CITY CDUNCIL PROCEEDINGS
REGULAR SESSION
Tl�e Dubuque City Council met in regukar session at 6:30 p.m.
on April 15, 2024, in the second-floar Counci] Chamhers of the
Historic Federa3 Building, 350 W. bth Street.
Present: Mayor Cavanagh; Council Members Farber, Jones,
Resnick{participated virtually; arrived at b:49 p.m.),
Roussell, Sprank, Wethal; City Manager Van Milligen, City
Attorney Brumwell.
Mayor Cavanagh read the call and staced this is a regular
session of the Ciry Cauncil called for the purpose of
cond�cting such bus�ness that may properly come be#�ore the
Ciry Council.

Recreation Division Manager Dan Kroger introduced Iowa Parks
and Recreation Association Repc�esentati�e Geoff Hubbard. Mr.
Hubbard virtually recognized Susan Stopplemoor, a part-time
employe� in the City of Dubuque Leisure Services Department,
far receiving the Iowa Parks and Recreation Associations
Permanent Part-Time Team Member of t�e Year Award.

4. ApprovaE of City Expenditures: Upon motion the doci►ments
were received and �iled, and Resolution No. 81-24 Authorizing
the Chief Financial Officer/City Treasurer to make certain
paynients of bills that must be paid and approved for payinent
in accordance with City procedures was adopted.
5. Letter of Support for Canadian and Iowa Northern Railway
Integcation: City Manager pro�ided a copy of a letter of
support on behalf of the City of Dtibuque in support of the
Canadian and Iowa Narthea�n Railway Integration. Upon motion
the documents weE-e rece'sved, filed, and approved.
6. Pledge Agreement for an Towa Partners for Conservation
Grant: Upon motion the documents were recei�ed and �led, and
Resolution No. 82-24 Pledging Support and up to$25,000
Tn-Kind Local Matching Funds for the Dubugue Sail & Water
Conservation Districts Application for a $$25,004 U.S.
Department of Agricultt�re Natural Resource Conservation
Service Iowa Par[ners fot' Conservation Grant was adopted.
7. City Clerk's Office Promotion of Civic Engagement at the
M�jlticultura! Family Center's Teen Career Fair: Upon motian

Update: Motion by Sprank to receive and file the documents.
Seconded by Wethal. Assistant Housing & Coanmanity Development
Director Micheal Belmont provided the current demolition
schedule. City Council Members emphasized the need for the
deniolition to occur on schedule. Motion carrred 6-0 with
Council Member Resnick absent.
12. Bloomberg Youth Climate Action Grant Award: Upon motion
the doc�►ments were received, filed, and approved.
13. Sustainable Dubuque Grant Recommendation: Motion by
7ones to receive and file the docun-�ents and adagt Resolution
No. 83-24 Awarding Sustainable Dttbuque Grant to the Boys and
Gii•1 Club of'Greater Dubuque; Resolution No. $4-24 Awardi�g
Sustainable Dubuque Grant to 7essica Paisley; Resolution No.
85-24 Awarding Sustainable Dubuque Grant to Mississippi River
Revival, DBQ, Inc.; Resolution No. 86-24 Awarding Sustainable

15. Approve 7effris Poundation Grant Application Submission
and Authorize City Manager to Execute Grant Agreement and
Contract for a Historic Structure Report foe �.agle Point Park:
Upon motion the documents were received and filed, and
Resolution No. 90-24 Autharizing the City Manager to execute
an app[ication for 7effris Foundation Jeffi-is Heartland Fund
Grant and authot•izing the Leisure Services Director and the
City Manager ta approve the application was adopted.

motion the documents weee received and filed, and Resolution
No. 92-24 Approving the First Amendment to Devefopment
Agreement by and Between khe City of Dubuqtte, jowa and Switch
Homes, LLC was adopted.
21. Plat of Survey of Splendid Valley Estates: Upon motion
the documents were received and f�led, and Resolution No.
93-24 Approving the Final Plat of Splendid Vailey Estates,
Dubuque County, Iowa was adopted.
22. Signed C`ontract{s): BoEton& Menk, Inc. for the Central
Avenue and White Street Corridar Traffic Study; J&R Supply,
Inc. for the Ring &Lids -Metal Supply. Upon motion the
documents were received and filed.
23. Iowa Department of Transportation HMA Resurfacing and
PCC Patching Projects Notitications: Correspondence from Jesse
Tibodeau, Assistant District Engineer for the Iowa Department
of Tcansportation, pro�iding noti�cation of HMA resurfacing
and PCC patching projects within the ciry. Upon motion the
documents were received and filed.
24. Civil Service Commission Certified List - Police
Officer: Upon motion the documents were received, filed, and
made a matter of recard.
25. Approval of Reta�l Alcohol Licenses: Upon motion the
documents were received and filed, axid Resolution No. 94-24
App�•oving applications for retail alcol�o] ]icenses, as
required by City oF Dubuque Code of Ordinances Title 4
Bi�siness and License Regulations, Chapter 2 Liquor Control,
Article B Liquar, Beer and Wine Licenses and Permits was
adopted.

Motion by Roussell to receive and fiie the c�ocuments, adapt
the resolutions, and set the public hearings as indicated.

