Ald. McIntosh moved that the bill
of Frank Buetin for extras on curb
and gutter work and material on Lin-
coln avenue h be taken from the Com-
mittee of the Whole and acted on by
the City Council. Carried.
Ald. McIntosh moved that the bill
of Frank Beutin be paid and that
warrants be ordered drawn on the
City Treasurer to cover the same.
Carried.
Petition of the Dubuque Poultry As-
sociation asking for permission for
the use of Armory Hall for its poultry
show, December 4th to 13th, inclusive,
1915, presented and read. On mo-
tion of Ald. Singrin the prayer of the
petitioners was granted.
Petition of Schrup Motor Car Co.
asking for permission to place an air
station in front of the Auto Supply
Co. on Seventh Street presented and
read. On motion of Ald. Callahan the

AN ORDINANCE REPEALING SEC-
TION 32 OF AN ORDINANCE EN-
TITLED "AN ORDINACE TO PRO-
VIDE FOR IMPROVING THE
STREETS, ALLEYS AND PUBLIC
LANDINGS, AND FOR THE CON-
STRUCTION AND REPAIR OF
SIDEWALKS" OF THE REVISED
ORDINANCES OF 1901.
Be it Ordained by the City Council
of the City of Dubuque:• —
Sec. 1. That Sec. 32 of an Ordi-
nance entitled "An Ordinance to pro-
vide for improving the streets, alleys
and ppblic landings, and for the con-
struction and repair of sidewalks," of
the revised Ordinances of 1901, be and
the same is hereby repealed, said sec-
tion being as follows:
"Section 32. Curbstones shall be
set on all streets sixty -four feet wide
at a distance of twelve feet from the
line of the street, so that the street
beween the curbstones shall be forty
feet wide, and on all other streets the
curbstone ;hall be set at 'a distance
from the line of the street of one -fifth
part of the "whole width of the street."
Sec. 2. This Ordinance shall he in
fcrce and effect from and after its
passage, and publication in the official
newspapers in the city as provided
by law.

To Whom it May Concern:
You and each of you are hereby
notified that it is the intention of the
City Council of the City of Dubuque,
Iowa, to improve Putnam street from
Broadway Extension to Muscatine
street by narrowing said street to
twenty -six feet between curbs.
That a plat of said improvement is
now on file in the office of the City
Recorder.
It is estimated by the City Engineer
that said improvement will require:
625 square yards macadam.
490 lineal feet combination cement
curb and gutter.
Making a total estimated cost to the
legally assessable property owner; of
$840.00,
Any person having objection to said
improvement is hereby notified to ap-
pear before the city council at its
next regular session to be held Thurs-
day, October 7th, 1915, or to file with
the city recorder their objection in
writing on or before October 7th,
1915.

the north property line of Grandview
avenue to the south lot line of Can-
non street.
That a plat of said improvement is

575 lineal feet combination cement
curb and gutter.
310 square yards macadam.
Making a total estimated cost to
the legally assessable property own-

Petition of Mr. R. Bartells asking
permission to place a private six -inch.
sanitary sewer and water from the
center of his property to the manhole
in West Fifth Street at College Ave-
nue and also that he be relieved from
paying any sewer that may be laid in
Forest Lane in the future presented
and read. On motion of Aid, Wallis
the prayer of the petitioner was grant-
ed providing that he sign waiver and
agreement prepared b ythe City At-
torney.
Petition of Robt. E. Twaites relative
to cancelling the erroneous assessment
charged against his, lots in Columbia
Addition presented and read. On mo-
tion of Ald. Clancy the petition was
referred to the Committee of the
Whole and Mr. Twaites notified to be
present.
Petition of L. Beckett, et al asking
the City Council to install an electric
street light at the corner of St. Am-
brose and Hazel Streets presented
and read. On motion of Ald. Wallis
the prayer of the petitioner was grant-
ed and the City Electrician instruct-
ed accordingly.
Petition of Hattie M. and Harry
Bennett asking the City Council to
grant them a reduction in the special
assessment levied against Lots 6, 7,
8 and 9 on Rosedale Avenue due to a`
change of grade presented and read.
On motion of Ald. Singrin the petition
was referred to the Committee of the
Who1e to view the grounds.
Ald. Clancy moved to suspend the
rules for the purpose of allowing par-
ties in the Council Chamber to ad-
dress the Council. Carried by the fol-
lowing vote:

