Amendments to the City of Dubuque Code of Ordinances (city code) are recommended
to address the following actions concerning boards and commissions:
• Repeal Gender Balance Requirements for State -Mandated Boards and
Commissions
• Coincide with Iowa Code Language and Processes for State -Mandated Boards
and Commissions
• Amend Removal Process for the Zoning Advisory Commission and Housing
Appeals and Mediation Board to Coincide with Iowa Code
• Amend Meeting Minutes Filing Requirement
• Repeal Minimum Age Requirement
• Update Terms Section of the Arts and Cultural Affairs Advisory Commission and
Resilient Community Advisory Commission
• Clarify the Appointment Process for Cross Representatives from the Housing
Commission, Housing Trust Fund Advisory Commission, Zoning Advisory
Commission, and Zoning Board of Adjustment
• Remove Unnecessary Language Regarding Reappointments
• Other Miscellaneous Language Updates
Each recommendation is explained in greater detail below. Additionally, a spreadsheet
summarizing the recommended changes for each board and commission has been
included as a separate document.
Repeal Gender Balance Requirements for State -Mandated Boards and
Commissions
The City of Dubuque's boards and commissions mandated by Iowa Code have been
subject to Iowa Code §69.16A:
69.16A Gender balance.
1. All appointive boards, commissions, committees, and councils of the state established
by the Code, if not otherwise provided by law, shall be gender balanced. No person shall
be appointed or reappointed to any board, commission, committee, or council established
by the Code if that appointment or reappointment would cause the number of members
of the board, commission, committee, or council of one gender to be greater than one-
half the membership of the board, commission, committee, or council plus one if the
board, commission, committee, or council is composed of an odd number of members. If
the board, commission, committee, or council is composed of an even number of
members, not more than one-half of the membership shall be of one gender. If there are
multiple appointing authorities for a board, commission, committee, or council, they shall
consult each other to avoid a violation of this section.
2. All appointive boards, commissions, committees, and councils of a political subdivision
of the state that are established by the Code, if not otherwise provided by law, shall be
gender balanced as provided by subsection 1 unless the political subdivision has made
a good faith effort to appoint a qualified person to fill a vacancy on a board, commission,
committee, or council in compliance with subsection 1 for a period of three months but
has been unable to make a compliant appointment. In complying with the requirements
of this subsection, political subdivisions shall utilize a fair and unbiased method of
selecting the best qualified applicants. This subsection shall not prohibit an individual
whose term expires prior to January 1, 2012, from being reappointed even though the
reappointment continues an inequity in gender balance.
The following boards and commissions are mandated by Iowa Code and therefore subject
to §69.16A: Airport Commission, Airport Zoning Commission, Airport Zoning Board of
Adjustment, Board of Library Trustees, Civil Service Commission, Equity and Human
Rights Commission, Historic Preservation Commission, Zoning Advisory Commission,
and Zoning Board of Adjustment.
In the 2023 session, the Iowa Legislature passed Senate File 2096, repealing gender
balance requirements for appointive bodies, including city boards and commissions
mandated by state code. Governor Kim Reynolds signed this legislation on April 3, 2024,
effective July 1, 2024. Consequently, proposed ordinance amendments will repeal gender
balance requirements from the applicable city boards and commissions to align with the
revised Iowa Code.
Coincide with Iowa Code Language and Processes for State -Mandated Boards and
Commissions
Proposed amendments aim to align the language of city ordinances for state -mandated
boards and commissions with the Iowa Code. Specifically, these amendments update
terminology and appointment processes to match state code.
The Iowa Code uses the term "appoint" for most state -mandated boards and
commissions. However, for the Airport Zoning Commission and the Airport Zoning Board
of Adjustment, the term "select" is used. Therefore, the proposed amendments will
replace "appoint" with "select" for these two boards to align with the state code.
An additional amendment clarifies the appointment process for the Civil Service
Commission, aligning it with Iowa Code §400.1:
400.1 Appointment of commission.
1. In cities having a population of eight thousand or over and having a paid fire department
or a paid police department, the mayor, one year after a regular city election, with the
approval of the council, shall appoint three civil service commissioners. The mayor shall
publish notice of the names of persons selected for appointment no less than thirty days
prior to a vote by the city council. Commissioners shall hold office, one until the first
Monday in April of the second year, one until the first Monday in April of the third year,
and one until the first Monday in April of the fourth year after such appointment, whose
successors shall be appointed for a term of four years. In cities having a population of
more than seventy thousand, the city council may establish, by ordinance, the number of
civil service commissioners at not less than three.
Per this section, the Mayor appoints the three Civil Service Commissioners, with the
appointments subject to a vote by the City Council after fulfilling publication requirements.
The proposed amendment to city code specifies this process for greater clarity on the
requirement.
Amend Removal Process for the Zoning Advisory Commission and Housing
Appeals and Mediation Board to Align with Iowa Code
Proposed amendments will align the removal processes for city boards and commissions
with Iowa Code requirements.
For most state -mandated boards and commissions, the removal process in city code
specifies that the City Council may remove any member for cause upon written charges
and after a public hearing. Boards and Commissions not required by the state specify in
city code that the City Council may remove any Board Member or Commissioner for good
cause. The Zoning Advisory Commission currently states that the City Council may
remove any Commissioner for good cause. However, the Zoning Advisory Commission
