Gentlemen: I herewith submit my
report of defective lights for month
of December, 1913. I find from the
report of the Police Department that
the total hours that 42 lamps failed to
burn would equal 21 lamps burning for
one month, or $12.50. '

Alderman McLaughlin moved that
the Secretary of the Board of Health
notify the garbage contractor to com-
ply with his contract for the collection
of garbage. Carried.
R. Kolck moved that the Sanitary
Officer be instructed to notify the
proprietor of the Central Hotel to re-
move all rubbish in the rear of the
building. .

The Hon. Mayor and City Council of
the City of Dubuque:
Gentlemen: . Your Committee on
Claims and City Attorney respectfully
report that they have received a prop
osition of settlement in the case of
Lizzie J. Post versus City, from the
attorney representing plaintiff, by the
terms of which plaintiff agrees to ac-
cept the sum of five hundred ($5C0) dol-
lars in full settlement for all claims
she may have arising out of injury she
sustained by which she claims dam-
ages in said action, each of the par -
ties to the action to pay their own
costs.
This suit was commenced for the
January term, 1908, and was tried to a
jury during the March term, 1909,
jury returning a verdict for the plain-
tiff in the sum of $1,500. This verdict
was set aside by the court and the
case again tried during the May term,
1910, jury returning a verdict for the
defendant city. This verdict was set
aside by the court and an appeal was
taken to the supreme court, the su-
preme court affirming the action of
the lower court in granting a new trial.
The action was for $7,500, plaintiff
claiming to have fallen on a sidewalk
in front of 305 South Locust Street on
the 3rd day of October, 1908, due to
being tripped by loose plank, causing
injuries to her right hip, spine, spinal
cord, shaking her nervous system and
causing internal injuries.
Your committee, believing it to be
to the best interest of the city to set-
tle and 'compromise the case upon the
basis above stated, do therefore rec-
ommend that settlement be authorized
for the sum of five hundred dollars.
the city to pay its own costs, and fur-
ther recommend that a warrant in the
sum of $500 he ordered drawn to cover
the amount of the settlement and a
further warrant be ordered drawn in
such sum as may be necessary to pay
the city's costs, the amount thereof to
be furnished the Treasurer by the
City Attorney.

City Recorder transmit to the bereaved
family a copy of the resolution and
also to the Carnegie Hero Commission
our recommendation that they give
consideration to this case as an in-
stance of heroic bravery.

Your Committee of the Whole, to
whom was referred the matter of
providing tor all night and every night
street lighting in lieu of the present
Philadelphia Moonlight schedule, would
respectfully report that we have re-
ceived a proposition from the Union
Electric Company to furnish this ser-
vice at a lower rate than that named
in its contract, which was $70.00 per
lamp per annum for the first four
hundred and twenty -five lamps, and
$65.00 per lamp per annum for all in
excess of that number. The said Union
Electric Company now agrees to fur-
nish an all night and every night
lighting service for $67.50 for the first
four hundred and twenty -five lamps
and $62.50 for all lamps in excess there-
of. Besides the foregoing, said com-
pany also agrees to keep the boulevard
lamps lighted at street intersections
throughout the entire district served
by such lamps, from midnight till
dawn, fair the sum of $2.75 per lamp
per month, all of which arrangeny,nts
to terminate with the present street
lighting contract.
Deeming this service necessary and
advisable, we respectfully recommend
that th same be adopted, and that
the Mayor be authorized, in behalf of
the City, to enter into a supplementary

contract with said Union Electric
Company for the additional service
herein recommended.

entered an order that all cases
brought prior to January 1, 1913, be
either tried or dismissed at the
March term of court. This will mean
the dismissal of the cases commonly
known as the Water Works cases, un-
less you take some action on my for-
mer communications asking for expert
bookkeepers. I can proceed no fur-
ther in these cases until I am fur-
nished with the material necessary to
comply with the rulings of the Court
made on motions.

Whereas, The contract heretofore
entered into by the City .of Dubuque
for the construction of a sanitary
sewer as hereinafter described has
been completed, and the City Engi-
neer has computed that the cost and
expense of said improvement amounts
to $671.18.
Therefore, Pe It Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of con-
structing a sanitary sewer in Walnut
street from a point opposite the north-
erly line of Lot No. 8, in Bissell's Du-
buque, northerly to present sewer in
West Fourteenth street, the Mayor
be and he is hereby required to exe-
cute, and deliver to the City Recorder,
to be by him registered and counter-
signed two bonds for two hundred and
fifty dollars each and one for one hun-