Gentlemen: In the assessment pre-
pared for the paving of Julien Ave-
nue and Delhi Street it has come to
my notice that Lot 4 and Lot 5 of the
Sub. of Mineral Lot 172 were over -
assessed to the amount of $83.12 each.
In checking over the plats on record
I find that the lots In question show
a frontage of 0.75 chains instead of
75 feet frontage. I would therefore
respectfully recommend that the City
Treasurer be instructed to accept the
amount of $171.18 for Lot 4 of Min-
eral Lot 172 and $171.18 for Lot 5
of Mineral Lot 172.

To the Honorable Mayor and Council
of the City of Dubuque.
Gentlemen: On August 5th, 1915,
Fred Spielman, presented a claim for
damages for injuries sustained by him
on Eighth Avenue in the City of Du-
buque, in the sum of Twenty -seven
and 50 -100 ($27.50) Dollars. Upon in-
vestigating the facts in this case
we found thas the injury com-
plained of was sustained by fall-
ing over some ties that had been
placed upon the walk by the Union
Electric Co., during the construction
of their part of the improvement on
Rhomberg Ave. We immediately noti-
fled the Union Electric Co. of the
claim and also informed them that,
in our opinion, they alone were re-
sponsible to said Speilman for his in-
juries. Since receiving our notice we
have received information that the
Union Electric Co., has paid this
claim for damages to Mr. Spellman
and Mr. Spielman has released the
City from all liability.
We, therefor, return the claim with
the recommendation that the same he
received and filed.

City Assessor and City Attorney, the
petition of Mary Y. Hancock, asking
that there be an official expression
made by you to the effect that a car.
tain tax assessment standing in the
name of C. T, Hancock and Mary Han-
cock in the sum of Twenty -five Thou-
sand ($25000.00) Dollars, does not re-
fer to Mary Y. Hancock, and that said
assessment in the name of Mary Han-
cock, is not a cloud upon the title or a
lien upon the property belonging to
Mary Y. Hancock.
We, in accordance with your re-
quest, have investigated this matter
and And that the tax assessment as
shown upon the Treasurer's books in
the name of C. T, Hancock and Mary
Hancock, refers to Mary Hancock,
the sister of C. T, Hancock, and not
to Mary Y. Hancock, the wife of said
C. T. Hancock, and that Mary Han-
cock and Mary Y. Hancock are two
different persons.
We further find that there are no
taxes now due and collectable from
Mary Y, Hancock, and that the assess-
ment upon the books of the City of
Dubuque for the year 1913, against
Mary Hancock, is not a lien against
the property of Mary Y. Hancock, In
order, therefor, that there be no doubt
or question about the assessment now
appearing upon the books In the
Treasurer's office, we , suggest that

Section 2. Any company operating
said "Street Cars" for hire or any
employe thereof violating the pro-
visions of this ordinance shall be
deemed guilty of a misdemeanor and
upon conviction the =eo` shall be fined
not less than Five ($5) Dollars nor
more than Twenty -five (25) Dollars
for each and every such violation.
Section 3. This ordinance .shall be
in force and take effect from and after
its passage by the City Council and
its publication one time in the Du-
buque Telegraph- Herald and Times -
Journal newspapers.

