Special Session October 4th, 1916.
Council met at 4:15 p. m.
Mayor Saul in the chair.
Present — Aldermen Callahan, Frith,
1\1cLaughlin, Plamondon, Strobel,
Wallis.
Absent —Aid. Leist.
Mayor Saul stated that this meeting
is called for the purpose of hearing
from the representatives of the Du-
buque Electric Co. relative to their
new rates for electric current and act-
ing on any other business that might
properly come before a regular meet-
ing of the city council.
Alc1. Frith moved to suspend the
rules for the purpose of allowing the
representatives of the Dubuque Elec-
tric Co. to address the council. Car-
ried by the following vote:
Yeas —Alds. Callahan, Frith, 14Ic-
Laughlin, Plamondon, Strobel, Wallis.
Nays- -None.
Absent—Ald. Deist.
Mr. Maynard, secretary of the Du-
buque Electric Co. and Mr. Matthews,
expert on electric rates addressed the
council relative to the new rates for
electric current.
Ald. - Wallis moved that the council
agree to meet Tuesday, October 10th,
1916, at 8:00 p. m. to take up the mat-
ter of electric rates. Carried.
Alit. Callahan moved to adjourn.

the northerly property line of Curtis

Notice to Contractors.
Sealed proposals will be received at
the City Recorder's office, City Hall,
by the City Recorder until 8:00 p. m.
Thursday, October 5th, 1916, for con-
structing a sidewalk abutting the
west 1 -2 of City Lot 254, on the
north side of Eighth street, in accord-
ance with the plans and specifica-
tions prepared by the City Engineer
and now on file in the office of the
City Recorder.
It is estimated by the City Engineer
that said improvement will require:
600 square feet of cement sidewalk.
The work to be paid for when said
work is completed and as prescribed
by Chapter XXXII and amendments
thereto of the Revised Ordinances of
1901 of the City of Dubuque, Iowa,
work to be completed on or before
the 25th day of October, 1916.
Bidders must state price per square
foot of cement sidewalk.
Each bid must be accompanied by
a certified check for $15.00 on some
Dubuque bank as a guarantee that a
contract will be entered into if
awarded. Check and bid in separate
envelopes.
The City Council reserves the right
to reject any and all bids.

Petition of E. Hemmi stating that
he desired to exercise the privilege in
taking the salvage on Clay street im-
provement Lot 448 presented and
read. On motion of Ald. Leist the
petition was made a matter of record.
Communication of the \Western
Improvement Co. relative to interest
due on their 5 per cent retained for
the improving of Julien avenue and
Delhi street presented and read. On
motion of Ald. Wallis the city re-
corder was instructed to notify the
'Western Inrprovernent Co. that the
City of Dubuque does not pay inter-
est on 5 per cent retained on contract
work.
Petition of Mrs. Mary A. Dolan ask-
ing the city council to cancel the
taxes for the year 1915 on the west
1 -2 of Lot 62, Union Addition pre-
sented and read. On motion of Ald.
Frith the petition was referred to the
delinquent tax committee.

entered into by the City of Dubuque
for the construction of a sanitary
sewer in Atlantic avenue hereinafter
described has been completed, and the
city engineer has computed that the
cost and expense of said improvement
amount to $1,657.97
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of con-
structing a sanitary sewer in Atlantic
avenue from Rosedale avenue to West
Fourteenth street, the mayor be and
he is hereby, required to execute and
deliver to the city recorder, to be by
him registered and countersigned, six
bonds for Two Hundred and Fifty

Dollars each and one for One Hun-
dred Sixty -seven and 97 -100 Dollars,

istered and countersigned, one bond

Ninety and 86 -100 Dollars numbered
4575 and 4579, dated November 4th,
1916, payable on or before seven

NAME OF FREMONT AVENUE
TO WARTBURG AVENUE.
Be it ordained by the City Council of
the City of Dubuque:
Section 1. That the name of Fre- '
mont Avenue be and the same is here-
by changed to - Wartburg Avenue.
Section 2. This Ordinance shall be
in force and take effect from and af-
ter its passage by the City Council and
its publication in the official news-
papers of the City of Dubuque.

