Corporation et al., relative to the ur-
gent need of a re- valuation of the real
property in the city for the purpose
of taxation, presented and read.
Ald. Frith ,moved to suspend the
rules for the purpose of allowing any-
one in the room to address the Coun-
cil on the re- assessing of the city.
Carried by the following vote:

dressed the Council relative to re-
assessing the city.
Ald. Saul moved to refer the peti-

Ald. Saul moved to suspend the

Ald. Frith moved to refer bids for
improving West Locust Street to the
City Engineer, he to report later in
the evening. Carried.
Petition of F. G. Hohnecker, rela-
tive to improving Eagle Street from
Viola Street to Althauser Avenue,
presented and read. On motion of
Ald. Andresen petition was referred

winter, in the event of heavy snow,
said Union Electric Company, its suc-
cessors, or assigns, shall not obstruct
said streets by the removal of snow
from its tracks, but shall remove any
excess of snow which may be necessary
to render said street passable for vehi-
cles. Any excess of snow thrown from
said street railway tracks, and which
is not removed within ten hours there-
after, may be removed by the city at
the expense of said Union Electric
Company, its successors or assigns.
Section 9. The cars of said railway
shall begin running not later than six
A. M., and shall cease not earlier than
eleven thirty P. M., and shall run, in
each direction, at intervals of not
more than twenty minutes. Operation
on Sundays may begin one hour later.
Section 10. The provisions of an
ordinance passed by the City Council
of Dubuque March 6, 1902, approved
March 13, 1902, and accepted on said
March 13, 1902, are hereby applicable
to and a part of this ordinance so far
as the same are contained in the fol-
lowing sections of said ordinance, to-
wit. Section 4, relating to paving and
macadamizing; Section 12, relating to
other electric lines crossing or using
tracks; Section 13, relating to cars,
trailers, lights and crossings; Section
15, relating to poles and posts; Sec-
tion 17, relating to special assess-
ments; Section 18, relating to fares
and transfers; and Section 19, relat-
ing to transportation of policemen and
firemen.
Section 11. The new lines of rail-
way herein authorized to be construct-
ed, shall be completed and in opera-
tion within one year from the date of
the passage of this ordinance on such
streets as are now graded and im-
proved, and on those not. at present
graded and improved, within one year
from the time said streets are graded
and improved. If not so completed
and in operation, the City Council
may, at its option, declare a forfeiture
of all rights and privileges granted
said Union Electric Company under
this ordinance.
Said Union Electric Company, its
successors or assigns, shall maintain
and operate, in accordance with the
provisions of this franchise, such
lines as are provided for herein, and
shall operate same with adequate
equipment and provide adequate and
reasonable service on said lines; and
, said Union Electric Company, its suc-
cessors or assigns, shall not abandon
any part of said lines unless permitted
so to do by the City Council.
If said company shall abandon any
part of the lines herein provided for,
or shall fail to operate said lines in
accordance with this ordinance, the
City Council may, at its option, de-
clare a forfeiture of all rights and
privileges granted said Union Electric
Official Notices
Company under this ordinance. Pro-
vided, however, that failure to operate
because of strikes, fires, or other
causes beyond the control of said
company, shall not work such a for-
feiture.
Section 12. This ordinance shall
take effect and be in force on and af-
ter its passage and approval and ac-
ceptance in writing by the grantee, or
its assigns, and its publication in the
Telegraph - Herald and Times- Journal,
the official papers of the City of Du-
buque, provided that it receive a fav-
orable vote of a majority of the legal
electors of the City of Dubuque, Iowa,
voting on the question at the election
to be held for that purpose, and the
expense of such special election shall
be paid by the grantee or its assigns.
The question whether this franchise
shall be granted and the foregoing or-
dinance take effect shall be submitted
to the legal electors of the city of Du-
buque, Iowa, to be voted upon at a
special election to be held on the 22nd
ccay of April, A. D. 1913. At such
election on this question the form of
ballot shall be as follows, viz:

the right to erect, maintain and oper-
ate on the following named streets in
the City of Dubuque, viz: commencing
at the intersection of Thirteenth and
Main streets, thence west along the
center line of Thirteenth street to Lo-
cust street, thence north along the
center line of Locust street to Six-
teenth street, thence north and wes-
terly along the center line of West Lo-
cust street to Arch street. Thence
westerly along the center line of Arch
street to St. Ambrose street, thence
south along the center line of St. Am-
brose street to Asbury street, thence
southeasterly along the center line of
Asbury street to a connection with the
end of the present track now on Del-
hi street, a certain line of street rail-
way for the term of twenty -five years
as provided and on the terms and con-
ditions stated in the ordinance, a copy
of which is printed hereon.