Be it Ordained by the City Council of
the City of Dubuque:
, Sec. 1. That in consideration of an
easement ever the property belonging
to the Illinois Central Railroad Com-
pany, for all purposes, ane for such
other considerations as are hereinaft-
er provided, said property being here-
inafter described, the .said Illinois Cen-
tral Railroad Company is hereby
granted the privilege to lay a single
track upon that part of Iowa Street
between First Street and Jones Street
in the City of Dubuque, lying just
east of the easterly track now in
place, thereby making three tracks
east of the freight house, belonging
to said railroad company.
Sec. 2. The said Illinois Central
Railroad Company hereby grants to
the City of Dubuque an easement for
all purposes consistent with the pub-
lic use over the , following described
premises, to wit: Beginning at junc-
ture of the alley and Jones Street,
thence proceeding in an easterly di-
rection 150 feet, thence north 59 feet,
thence west 60 feet, thence north 219
feet, thence west 25 feet, thence north
305 feet, thence in a northeasterly di-
rection 99 feet, thence in a westerly
direction 40 feet, thence in a south
erly direction along the curb 250 feet,
thence in a straight line 387 feet to
the point of beginning.
Sec. 3. That, in further considera-
tion for the right of way hereby grant-
ed the sain Illinois Central Railroad
Company, said company shall pave
with granite blocks all that portion
of the property above described over
which the city gets an easement
which is not now so paved, and it
shall be toe duty of sale company to
place the present pavement in first -
class condition.
Sec. 4. It shall be the duty of said
company to maintain the whole of the
pavement upon the property above de-
scribed in a first -class condition
throughout the term covered by this
Ordinance, and said pavement shall
be repaired by said company in com-
pliance with the order at any time
made by the City Council.
Sec. 5. It shall be the duty of said
company to remove the shanty, now
in place, on Jones Street near the

Alderman McIntosh offered the fol-
lowing:
Be it Resolved by the City Council
of the City of Dubuque, That it is
deemed necessary and advisable to
construct a sanitary sewer in Heeb
street as follows to wit, an eight inch
tile pipe sanitary sewer in Heeb street
from the end of the present sewer

north, but the same to remain on the
property covered by the easement
given by the company to the City.
Sec. 7. It shall be the duty of the
company to remove the sidewalk on
Jones Street south of the property
covered by the easement, and said
company shall pave said space with
granite block or brick on concrete
foundation.
Sec. 8. That said company hereby
agrees to maintain tha whole of the
pavement covered by the easement
above described in a first -class condi-
tion during the term of this grant,
and to comply with the order of the
City. Council in making all necessary
repairs. It being hereby expressly
understood that in the event said
company should refuse to maintain
said pavement in a first -class condi-
tion, and refuse to obo y the order of
the City Council relating to repairs,
'then the , 'ty Council of the City of
Dubuque, shall have the right, with-
out notice, to revoke the grant he: e-
by conferred to maintain its tracks
along the street above mentioned, and
said company shall, when notified to
do so by said Council, immediately
remove said track as herein authorized
to be placed, and said company furth-
er agrees to waive any and all rights
it might have, in law or equity, by
reason of the action of the City Coun
cil in demanding the removal of said
track.
Sec. 9. The said company is here-
by granted the privilege to maintain
its track upon the right of way hereby
granted as long as the city shall have
the right to use and occupy, for all
purposes, the ',remises covered by the
easement above described.
Sec. 10. The Illinois Central Rail-
road Company shall file with the City
Recorder. a writ of ac- -ptance of the
Ordinance within fifteen days after its
passage by the Council; otherwise it
shall become absolute null and void.
If this Ordinance shall be accepted by
said company within the time herein

widening prepared by the City Engi-
neer and now on file in his office;
Therefore be it resolved by the City
Council of the City of Dubuque that
the City Recorder be and he is here-
by instructed to issue a venire to the
Chief of Police, and to furnish him
with the names of the owners of pro-
perty as furnished him by the City
Engineer, and commanding him to
summon a jury of twelve freeholders,
citizens of said city and not directly
interested to appear at a time and
place therein stated, which time shall
be not less than five days from the
date thereof, and that the Chief of
Police shall give the persons named
as owners of property as aforesaid
(provided they be residents of the
city) of the time and place when and
where the jury so summoned shall ap-
pear.
Be it further resolved that the pro-
ceedings thereupon had at the time
and place thus affixed shall be in the
manner as provided by Chapter XXXI
of the Revised Ordinance of the City
of Dubuque.

the purchase price is concerned,
when carefully considered, its attrac-
tiveness is lost upon me. The init-
ial cost is a very small item; the
maintenance and future up -keep, in
fact, the making of a real park out
of this place, is what will cost the
taxpayers of this city many thous-
ands of dollars, and, in my opinion,
will be a constant drain upon the
city's resources.
"4th —While I believe that the pur-
pose of the association to do honor
to Dubuque's greatest citizens, W. B.
Allison and D. B, Henderson, is a no-
ble one, yet I do not feel that I should
permit the city to assume an obli-
gation which is bound to prove a
hardship rather than a benefit to
our citizens.
"For this reason, gentlemen, I feel
it is my duty to veto your action in
granting the prayer of the petition of
the Allison - Henderson Memorial As-
sociation, and in doing so I beg to
advise you that my action is not a
hasty one, but is the outcome of due
and earnest consideration upon my
part.

