Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor Crossing Project (part of Phase IV of the Bee Branch Watershed Flood Mitigation Project) - Project #5581500003 Acceptance of Public Improvements and Contract DATE: May 13, 2024 INTRODUCTION The enclosed resolution provides for the acceptance of the Public Improvement Construction Contract for the Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor Crossing Project. BACKGROUND In November of 2013, the City Council passed Resolution 335-13 adopting the 2013 Drainage Basin Master Plan Amendment. The amended Drainage Basin Master Plan outlined several improvements throughout the Bee Branch watershed to mitigate the effects of future flooding and disasters. Collectively, the improvements form the basis of the Bee Branch Watershed Flood Mitigation Project outlined in Table 1 below. Table 1. Two federal grants will allow for proceeding with bidding the work in 2024. 2 80 of the 240 alleys have been reconstructed as"green", pervious alleys. Several are currently under design. 3 The Upper Bee Branch Creek Restoration Project includes the improvements associated with the Upper Bee Branch Railroad Culverts Project, including the sanitary sewer crossing through the railroad property. 4 Design complete to Kane Street. 5 Design is complete to Angela St., 60%design to Kirkwood St., 30%design to Rosedale. Until the sewer system through the railroad property could be installed, a temporary siphon was installed as part of the Upper Bee Branch Creek Restoration Project improvements included a temporary siphon to force wastewater flow under the restored creek, allowing the wastewater to flow west along Garfield Avenue, then south down Elm Street, and to the Cedar Street Lift Station. Siphons require significant maintenance challenges and as the flow characteristics necessarily back up wastewater flows which can lead to the accumulation of solids within the line upstream of the siphon. Installation of the proposed sewer through the railroad property will allow for the elimination of the siphon, providing a more hydraulically efficient system that will not be prone to the accumulation of solids or require frequent, intensive maintenance. On November 21, 2022, the City Council adopted Resolution 363-22 approving the plans, specifications, form of contract and estimated cost for the Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor Crossing Project, in the estimated amount $3,203,300.00. In December of 2022, the City Council adopted Resolution 396-22, awarding the construction contract for the Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor Crossing Project to Engineering & Construction Innovations, Inc of Oakdale, Minnesota in the amount of $3,265,620.00. DISCUSSION The Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor Crossing Project has been completed by Engineering & Construction Innovations, Inc of Oakdale, Minnesota, in the amount of $3,289,254.55 which is a 0.72% increase over the original contract amount of $3,265,620.00 at the time of award. RECOMMENDATION I recommend acceptance of the Public Improvements and authorize payment of $3,289,254.55 to Engineering & Construction Innovations, Inc for the Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor Crossing Project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City Engineer is approved and the Project is hereby accepted. Section 2.
