Due to supply chain delays during and following the Covid-19 pandemic, and subsequent economic impacts including increased material costs and higher lending interest rates, housing development slowed significantly from 2020 - 2023 increasing the necessary timeline to develop a residential housing subdivision. Greater Dubuque Development Corporation President and CEO Rick Dickinson met with the city and the developer on this project to propose that he would approach our state legislators to amend the current state law related to Housing TIF's. Our state legislators advocated on our behalf. This impact has been felt statewide, which has prompted the Iowa legislature and the Governor to support a three-year extension of housing urban renewal areas. This would extend the timeframe for division of revenue within the Area through 2032. As part of extending the division of revenue by three years as authorized by recent Iowa legislation, the City requested consent from the Dubuque County Board of Supervisors and the Dubuque Community School District via an Extension Agreement. This Extension Agreement was approved by the Board of Supervisors on June 3, 2024, and by the Dubuque Community School District Board of Education on June 10, 2024. The City is also a party to this attached extension agreement, which is attached hereto as well as a separate resolution. A City Council public hearing on the Amended and Restated Urban Renewal Plan is to be held on June 17, 2024. The notice of public hearing was published on June 7, 2024, to allow for the appropriate publication requirements. The proposed Amended and Restated Urban Renewal Plan would extend the timeline for urban renewal projects to be undertaken in accordance with recent revisions to Chapter 403 of the Iowa Code, and that the proposed Amended and Restated Urban Renewal Plan (the "Plan") be updated to include additional urban renewal project descriptions and make any other necessary revisions. BACKGROUND The South Pointe Housing Urban Renewal Area (the "Area") was originally established by Resolution 101-17 by the City Council of the City of Dubuque, Iowa, on March 20, 2017. The purpose of creating the Area was to facilitate the construction of much needed housing and residential development in the Dubuque area market, as described in the Plan, and as defined by the Iowa Code §403.17(12). Per Iowa Code Section §403.19 the City of Dubuque was limited to collecting tax increment for a period of ten years in that District. DISCUSSION Due to supply chain delays during and following the Covid-19 pandemic, and subsequent economic impacts including increased material costs and higher lending interest rates, housing development has slowed significantly, increasing the necessary timeline to develop the residential housing. This impact has been felt statewide, which has prompted the Iowa legislature and the Governor to support a three-year extension of housing urban renewal areas by a period of three years. This would extend the timeframe for division of revenue within the Area through 2032. A consultation process was conducted with the affected taxing entities as required by Chapter 403 of the Iowa Code. Prior to the meeting, the taxing entities were mailed copies of the Plan and the Notice of Public Hearing. The required consultation to discuss, question, or object to the findings in these documents was held on May 29, 2024. No representatives from the taxing bodies were in attendance. Minutes are attached. As part of extending the division of revenue by three years as authorized by recent Iowa legislation, the City requested consent from the Dubuque County Board of Supervisors and the Dubuque Community School District via an Extension Agreement. INTRODUCTION This Amended and Restated Urban Renewal Plan for the South Pointe Housing Urban Renewal Area ("Plan" or "Urban Renewal Plan") has been developed to help local officials promote housing and residential development in the City of Dubuque ("City"). The primary goal of the Plan is to stimulate, through public involvement and commitment, private investment in new housing and residential development as defined by the Iowa Code Section 403.17(12). In order to achieve this objective, the City intends to undertake urban renewal activities pursuant to the powers granted to it under Chapter 403 and Chapter 15A of the Code of Iowa, as amended. B. DESCRIPTION OF THE URBAN RENEWAL AREA The South Pointe Housing Urban Renewal Area ("Area" or "Urban Renewal Area") is illustrated in Attachments A, B-1, and B-2 and described in Attachment D. The City reserves the right to modify the boundaries of the Area at some future date. Any amendments to the Plan will be completed in accordance with Chapter 403 of the Iowa Code ("Urban Renewal Law"). C. AREA DESIGNATION With the adoption of this Plan, the City designates this Urban Renewal Area as an economic development area that is appropriate for the provision of public improvements related to housing and residential development. D. BASE VALUE If the Urban Renewal Area is legally established, a tax increment financing ("TIF") ordinance is adopted, and debt is certified prior to December 1, 2017, the taxable valuation within the area included in the TIF ordinance as of January 1, 2016, will be considered the "base valuation." If debt is not certified until a later date, the "base value" will be the assessed value of the taxable property in the TIF ordinance area as of January 1 of the calendar year preceding the calendar year in which the City first certifies the amount