Mayor Saul stated that this meet-
ing is called for the purpose of veto-
ing the petition of the Allison- Hender-
son Memorial association granted by
the City Council October 7th, 1915,
and acting on any other business that
might properly come before a regular
meeting of the City Council.
"Dubuque, Ia., Oct. 20, 1915.
"To the Honorable City Council of
the City of Dubuque, Iowa:
"Gentlemen: —
"On the 7th day of October,
1915, a petition was presented to
your honorabl body by the Allison -
Henderson Memorial Association, in
which it was proposed to turn over
to the City of Dubuque, for park pur-
poses, an unimproved strip of ground
belonging to M. H. McCarthy, which
formerly constituted a part of the
Standard Lumber yards, and to be
converted into a river front park.
The obligation which the city is ask-
ed to assume, is a certain mortgage,
payable in six years, in the sum of
$2,750 and in addition to this the
city is to remit taxes upon this prop -
erity in the sum of about $600. The
proposition appealed to a majority of
your number, and was acted upon
favorably by you. Gentlemen, I beg
to state, while I realize the great
power vested in me, as mayor, in
placing in my hands the right to veto
any action taken by you which to me
seems unreasonable and is liable to
impose a hardship upon our citizens
and, realizing further that this pow-
er should not be arbitrarily exercised,
yet, in this case I feel it my duty to
exercise the same, and give as my
reason therefor, the following:
"1st —Being thoroughly familiar
with the location of the proposed
park, I do not believe it would be of
universal benefit to all of our citi-
zens.
"2nd —In addition to knowing the
location of the proposed park, I am
also familiar wiith the soil of which
it is composed, and know that it is
practically devoid of life vegetation,
formerly having been the dumping
ground for the old saw mill. For
this reason it is unfit for park pur-
poses.
"3rd —While the proposition as
made by the association appears at-
tractive upon its face insofar as the

ly 38.9 feet of Lot 14 Tschirgi and
Schwind's Sub. was over assessed,
being assessed for 39.9 feet, when
same should have been assessed for
a frontage of 38.9 feet, making a dif-
ference in this assessment to the
amount of $3.79. I would therefore
recommend that the City Treasurer
be instructed to deduct the amount
of $3.79 from the assessment against
this lot.

of the City of Dubuque.
Gentlemen: —
At the present term of Court the
case of M. Kassler vs. City of Du-
buque, law No. 17397, was called for
trial. This was a suit for damages
claimed to have been sustained by
the plaintiff by reason of water over-
flowing White street on the corner of
5th, flooding his basement and there-
by doing him considerable damage in
the year 1912. The suit was originally
brought for the sum of Five Thousand
Three hundred fifty ($5350.00) Dollars.
After a jury had been secured to try
the case, and after the plaintiff had
begun to introduce his evidence, it
was deemed advisable by us to effect
as reasonable a settlement as possi-
ble. Our proposition to the plaintiff
was to pay him the sum of Three
Hundred and fifty ($350.00) dollars in
full satisfaction of his claim. After
some delay this settlement was agreed
upon, subject to the wish of your Hon-
orable Body.
The case of James Rizos vs. City
of Dubuque, was also called for trial.
This was a case for personal injuries
sustained by the plaintiff on or about
the 7th day of January, 1915, when
the plaintiff slipped and fell upon an
icy walk, thereby sustaining a double
fracture of his right leg. Plaintiff
brought suit against the City in the
sum of Five Thousand ($5000.00) Dol-
lars. After a careful consideration of
the city's liability in that case, we
decided to effect a settlement if pos-
sible. We proposed to pay the sum
of One Hundred and fifty ($150.00)
Dollars in full satisfactioi_ of the
claim, subject to the will of your Hon-
orable Body. The amount proposed
by us in this case is less than the
actual expense of the plaintiff, and we
consider this settlement a good one.
If these settlements are satisfactory
to your Honorable B'ody you will in-
struct your City Treasurer to draw
two warrants in my favor, one in the
sum of Three Hundred and fifty
($350.00) Dollars, as a settlement of
the Kassler case, and the other in
the sum of One Hundred and Fifty
($150.00) Dollars, as a settlement in
the Rizos case, said warrants to be
endorsed over by me to the proper,
parties when I am satisfied that the
City has been properly released from
all liability and a dismissal of the
case on file.
In relation to the Kassler case, I
beg to advise your Honorable Body,
that from a careful investigation of
the conditions in that part of the city,
I believe it would be advisable and