is a state -mandated commission, and therefore the removal process is subject to a public
hearing. Consequently, an ordinance amendment will specify that a public hearing
process is necessary for commissioner removal from the Zoning Advisory Commission.
Conversely, the Housing Appeals and Mediation Board currently requires a public hearing
for the removal of a board member. Since it is not a state -mandated board, a public
hearing is not necessary. A proposed ordinance amendment will specify that the City
Council may remove any Housing Appeals and Mediation Board member for good cause,
removing the public hearing requirement.
These amendments will ensure that the removal processes for both the Zoning Advisory
Commission and the Housing Appeals and Mediation Board are consistent with the
requirements and practices established by both state and city code.
Amend Meeting Minutes Filing Requirement
Currently, most City of Dubuque boards and commissions must file a copy of the meeting
minutes with the city council. Copies of meeting minutes are submitted to the City Council
as a consent item for the City Council to receive and file. However, the city code does not
specify whether the minutes should be the approved or unapproved versions. The
proposed amendment clarifies that a copy of the approved minutes must be filed,
providing greater clarity on the requirement. Additionally, it is recommended to add
wording that clarifies that all meeting minutes, including both regular and special minutes,
fall under this requirement.
Additional updates are requested of the Board of Library Trustees to align their processes
with all other city boards and commissions. Proposed amendments specify that the
appointed secretary does not need to be a member of the commission and adds standard
verbiage for filing minutes that all other boards and commissions require.
These amendments ensure uniformity and clarity in the filing requirements for meeting
minutes across all city boards and commissions.
Repeal Minimum Age Requirement
Upon reviewing city code, it was noted that several boards and commissions specify that
members must be at least 18 years old. Iowa Code does not set a minimum age
requirement for eligibility on boards and commissions. Additionally, having this
requirement for only some boards and commissions creates inconsistency. Therefore,
the proposed amendment will repeal the minimum age requirement to ensure uniform
eligibility criteria across all boards and commissions.
Update Terms Section of the Arts and Cultural Affairs Advisory Commission and
Resilient Community Advisory Commission
The Arts and Cultural Affairs Advisory Commission currently specifies the names and
term expiration dates of current commissioners in §2-8-7 Terms. The proposed
amendment strikes the commissioner names and expiration dates. This change
recognizes that commissioner turnover will occur, leading the information to become
obsolete once expiration dates have passed.
A similar change is requested for the Resilient Community Advisory Commission. The
Resilient Community Advisory Commission currently specifies the initial commission
terms in §2-8-7 Terms, and it is recommended that this information be removed.
All other boards and commissions list term lengths but do not detail specific
commissioners or term expiration dates. Striking this language from both the Arts and
Cultural Affairs Advisory Commission and Resilient Community Advisory Commission will
simplify the language, ensure the requirements remain relevant, and coincide with all
other boards and commissions code language.
Clarify the Appointment Process for Cross Representatives from the Housing
Commission, Housing Trust Fund Advisory Commission, Zoning Advisory
Commission, and Zoning Board of Adjustment
Regarding the Housing Commission, city code specifies in §2-5B-5(B)(4) that one
member of the commission serves as cross representative on the Community
Development Advisory Commission and one member serves on the Long Range
Planning Advisory Commission. However, the language for both requirements differ, with
the Community Development Advisory Commission appointment requiring City Council
approval while the Long Range Planning Advisory Commission appointment requiring
City Council concurrence. Therefore, it is recommended to update the appointment
process for the Long Range Planning Advisory Commission to specify city council
approval is required in order for both appointment language to match.
Another recommendation is to revise the Housing Trust Fund Advisory Committee §2-
5D-6(E)(2) to specify that two members are appointed by the committee, with city council
approval, to serve on the housing commission. This provides greater clarity to the
process.
Additional recommendations modify the Zoning Advisory Commission and Zoning Board
of Adjustment to indicate that the City Council selects the cross representatives to the
Airport Zoning Advisory Commission and Airport Zoning Board of Adjustment,
respectively. This will align with the verbiage in city code for the Airport Zoning Advisory
Commission and Airport Zoning Board of Adjustment.
Remove Unnecessary Language Regarding Reappointments
Most boards and commissions currently use the term "reappointment" in the city code.
However, it has been determined that this language is redundant, as the term
"appointment" already used in the city code applies to individuals appointed for additional
terms. Therefore, the recommended ordinance amendments strike the term
"reappointment" throughout all boards and commissions.
Other Miscellaneous Language Updates
A minor verbiage update is recommended to replace the term "consists of" with
"comprises" for membership of the Airport Zoning Board of Adjustment. Additionally, the
Civil Service Commission has been updated to reflect the current terminology of the
Equity and Human Rights Department, whose director shall be an ex officio member of
the Civil Service Commission per Iowa Code.
Conclusion
The effective date of the recommended ordinances is July 1, 2024, coinciding with the
repeal of gender balance requirements from the Iowa Code. I extend my sincerest
appreciation to Senior Counsel Barry Lindahl and Paralegal Jenny Messerich for their
efforts in these amendments.
I respectfully recommend City Council adoption of the ordinances amending boards and
commissions processes and language to align with the Iowa Code, enhance uniformity
and simplicity, and eliminate redundancy.