of any debt. E. DEVELOPMENT PLAN -3- The City Council has approved a general plan for the physical development of the City as a whole, outlined in the 2012 City of Dubuque Comprehensive Plan that was adopted by the City Council on February 6, 2012. The goals, objectives, and projects in this Urban Renewal Plan are in conformity with the City's Comprehensive Plan. The Urban Renewal Area is subject to zoning ordinances adopted by the City and County of Dubuque, and includes the following zoning classifications: City R-1, City R-2, City R-3, City R-4, City C-2, City C-2c, City C-3, City C-3c, City CS, City CSc, City LI, City AG, City PI, City PC, and City PR; and County R1, County R2, County R3, County R4, County Al, County B1, County B2, County M1, and County M2. See Attachment E for details. This Urban Renewal Plan does not in any way replace the City's current land use planning or zoning regulation process. For details on current and proposed land use, see attached land use maps, Attachments B-1 and B-2. The need for improved traffic, public transportation, public utilities, recreational and community facilities, or other public improvements within the Urban Renewal Area is set forth in this Plan, as amended. As the Area develops, the need for public infrastructure extensions and upgrades will be evaluated and planned for by the City. F. RESIDENTIAL DEVELOPMENT The City's objective in the Urban Renewal Area is to promote new housing and residential development. When a City utilizes tax increment financing to support residential development, a percentage of the incremental revenues (or other revenues) generated by the project (not to exceed the project costs which are limited to reimbursement of "public improvement" costs as defined by Iowa law) must be used to provide assistance for low and moderate income ("LMI") family housing. LMI families are those whose incomes do not exceed 80% of the median Dubuque County income. LMI families include single person households. Unless a reduction is approved by the Iowa Economic Development Authority, the percentage of incremental revenues used to provide LMI family housing assistance must be at least equal to the percentage of LMI families living in Dubuque County, -4- as determined by the U.S. Department of Housing and Urban Development using Section 8 guidelines. Incremental revenues equal to the required amount of LMI assistance will be used by the City to provide LMI family housing assistance. The assistance for LMI family housing may be provided anywhere within the City and may include, but is not limited to: 1. Lots for LMI housing within or outside the Urban Renewal Area; 2. Construction of LMI housing within or outside the Urban Renewal Area; 3. Grants, credits or other direct assistance to LMI families living within or outside the Urban Renewal Area, but within the area of operation of the municipality; 4. Payments to a LMI housing fund established by the City to be expended for one or more of the above purposes, including matching funds for any state or federal moneys used for such purposes. G. AREA OBJECTIVES Renewal activities are designed to provide opportunities, incentives, and sites for new residential development within the Urban Renewal Area and to provide housing assistance to LMI families. More specific objectives for development within the Urban Renewal Area are as follows: 1. To increase the availability of housing opportunities, which may in turn attract and retain local industries and commercial enterprises that will strengthen and revitalize the economy of the State of Iowa and the City of Dubuque. 2. To stimulate through public action and commitment, private investment in new residential development. 3. To plan for and provide sufficient land for residential development in a manner that is efficient from the standpoint of providing municipal services. 4. To help finance the cost of eligible public improvements, as defined in Iowa Code §384.37 (19) in support of new housing development. -5- 5. To provide a more marketable and attractive investment climate. 6. To improve the housing conditions and housing opportunities for LMI families. H. TYPE OF RENEWAL ACTIVITIES To meet the objectives of this Urban Renewal Plan and to encourage the development of the Urban Renewal Area, the City intends to utilize the powers conferred under Chapter 403 and Chapter 15A, Code of Iowa including, but not limited to, tax increment financing. Activities may include: 1. To undertake and carry out urban renewal projects through the execution of contracts and other instruments. 2. To arrange for or cause to be provided the construction or maintenance of public infrastructure including but not limited to eligible public improvements, as defined in Iowa Code §384.37 (19). 3. To finance programs which will directly benefit housing conditions and promote the availability of housing in the community. 4. To make loans, grants, rebates, or other types of economic development grants or incentives to private persons, local development organizations, or businesses to promote housing projects on such terms as may be determined by the City Council. 5. To borrow money and to provide security therefor. 6. To make or have made surveys and plans necessary for the implementation of the urban renewal program or specific urban renewal projects. 7. To use tax increment financing for a number of objectives, including but not limited to, providing for necessary physical improvements and infrastructure. 