the contract. Carried.
Ald. Wallis moved that the contract
for constructing a permanent sidewalk
in front of Lot 4 Home Add., be award-
ed to Frank Bauck he being the lowest
bidder and his bond placed at 1 -4 the
amount of the contract. Carried.

Ald. Wallis moved to suspend the
rules for the purpose of allowing the
interested parties to address the coun-
cil.

Mr. E. H, Willging et al addressed
the council relative to the improving
of Julien avenue and Delhi street, al-
so the representative of the Austin.
Western Co. addressed the council to
the selling the city a street sweeper.
Ald. Wallis moved that the Austin
Western Co. be allowed to ship a
street sweeper to the city of Dubuque
for a trial. Carried.
Ald. Wallis moved that the notice Of
publication for the improving of Julien
avenue and Delhi street from the east
curb line of Alpine street to the west
curb line of Asbury street and also
the written remonstrance of F. A.
Lawsen et al be received and filed.

Petition of McFadden Building Co.,
by J. M. McFadden, pres., asking the
City Council to cancel the assessment
on Lot 1 of the Sub. of 529 and 530 in
accordance with the terms of an ordi-
nance adopted in 1909 presented and
read. On motion of Ald McLaughlin
the prayer of the petitioners was
granted ; ,d the City Treasurer in-
structed accordingly.
Petition of C. L. McGovern asking
the City Council to accept the sum of
$25.00 in full settlement of the special
assessment Levied against Lot 20 and
21 in Kringle's Sub. for the improve-
ment of West 17th street in 1897 pre-
sented and read. On motion of Ald.
Wallis the petition was referred to
the City Treasurer ti report back to
the Council.
Petition of Louis Giesemann asking
the City Council to either vacate, the
triangle in front of the West two -
thirds and the North 30 feet of the
East one -third of Lot 1 of Lawrence
Sub., or either to refund the money
paid for the street and sewer assess-
ments presented and read. On motion
of Ald. Wallis the petition was re-
ferred to the Committee of the Whole
to view the grounds.
Petition of Wm. J. Glenn making ap-
plication as driver of the ambulance
or patrol presented and read. On mo-
tion of _'_ld. Singrin the petition was
referred to the Committee of the

City Council to order a warrant drawn
in favor the Upper River Mississippi
association for the payment of their
annual assessment presented and read.
On motion of Ald. Singrin the prayer
of the petition was granted and a
warrant in the sum of $250.00 was
ordered drawn on the City Treasurer
to cover the same.
Petition of P. W. Hassett asking the
City Council for permission to resume
operations i__ the quarry on Southern
avenue presented and read. On mo-
tion of Ald. Clancy the petition was
referred to the Committee of the
Whole,
Petition of J. D. Bush et al, asking
the City Council to construct a sani-
tary sewer and also to improve Wood
street from Julien avenue to West
14th street and also asking the City
Council to not compel the property
owners on the east side of Wood street
to lay permanent sidewalks for a
period of one year after the comple-
tion of the improvement and also not
to compel the property owners on the
west side of Wood street to lay per-
manent sidewalks for a period of five
years after the completion of the im-
provement presented and read. On
motion of Ald. Wallis the prayer of
the petitioners was granted and the
proper resolutions ordered drawn to
cover the same.
On motion of Ald. Singrin the bond
of James Street for excavating in the
streets and alleys and also the bond
of Chas. Sitterly for construction of
permanent sidewalks were referred
to the City Attorney.
Petition of Miss Mary Haws stating
that she will accept the sum of $125.00
in full settlement of the claim filed
by her for injuries sustained by falling
on an icy sidewalk presented and read.
On motion of Ald Callahan the peti-
tion was referred to the Committee -
of the Whole.
Original notice of suit of Catherine
Werb vs. City of Dubuque in the sum
of $1000.00 presented and read. On
motion of Ald. Singrin the notice of
suit was referred to the City Attorney.

Notice of Claim of damage to prop-

Gentlemen: Regarding the special
assessment for the construction of a
cement sidewalk abutting Lot 69 East
Dubuque Add. J, B. Murray, owner,
which was referred to me, would re-
spectfully say that 'this lot has a front-
age of 51.2 lineal feet that the meas-
urement of this walk was 52.7 lineal
feet, therefore showing that this walk
over lapped onto the next lot a dis-
tance of 1 1 -2 feet assessment to 9
square feet. I would respectfully rec-
ommend that the special assessment
be levied as it was advertised, and that
the City Treasurer be instructed to de-
duct the amount of $.96 from this as-
sessment.