AMENDING CITY OF DUBUQUE CODE OF ORDINANCES TITLE 12 AIRPORT,
CHAPTER 4 AIRPORT COMMISSION
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Title 12, Chapter 4 of the City of Dubuque Code of Ordinances is hereby
amended to read as follows:
12-4-5: MEMBERSHIP:
The commission comprises five (5) residents of the city, appointed by the city council.

first meeting of the commission following the appointment or at the city clerk's office any
time prior to the first meeting of the commission.

B. Open Meetings: All meetings must be called and held in conformance with the
Iowa open meetings law.
C. Attendance:
1. In the event a commissioner has been absent for three (3) or more
consecutive meetings of the commission, without being excused by the
chairperson, such absence will be grounds for the commission to recommend to
the city council that the position be declared vacant and a replacement appointed.
2. Attendance must be entered upon the minutes of all meetings.
D. Minutes: A copy of the minutes of all regular and special meetings of the
commission must be filed with the city council within ten (10) working days after approval
by the commission, or by the next regularly scheduled city council meeting, whichever is
later.
E. Quorum: Three (3) members of the commission constitute a quorum for the

AMENDING CITY OF DUBUQUE CODE OF ORDINANCES TITLE 12 AIRPORT,
CHAPTER 6 AIRPORT ZONING BOARD OF ADJUSTMENT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Title 12, Chapter 6 of the City of Dubuque Code of Ordinances is hereby
amended to read as follows:
12-6-5: MEMBERSHIP:
A. Composition: The board comprises five (5) residents of the city.
B. Special Qualifications:
1. Two (2) members must be selected by the city council from the city of
Dubuque zoning board of adjustment.
2. Two (2) members must be selected by the Dubuque County board of
supervisors.
3. One member from the public at large must be selected by the other four (4)
members. This member will serve as chairperson.
12-6-6: OATH:
Each person, upon selection to the board, must execute an oath of office at the first
meeting of the board following the selection or at the city clerk's office any time prior to
the first meeting of the board.
12-6-8: VACANCIES:
Vacancies must be filled in the same manner as original selections.
12-6-10: MEETINGS:
A. Meetings: Meetings may be called by the chairperson or at the written request of
a majority of the members.

which the board is required to pass under this chapter, or to effect any variation from the
terms thereof.