8. To provide for the construction of specific site improvements such as grading and site preparation activities, access roads and parking, fencing, utility connections, and related activities. 9. To use any or all other powers granted by the Urban Renewal Act to develop and provide for improved economic conditions for the City of Dubuque and the State of Iowa. M Nothing herein shall be construed as a limitation on the power of the City to exercise any lawful power granted to the City under Chapter 15, Chapter 15A, Chapter 403, Chapter 427B, or any other provision of the Code of Iowa in furtherance of the objectives of this Urban Renewal Plan. I. PROPOSED PROJECT 1. Public Improvements. This urban renewal project involves the construction of public infrastructure to serve a new approximately 184-lot subdivision under development by Dubuque South Pointe, LLC or a related entity ("Developer"). The City expects to construct certain public improvements in the Area which may include a public recreational area, fiber conduit, stormwater, sanitary, & water utility improvements, and road improvements. The estimated time period for completion of this project is 2017 — 2028. The total cost for construction of the public improvements shall not exceed $3.4 million. 2. Development Agreement. This proposed urban renewal project involves providing incentives necessary to construct certain public improvements in a new non-LMI subdivision. The City expects to provide assistance to the Developer in the form of property tax rebates of potential incremental taxes, under the terms of a rebate agreement between the City and the Developer. Under the proposal, some of the incremental property tax generated from the new houses constructed within the Urban Renewal Area pursuant to Iowa Code Section 403.19 is expected to be rebated to the Developer (in an amount not to exceed the Developer's certified costs of constructing certain of the required public improvements. Rebates for Developer's certified actual costs related to Phase One of the project are not to exceed $770,701 (or such lesser amount as may be determined by the City Council), whichever is less, for a period of time to be determined by the City Council, but in no event shall the rebates be available for a period of more than 13 years. Rebates, related to Phase Two of the project, made after May 21, 2024, are not to exceed the actual total of the Qualified Costs, as defined in the Development Agreement, dated for reference June 5, 2017, as amended, during the term of the Amended Development Agreement, for development activities. These rebates related to Phase One and Phase Two will not be general obligations of the City but will be payable solely from incremental property taxes generated by the project. The City will set aside at least the amount of incremental taxes generated by the project in accordance with Iowa Code §403.22 to support LMI family -7- housing anywhere in the community. The remaining incremental taxes will be available to reimburse the City for its planning, legal and other project costs, public improvement costs, and to fund property tax rebates to the Developer up to a maximum of the Developer's certified costs of public improvements, as set forth in a development agreement with Developer. 3. Planning, engineering fees (for urban renewal plans), attorney fees, other related costs to support urban renewal projects consistent with the provisions of Section 403.6 and Section 403.12 including, but not limited to, staffing and personnel related expenses such as salary incurred by the economic development, engineering, and planning departments and other City personnel related to and supporting economic development and urban renewal projects within the Area. Such fees and expenses shall not exceed $50,000. J. FINANCIAL DATA 1. July 1, 2024, Statutory debt limit: $262,722,395(see Attachment C) 2. Outstanding general obligation debt: $105,280,288 (see Attachment C) 3. Proposed amount of indebtedness to be incurred: A specific amount of indebtedness to be incurred for the Proposed Projects has not yet been determined. This document is for planning purposes only. The estimated project costs in this Plan are estimates only and will be incurred and spent over a number of years. In no event will the City's constitutional debt limit be exceeded. The City Council will consider each project proposal on a case -by -case basis to determine if it is in the City's best interest to participate before approving an urban renewal project or expense. If is further expected that such indebtedness, including interest on the same, may be financed in whole or in part with tax increment revenues from the Urban Renewal Area. Subject to the foregoing, it is estimated that the cost of the Proposed Projects as described above will be approximately $3,399,560 plus any LMI set -aside. K. URBAN RENEWAL FINANCING The City intends to utilize various financing tools such as those described below to successfully undertake the proposed urban renewal actions. The City has the statutory authority to use a variety of tools to finance physical improvements within the Area. These include- 1 . Tax Increment Financing -8- Under Section 403.19 of the Iowa Code, urban renewal areas may utilize the tax increment financing mechanism to finance the costs of public improvements or economic development incentives associated with redevelopment projects. Upon creation of a tax increment district within the Area, by ordinance, the assessment base is frozen and the amount of tax revenue available from taxes paid on the difference between the