Mayor Cavanagh read the call and stated this is a special session of the City Council called for the purpose of conducting work sessions on Project HOPE and iJAG's City Life Presentation. WORK SESSIONS 1. Project HOPE Update Alex Baum, Director of Advocacy, Data, and Learning with the Community Foundation of Greater Dubuque presented an update on Project HOPE activities and responded to questions from the City Council. This work session concluded at 6:01 p.m. 2. lowa Jobs for America's Graduates (iJAG) City Life Student Presentation to City Council Community Engagement Coordinator Temwa Phiri made introductory remarks. iJAG Education Specialist Janie Hessong provided an overview of the iJAG program at Stephen Hempstead and Dubuque Senior High Schools. Laila Saunders, Ana Bermudez, Wyleah Jaeger, and Olivia Skemp presented about their experiences participating in City Life and responded to questions from the City Council. Building Safety Month (May 2024) was accepted by Building Code Advisory and Appeals Board Member Tom Townsend on behalf of the Housing and Community Development Department and the Building Code Advisory and Appeals Board. 3. Mental Health Month (May 2024) was accepted by Vicki Gassman and Brenna Burgart on behalf of Mental Health America of Dubuque County. 4. Walk, Bike, and Roll to School Day (May 8, 2024) was accepted by Assistant Planner Jason Duba on behalf the Safe Routes to School Partnership, consisting of the City of Dubuque, the Dubuque Community School District, and Holy Family Catholic Schools. 9. Public Works Week (May 19-25, 2024)was accepted by Public Works Director Arielle Swift and City Engineer Gus Psihoyos on behalf of the Public Works Department and Engineering Department. 2 10. Ric Jones 50 Years of Service Recognition: Mayor Cavanagh presented Council Member Jones with a surprise proclamation commemorating his 50 years of service to the City of Dubuque. Upon motion the documents were received, filed, and concurred. 4. Approval of City Expenditures: Upon motion the documents were received and filed, and Resolution No. 104-24 Authorizing the Chief Financial Officer/City Treasurer to make certain payments of bills that must be paid and approved for payment in accordance with City procedures was adopted. 5. Maturity Extensions of State Revolving Fund Planning and Design Loans, Series 2021A, 2021 B and 2021 C: Upon motion the documents were received and filed, and Resolution No. 105-24 Extending the Maturity Dates of the City's Sewer Revenue Capital Loan Notes Anticipation Project Notes, Series 2021A-C was adopted. 6. 2024 — Q2 Update on Childcare Challenges and Collaborations: Upon motion the documents were received and filed. 7. Burlington Street Water Main Improvement Project 2023: Project Acceptance and Resolution: Upon motion the documents were received and filed, and Resolution No. 106-24 Accepting Public Improvement Contract for the Burlington Street Water Main Improvement Project was adopted. 3 8. Award of CY2024 Family Self Sufficiency Coordinator Grant: Upon motion the documents were received and filed, and Resolution No. 107-24 Authorizing the Director of Housing and Community Development to execute the acceptance of the notice of award for the HUD Family Self-Sufficiency Program Grant was adopted. 9. Five Flags Pyrotechnics Permit: City Manager recommended City Council approval of a permit to use pyrotechnics at a music performance at Five Flags on May 17, 2024. Request Approval to Hire a Temporary Summer Teen Night Supervisor Position for the 2024 Season: Upon motion the documents were received, filed, and approved. 11. 2024 Maintenance Dredging Project No. 1 - Award Public Improvement Contract Project Number: 5546000001-304-67990 Harbor Area Dredging: Upon motion the documents were received and filed, and Resolution No. 108-24 Awarding Public Improvement Construction Contract for the 2024 Maintenance Dredging Project No. 1 was adopted. 12. Kerper Court and Kerper Boulevard Intersection Improvement Project (PROJECT 5521000047): Upon motion the documents were received and filed, and Resolution No. 109-24 Accepting the Kerper Court and Kerper Boulevard Intersection Improvement Project and authorizing final payment to the contractor was adopted. 13. Schmitt Island Sanitary Improvements Project: City Manager recommended City Council approval of the committee and authorization to release an RFP for a consultant to assist with the design of the Schmitt Island Sanitary Improvements Project. Upon motion the documents were received, filed, and approved. 