INTRODUCTION
The enclosed resolution provides for the acceptance of the Public Improvement Construction
Contract for the Maus Park Lake Pump Station Culvert Repair Project.
BACKGROUND
Prior to the construction of the floodwall, a concrete arch culvert served to drain Maus Lake
beneath what are now Canadian National (CN) mainline railroad tracks to the Mississippi
River. When the floodwall was constructed, the existing arch culvert was retrofitted with
sections of 48-inch reinforced concrete pipe at the upstream and downstream ends to extend
the pipe. The flow line of the arch culvert was filled with concrete and formed to the radius of
a 48-inch pipe. A manually operated flood gate was installed at the downstream end, and a
pumping station was constructed at Maus Lake. In May 2017, ballast subsidence under the
railroad tracks was discovered at the location of the culvert crossing. Further investigation
revealed joint openings in the concrete arch below the tracks. The joint openings were filled
with epoxy and steel plates were installed along the roof of the pipe as a temporary repair
measure until a permanent solution could be developed.
The Maus Park Lake Pump Station Culvert Repair Project (Project) involved the lining of the
culvert that allows stormwater runoff to pass from the Maus Lake ponding area, under a set
of railroad mainline tracks, through the floodwall/levee system, into the Mississippi.
Specifically, the work involved the trenchless installation of approximately 110 lineal feet of a
steel slip liner inside the existing culvert resulting in a new culvert under the railroad tracks,
partially through the levee. In addition, the work included the construction of a permanent
cofferdam and concrete apron, concrete walls, and stop log level control system on the
interior side of the floodwall/levee system to facilitate both the lining process and allow for
maintenance of the culvert once complete.
In October of 2023, the City Council adopted Resolution 324-23, awarding the construction
contract for the Maus Park Lake Pump Station Culvert Repair Project to Tschiggfrie
Excavating in the amount of$525,172.00.
DISCUSSION
The Maus Park Lake Pump Station Culvert Repair Project has been completed by Tschiggfrie
Excavating of Dubuque, lowa, in the amount of$527,942.00 which is a 0.53% increase over
the original contract amount of $525,172.00 at the time of award.

RECOMMENDATION
I recommend acceptance of the Public Improvements and authorize payment of$527,942.00
to Tschiggfrie Excavating for the Maus Park Lake Pump Station Culvert Repair Project.

The estimate of probable cost for the Maus Park Lake Pump Station Culvert Repair Project
is as follows:

The Project is to be funded through an FY24 appropriation in the amount of $463,940 for
Maus Park Culvert Restoration (Project 5586500032). Because the pump station and culvert
were insured, the City submitted a claim (ICP047008A1)to the lowa Communities Assurance
Pool (ICAP)for making permanent repairs to the culvert that will offset the City's cost. Pending
the outcome of the claim, additional funds if needed will come from an FY24 appropriations
for Storm Sewer Replacements (Project 5586500001) and for Storm Sewer
Improvements/Extensions (Project 5586500020).
ACTION TO BE TAKEN
I respectfully request adoption of the attached resolution accepting the Public Improvement
Construction Contract and to authorize final payment in the amount of $527,942.00 to
Tschiggfrie Excavating for the Maus Park Lake Pump Station Culvert Repair Project.

RESOLUTION NO. 133-24
ACCEPTING THE MAUS PARK LAKE PUMP STATION CULVERT REPAIR PROJECT
AND AUTHORIZING FINAL PAYMENT TO THE CONTRACTOR
Whereas, the Public Improvement Contract for the Maus Park Lake Pump Station
Culvert Repair Project (the Project) has been completed by Tschiggfrie Excavating (the
Contractor), and the City Engineer has examined the work and that the Project be
accepted; and
Whereas, the final contract amount for the Project is $527,942.00; and
Whereas, the Contractor has previously been paid $501,544.90, leaving a balance
of $26,397.10; and
Whereas, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Chief Financial Officer is hereby directed to pay to the Contractor
the balance of the retainage of $26,397.10 as provided in Iowa Chapter 573, and to pay
such retainage only in accordance with the provisions of Iowa Code Chapter 573 or Iowa
Code Chapter 26.13.