1. Resalution 3etting a Public Hearing on a Proposed
Development Agi•eement by and among the City of Dubuque, Iowa,
Woodward Communications, Inc., and WHKS & CO., Inc. Providing
for Ehe Issuance of Urban Renewal Tax Increment Revenue Grant
Obligations Pursuant to the Development Agreement: Upon motion
the documer�ts were received and fYled and Resolution No. 95-24
Fixin� the date for a Public Hearing of the City Council of
the City of Dubuque, Iowa on the Proposed D�velopment
Agreement by and among the City of Dubuque, Iowa, Waodward
Communications, Inc., and WHKS & Co., Inc., including the
proposed issuance of Urban Renewal Tax Increment Revenue Grank
Obligations to Woodward Commuraications, Inc., and providing
for the publication of notice theE�eot�was adopted setting a
public hearing for a me�ting to commence at b:3U p.m. on May
6, 2024 in the Historic Federal Building.
2. Set Public Hearing far Disposit[on of City-Owned Lot at
b27 Rhombei-g A�enue: Upon motion the documenEs were eeceived
and filed and Resolution No. 96-24 Intent to dispose of an
interest in City oE'Dubugue rea] estate to Karl Williams,
setting a time and place for hearing, and providing far the
publication of notice theE�eof was adopted sett�ng a public
hearing for a meeting to canv3ience at 6:30 p.m. on May b, 2424
in the Historic Federal Building.
PUBLIC HEARINGS
1. Request Co Rezone 2529 Marywood Drive: Motion by Jones to
receive and file the documents and that the requirement that a
proposed oa�dinance be cansidered and voted on for passage at
two Coun�il meetings prior to the meeting at which it is to be
passed be suspended. Seconded by Wethal. Planning Services
Diz�sctor Wally WernimonE provided a sEa€f report. Dakota
Schilling, 1234b Swiss Valley Rd., introduced himself as thc
applicant and Sheri Kubly, 679 Bluff 5t., introduced herselF
as the propertys realtor and summarized the inspections that
have occura•ed on the property. Responding to a question from
the City Couneil, Mr. Werniniont stated that a conditional use
permit for an accesso�y dwelling is the more expensive option
for� achieving the applicants goals, hence why the applicant
requested the rezoning instead. Mation carried 7-0.
Motian by Jones for fina! �onsideration and passage of
Ordinance No. 8-24 Amending Title 16 of the City of Du6uque
Code of Ordinances, Unified Devetopment Code, by reclassifying
hereinafter described property from R-1 Single-Family
Resident;al to R-2 Two-Family Residential. Seconded by Farber.
Motian carried 7-0.
2. Unified Development Gode AmendmenE Removing Off-Street
Parking Requirements in the Jackson Park and Cathedral
Historic Districts: Motio�i by Ro�issell ta receive and file the
documents and that the requirement that a proposed ordinance
be considered and voted on for passage at two Cotmcil n�eetings
peior to the meeti�Zg at which it is to be passed be siispended.
Seconded by Sprank. Planning Services Director Wally Wernimont
provided a staf#'report. Motion carried 7-U.
Motion by Rousell for final consideration and passage of
Oedinance No. 9-24 Amendin� Tit1e 16 of the City of Dubuque
Code of Ordinances, Unitled Development Code, by Amending
Articles 16-5-3-5 (R-1}, 16-5-4-5 (R-2a), 16-5-5-5 (R-3),
16-5-6-5 (A-4), 16-5-7-5 (Or), 16-5-5-5 (OS), 1b-5-9-5 (OC,
1b-5-10-5 (C-1), 16-5-11-2 (C-2), A�id 16-5-13-5 {C-3) by
Rernoving the Off-Street Parking Requirement for properties
located within the Jackson Park and Cathedt'al Historic
Districts. Seconded by Sprank, Motion carried 7-D.
3. 2024 Maintenance Dredging Project No. 1 Pubtic Hearing:
Motion by ]ones to receive and �ile the documents and adopt
Resolution No. 97-24 Approval of plans, specifications, form
of contract, and estimated cost fot' the 2024 Maintenance
Dredging Projeet No. 1. Seconded hy Farber. Motion carried
7-0.
4. Fiscal Year 2025 Bt�dget Adoption: MoFion by Farber to
receive and File the doct�ments and adopt Resolution No. 9$-24
Adoption of Budget and Certi�icatian of City Taxes; Resolution
No. 99-24 Ado�ting the City of Dubuque Fiscal Year 2025 Annual
Budget; and Resolution No. 100-24 Adopting the City of Dubuque
Fi�e Year Capital Improvement Program. 5econded by Wekhal.

and adopt Resolution No. 102-24 Adopting the Five-Year 5treet
Construction Program for Fiscal Years 2025 - 2029. Seconded by

COUNCIL MEMBER REPORTS
Council Member Wethal eepoY�ted an the 100th anniversaiy of
Medical Associates.
Council Member 7ones reported on the Firefighters
Association annual dinnei•. Mr. lones also reported on
attending a rihbon cutting for a transitional living house for
raaen establastaed by the Fountain of Youth F�-oga�am aa�d Hiilcrest
Family Services.
Council MeEn6er Facber reported on attending the University
of Dubuques annua] board meeting and the ane-year anniversary
of MedOne.
Council Member Sprank reported on the Multicultural Family
Centers Celebrate Africa ar�d the Diaspora event.
Mayor Cavanagh t•eported on presentang at an Iowa Department
of Transportation commission meetin�. Mayor Cavanagh also
repor•ted on two upcoming festivals in Dubuque: the Growing
Sustainable Communities Conference and the 7ulien Dubuque
Internatianal Film Festival.
CLOSED SESSION
Motion by Jones to canvene in closed session at 8:37 p.m. to
disctEss Pending Litigation and Pau�chase or 5ale of Real Estate
Chapter 21.5(1)(c),(j} Code of Iowa. Seconded by Wethal. Mayor
Cavanagh stated for the record that the attoi•ney who will
consult with the City Council on the issues to be discussed in
the closed session is City Attarney Brumwell. Mation carried
7-0.
Tl�e City Couneil reconvened in open session at 9:48 p.m.
stating that staff had been given pt•oper dir•ection.
ADJOURNMENT
There being no further business, Mayor Ca�anagh deciared the