BOARD
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Section 14-1 A-6 of the City of Dubuque Code of Ordinances is hereby
amended to read as follows:
E. Membership:
1. The board comprises seven (7) residents of the city, appointed by the city
council.
2. Special experience and training qualifications:
a. One member must be a residential construction professional.
b. One member must be a commercial construction professional.
c. One member must be an electrical construction professional.
d. One member must be a plumbing construction professional.
e. One member must be a heating, ventilation, and air conditioning
(HVAC) construction professional.
f. Two (2) multi -disciplinary representatives, which could be an
architect, engineer, building designer, or general construction professional.
3. Alternates: Alternate representatives shall be appointed for the residential
construction professional, commercial construction professional, electrical
construction professional, plumbing construction professional, and HVAC
construction professional positions and shall be called upon to participate in the
event of a conflict of interest or unavailability of the primary appointee.
F. Oath: Each person, upon appointment to the board, must execute an oath of office
at the first meeting of the board following the appointment or at the City Clerk's Office any
time prior to the first meeting of the board.
J. Meetings:
1. Regular Meetings: The board must meet upon call of the Chairperson, the
City Manager, or the City Manager's designee.
2. Special Meetings: Special meetings may be called by the Chairperson or at
the written request of a majority of the members.
3. Open Meetings: All meetings must be called and held in conformance with
the Iowa Open Meetings Law.
4. Appeals: The board shall meet upon notice from the Chairman, within not
less than ten (10) days and not more than ninety (90) days of the filing of an appeal,
at stated periodic meetings, or at the written request of a majority of the members.
5. Attendance:
a. In the event a member of the board has been absent for three (3) or
more consecutive meetings of the board, without being excused by the
Chairperson, such absence will be grounds for the board to recommend to
the City Council that the position be declared vacant and a replacement
appointed.
b. Attendance must be entered upon the minutes of all meetings.
6. Minutes: A copy of the minutes of all regular and special meetings of the
board must be filed with the City Council within ten (10) working days after approval
by the board, or by the next regularly scheduled City Council meeting, whichever
is later.
7. Quorum: Four (4) members of the board must be in attendance to constitute
a quorum for the transaction of business. An affirmative vote of a majority of the
members present and voting is necessary for the adoption of any motion or
resolution.
L. Removal: Except as provided in subsection 14-1A-6E5a of this chapter, the city
council may remove any commissioner for good cause.
Section 2. This ordinance shall take effect July 1, 2024.

AMENDING CITY OF DUBUQUE CODE OF ORDINANCES TITLE 2 BOARDS AND
COMMISSIONS, CHAPTER 5 HOUSING AGENCY AND COMMUNITY
DEVELOPMENT COMMISSIONS, ARTICLE B HOUSING COMMISSION
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Title 2, Chapter 5, Article B of the City of Dubuque Code of Ordinances
is hereby amended to read as follows:
2-5B-5: MEMBERSHIP:
A. Number: The commission comprises ten (10) residents of the city.
B. Special Qualifications:
1. At least three (3) members must be appointed specifically on the basis of
experience in real estate development, banking, finance, accounting, funds
management, or other related areas of expertise.
2. One (1) member must be a person who is a recipient of tenant based rental
assistance under section 8 of the United States Housing Act of 1937, whose name
appears on a lease of section 8 property. If such member ceases to be a recipient
of rental assistance under section 8, the term of such member is deemed
terminated and a new member who meets the requirements of this subsection
must be appointed for the remainder of the term.
3. The remaining members are at -large members.
4. Cross -Representation:
a. One (1) member must be appointed by the commission, with city
council approval, to serve on the community development advisory
commission.
b. One (1) member must be appointed by the commission, with city
council approval, to serve on the long range planning advisory commission.