Vehicles, and providing a Penalty for
the Violation thereof ", be and the
same is hereby amended by inserting
in the title thereof, between the
words "by" and "carts ", the word
"persons ", and placing after such
word "persons" a comma, so that said
title when amended will read as fol-
lows:
"An Ordinance Relating to Street
Traffic, and Regulating the Use of the
Streets, Alleys and Public Places of
the City of Dubuque, by Persons,
Carts, rays, Hackney Coaches, Om-
nibuses, Carriages, Wagons, Motor
Vehicles, and all other Vehicles, and
Providing a Penalty for the Violation
thereof."
Sec. 2. That said Ordinance be
amended by adding thereto the follow-
ing section:
"Sec. 33%. All persons while
crossing from one side of the street
to the other shall go to the corner of
the block in said street, thence di-
rectly to the opposite corner, and no
person shall be permitted to cross any
street by passing through the center
thereof diagonally."
Sec. 3. This Ordinance shall be in
full force and effect from and after its
passage and publication as required
by law.

Council met at 9:00 p. m.
Mayor Saul in the chair.
Present —Alds. Callahan, Clancy,
Heim, McIntosh, McLaughlin, Singrin,
Wallis.
Mayor Saul stated that this meet-
ing is called for the purpose of acting
on any matter that might properly
come before a regular session of the
city council.
Petition of Mrs. Dolter Cushing ask-
ing the city council to allow the taxes
to remain a lien on her property and
not to sell the same situated on Kauf-
mann avenue, Lot 149 Langworthy's
.Add., presented and read. On motion
of Ald. Callahan the petition was re-
ferred to the City Assessor to report
back to the council.
Alderman Clancy offered the follow-
ing:
Be it resolved by the city council
of the city of Dubuque, That it is
deemed necessary and advisable to
construct a sanitary sewer in South
Dodge street from the south lot line
of Rush street to Grandview avenue
southerly in Grandview avenue to the
unnamed street in Grandview avenue
a 'distance of about five hundred feet
as follows: to -wit: An eight -inch tile
pipe sanitary sewer in South Dodge
street and to assess the cost of said
sewer against the abutting property.

Alderman Clancy offered the fol-
lowing:
Be it resolved by the city council
of the city of Dubuque, That the city
engineer be and he is hereby directed
to prepare a plat and specifications
for an eight -inch tile pipe sanitary
sewer in South Dodge street from the
south lot line of Rush street to Grand-
view avenue southerly in Grandview
avenue to the unnamed street in
Grandview avenue a distance of about
five hundred feet, showing the loca-
tions and general nature of such im-
provement, the extent thereof, the
size and kind of material to be used,
and to prepare an estimate of the
cost thereof and the amount assess-
able upon each lot or parcel of land
adjacent to or abutting thereon per
front feet or• square feet in area, and
to file such plat, specifications and
estimate in the office of City Record-
er.
That after such plat is so filed, the
City Recorder shall cause to be pub-
lished notice of the intention of the
council to make such improvement,
which notice shall be published in
three consecutive issues of the offi-
cial paper of the City of Dubuque,
stating that such plat is on file, and
generally the nature of the sewer, its
location, size and kinds of material
to be used, and the estimate of its
cost, and fixing the time before which
objections can be filed, which time
shall not be less than five days after
the last publication of said notice, and
after the completion of the publica-
tion of such notice, he shall at its
next session, notify the council there-
of in writing with a printed copy of
such notice accompanying the same.