Be it Resolved by the City Council
of the City of Dubuque, that it is
deemed necessary and advisable to
widen Hill and West Third streets at
the northwest corner thereof, and be
it further resolved that the city engi-
neer he and he is hereby instructed
to make a plat and survey of such
purposed improvements, showing the
land or lots through or over which
the same is purposed to be made;. and
file such plat in his office for public
inspection.
That after such plat is prepared
and filed, said city engineer shall give
the owners of property through or
over which such improvement is pur-
posed to be made' notice as pre-
scribed by Section 2 of Chapter 31 of
the ordinances of the city of Du-
buque.

ULATE THE PRICES AND
CHARGES OF ELECTRIC CUR-
RENT FOR PRIVATE CONSUMP-
TION IN THE CITY OF DU-
BTJQUE.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That every person,
firm or corporation that now is fur-
nishing or may hereafter furnish
electric to the inhabitants of the City
of Dubuque shall he entitled to
charge and receive therefor the fol-
lowing prices and not more, to -wit:
Minimum —$.75.
First 15 K. W. H, at 10 cts. per K.
W. H.
Next 20 at 7 cts. per K. W. H.
Next 465 at 5 cts., per K. W. H.
Next 500 at 4 cts. per K. W. H.
Next 1000 at 3 cts., per K. W. 'H.
Next 1000 at 2 and 1 -2 cts. per K.

All over at 2 cents per K. W. H.
Bills paid by the 10th of month, 5
per cent discount as now. No dis-
count on the 75 cent minimum.
Section 2. These rates shall be
subject to change at any future date
by the City Council.
Section 3. Not more than one
meter shall be installed in each
building, except with the consent and
at the request of the owner, or own-
ers of the building.
Section 4. This ordinance shall not
be taken as conferring on any person,
firm or corporation the franchise
rights for the use of the streets, al-
leys or public places except uch as
now have been already confered by

Telephone company amount to Thir-
ty- seven and 80 -100 ($37.80) dollars.
You will recall that this was the case
in which the city brought injunction
proceedings against the defendant
company to oust said company from
the streets which they occupied and
to compel it to procure a franchise.
This action was submitted upon a.'
demurrer and an adverse ruling. to
the city made thereon.
These costs ought to be paid, and
I would respectfully recommend that
a warrant be drawn in the sum of
Thirty -seven and 80 -100 ($37.80)
dollars in favor of C. D. Harring-
ton, clerk of the district court.

Gentlemen: The case of C. 11.
Gillian vs, City of Dubuque, wherein
the plaintiff asks for the sum of
:twenty -five Hundred ($2500.00) dol-
lars for personal injuries sustained
by hint, has been filed in' the district
court of this county. It is claimed
by the plaintiff that on or about the
11th day of February, 1916, he sus-
tained a broken arm when he fell
over and against an obstruction which
was upon the sidewalk on the west
side of Main street between Tenth
and Eleventh streets, and leading
from the property owned by Gustave
Levi, which property was formerly
used by a charitable institution,
known as the Neighborhood House.
When this action was filed we joined
in the suit Gustave Levi, claiming
that the obstruction was placed upon
the sidewalk by him and that he was
at least partially responsible for said'
injuries.
From an investigation of the case,
we are convinced thitt there exists a
clear liability upon the part of the
city. We also found that the injuries
sustained are permanent, and that
the plaintiff was put to considerable
expense. Under such circumstances
we deemed it advisable to effect a
settlement and took the matter up
with 1\[r. Levi through his attorneys.
'We have succeeded in effecting what,
in our judgment, is a very satisfactory
compromise. The city's part of the
settlement is Two Hundred ($200.00)
dollars, the other party to pay a like
amount.
We respectfully recommend that
this settlement be approved by you
and a warrant be drawn in favor of
George T. Lyon in the sum of Two
Hundred ($200.00) dollars, as attor-
ney for the plaintiff.

