Amendment to Development Agreement for redevelopment of the Property by 799 Main, LLC, according to the terms and conditions set out in the Second Amendment to Development Agreement, is in the public interest of the City of Dubuque. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU- QUE, IOWA: Section 1. That the Second Amendment to Development Agreement by and between the City of Dubuque, Iowa, and 799 Main, LLC, a copy of which is attached hereto, is hereby approved. Section 2. That the Mayor is hereby authorized and directed to execute the Second Amend- ment to Development Agreement on behalf of the City of Dubuque and the City Clerk is author- ized and directed to attest to his signature. Section 3. That the City Manager is authorized to take such actions as are necessary to comply with the terms of the Second Amendment to Development Agreement as herein ap- proved. RESOLUTION NO. 398-23 APPROVING THE SECOND AMENDMENT TO PURCHASE AGREEMENT AND DEVELOP- MENT AGREEMENT BETWEEN THE CITY OF DUBUQUE, IOWA AND UNION AT THE MA- RINA, LP Whereas, a Purchase Agreement and Development Agreement (hereinafter, the “Agree- ment”), dated for reference purposes the 16th day of October, 2023, was entered into by and between the City of Dubuque, Iowa, a municipality (“City”), acting under authorizati on of Iowa Code Chapter 403, as amended, and Union at the Marina, LP, an Iowa limited partnership (“De- veloper”) (collectively the “Parties”); and Whereas, a First Amendment to the Agreement was entered into by the Parties on October 24, 2023; and Whereas, the Parties desire to further amend the Agreement as set forth in the attached Second Amendment; and Whereas, the City Council finds that it is in the best interests of the City to approve the Second Amendment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU- QUE, IOWA AS FOLLOWS: Section 1. The Second Amendment attached hereto is hereby approved. Section 2. Grass and Weed Cutting and Garbage Collection Assessments: Upon motion the docu- ments were received and filed, and Resolution No. 399-23 Authorizing the city to collect delin- quent grass and weed cutting and garbage collection charges in accordance with Title 6 -4-3a and Title 6-8-2 of the Code of Ordinances of the City of Dubuque, Iowa was adopted. RESOLUTION NO. 399-23 AUTHORIZING THE CITY TO COLLECT DELINQUENT GRASS AND WEED CUTTING AND GARBAGE COLLECTION CHARGES IN ACCORDANCE WITH TITLE 6-4-3A and TITLE 6- 8-2 OF THE CODE OF ORDINANCES OF THE CITY OF DUBUQUE, IOWA WHEREAS, residential properties in the City of Dubuque are considered substandard if any conditions exist to an extent that endanger life, limb, health, property, safety, or welfare of the public or the occupants thereof; and WHEREAS, whenever in the judgment of the Housing Officer, a nuisance that is “palpably and indisputably such” exists which requires immediate action to protect the public health, safety or welfare of the public, the Housing Officer may order the emergency abatement of such; and WHEREAS, delinquent grass and weed cutting and garbage collection charges shall be cer- tified by the City Clerk to the Dubuque County Treasurer for collection with, and in the same manner as general property taxes; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU- QUE, IOWA: Section I. That the persons listed on the attached Grass/Weed/Garbage Assessment Sched- ule are delinquent in the payment of grass and weed cutting and garbage collection charges: Section 2. That the City Clerk be and is hereby ordered and directed to certify to the County Treasurer of Dubuque County, Iowa, that the persons named on the attached Grass/Weed/Gar- bage Assessment Schedule are delinquent in the payment of grass and weed cutting and gar- bage collection charges in the amount set aside of the respective names, and that said amounts shall be collected in the same manner as general property taxes against the respective parcels of property set opposite the names of the owners. Assistant Housing and Community Development Director Mi- chael Belmont provided an update on the recent status of the building , stating that a design of certain areas of the building to verify its stabilization is pending from McClure Engineering. Mr. Belmont also read an email from McClure Engineering that he received on December 4th. The email summarized recent work on the building, including selective demolition to remove unsta- ble portions of the exterior, installation of temporary supports, and the various bracings being utilized as part of stabilization. Steve Emerson, owner of the building, spoke virtually about re- cent updates to the building stabilization and stated that April 10th is the targeted deadline for work completion, as that is the deadline for the state funding he is seeking for the project . City Council Members expressed frustration on the progress of the building, stating tha t they receive consistent public input on the negative impacts of the street closures resulting from the stabili- zation efforts. Responding to a question from the City Council, Housing and Community Devel- opment Director Alexis Steger stated that the engineering firm’s availability and capacity a re factors that may delay completion of the stabilization. Mr. Belmont stated that the complexity, age, and size of the building leads to challenges and delays in analyzing next steps. Motion carried 7-0. 