SUBJECT: FY 2025 Community Development Block Grant Annual Action Plan

Housing & Community Development Director Alexis Steger is recommending City
Council approve the attached resolution adopting the proposed Annual Action Plan for
FY 2025 as recommended by the Community Development Advisory Commission and
direct staff to transmit this plan to the U.S. Department of Housing and Urban
Development as required.
The final FY 2025 Annual Action Plan provides for use of Community Development
Block Grant (CDBG) funds for the actual entitlement allocation of$1,035,721 and
revenues of $108,142 in program income, for a total of$1,143,863. Based on the
contingency provision on the Pre-Allocation Annual Action Plan, the slight increase of
$4,269 in formula entitlement allocation will go toward Emri Apartments, increasing their
allocation from $77,527 to $81,796.
FY 2025 Annual Action Plan has several reoccurring programs such as a
Microenterprise Assistance Program, First Time Homebuyer, Homeowner Rehab, Lead
and Healthy Homes Program, Neighborhood Recreation Program, Zoning Enforcement
and Low-Mod Income Parks. These activities will meet the 5-year Consolidated Plan
Goals as well as the Goals and Priorities of the City Council.
Additionally, FY25 Annual Action Plan includes two new activities approved by
Community Development Advisory Commission at the November 29 meeting to be
included in the FY25 Pre-Allocation Annual Action Plan. These two activities were
applications received during an open application process from October 2-October 31.
The two applications, now approved activities, are being recommended for funding as
part of the FY25 Pre-Allocation Annual Action Plan are Area Residential Care's Penn
Community Living Home Remodel and acquisition of land for Emri Apartments.
Per our Citizen Participation Plan, this final FY25 Annual Action Plan is considered a
"non-substantial" amendment. Therefore, non-substantial amendments shall be
approved by the Community Development Advisory Commission and forwarded to the
Council to adopt by Resolution.
The Community Development Advisory Commission reviewed and approved this FY25
Annual Action Plan at their May 15, 2024 meeting and recommends City Council adopt
the changes.

INTRODUCTION
The Housing & Community Development Department is submitting the attached Annual
Action Plan for the use of Community Development Block Grant funds to adopt by the
City Council at the May 20, 2024 meeting. This memorandum transmits a resolution to
approve the FY 2025 Annual Action Plan.
BACKGROUND
The city is required to submit an Annual Action Plan to the United States Department of
Housing and Urban Development (HUD) for the Community Development Block Grant
(CDBG) program. During the FY25 Budget Hearing, a plan was presented for adoption
to the FY25 budget based on the previous year's formula entitlement allocation of
$1,031,452 and revenues of$108,142 in program income, for a total of $1,139,594. Our
actual allocation shows a slight increase in formula entitlement allocation and is
reflected in the final Annual Action Plan.

FOR APPROVAL
Whereas, the City of Dubuque, through a series of public meetings and hearings,
proposed a Fiscal Year 2025 (Program Year 2024) Community Development Block
Grant Annual Action Plan be approved addressing housing and non -housing needs in
the community; and
Whereas, the Community Development Advisory Commission held a public
hearing on January 171h, 2024, April 11th 2024, and a public meeting on May 15th, 2024
to receive community input on the Fiscal Year 2025 (Program Year 2024) Community
Development Block Grant Annual Action Plan; and
Whereas, the Community Development Advisory Commission unanimously
recommended the City Council approve Fiscal Year 2025 (Program Year 2024)
Community Development Block Grant Annual Action Plan on January 171h, 2024 and
May 15th, 2024.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Community Development Block Grant Fiscal Year 2025
(Program Year 2024) Annual Action Plan, attached hereto and by this reference made a
part hereof, is hereby adopted.
Section 2. The City Manager or his designee of the City of Dubuque is hereby
authorized to direct staff to prepare and submit to the United States Department of
Housing and Urban Development the Fiscal Year 2025 (Program Year 2024) Annual
Action Plan with all related documents, for the use of Community Development Block
Grant funds based on this adopted budget and execute standard contracts and
agreements.

The City of Dubuque distinguishes between four different but complementary areas of program
development in its overall CDBG program: Housing Development, Economic Development,
Neighborhood and Community Development and Planning & Administration. The following
description of activities summarizes the projects to be completed in the FY 2025 Annual
Action Plan with the use of CDBG funds.

Program income projects are based on forecast for loan repayments based on the loan portfolio and
program income generated from CDBG funded programs.

meet the needs of at-risk youth,promote self-esteem, and build community. Activities include after-
school programs,open gym,basketball league,music lessons,mobile recreation,scholarships, and
summer day camp.

The Entitlement Community certifies that:
Citizen Participation -- It is in full compliance and following a detailed citizen participation plan that
satisfies the requirements of 24 CFR 91.105.
Community Development Plan -- Its consolidated plan identifies community development and housing
needs and specifies both short-term and long-term community development objectives that that have been
developed in accordance with the primary objective of the CDBG program (i.e., the development of viable
urban communities, by providing decent housing and expanding economic opportunities, primarily for
persons of low and moderate income) and requirements of 24 CFR Parts 91. and 570.
Following a Plan -- It is following a current consolidated plan that has been approved by HUD.
Use of Funds -- It has complied with the following criteria:
1. Maximum Feasible Priority. With respect to activities expected to be assisted with CDBG
funds, it has developed its Action Plan so as to give maximum feasible priority to activities
which benefit low- and moderate -income families or aid in the prevention or elimination of
slums or blight. The Action Plan may also include CDBG-assisted activities which the grantee
certifies are designed to meet other community development needs having particular urgency
because existing conditions pose a serious and immediate threat to the health or welfare of the
community, and other financial resources are not available (see Optional CDBG Certification).
2. Overall Benefit. The aggregate use of CDBG funds, including Section 108 guaranteed loans,
during program year(s) 2024 [a period specified by the grantee of one,
two, or three specific consecutive program years], shall principally benefit persons of low and
moderate income in a manner that ensures that at least 70 percent of the amount is expended for
activities that benefit such persons during the designated period.
3. Special Assessments. It will not attempt to recover any capital costs of public improvements
assisted with CDBG funds, including Section 108 loan guaranteed funds, by assessing any
amount against properties owned and occupied by persons of low and moderate income,
including any fee charged or assessment made as a condition of obtaining access to such
public improvements.
I-lowever, if CDBG funds are used to pay the proportion of a fee or assessment that relates to the
capital costs of public improvements (assisted in part with CDBG funds) financed from other
revenue sources, an assessment or charge may be made against the property with respect to the
public improvements financed by a source other than CDBG funds.
In addition, in the case of properties owned and occupied by moderate -income (not low-income)
families, an assessment or charge may be made against the property for public improvements
financed by a source other than CDBG funds if the jurisdiction certifies that it lacks CDBG funds
to cover the assessment.
Excessive Force -- It has adopted and is enforcing:
1. A policy prohibiting the use of excessive force by law enforcement agencies within its
jurisdiction against any individuals engaged in non-violent civil rights demonstrations, and
2. A policy of enforcing applicable State and local laws against physically barring entrance to or
exit from a facility or location which is the subject of such non-violent civil rights
demonstrations within its jurisdiction.
Compliance with Anti -discrimination laws -- The grant will be conducted and administered in