Gentlemen: The claim of Bridget
Robinson for personal injuries sustain-
ed by her by reason of a fall upon a
defective sidewalk has been referred
to me for report. This claim was
filed in the sum of Five Thousand
($5000.00) dollars. I beg to state that
we have made a careful examination
of this claim and find that city is liable
for damages which she sustained. I
have, therefor, sought to make as rea-
sonable a compromise of this claim
as is possible with a view of saving
to the City a larger judgment. I have
ascertained the exact amount of the
actual expense to which Mrs. Robin-
son was put to date and find the same
to be in the sum of Three Hundred
and Twenty -five (0325.00) dollars. This
amount does not allow her anything
for pain and suffering or for the per -
minancy of her injury, nor for future
expense which I am sure will be neces-
sary for her to make. In my judgment
this is a fair settlement and, there-
for, recommend, subject to your honor-
able Body's approval that a warrant
be drawn in her favor in this amount,

and the Treasurer instructed accord-
ingly.

City start a pumping test at 8:00 a.
m. Saturday, April 17, 1915, at the

with combination cement curb and
gutter and to macadamize said por-
tion of said street and to assess the
cost of said grading, eurb and gutter-
ing and paving, against the abutting
property.

tention to the death of John W. Law-

grin moved that the recommendation

Sealed proposals will be received at
the City Recorder's office, City ball,
by the City Recorder until 8:00 p. m.,
Thursday, April 15th, 1915, for improv-
ing Julien Avenue and Delhi street,
from the east curb line of Alpine
street, to the west curb line of As-
bury street, in accordance with the
plans and specifications prepared by
the City Engineer and now on file in

ERLY BETWEEN CLEVELAND
AVENUE AND RUSH STREET IN
UNION ADDITION TO THE CITY
OF DUBUQUE, 1A,
Whereas, J. Cosgrove, the owner of
the lots abutting thereon has peti-
tioned the City Council of the City of
Dubuque for the vacation and annul-
ment of the alley extending from
Plum Street easterly between Cleve-
land Avenue and Rush Street in
Union Addition to the City of Du-
buque, Iowa, and
Whereas, By direction of the City
Council of the City of Dubuque,. the
City Engineer has made a plat of and
showing said portion of said alley
purposed to be vacated and filed the
same in his office subject to public
inspection and due notice has been
given to all abutting property own-
ers and ten (10) days' notice of such
purposed vacation has been published
in the official papers of the City and
the proposed action has been sub-
mitted to the City Council at two reg-
ular sessions, and
Whereas, It appears that no valid
objections have been made to the va-
cation of said alley and the same is
not required for public purposes.
Therefore, Be it Ordained by the
City Council of the City of Dubuque:
Section 1. That the alley extend-
ing from Plum Street easterly be-
tween Cleveland Avenue and Rush
Street in Union Addition in the City

Notice is hereby given to all con-
cerned that a special assessment as
provided by law will be levied at a
session of the City Council of the city
of Dubuque, Iowa, to be held Thurs-
day, May 6th, 1915, to pay for brick
paving the alley between Alta Vista
street and Center Place, from Julien
avenue to the southerly line of lot
6, McNulty's Sub. C. B. McNamara
& Co., contractors.

firm or corporation shall excavate in

for cleaning around the Market House
and hauling cleanings away as per
specifications on file in said office.
Bidders must state price per month
and each bid must be accompanied
by a certified check of $25.00 on some
Dubuque bank as a guarantee that a
contract will be entered into if award-
ed. The City Council reserves the
right to reject any and all bids.

to improve West Locust Street from
the end of the present brick improve-
ment at Seventeenth Street westerly
to the east line of Hodgdon avenue.
To whom it may concern: You and
each of you are hereby notified that
it is the intention of the City Council
of the City of Dubuque, Iowa, to im-
prove West Locust Street from the
end of the present brick improvement
at Seventeenth Street, westerly to the
east line of Hodgdon avenue.
That a plat of said improvement
is now on file in the office of the
City Recorder.
It is estimated by the City Engineer
that said improvement will require:
If brick block paving-
8,280 square yards of brick block
on a concrete foundation outside of
tracks.
1,910 spuare yards of brick block
on a concrete foundation inside of
tracks and one foot outside thereof.
500 lineal feet of stone curb reset.
150 lineal feet of new stone curb.
100 lineal feet of new cement curb.
Making a total estimate cost to the
abutting property owners of $20,334.50.