2. Section 2-5B-5 of the City of Dubuque Code of Ordinances is hereby amended to read as follows: 2-5B-5: MEMBERSHIP: A. Number: The commission comprises ten (10) residents of the city. B. Age: Residents must be eighteen (18) years of age or older. C. Special Qualifications: 1. At least three (3) members must be selected specifically on the basis of experience in real estate development, banking, finance, accounting, funds management, or other related areas of expertise. 2. One (1) member must be a person who is a recipient of tenant based rental assis- tance under section 8 of the United States Housing Act of 1937, whose name appears on a lease of section 8 property. To contribute as appropriate in the planning, coordinating, and review of housing de- velopment; B. To conduct public hearings to ensure meaningful citizen input in the planning, imple- mentation, and assessment of the city's housing programs; C. To provide for and encourage the participation of low- and moderate-income persons in the planning, implementation, and assessment of housing programs; 17 D. To provide input into the community planning process and to assist in accomplishing a coordinated and consistent housing development program of the city in accordance with pre- sent and future housing needs; E. To request and review ongoing surveys assessing housing needs and identifying future community housing needs, particularly the needs of persons of low and moderate income; F. To support the efforts of the city council and other city commissions in the assessment of the general housing needs of the community; G. To undertake from time-to-time other specific ongoing housing planning which may be referred to it by the city council; H. To research and recommend to the city council policies and programs facilitating the development of affordable housing; I. To undertake public information efforts to educate citizens of the availability of federal, state, and locally funded housing assistance programs; J. To assist in the preparation of the housing element of the city comprehensive plan and the annual consolidated plan; and K. Undertake such additional duties, upon the request of the City Council. Childcare Business Champion Pledge: Motion by Resnick to receive and file the docu- ments and approve pledging $25,000 toward a childcare wage enhancement effort. Seconded by Sprank. City Council Members congratulated Dubuque Initiatives on their creativity with the pledge and emphasized that access to quality childcare and living wages for childcare workers are important community needs. Central Avenue & White Street Corridor Traffic Study: Request to Distribute RFP and Cre- ate an RFQ Review Committee - CIP 55-24000038: Motion by Jones to receive and file the documents and approve distribute a Request for Proposals (RFP) for professional consultant services to study the feasibility of Central Avenue and White Street from its existing one -way pair to all alternatives for these corridors, including a two-way conversion, from 4th Street to 22nd Street. Seconded by Sprank. City Manager Van Milligen stated his intent to invite a prop- erty owner from the impacted area, a small proprietor from the impacted area, and a trucking representative to serve on the committee. City Council Members expressed support for com- mittee representation from the business and trucking industries and commented on the potential for the area. Motion carried 7-0. 5. Central Avenue / White Street Truck Route Amend Commercial Motor Vehicles Ordinance: Motion by Farber to receive and file the documents and table the item to December 18, 2023. Seconded by Sprank. Point of Information by Resnick on whether the justification for the motion could be stated. City Attorney Brumwell stated that a brief explanation could be provided on the rationale for selecting December 18th as the date for tabling the item. Mayor Pro Tem Wethal stated that additional time was needed to disc uss the proposed ordinance amendment before a vote occurs. Motion carried 6-1 with Jones voting nay. 6. Work Session Request: Officer Involved Shooting Procedures: Motion by Jones to receive and file the documents and schedule the work session for February 19, 2024, at 5:30 p.m. 18 Seconded by Roussell. COUNCIL MEMBER REPORTS Council Member Jones reported on recent meetings of the Dubuque Metropolitan Area Solid Waste Agency Board, of which he and Council Member Resnick are board members, that have involved discussions on the planned expansion of the city’s food waste collection program. Council Member Resnick reported on the recent Legislative Dinner. Council Member Sprank reported on recent events in the Central Avenue Corridor and Mill- work District. Mayor Cavanagh reported on his recent attendance at the United Nation’s Climate Change Conference (COP28) with Sustainability Director Gina Bell. Mayor Pro Tem Wethal reported on the Dubuque Symphony’s recent performance and the Grand Opera House’s upcoming performances of The Nutcracker Ballet. Mayor Pro Tem Wethal also stated the importance of remembering those who need assistance in the community during the holiday season.
