Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request.
The application, staff report and related materials are attached for your review.

Mark Arthofer, owner of 165 Westside Court, spoke in favor of the request. He stated that
he is seeking approval of the proposed plat in order to adjust the property boundaries so
they can sell Lot 1.
Staff detailed the staff report noting the submitted simple subdivision is for a
reconfiguration of two existing lots where Lot 2 does not have street frontage and
therefore requires ZAC review and City Council review and approval. Staff further
explained that the plat of survey was reviewed by the Development Review Team and
that as proposed, the plat does comply with all other city codes.
The Commission sought to clarify whether appropriate access and utility easements were
included, and staff confirmed that as proposed, the plat of survey includes access and
utility easements for both lots.
There were no public comments.
The Zoning Advisory Commission discussed the request and found it appropriate.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving lot frontage for Lot 2.
A simple majority vote is needed for the City Council to approve the request.

The proposed plat of survey realigns two existing lots. In doing so, the proposed southern
lot (Lot 2) would not have street frontage. Pursuant to the Unified Development Code
(UDC), the proposed subdivision is classified as a Simple Subdivision' and is creating a
lot that does not have frontage and therefore requires review by the Zoning Advisory
Commission and City Council.
DISCUSSION
As proposed, the Plat of Survey of Arthofer's Skyline Addition 2 would effectively realign
the existing property line which divides the 129,377 sq. ft. parcel.
The proposed plat would create the following lots:
• Lot 1 would be .80 acres (34,681 sq. ft.) and is developed with Skyline
Construction's main office building and garage-,
• Lot 2 would be 2.17 acres (94,691 sq. ft.) and is developed with several storage
buildings.
Lot 2 does not have frontage on a public or private street and therefore requires review
by the Zoning Advisory Commission and City Council. The proposed lots are otherwise
in substantial conformance with the Unified Development Code. The proposed
subdivision is not anticipated to be in conflict with the City's Comprehensive Plan uses
and goals.
The Zoning Advisory Commission shall review the submitted plat to determine whether it
is in substantial conformance with the Unified Development Code.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Plat of Survey
of Arthofer's Skyline Addition 2 and recommends approval.

Simple Division: Any subdivision or consolidation of property in which no new streets, public or
private, are proposed, which does not require the construction of any public improvements, and
which creates fewer than three (3) lots.

RESOLUTION NO. 223-24
A RESOLUTION APPROVING THE PLAT OF SURVEY ARTHOFER'S SKYLINE
ADDITION 2, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat Of Survey Arthofel's
Skyline Addition 2 in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is walved to allow 0 feet of frontage on a public
street or an approved private street for Lot 2 Arthofers Skyline Addition 2.
Section 2. That the Plat of Survey Arthofel's Skyline Addition 2, in the City of
Dubuque, Iowa Is hereby approved, and the Mayor and City Clerk are hereby authorized
and directed to endorse the approval of the City of Dubuque, Iowa upon said Plat of
Survey.