14. Approval of an Easement Agreement for a Permanent Signage Easement across QWEST Corporation Property on John F. Kennedy Road as part of the Smart Traffic Routing with Efficient Traffic Signals (STREETS) Project: Upon motion the documents were received and filed, and Resolution No. 110-24 Approving an agreement with QWEST Corporation for a grant of permanent signage easement over QWEST Corporation Property on JFK Road as part of the STREETS Project, in the City of Dubuque, lowa was adopted. 15. Irrevocable License — 799 Locust Street: City Manager recommended City Council approve the irrevocable license for Cottingham & Butler at 799 Locust Street to encroach in the public right of way as described in the irrevocable license. Upon motion the documents were received, filed, and approved. 16. Southwest Arterial / US52 Corridor Right-of-Way Survey & Replat: AECOM - Consultant Services Supplemental Agreement No. 1 : Upon motion the documents were received and filed, and Resolution No. 111-24 Approving the Consultant Professional Services - Supplemental Agreement No. 1 Between AECOM Technical Services, Inc. and the City of Dubuque to complete land survey and replating of property along the Southwest Arterial / US52 Corridor from US Highway 20 to US Highway 61 / 151 was adopted. 17. 2024 LEMHWA COPS Grant: City Manager recommended City Council approval to apply for the 2024 Law Enforcement Mental Health and Wellness Act (LEMHWA) Grant in the amount of$118,062.63. Upon motion the documents were received, filed, and approved. 4 18. Letter of support for Chronic Wasting Disease Ambassadors: City Manager recommended City Council approval of a letter of support for the lowa Department of Natural Resources and lowa State University Extension to the Wildlife Society's Conservation Education Award for their Chronic Wasting Disease (CWD) course. Upon motion the documents were received, filed, and approved. 19. Letter of Support for Crescent Community Health Center's funding request for the Advance Cancer Prevention and Care for Blacks/African Americans Program: City Manager provided a copy of a letter of support to the lowa Cancer Consortium Board of Directors to fund Crescent Community Health Center's Advance Cancer Prevention and Care for Blacks/African Americans Program. Upon motion the documents were received, filed, and approved. 20. Amended Citizen Participation Plan: Upon motion the documents were received and filed, and Resolution No. 112-24 Adopting the Amendment of the Citizen Participation Plan for the Community Development Block Grant Program was adopted. 21. 3000 Jackson Dubuque Brewing and Malting Project Update: Assistant Housing and Community Development Director Michael Belmont summarized recent updates on the building's demolition process and stated that surrounding streets should be opened next week. Motion by Resnick to receive and file the documents. Seconded by Farber. Motion carried 7-0. 22. Letter of Support for FY2025 Community Project Funding Request: City Manager provided a copy of a Letter of Support for Congresswoman Ashley Hinson's FY2025 Community Project Funding Request by Dubuque County for the Dubuque Community Y's new facility as part of their "We Can Be Great Here" Capital Campaign. Upon motion the documents were received, filed, and approved. 23. Signed Contract(s): Memorandum of Understanding between the National League of Cities Institute and Creative Adventure Lab for the City Inclusive Entrepreneurship Program. Upon motion the documents were received and filed. 24. Proposed Amendment to I-NET agreement Exhibit A I-Net Sites between the City of Dubuque and MCC lowa LLC (Mediacom): Upon motion the documents were received, filed, and approved. 