frozen base and the increased value, if any, is segregated into a separate fund for the use by the City to pay costs of the eligible urban renewal projects. The increased taxes generated by any new development, above the base value, are distributed to the taxing entities, if not requested by the City. 2. General Obligation Bonds Under Division III of Chapter 384 and Chapter 403 of the Iowa Code, the City has the authority to issue and sell general obligation bonds for specified essential and general corporate purposes, including the acquisition and construction of certain public improvements within the Area or incentives for development consistent with this Plan. Such bonds are payable from the levy of unlimited ad valorem taxes on all the taxable property within the City. It may be the City will elect to abate some or all of the debt service on these bonds with incremental taxes from this Area. The City may also determine to use tax increment financing to provide incentives such as cash grants, loans, tax rebates or other incentives to developers in connection with urban renewal projects in the Plan or other urban renewal projects. In addition, the City may determine to issue general obligation bonds, tax increment revenue bonds or such other obligations, or loan agreements for the purpose of making loans or grants of public funds to private businesses located in the Area. Alternatively, the City may determine to use available funds for making such loans or grants for urban renewal projects. In any event, the City may determine to use tax increment financing to reimburse the City for any obligations or advances. Nothing herein shall be construed as a limitation on the power of the City to exercise any lawful power granted to the City under Chapter 15, Chapter 15A, Chapter 403, Chapter 427B, or any other provision of the Code in furtherance of the objectives of this Urban Renewal Plan. L. PROPERTY ACQUISITION/DISPOSITION IM Other than easements and public rights -of -way, no property acquisition by the City is anticipated at this time. However, if any property acquisition/disposition becomes necessary to accomplish the objectives of the Plan, urban renewal powers will be carried out, without limitation, in accordance with Iowa Code. M. RELOCATION The City does not expect there to be any relocation required of residents or businesses as part of the proposed urban renewal projects; however, if any relocation is necessary, the City will follow all applicable relocation requirements. N. STATE AND LOCAL REQUIREMENTS All provisions necessary to conform to State and local laws will be complied with by the City in implementing this Urban Renewal Plan and its supporting documents. O. SEVERABILITY In the event one or more provisions contained in this Urban Renewal Plan, as it may be amended, shall be held for any reason to be invalid, illegal, unauthorized or unenforceable in any respect, such invalidity, illegality, lack of authorization or enforceability shall not affect any other provision of this Urban Renewal Plan, and this Urban Renewal Plan shall be construed and implemented as if such provisions had never been contained herein. 1:7 7_1►IN4611ATi%1>!�W_1z1461111iyiI4Z111'? This Urban Renewal Plan may be amended from time to time for a number of reasons, including but not limited to, change in the area, to add or change land use controls and regulations, to modify goals or types of renewal activities, to add or change the urban renewal projects, or to amend property acquisition and disposition provisions. The City Council may amend this Plan pursuant to appropriate procedures under Iowa Code Chapter 403. Q. EFFECTIVE PERIOD This Urban Renewal Plan will become effective upon its adoption by the City Council and will remain in effect until it is repealed by the City Council. -10- With respect to the property included within the Urban Renewal Area, which is also included in an ordinance which designates that property as a tax increment area and is designated based on an economic development finding, to provide or to assist in the provision of public improvements related to housing and residential development, the use of incremental property tax revenues or the "division of revenue," as those words are used in Chapter 403 of the Code of Iowa, is limited to thirteen (13) years for this Urban Renewal Area as it was originally created prior to January 1, 2018 and the 2024 amendment to the Iowa Code at §403.22(5) authorizes a three (3) year extension with the consent of the County and School District. The "division of revenue" begins with the second fiscal year following the year in which the City first certifies to the County Auditor the amount of any loans, advances, indebtedness, or bonds which qualify for payment from the incremental property tax revenues attributable to that property within the Urban Renewal Area. At all times, the use of tax increment financing revenues (including the amount of loans, advances, indebtedness or bonds which qualify for payment from the division of revenue provided in Section 403.19 of the Code of Iowa) by the City for activities carried out under the Urban Renewal Plan shall be limited as deemed appropriate by the City Council and consistent with all applicable provisions of law. R. PROPERTY WITHIN URBAN REVITALIZATION AREA The Urban Renewal Area is, or at some future date may be, located within an Urban Revitalization Area under Chapter 404 of the Iowa Code. No tax abatement incentives will be allowed for development that occurs in the Urban Renewal Area