Ald. Wallis offered the following:
Whereas the amount of money real-
ized from the sale of the Julien Ave-
nue and Delhi street improvement
bonds to date added to the amount
paid to date by owners of property
subject to assessment for said im-
provement totals about $14,000.00 and
Whereas such sum is not sufficient
to pay the contractor the amount due
him at this time for the improvement,
Be it Resolved, That the finance
committee be empowered to pay
the contractor The Western Improve-
ment Co., the money mentioned above
and to borrow sufficient more money
to pay the contractor the balance due,
the borrowed money to be repaid
from the sale of bonds or from money
received from property owners as the
money is paid.

session of the City Council of the
City of Dubuque, Iowa, to be held
Thursday, October 21st, 1915, to pay
for brick guttering Madison street
from the north lot line of Seventeenth
street to the south curb line of Semi-
nary street, Jas. F. Lee, contractor.
Amount of Special Assessment,
$3,754.97, same to be assessed against
the property legally subject to as-
sessment upon and along said street.
And that there is a plat and sched-

AN ORDINANCE REGULATING
THE NUMBER OF EMPLO YES
REQUIRED TO OPERATE
STREET CARS OPERATING UN-
DER A FRANCHISE FROM THE
CITY OF DUBUQUE, AND PRO-
VIDING PENALTY FOR VIOLA-
TION.
Whereas, Foresaid "Street cars"
carrying passengers cannot be operat-
ed under the supervision of a single
person with safety and convenience
to the public, and a due regard to the
security and safety of the streets,
therefore,
Be It Ordained by the City Council
of the City of Dubuque, Iowa:
Section 1. It shall be unlawful to
operate upon the streets of Dubuque
and any said street cars carrying
passengers without having thereon an
employe in addition to the motorman
to assist in the control and care of the
cars and its passengers and to pre-
vent accidents.
Section 2. Any company operating
said "Street Cars" for hire or any
employe thereof violating the pro-
visions of this ordinance shall be
deemed guilty of a misdemeanor and
upon conviction thereof shall be fined
not less than Five ($5) Dollars nor
more than Twenty -five (25) Dollars
for each and every such violation.
Section 3. This ordinance shall be
in force and take effect from and after
its passage by the City Council and

SPECIAL ASSESSMENT NOTICE.
Notice is hereby given to all con-
cerned that a special assessment as
provided by law will be levied at a
session of the City Council of the
City of Dubuque, Iowa, to be held
Thursday, November 4th, 1915, to pay
for improving West Eighth street and
that portion of Julien avenue from the
west line of Lot 49, Corriell's Du-
buque, to the north lot line of Hill
street; James F. Lee, contractor.
Amount of special assessment,
$1,714.02; same to be assessed
against the property legally subject
to assessment upon and along said
streets.
And that there is a plat and sched-
ule on file in the office of the City
Recorder of said City of Dubuque,
showing the streets in which said im-
provement was made and the sepa-
rate lots and parcels of ground or
specified portions thereof subject to
assessment for such improvement, the
name of the owner thereof as far as
practicable and the amount to be as-
sessed against each lot or parcel of
ground, which plat and schedule are
subject to public inspection.
And that any and all persons ob-
jecting to said assessment or to said
plat must file his or their objections
in writing with the City Recorder of
said City of Dubuque on or before
said session of the City Council to be
held Thursday, November 4th, 1915,
or to appear at said session of the
Council to show cause, if any you
have, why said assessment should not
be levied.

