INTRODUCTION
The purpose of this memorandum is to seek acceptance of a grant of public sanitary
sewer easement from Radford Road Real Estate for a relocated sanitary sewer main
associated with an agreement with Dubuque Housing, LLC for Public Sanitary Sewer
Main Construction Serving Lots 1, 1-2, and 2-2 of Pizza Ranch Place on Radford Road
(the EMRI Apartment Development).
BACKGROUND
Radford Road Real Estate LLC is the current owner of the property south of the existing
Pizza Ranch restaurant property at 2020 Radford Road. Recently, Radford Road Real
Estate LLC divided the property into two lots for the sale of the easterly lot to Dubuque
Housing, LLC. Dubuque Housing, LLC is planning to construct the EMRI Apartment
Development on said easterly lot as shown on Exhibit 1 of the attached Sanitary Sewer
Construction Agreement document.
DISCUSSION
In order to make the two new lots south of the Pizza Ranch restaurant property more
developable, Dubuque Housing, LLC is proposing to relocate the existing sanitary
sewer main to the common lot line between the two lots. The existing sanitary sewer to
be relocated is currently privately owned. The developer is proposing to design, to City
Standards, and construct a new sanitary sewer on the common lot line as described
above. Once the new sewer has been constructed and inspected by City Staff,
Dubuque Housing, LLC will dedicate the utility to the City for ownership and
maintenance. The City has required that plat of survey creating the two subject lots
included a dedication of an appropriate public sanitary sewer easement to
accommodate the relocated sewer main and provide rights for the City to own and
maintain the utility into the future. Per the attached Plat of Survey of Lot 1-2 and 2-2 of
Pizza Ranch Place, in the City of Dubuque, Iowa, recorded as instrument number 2024-
00004704 in the Dubuque County Recorder's Office, Radford Road Real Estate, LLC
has dedicated a Grant of Public Sanitary Sewer Easement through, over and across
Parts of Lots 1-2 and 2-2 of Pizza Ranch Place, in the City of Dubuque, Iowa

Lots 1-2 and 2-2 of Pizza Ranch Place, in the City of Dubuque, Iowa.
RECOMMENDATION
I recommend accepting the Grant of Public Sanitary Sewer Easement through, under
and across Parts of Lots 1-2 and 2-2 of Pizza Ranch Place, in the City of Dubuque,
Iowa as shown on the attached recorded Plat of Survey.
ACTION TO BE TAKEN
I respectfully request acceptance of the Grant of Public Sanitary Sewer Easement from

instrument number 2024-00004704 in the Dubuque County Recorder's Office, a Grant of
Public Sanitary Sewer Easement through, over and across Parts of Lots 1-2 and 2-2 of
Pizza Ranch Place, in the City of Dubuque, Iowa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the dedication of a Grant of Public Sanitary Sewer Easement

EASEMENT DEDICATION
The public sanitary sewer easement as stated and as shown on this plat is hereby dedicated to the City of Dubuque, and its agents
and contractors, for the purpose of constructing and maintaining said utility, along with the right privilege, and authority to construct,
reconstruct, maintain, operate, repair, patrol and remove said improvements. Said easement shall also include the right to cut,
trim, or remove trees, bushes, and roots as may be required. City shall restore the disturbed surface areas due to the construction
maintenance, or repair of said utility and appurtenances to equal conditions. Lot owners shall not erect or install any trees,
landscaping, paving or structure over or within the easement areas without obtaining the prior written approval of the City Engineer.
Lot owners shall not change the grade, elevation, and contour, or perform any construction or any excavation that will diminish the
lateral support or integrity of said utility improvements without obtaining the prior written consent of the City Engineer.
All public utility easements and storm drainage easements, except those labeled as private, as stated and as shown on this plat
are hereby dedicated to the Public. Lot owners shall not erect any structure, fence, planting or other obstructions over or within the
public utility or storm drainage easement areas without obtaining the prior written approval of the City Engineer. Lot owners shall
not change the grade elevation, and contour or perform any construction or any excavation that would hinder the orderly flow of
storm water runoff or diminish the lateral support or integrity of said utilities and improvements without obtaining the prior written
consent of the City Engineer.

I, Craig L. Geiser, a Duly licensed Land Surveyor in the State of Iowa, do hereby certify that the foWwing real estate was surveyed
and platted by me or under my direct personal supervision, To Wit:
Lot 2 of Pizza Ranch Place in the City of Dubuque, Iowa.
This survey was performed for the purpose of subdividing and platting said real estate henceforth to be known as
Lot 1-2 and 2-2 of Pizza Ranch Place in the City of Dubuque, Iowa.
Containing 4.35 acres, more or less, and subject to easements, reservations, restrictions, and rights -of -way of record and not of
record, the plat of which is attached hereto and made a part of this certificate.
EASEMENT DEDICATION
The public sanitary sewer easement as stated and as shown on this plat is hereby dedicated to the Dry of Dubuque, and its agents
and contractors, for the purpose of constructing and maintaining said utility, along with the right privilege, and authority to construct,
reconstruct, maintain, operate, repair, patrol and remove said improvements. Said easement shall also include the right to cut,
trim, or remove trees, bushes, and roots as may be required. City shall restore the disturbed surface areas due to the construction
maintenance, or repair of said utility and appurtenances to equal conditions. Lot owners shall not erect or install any trees,
landscaping, paving or structure over or within the easement areas without obtaining the prior written approval of the City Engineer.
Lot owners shall not change the grade, elevation, and contour, or perform any construction or any excavation that will diminish the
lateral support or integrity of said utility improvements without obtaining the prior written consent of the City Engineer.
All public utility easements and storm drainage easements, except those labeled as private, as stated and as shown on this plat
are hereby dedicated to the Public. Lot owners shall not erect any structure, fence, planting or other obstructions over or within the
public utility or storm drainage easement areas without obtaining the prior written approval of the City Engineer. Lot owners shall
not change the grade elevation, and contour or perform any construction or any excavation that would hinder the orderly flow of
storm water runoff or diminish the lateral support or integrity of said utilities and improvements without obtaining the prior written
consent of the City Engineer.