25. Approval of Retail Tobacco, Alternative Nicotine, and Vapor Product Permit Applications: Upon motion the documents were received and filed, and Resolution No. 114-24 Approving applications for retail permits to sell Tobacco, Tobacco Products, Alternative Nicotine Products, and Vapor Products, as required by lowa Code §453A.47A was adopted. Resolution Setting a Public Hearing on a Proposed Development Agreement by and between the City of Dubuque, lowa and Wilson House Apts, LLC Providing for the Issuance of Urban Renewal Tax Increment Revenue Grant Obligations Pursuant to the Development Agreement: Upon motion the documents were received and filed and Resolution No. 115-24 Fixing the date for a public hearing of the City Council of the City of Dubuque, lowa on a 5 development agreement by and between the City of Dubuque, lowa and Wilson House Apts, LLC, including the proposed issuance of urban renewal tax increment revenue obligations relating thereto and providing for the publication of notice thereof was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on May 20, 2024 in the Historic Federal Building. 2. Setting a Public Hearing for the 2024 Pavement Marking Project: Upon motion the documents were received and filed and Resolution No. 116-24 2024 Pavement Marking Project: preliminary approval of plans, specifications, form of contract, and estimated cost; setting date of public hearing on plans, specifications, form of contract, and estimated cost; and ordering the advertisement for bids was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on May 20, 2024 in the Historic Federal Building. 3. Set Public Hearing for Disposition of City-Owned Property at 2601 Jackson St.: Upon motion the documents were received and filed and Resolution No. 122-24 Intent to dispose of an interest in City of Dubuque real estate to Timothy Johnson, setting a time and place for hearing, and providing for the publication of notice thereof was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on May 20, 2024 in the Historic Federal Building. 9. Set Public Hearing for the Fiscal Year 2024 Second Budget Amendment: Upon motion the documents were received and filed and Resolution No. 123-24 Setting the date for the public hearing on Amendment No. 2 to the Fiscal Year 2024 Budget for the City of Dubuque was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on May 20, 2024 in the Historic Federal Building. 10. Setting a Public Hearing for the Jule's lowa Department of Transportation's Consolidated Funding: Upon motion the documents were received and filed and Resolution No. 124-24 Setting the date for a public hearing on lowa DOT Consolidated Funding Application was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on June 17, 2024 in the Historic Federal Building. BOARDS/COMMISSIONS Applications were reviewed for the following Boards and Commissions. Applicants were invited to address the City Council regarding their desire to serve on the following Boards/Commissions. 1. Zoning Board of Adjustment: One, 5-Year term through March 25, 2029 (Expired term of Kosel). Applicant: Gwen Kosel, 1130 Arrowhead Dr. Appointments were made to the following boards/commissions. 1. Civil Service Commission: One, 4-Year term through April 6, 2028 (Expiring term of Heathcote). Applicant: Carla Heathcote, 2529 Stafford St. — Selected by Mayor Cavanagh for appointment at the April 1, 2024, City Council meeting. Motion by Jones to approve the selection of Ms. Heathcote for reappointment to the 4-Year term through April 6, 2028. Seconded by Wethal. Motion carried 7-0. PUBLIC HEARINGS 1. Resolution Approving a Proposed Development Agreement by and among the City of Dubuque, lowa, Woodward Communications, Inc., and WHKS & CO., Inc. Providing for the Issuance of Urban Renewal Tax Increment Revenue Grant Obligations Pursuant to the Development Agreement: Motion by Wethal to receive and file the documents and adopt Resolution No. 125-24 Approving a Development Agreement by and among the City of Dubuque, lowa, Woodward Communications, Inc., and WHKS & Co., Inc. 799 Main, LLC including the issuance of urban tax increment revenue obligations. Seconded by Jones. City Council Members commended the work scheduled for the property. Motion carried 7-0. 2. Public Hearing for Sale of City-Owned Lot at 627 Rhomberg Ave.: Motion by Sprank to receive and file the documents and adopt Resolution No. 126-24 Disposing of city interest in real property at 627 Rhomberg, in the City of Dubuque, lowa. Seconded by Jones. Motion 7 carried 7-0. PUBLIC INPUT Catherine Sorenson, 2613 Jackson St., provided input regarding Item Set for Public Hearing No. 8, requesting the city trim a tree located on the property. ACTION ITEMS 1. 