unless previously authorized by the City Council. S. JOINT CITY/COUNTY AGREEMENT In accordance with Section 403.17(4) of the Code of Iowa, a City may exercise urban renewal powers with respect to property which is located outside but within two (2) miles of the boundary of a City only if the City obtains the consent of the County within which such property is located. A Joint Agreement, which gives the City permission to include property outside the City limits in the Urban Renewal Area, has been executed by the City and Dubuque County. A form of the Joint Agreement is attached as Attachment F. EXTENSION AGREEMENT BY AND AMONG CITY OF DUBUQUE, IOWA; COUNTY OF DUBUQUE, IOWA; AND DUBUQUE COMMUNITY SCHOOL DISTRICT WHEREAS, the City of Dubuque, Iowa ("City") has adopted the Amended and Restated Urban Renewal Plan (the "Urban Renewal Plan") for South Pointe Housing Urban Renewal Area (the "Urban Renewal Area") within the limits of the City, the County of Dubuque, Iowa ("County"), and the Dubuque Community School District ("School District"); and WHEREAS, Iowa Code Section 403.22(5) provides that the division of revenue under Iowa Code Section 403.19 for the provision of public improvements related to housing and residential development may continue for 10 fiscal years (beginning with the second fiscal year after the year of first certification of debt); provided, however, that under Iowa Code Section 403.22(5)(c), for urban renewal areas established before January 1, 2018, a municipality may extend the division of revenue for up to three (3) years if necessary to adequately fund the project, subject to receiving approval from the governing bodies of all "affected taxing entities'; and WHEREAS, this amendment to the Iowa Code was responsive to the impact of the COVID- 19 pandemic on supply chains, financing difficulties, and the critical need for additional housing across the state; and WHEREAS, the South Pointe Urban Renewal Area was adopted in June 2017; and WHEREAS, pursuant to the Urban Renewal Plan and a related development agreement, the City has undertaken an urban renewal project for the provision of public improvements in connection with the development of a residential subdivision in the Urban Renewal Area; and WHEREAS, sufficient incremental taxes may not be generated to allow full finding of the project during the ten (10) years statutorily allowed for the division of revenue under Section 403.22(5); and WHEREAS, the City is requesting that the City, County, and School District, as the affected taxing entities approve an extension of the division of revenue under Iowa Code Section 403.19 in order to adequately fund the residential projects in Urban Renewal Area. NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: Section 1. Breiffef er City Clerk EXTENSION AGREEMENT BY AND AMONG CITY OF DUBUQUE, IOWA; COUNTY OF DUBUQUE, IOWA; AND DUBUQUE COMMUNITY SCHOOL DISTRICT WHEREAS, the City of Dubuque, Iowa ("City") has adopted the Amended and Restated Urban Renewal Plan (the "Urban Renewal Plan") for South Pointe Housing Urban Renewal Area (the "Urban Renewal Area") within the limits of the City, the County of Dubuque, Iowa ("County"), and the Dubuque Community School District ("School District"); and WHEREAS, Iowa Code Section 403.22(5) provides that the division of revenue under Iowa Code Section 403.19 for the provision of public improvements related to housing and residential development may continue for 10 fiscal years (beginning with the second fiscal year after the year of first certification of debt); provided, however, that under Iowa Code Section 403.22(5)(c), for urban renewal areas established before January 1, 2018, a municipality may extend the division of revenue for up to three (3) years if necessary to adequately fund the project, subject to receiving approval from the governing bodies of all "affected taxing entities"; and WHEREAS, this amendment to the Iowa Code was responsive to the impact of the COVID- 19 pandemic on supply chains, financing difficulties, and the critical need for additional housing across the state; and WHEREAS, the South Pointe Urban Renewal Area was adopted in June 2017; and WHEREAS, pursuant to the Urban Renewal Plan and a related development agreement, the City has undertaken an urban renewal project for the provision of public improvements in connection with the development of a residential subdivision in the Urban Renewal Area; and WHEREAS, sufficient incremental taxes may not be generated to allow full funding of the project during the ten (10) years statutorily allowed for the division of revenue under Section 403.22(5); and WHEREAS, the City is requesting that the City, County, and School District, as the affected taxing entities approve an extension of the division of revenue under Iowa Code Section 403.19 in order to adequately fund the residential projects in Urban Renewal Area. NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: Section 1. Pursuant to Iowa Code Section 403.22(5)(c), each of the undersigned affected taxing entities has, by resolution of their governing bodies, approved the extension of the Iowa Code Section 403.19 division of revenue within the South Pointe Housing Urban Renewal Area for the City of Dubuque, Iowa, for projects involving the provision of public improvements related to housing and residential development for a total of up to thirteen (13) fiscal years of division of revenue (beginning with the second fiscal year after the year of first certification of debt) in connection with the housing projects.