Be It Resolved by the City Council
of the City of Dubuque, That in ac-
cordance with the provisions of Sec-
tion 7 of Chapter 63 of the Laws of
the Thirty- fourth General Assembly,
it is hereby determined that inasmuch
as the tax levy for the present year
has been fixed at fourteen and one -
half mills, which levy is based on the
assessment on actual values on a one
hundred per cent basis, it is hereby
determined that the equivalent there-
of based upon a twenty -five per cent
(25 per cent) valuation would be fifty -
eight (58) mills.
It is hereby ordered that the City
Recorder shall certify said aggregate
value of 58 mills to the County Treas
urer of Dubuqoe County, Iowa, for
the purpose of computing the propor-
tion of the taxes due the City of Du-
buque under said Act.

was called for the purpose of receiving
the report of the committee of the
whole and taking action thereon, and
also on any other business that might
properly come before the meeting.
Ald. Saul presented the following re-
ports of the Committee of the Whole:
Your Committee of the Whole, to
whom was referred the petition of
John L. Buelow et al asking that a
reasonable reduction be made in the
assessment levied for the improvement
of Couler Avenue from 22nd Street to a
point about fifty feet north of Peru
Road, would respectfully recommend.
on account of said avenue being the
main artery of travel in and out of
the city at the north end thereof that
the prayer of the petitioners he grant_
ed, and that a reduction of twenty per
cent be allowed the property on either
side of said avenue from 22nd Street
to 24th Street, and a reduction of
thirty per cent on the property on
either side of said avenue from 24th
Street to the north end of said im-
provement, that no interest be charged
on said levy until February 1st, 1914,
and that the City Treasurer be noti-
fied of the foregoing action.
We further recommend that the re-
duction herein provided for shall not
be held to apply to the assessment
levied against the Union Electric Co.
for its proportion of said improvement.

P. Maclay et al., asking that steps he
taken to acquire a strip off from the
north side of Lot 4 of Lot 1 of Min-
eral Lot 150 for the purpose of widen-
ing Dodge street at that point to con-
form with the width of the rest of the
street, would respectfully report that
a committee composed of Alds. Saul,
Singrin, Wallis and Heim, has been
appointed to confer with the owner
of the property and ascertain on what
terms the necessary ground can be
acquired and report its findings to the
Committee of the Whole. We re-
spectfully recommend that the action
of your committee be approved.

special assessment levied against Lot
5 of the Sub. of Mineral Lot 170, for
the construction of a sanitary sewer in
Delhi street be canceled, for the rea-
son that his lot is too low to permit
of connection being made with said
sewer, -yould respectfully recommend
that the prayer of the petitioner be
granted, and that the Treasurer be so
instructed. Provided, that if, at any
time in the future, it becomes possi-
ble, either by changing the grade of
said lot or raising the house thereon,
to connect with said sewer, and such
connection is sought to be made, said
assessment shall be paid before per-
mission so to do shall be granted.
We further recommend that the
City Engineer be notified of the above
provision, and that he be instructed
to make a notation thereof on the
records in his office.

walk abutting Lot 4, Cleminson's Sub.,
which has been constructed under
contract by the City, was not in ac-
cordance with the specifications pre-
pared therefor, and that said walk
has become disintegrated and is now
practically useless, and asking there_
fore that the balance of the special
assessment levied against said lot for
the construction of a sidewalk be
canceled, would respectfully recom-
mend that the prayer of the petitioner
be granted and that the Treasurer be
instructed accordingly.

Alderman Wallis offered the fol-
lowing:
Whereas, It is deemed necessary
and advisable by the City Council of
the City of Dubuque to open Vernon
Street through Lot 1 of 9 of Mount
Pleasant Addition, owned by J.
Jungwirth, making said portion of
said street of the same width as those
parts at present laid out and open-
ed, that is, fifty feet, according to
the plans of said opening prepared by
the City Engineer and now on file in
his office;
Therefore, be it Resolved by the
City Council of the City of Dubuque,
that the City Recorder be and he is
hereby instructed to issue a venire
to the Chief of Police and to furnish
him with the names of the owners of
property as furnished by the City
Engineer, and commanding him to
summon a jury of twelve free holders,
citizens of said city not directly in-
terested. to appear at a time and
place therein stated, which time shall
not be less than five days from the
date thereof, and that the Chief of
Police shall also give the persons
named as owners of property as afore-
said (provided they be residents of
the city), notice in writing of
the time and place when and where
the jury so summoned will appear.
Be it further Resolved that the
proceedings thereupon bad at the
time and place thus fixed shall b'e
in the manner as provided by Chapter
XXXI. of the Revised Ordinances of
the City of Dubuque.

cerned that a special assessment as
provided by law will be levied at a
session of the City Council of the city
of Dubuque, Iowa, to be held January
15th, 1914, to pay for improving Musca-
tine Street from the north curb line
of Gay Street to the south curb line of
