CITY ATTORNEY
To: Mayor Brad M. Cavanagh and
Members of the City Council
DATE: February 1, 2024
RE: Settlement Authority for City Manager and City Attorney
The purpose of this memorandum is to ask the Mayor and City Council to clarify the
authority of the City Manager and the City Attorney to settle claims by the City for
damage to city property.
The City Council has previously authorized the City Manager and City Attorney to settle
claims against the City where the amount of the settlement was $20,000 or less (City
Manager) and $10,000 or less (City Attorney).
Claims by the City against others for damages have not been covered previously. The
attached amendment authorizes the City Manager and City Attorney to settle claims at
the same dollar amounts for damage to city property.
All other claims not within the scope of the resolution would require formal City Council
approval of a settlement.
