SUBJECT: First Amendment to CDBG Subrecipient Agreement between the City of
Dubuque and Catholic Charities of the Archdiocese of Dubuque

Housing & Community Development Director Alexis Steger is recommending City
Council approve the first amendment to the subrecipient agreement with Catholic
Charities of the Archdiocese of Dubuque for the replacement of two elevators in
Ecumenical Tower and authorize the Mayor to execute the amendment on behalf of the
City.
Unexpected delays in materials have necessitated an updated time of performance to
make this project viable. This memorandum transmits a resolution to amend the
subrecipient agreement to reflect an updated time of performance.
The Ecumenical Tower elevator replacement project meets the National Objective of
Low/Mod-Income Housing, and the Eligible Activity of 14B — Rehab-, Multi -Unit
Residential. The project budget for this agreement is $380,000.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The attached memorandum transmits the first amendment to the subrecipient
agreement for CDBG funds to assist Catholic Charities of the Archdiocese of Dubuque
for the replacement of two elevators in Ecumenical Tower.
BACKGROUND
The City of Dubuque entered into a Community Development Block Grant (CDBG)
subrecipient agreement with Catholic Charities of the Archdiocese of Dubuque on
September 18, 2023, to assist with construction costs of a complete renovation and
modernization of the two elevators in Ecumenical Tower. Unexpected delays in
materials have necessitated an updated time of performance to make this project viable.
This memorandum transmits a resolution to amend the subrecipient agreement to
reflect an updated time of performance.
DISCUSSION
Catholic Charities manages Ecumenical Tower which provides 88 units of affordable
housing for seniors and disabled adults, most at 30% or below of the area median
income. Ecumenical Tower's greatest need is to replace the elevator cars. The first
amendment includes an updated time of performance due to unexpected delays in
materials.

RECOMMENDED ACTION
I recommend the City Council approve the first amendment to the subrecipient
agreement with Catholic Charities of the Archdiocese of Dubuque and authorize the
Mayor to execute the amendment on behalf of the City.

RESOLUTION NO. 188-24
RESOLUTION AUTHORIZING THE FIRST AMENDMENT TO THE CDBG SUBRECIPIENT
AGREEMENT BETWEEN THE CITY OF DUBUQUE AND CATHOLIC CHARITIES OF THE
ARCHDIOCESE OF DUBUQUE
Whereas, the City of Dubuque and Catholic Charities of the Archdiocese of Dubuque
entered into a CDBG Subrecipient Agreement dated September 18, 2023 with respect to a
rehab to completely replace and modernize two electric elevators; and
Whereas, the parties desire to modify the Subreciplent Agreement as set out in the First
Amendment to the Subrecipient Agreement attached hereto, and
Whereas, the Ecumenical Tower provides services to a minimum of 51 % low/moderate
income residents, meeting the CDBG National Objective of Low/Mod-Income Housing benefit,
and eligible activity of 14B: Rehab, Multi -Unit Residential.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. That the First Amendment to the CDBG Subrecipient Agreement be approved.
Section 2. That the Mayor of the City of Dubuque is hereby authorized to execute the First
Amendment.
Section 3. That the Mayor of the City of Dubuque Iowa is hereby authorized and directed to
designate the City Manager or the Housing and Community Development Department Director to
execute said Amendment and related documents on behalf of the City of Dubuque, Iowa.

FIRST AMENDMENT
TO
SUBRECIPEINT AGREEMENT BETWEEN
THE CITY OF DUBUQUE
AND
CATHOLIC CHARITIES OF THE ARCHDIOCESE OF DUBUQUE
This first Amendment to Subrecipient Agreement, dated for reference purposes the 17th day
of June , 2024, is made and entered into by the City of Dubuque, Iowa, a Responsible Entity
administering Community Development Block Grant funds (City), and the Catholic Charities of the
Archdiocese of Dubuque (Subrecipient).
WHEREAS, City and Subrecipient entered into a Subrecipient Agreement dated September 18,
2023 (the Subrecipient Agreement); and
herein.
WHEREAS, City and Subrecipient desire to amend the Subrecipient Agreement as set forth
NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL TERMS AND COVENANTS CONTAINED
HEREIN, CITY AND SUBRECIPIENT AGREE AS FOLLOWS:
Section 1. Section A.6 of the Subrecipient Agreement is hereby amended to read as Follows:
A.6 Time and Term of Performance
Services of the Subrecipient shall start on September 18, 2023 and end on December 31, 2024.
All the required activities and services, except for audit, will be completed by or before this date.
The City may grant extensions at its sole discretion. Only a valid written Amendment to the
Agreement shall alter this completion date. The term of this Agreement and the provisions herein
shall be extended to cover any additional time period during which the Subrecipient remains in
control of CDBG funds or other assets, including program income.
Section 2. Except as modified herein, the Subrecipient Agreement shall remain in full force and
effect.