of the City of Dubuque.
Gentlemen: At a recent meeting
of your honorable body, you request-
ed me to inquire into the franchise
of the Dubuque Pontoon Bridge com-
pany for the purpose of determining
-what were the rights reserved to the
city under said franchise. The ques-
tion presented to me was: What
must the city do in order to get pos-
session and control over the high
bridge between Dubuque and East
Dubuque? And what are the city's
legal rights as provided by the ordi-
nances granting the franchise?
At the time the bridge was con-
structed, the city of Dubuque agreed
to contribute toward the construction
of the bridge the sum of Twenty -five
Thousand ($25,000.00) dollars, and
agreed further that .the owners of the
bridge would not be compelled to
pay taxes thereon until such a time
when the revenues derived front op-
erating the bridge would be sufficient
to pay a net annual dividend, or in-
terest, of Eight (8' per cent) per cent
on the money actually invested in the
construction of said bridge and its
approaches, less the amount con-
tributed by the city. In return for
the aid and exemption given, the city
retained unto itself the right, to take
over the bridge and operate the

same, providing, that the bridge
should be made a free bridge or near-
ly so, the exact language of the fran-
chise being as follows:
"Sec. 7. In further consideration
of said aid and exemption, it is here-
by expressly stipulated that if at any
time the City of Dubuque should de-
sire to make said bridge free from
toll, or partially so, it shall have for
that purpose the right to take said
bridge into its own possession and
control, and to operate the same by
paying yearly at the end of each
year, to said Dubuque Pontoon Bridge
company, the • net annual interest of
Eight (8 per cent) per cent on the
actual cost of constructing said
bridge and its approaches, less the
Twenty -five Tllousancl. ($25,000.00)
dollars, contributed by said city."
Linder this provision of the fran-
chise, the city has the right to take
over said bridge and operate it as a
free bridge but if it does so it must
pay to the bridge company a net an-
nual interest of Eight (8 per cent)
per cent on the actual cost of con-
structing the bridge. No where in
the franchise is it provided that the
city possesses the right to purchase
said bridge. The only right the city
has is to take the bridge over, make
a free bridge of it and pay to the
idge company Eight (8 per cent)
per cent every year on the actual
original investment, less the amount
contributed by the city. But even
this right is subject to a limitation.
The franchise provides further:
"In such case the City of Dubuque
shall itself keep said bridge in good
repair and condition, and pay the ex —
pense of operation. But at any time,
whether before or after the city has
determined to exercise this right (to
take over the bridge as above stated)
the bridge company may pay back to
the city the said Twenty -five Thousand
($25,000.00) dollars, by it contribut-
ed toward constructing the bridge,
without interest, and thereafter may
have, hold and operate said bridge,
discharged of all right on the part of
the city to make it a free bridge un-
der the foregoing option."
Under this part of the franchise, if
the city should desire to exercise its
right to make the bridge a free
bridge and take it over for that pur-
pose, even then the bridge company
could step in, pay back to the city
the Twenty -five Thousand ($25,000.00)
dollars contributed by the city, and
thereby relieve itself from any inter-
ference whatsoever by the city.
As before stated there is no provi-
sion in the franchise giving to the city
the right to purchase the bridge out-
right. The only rights that the city
has under this franchise are those
above enumerated. It is only in the

nature of a rental . proposition with
the condition attached that the
bridge, if operated by the city, be
made free or nearly so.
I respectfully submit the above as
my opinion and conclusions. from an
inspection of the Pontoon Bridge
company's franchise.

AN ORDINANCE CHANGING THE
_NAME OF FREMONT AVENUE
TO - WARTBURG AVENUE.
Be it ordained by the City Council of
the City of Dubuque:
Section 1. That the name of Fre-
mont Avenue be and the same is here-
by changed to Wartburg Avenue.
Section 2. This Ordinance shall be
in force and take effect from and af-
ter its passage by the City Council and
its publication in the official news-
papers of the City of Dubuque.

Sealed proposals will be received at
the City Recorder's office, City Hall,
by the Pity Recorder, until 8:00 p. m.,
Thursday, October 19th, 1916. for
furnishing the City of Dubuque with
150 tons of coal, more or less. The
coal to be delivered at the pleasure
of the ,City. Bidders must state price
per ton for six -inch lump Carterville,
price per ton for Indiana Block and
Price per ton for Hard Coal, Nut and
pr mixed. Each bid must be ac-
companied by a certified check for
$50.00 on some Dubuque bank as a
guarantee that a contract will be en-
tered into if awarded.
The City Council reserves the right

their respective places on Thursday,
