The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request stating that they are proposing the subdivision plat in order to reconfigure some existing lots and to clean up the smaller lots on the property. He identified the changes to the Dunkin' Donuts property on Lot 1, explained that Lot 2 would contain the majority of the shopping center, that Lot 3 is proposed for future development, and Lot 4 is the remaining portion of the property. Staff reviewed the staff report, noting the submitted proposed plat of survey would reconfigure the existing twelve (12) lots on the site into four (4) lots. Staff stated that all lots would have adequate street frontage along either Dodge Street or Brunskill Road and that the lots would meet all other city code requirements. Proposed access and utilities easements throughout the site were highlighted and staff noted that the Subway property within Plaza 20 was previously created and is not part of this plat. There were no public comments. The Zoning Advisory Commission discussed the request finding it appropriate. Recommendation By a vote of 3 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified as a Minor Subdivision' and therefore requires review by the Zoning Advisory Commission and City Council. DISCUSSION As proposed, the Plat of Survey of Plaza 20 No. 9 would consolidate the twelve (12) existing lots that make up and surround the Plaza 20 Shopping Center down to four (4) new lots. The applicant desires to modify the existing lot configurations in order to combine and clean up remnants of smaller lots and to create new lots for potential future development. The proposed plat would create the following lots: • Lot 1 will be 0.550 acres and is the Dunkin' Donuts site; Lot 2 will be 21.826 acres and is occupied by the existing Plaza 20 Shopping Center buildings; Lot 3 will be 16.004 acres and is undeveloped-, and • Lot 4 will be 24.778 acres and is also undeveloped. The North Fork Catfish Creek runs through this lot and consequently a portion of it contains flood plain and flood way. All four (4) lots have street frontage along either Highway 20 or Brunskill Road. The proposed lots are in substantial conformance with the Unified Development Code and the City's Comprehensive Plan which recommends continued concentration of commercial uses with a regional draw along major transportation corridors. The Zoning Advisory Commission shall review the submitted plat to determine whether it is in substantial conformance with the Unified Development Code. UDC Chapter 16-11-6 defines a Minor Subdivision as "Any subdivision or consolidation of property in which no new streets, public or private, are proposed and which does not require the construction of any public improvements and which creates three (3) or more lots."
