You and each of you are hereby
notified that it is the intention of the
City Council of the City • of Dubuque,
Iowa, to construct an eight -inch tile .
pipe sanitary sewer in North Main
Street from the end of the present
sewer south to ten feet south of the
north lot line of Lot 19, L. H. Lang -
worthy's Subdivision.
That a plat of said improvement is
now on file in the office of the City
Recorder.
It is estimated by the City Engi-
neer that said improvement will re-
quire:
225 lineal feet of 8 -inch tile pipe.
1 manhole.
Making a total estimated cost to
the legally assessable 'property own-
ers of $250.00.
Any person having objection to
said improvement is hereby notified

Subdivision. On motion of Ald. Wal-
lis the notice was received and filed.
WAIVER AND AGREEMENT.
Whereas, it is deemed :necessary
and advisable by the city council of
the City of Dubuque, to improve
Heeb street from Kaufman avenue
southerly; and
Whereas, in order that said street,
when improved will be built upon a
serviceable, uniform and advantage-
ous grade, it is deemed necessary and
advisable to change the old establish-
ed grade to a grade prepared by the
city engineer of the City of Dubuque,
now on file in his office; and
Whereas, the undersigned property
owners have made improvement to
conform with the old established
grade; and
Whereas,_ the undersigned desire
that said old' established grade be
changed in accordance with the plat
prepared by the engineer heretofore
referred to; '
Now, therefor, we, the undersigned,
do hereby agree that said City of Du-
buque shall have a right and author -
ity to change. the.grade of said street,
as established, to the ,grade prepared
by the city engineer, and we- do here-
by waive all. our rights, either. legal
or ,equitable, which.. we have under
Sections, 785, 786, 787, 788, 789 and 790
of the Code of Iowa of 1897, providing
for the change of grades of streets
and the assessment of damages accru-
ing, to property owners. arising out of,
such change of grade, and we do
hereby waive any rights which we
might have to demand damages or,
avoid the assessment levied against
us to pay for, said street improvement
on account of such change of .grade;
and do consent that such change of
grade may be made without the for-
malities preliminary' thereto, as pro-
vided by law.

provement without objection to any
irregularities, changes or defects
which might have - occurred in any of
the proceedings touching upon said
improvement. The signing of this in-
strument shall be deemed as accept-
ance of the conditions thereof.

The bond of the Curtis Plumbing
'and Heating Co., relating to the mak-
ing of excavations in streets, etc., for
a period of one year, and in the sum
of $500.00, was also referred to me,
and I beg to state with reference
'thereto, that said bond is faulty in
Ithis that it has not been signed by the
principal thereof, and I, therefor, re-
turn the same with the recommenda-
tion that the Curtis Plumbing and

without any formal action therefor by
the City Council so that said street
'front the angle to the levee line be
improved by narrowing the same to
thirty -five feet between curbs, with
a five foot sidewalk space on the
north side thereof, and • a ten
foot sidewalk, space on the south
side thereof. The undersigned,
having requested such change, and
such change being made for the bene-
fit of the undersigned, do hereby
waive any and all objection which
they may have, at law or equity,
against the payment of the assess-
ment or assessments, which may be
levied against the above lots for the
payment of said street improvement,
growing out of, incident to, or in any
manner connected with the change of
the street above stated, and they do
hereby agree that said change be
made, and they will make no objec-
tion to the payment of their assess-
ment based upon such change.

tion of said building and the location
thereof, it is impossible to give pa-
tients therein confined the proper
treatment, and
Whereas, on account of the size of
said building, it is impossible to keep
patients suffering from different ail-
ments properly segregated, and
Whereas, the board of health of
the city of Dubuque considers it of
urgent necessity to the health of the
people of this community that a new
detention hospital be secured
Therefore, Be It Resolved By the
Board of Health of the City of Du-
buque, Iowa, that we hereby present
this petition to the board of super-
visors of Dubuque county, Iowa, and
request that they provide a new de-
tention hospital in such a location
and of such size as they shall see fit.