2024 Ken Kringle Awards Presentation: Motion by Resnick to receive and file the documents and listen to the presentation. Seconded by Farber. Planning Services Director Wally Wernimont introduced Historic Preservation Commission Vice-Chairperson Thea Dement, who made a presentation on the 2024 Ken Kringle Historic Preservation Awards. City Council Members praised the award recipients and their dedication to historic preservation. Motion carried 7-0. 2. Greater Dubuque Development Corporation - Quarterly Update: Motion by Roussell to receive and file the documents and listen to the presentation. Seconded by Resnick. President and CEO Rick Dickinson presented the quarterly update on the activities of the Greater Dubuque Development Corporation (GDDC). Responding to questions from the City Council, Mr. Dickinson summarized the history of the Access Dubuque Jobs website and GDDC's support of the iJAG program. Motion carried 7-0. 3. 2024 Dubuque Area Chamber of Commerce Washington DC Fly-in Report: Motion by Farber to receive and file the documents and listen to the presentation. Seconded by Jones. Director of Strategic Partnerships Teri Goodmann provided a report on the 2024 Dubuque Area Chamber of Commerce Washington DC Fly-in. Council Members thanked Ms. Goodmann for coordinating the event. Motion carried 7-0. 4. Reschedule Work Session: Inclusive Dubuque Update: Motion by Roussell to receive and file the documents and update the work session start time to 6:00 p.m. on Monday, May 20, 2024. Seconded by Wethal. Mayor Cavanagh stated that he will miss the work session due to attending the American Flood Coalition Summit. Motion carried 7-0. 5. Work Session Request: Historic Millwork District Master Plan Update: Motion by Jones to receive and file the documents and reschedule the work session to review the final draft of the Historic Millwork District Master Plan from 5:15 p.m. to 6:00 p.m. on Monday, May 20, 2024. Seconded by Sprank. Clarification from City Clerk Breitfelder that the requested start time of the work session is 5:15 p.m., and that the session is scheduled to conclude at 6:00 p.m. Motion amended by Jones and seconded by Sprank to schedule the work session for 5:15 p.m. Motion carried 7-0. 6. Work Session Request: Equitable Poverty Reduction & Prevention Plan: Motion by Farber to receive and file the documents and schedule the work session for Monday, June 17, 2024, at 5:15 p.m. Seconded by Wethal. Motion carried 7-0. COUNCIL MEMBER REPORTS Council Member Roussell reported on presenting at the Growing Sustainable Communities Conference, attending Dubuque Trees Forever's Arbor Day Celebration, volunteering for 8 Dubuque Days of Caring, and volunteering for Dubuque Main Street's Summer Farmer's Market. Council Member Sprank also reported on Dubuque Days of Caring, in addition to attending the first responder's dinner, neighborhood association meetings, the groundbreaking for The Key Hotel on Chaplain Schmitt Island, and the opening day of the Dubuque Farmers Market. Mr. Sprank also reported on meetings with residents of Table Mound Mobile Home Park and an artist who is making a sculpture out of refurbished Comiskey Park playground equipment for Audubon Elementary. Council Member Farber congratulated Dr. Jeffrey Bullock on his retirement as President of the University of Dubuque. Ms. Farber also reported on attending the Visiting Nurses Association (VNA)'s golf fundraiser and the upcoming Millwork Night Market. Council Member Jones also reported on attending The Key Hotel groundbreaking. Mr. Jones additionally reported on the recent adoption of the Dubuque Metropolitan Solid Waste Agency's Strategic Plan, delivering remarks at a Workers Memorial Day event, and the Fire Department's Hall of Fame Awards. Mayor Cavanagh reported on three recent events that occurred: the Growing Sustainable Communities Conference, the Julien Dubuque International Film Festival, and the University of lowa's Initiative for Sustainable Communities Partnership. City Manager Van Milligen stated that Council Member Wethal recently had an op-ed on school safety published in the Telegraph Herald. CLOSED SESSION Motion by Jones to convene in closed session at 8:47 p.m. to discuss Pending Litigation and Purchase or Sale of Real Estate — Chapter 21.5(1)O,(j) Code of lowa. Seconded by Wethal. Mayor Cavanagh stated for the record that the attorney who will consult with City Council on the issues to be discussed in the closed session is City Attorney Brumwell. Motion carried 7-0. The City Council reconvened in open session at 10:34 p.m. stating that staff had been given proper direction.