Each person, upon appointment to the commission, must execute an oath of office at the
first meeting of the commission following the appointment or at the city clerk's office any

COMMISSION
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Section 10-5A-2 of the City of Dubuque Code of Ordinances is hereby
amended to read as follows:
E. Membership: The commission comprises seven (7) residents of the City, appointed
by the City Council.
F. Oath: Each person, upon appointment to the commission, must execute an oath
of office at the first meeting of the commission following the appointment or at the City
Clerk's Office any time prior to the first meeting of the commission.
J. Meetings:
1. Regular Meetings: The commission must meet not less than bi-monthly.
2. Special Meetings: Special meetings may be called by the Chairperson or at
the written request of a majority of the Commissioners.
3. Open Meetings: All meetings must be called and held in conformance with
the Iowa Open Meetings Law.
4. Attendance:
a. In the event a Commissioner has been absent for three (3) or more
consecutive meetings of the commission, without being excused by the
Chairperson, such absence will be grounds for the commission to
recommend to the City Council that the position be declared vacant and a
replacement appointed.
b. Attendance must be entered upon the minutes of all meetings.
5. Minutes: A copy of the minutes of all regular and special meetings of the
commission must be filed with the City Council within ten (10) working days after
approval by the commission, or by the next regularly scheduled City Council
meeting, whichever is later.
6. Quorum: Four (4) Commissioners constitute a quorum for the transaction of
business. The affirmative vote of a majority of the Commissioners present and
voting is necessary for the adoption of any motion or resolution.

ORDINANCE NO. 41 - 24
AMENDING CITY OF DUBUQUE CODE OF ORDINANCES TITLE 16 UNIFIED
DEVELOPMENT CODE, CHAPTER 8 ZONING BOARD OF ADJUSTMENT
APPLICATIONS AND PROCEDURES, SECTION 16-8-1 ZONING BOARD OF
ADJUSTMENT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Section 16-8-1 of the City of Dubuque Code of Ordinances is hereby
amended to read as follows:
E. Membership:
1. The board comprises five (5) residents of the city, appointed by the city
council.
2. Two (2) members from the board must be selected by the city council as
cross representatives to the airport zoning board of adjustment.
3. A majority of the members of the board must be persons representing the
public at large and must not be involved in the business of purchasing or selling
real estate.
F. Oath: Each person, upon appointment to the board, must execute an oath of office
at the first meeting of the board following the appointment or at the city clerk's office any
time prior to the first meeting of the board.
J. Meetings:
1. Meetings: Meetings may be called by the chairperson or at the written
request of a majority of the members.
2. Open Meetings: All meetings must be called and held in conformance with
the Iowa open meetings law.
3. Attendance:
a. In the event a member of the board has been absent for three (3) or
more consecutive meetings of the board, without being excused by the
chairperson, such absence will be grounds for the board to recommend to
the city council that the position be declared vacant and a replacement
appointed.
b. Attendance must be entered upon the minutes of all meetings.
4. Minutes: A copy of the minutes of all regular and special meetings of the
board must be filed with the city council within ten (10) working days after approval
by the board, or by the next regularly scheduled city council meeting, whichever is
later.
5. Quorum: The concurring vote of three (3) members of the board is
necessary to reverse any order, requirement, decision, or determination of any
such administrative official, or to decide in favor of the applicant on any matter
upon which it is required to pass under any such ordinance or to effect any variation
in such ordinance.
Section 2. This ordinance shall take effect July 1, 2024.

W. 13TH STREET, DUBUQUE, AND MAY BE VIEWED DURING NORMAL
BUSINESS HOURS OF 8:00 AM TO 5:00 PM MONDAY TO FRIDAY.
Synopsis of ordinance amendments:
? Repeal minimum age requirement.
? Replace appoint verbiage with "select.
? Repeal gender balance requirement due to passage of Iowa
Senate File 2096 repealing Iowa State Code Section 69.16A
Gender balance.
? Update the filing minutes requirement to specify that a
copy of the minutes of all regular and special meetings must
be filed after approval by the board.
? Remove verbiage on reappointments.
This ordinance shall take effect July 1, 2024.