AN ORDINANCE GRANTING TO

ROAD COMPANY A RIGHT OF
WAY FOR A SINGLE TRACK
OVER THAT PART OP IOWA
STREET LYING BETWEEN FIRST
STREET AND JONES STREET
AND EAST OF THE EASTERLY
TRACK, NOW IN PLACE, MAKING
IN ALL THREE TRACKS BE-
LONGINts TO SAID ILLINOIS
CENTRAL RAILROAD COMPANY
EAST OF THE FREIGHT HOUSE,
AND RECEIVING IN EXCHANGE
THEREFOR AN EASEMENT FOR
ALL PURPOSES OVER PROPER-
TY BELONGING TO SAID ILLI-
NOIS CENTRAL RAILROAD
COMPANY.
Be it Ordained by the City Council of
the City of Dubuque:
Sec. 1. That in consideration of an
easement ever the property belonging
to the Illinois Central Railroad Com-
pany, for all purposes, ana for such
other considerations as are hereinaft-
er provided, said property being here-
inafter described, the said Illinois Cen-
tral Railroad Company is hereby
granted the privilege to lay a single
track upon that part of Iowa Street
between First Street and Jones Street
in the City of Dubu iue, lying just
east of the easterly track now in
place, thereby making three tracks
east of the freight house, belonging
to said railroad company.
Sec. 2. The said Illinois Central
Railroad Company hereby grants to
the City of Dubuque an easement for
all purposes consistent with the pub-
lic use over the following described
premises, to wit: Beginning at june
ture of the alley and Jones Street,
thence proceeding in an easterly di-
rection 150 feet, thence north 59 feet,
thence west 60 feet, thence north 219
feet, thence west 25 feet, thence north
305 feet, thence in a northeasterly di-
rection 99 feet, thence in a westerly
direction 40 feet, thence in a south-
erly direction along the curb 250 feet,
thence in a straight line 387 feet to
the point of beginning.
Sec. 3. That, in further considera-
tion for the right of way Hereby grant-
ed the saia Illinois Central Railroad
Company, said company shall pave
with granite blocks all that portion
of the property above described over
which the city gets an easement
which is not now so paved, and it
shall be tine duty of said company to
place the present pavement in first-
class condition.
Sec. 4. It shall be the duty of said
company to maintain the whole of the
pavement upon the property above de.
scribed in a first -class condition
throughout the term covered by this
Ordinance, and said pavement shall
be repaired by said company in com-
pliance with the order at any time
made by the City Council.
Sec. 5. It shall be the duty of said
company to remove the shanty, now
in place, on Jones Street near the
alley firs: east of Main Street.
Sec. 6. It shall be the duty of said
company to move the shanty standing
on Jones Street near Iowa Street
north, but the same to remain on the
property covered by the easement
given by the company to the City.
Sec. 7. It shall be the duty of the
company to remove the sidewalk on
Jones Street south of the property
covered by the easement, and said
company shall pave said space with
granite block or brick on concrete
foundation.
Sec. 8. That said company hereby
agrees to maintain the whole of the
pavement covered by the easement
above described in a first -class condi-
tion during the term of this grant,
and to comply with the order of the
City Council in making all necessary
repairs. It being hereby expressly
understood that in the event said
company should refuse to maintain
said pavement in a first -class condi-
tion, and refuse to obo y the order of
the City Council relating to repairs,
then the '=ty Council of the City of
Dubuque, shall have the right, with-
out notice, to revoke the grant here
by conferred to maintain its tracks
along the street above mentioned, and
said company shall, when notified to
do so by said Council, immediately
remove said track as herein authorized
to be placed, and said company furth-
er agrees to waive any and all rights
it might , have, in law or equity, by
reason of the action of the City Conn
cil in demanding the removal of said
track.
Sec. 9. The said company is here-
by granted the privilege to maintain,
its track upolr the right of way hereby
granted as long as the city shall have
the right to use and occupy, for all
purposes, the j remises covered by the
easement above described.
Sec. 10. The Illinois Central Rail-
road Company shall file with the City
Recorder a writ of ac- - ptance of the
Ordinance within fifteen days after its
passage by the Council; otherwise it
shall become absolute i null and void.
If this Ordinance shall be accepted by
said company within the time herein
specified, it shall thereupon be pub-
lished in the official newspapers in
the City of Dubuque, and shall take
effect and be in force from and after
its passage and such publication.

corner of Fourteenth and Delhi
Streets presented and read. On mo-
tion of Ald. Clancy the prayer of the
petitioner was granted providing that
he deposits $50.00 in cash to place
the street in the same condition as
before he excavated in the street.
Petition of the citizens of the City
of Dubuque asking the City Council
to appoint a commission of nine mem-
bers to be known as the "terminals
commission," whose duty shall be to
promote "A Union Depot and River
Terminals" and suggesting the names
of the members presented and read.
On motion of Ald. McIntosh the pe-
tition was referred to the Committee
of the Whole.