Mayor Saul stated that this meeting
is called for the purpose of acting on
the petition of E. T. Frith relative to
his garbage contract and acting on
any other business that might prop-
erly come before a regular meeting
of the city council.
Petition of E. T. Frith asking the
city council to release him front his
contract for the collection of garbage
and also to release him from his bond
on said contract which expires May,
1918, on account of his disposal plant
being destroyed by fire and submitting
the following proposals. Build a
modern incinerating and , disposal
plant at the same location of the old
one and collect the garbage, etc., for
the price of $31.49 per day, beginning
from the time the contract is entered
into and running up to the time when
the present contract would expire,
namely May, 1918, and at the stipu-
lated price of $40.00 per day for a
period of ten years from the time
when the present contract expires,
namely ten years from May, 1918, the
contract to be entered into at once
covering the entire period of practic-
ally eleven years and one -half, or, if
the council will grant him permission
to build a modern incinerating plant
upon his property at 18th and Syca-
more street he will enter into a con-
tract for the stipulated price of $31.49
per day, said contract to be entered
into at once and cover a period of
about eleven years and one -half, the
same to terminate in May, 1928, pre,
sented and read. Ald. Strobel mov-
ed to grant the prayer of the petition
cancelling present contract of E. T.
Frith with the City of Dubuque and
that the city council accept the first
proposition as stated in the proposal.

pay for improving the intersection of
Rhomberg Avenue and the alley ly-
ing between Ninth and Tenth Ave-
nues, and the alley running from
Rho'nbe. &venue to Lincoln Ave-

Thursday, September 21, 1916, for the
construction of an eight -inch tile pipe
sanitary sewer in North Main Street,
front the end of the present sewer
south ten feet south of the north
lot line of Lot. 19, L. H. Lang'worthy's'
Subdivision, in accordance with the
plans and specifications pre!ared by
City Engineer and now on file in the
office of the City Recorder.
It is estimated by the City Engineer
that said improvement will require:
225 lineal feet of 8 -inch tile pipe.

of the City Assessor, containing the
values and figures as placed by him
for the purihose of taxation, on Tues-

City Hall. Anyone aggrieved by the

Notice to Contractors.
Sealed proposals will be received at
the City Recorder's office, City Hall,
by the City Recorder until 8:00 p. tn.
Thursday, October 5th, 1916, for con-
structing a sidewalk abutting the
west 1 -2 of City Lot 254, on the
north side of Eighth street, in accord-
ance with the plans and specifica-
tions prepared by the City Engineer
and now on file in the office of the
City Recorder.
It is estimated by the City Engineer -
that said improvement will require:
600 square feet of cement sidewalk.
The work to be paid for when said
work is completed and as prescribed
by Chapter XXXII and amendments
thereto of the Revised Ordinances of
1901 of the City of Dubuque, Iowa,
work to be completed on or iiefore
the 25th day of October, 1916.
Bidders must state price per square
foot of cement sidewalk.
Each bid must be accompanied by
a certified check for $15.00 on some
Dubuque bank as a guarantee that a
contract will be entered into if
awarded. Check and bid in separate
envelopes.
The City Council reserves the right
to reject any and all bids.

Special Session October 4th, 1916.
Council met at 4:15 p. m.
Mayor Saul in the chair.
Present — Aldermen Callahan, Frith,
McLaughlin, Plamondon, Strobel,
Wallis.
Absent —Ald. Leist.
Mayor Saul stated that this meeting
is called for the purpose of hearing
from the representatives of the Du-
buque Electric Co. relative to their
new rates for electric current and act-
ing on any other business that might
properly come before a regular meet-
ing of the city council.
Ald. Frith moved to suspend the
rules for the purpose of allowing the
representatives of the Dubuque Elec-
tric Co. to address the council. Car-
ried by the following vote:
Yeas Alds. Callahan, Frith, Mc-
Laughlin, Plamondon, Strobel, Wallis.
Nays None.
Absent- -Ald. Leist.
Mr. Maynard, secretary of the Du-
buque Electric Co. and Mr. Matthews,
expert on electric rates addressed the
council relative to the new rates for
electric current.
A id. Wallis moved that the council
agree to meet Tuesday, October 10th,
1916, at 8:00 p. m. to take up the mat-
ter of electric rates. Carried.
Ald. Callahan moved to adjourn.