rich to be present.
Petition of Thos. B. Spensley, et al.,
relative to improving Cherry Street
from Asbury Street westerly to the
City Limits, presented and read. On
motion of Ald. Wallis the prayer of
the petitioners was granted and
proper resolutions ordered to be
drawn up.
Ald. Saul moved to refer the divi-
sion of the grading fund to the Com-
mittee of the Whole. Carried.
Petition of C. Clemens, relative to
an erroneous assessment against Lot
67, in Stafford's Add., for the con-
struction of a sanitary sewer in Queen
Street, presented and read. On mo-
tion of Ald. Saul petition was re-
ferred to the Committee of the Whole.
Petition of the residents of Rhom-
berg Avenue, relative to oiling of the
street presented and read.
Ald. Frith moved to suspend the
rules for the purpose of hearing from
the people on Rhomberg Avenue.

Mr. Ruegnitz addressed the Coun-
cil relative to oiling Rhomberg Ave-
nue,
Ald. Frith moved to refer the peti-
tion of oiling Rhomberg Avenue to
the Committee of the Whole, and the
matter of sprinkling Rhomberg Ave-
nue be referred to the Sprinkling
Committee. Carried.
Petition of G. Jansen, et al., rela-
tive to establishing a grade upon and
along Lois Street and the alley first
east of Alpine Street, between Solon
Street and Langworthy Avenue, pre-
sented and read. On motion of Ald.
Saul the prayer of the petitioners
was granted and the City Engineer
be instructed to prepare profile show-
ing grade.
Petition of Mrs. Margaret Dawson,
relative to having her taxes on Lot
79, Union Add., canceled for the year
1912, presented and read. Aid. Frith
moved to refer petition to the De-
linquent Tax Committee.
Ald. Saul amended Ald. Frith's mo-
tion to grant the prayer of the peti-
tioner.

Factory, relative to a coal shed now
obstructing West Main Street near

of Police be instructed to have said
shed removed.
Notice of suit of B. Glass for $3,000
against the City of Dubuque present-
ed and read. On motion of Ald. Mc-
Laughlin notice was referred to the
City Attorney.
Notice of suit of C. W. Nowlin for
$3,000 against the City of Dubuque
presented and read. On motion of
Ald. Andresen notice was referred to
the City Attorney.
Notice of suit of N. J. Loes against
the City of Dubuque presented and
read. On motion of Ald. Wallis no-
tice was referred to the Committee of
the Whole and City Attorney.
The petitions of Emil Lorenz and
M, B. Park, retail liquor dealers,
asking that the Council adopt resolu-
tions for consent to sell and keep for
sale intoxicating liquors, presented
and read. On motion of Ald. Singrin
the prayer of the petitioners was
granted.
Be it Resolved by the City Council
of the City of Dubuque, Iowa, That
consent is hereby given Emil Lorenz
to sell and keep for sale intoxicating
liquors and deal therein in the City
of Dubuque, Iowa, as provided by
law. This Resolution of Consent is
given in renewal of the Resolution of
Consent heretofore adopted and now
in force, consenting to the sale of in-
toxicating liquors in the City of Du-
buque, Iowa, by Charles F. Hoefflin,
and the renewal to Emil Lorenz shall
be in force and effect on and after
April 3, 1913, as provided by law.

Guire, to sell and keep for sale intoxi-
cating liquors and deal therein in the
City of Dubuque, Iowa, as provided
by law. This resolution of Consent
is given in renewal of the Reso-
tion of Consent heretofore adopt-
ed and now in force consent-
ing to the sale of intoxicating
liquors in the City of Dubuque, Iowa,
by Geo. B. MdGuire, and the re-
newal to M, B. Park shall be in force
and effect on and after the 3rd day of
April, 1913, as provided by law.

Gentlemen: Your Committee on
Claims and City Attorney respectfully
report that there is pending in the
District Court of Dubuque County an
action entitled Margaret Hahn, as ad-
ministratrix of estate of Emma Hahn,
deceased, versus City of Dubuque, be-
ing Law No. 17,213, which is an action
brought to recover damages for per-
sonal injuries sustained by plaintiff's
decedent, Emma Hahn, in the sum of
$10,000, plaintiff alleging that on the
31st day of December, 1911, Emma
Hahn, while walking on the sidewalk
on the west side of Main Street, at a
point in front of the southerly 34 feet
of the south 1 -5 of Lot 469, being at
the northwest corner of Main and
Thirteenth Streets, said Emma Hahn
fell, by reason of the condition- of the
sidewalk at said place, and fractured
her right hip at the hip joint, and
that as a result thereof said Emma
Hahn died on or about the 27th day
of February, 1912.
That the plaintiff, through her at-
torneys, have offered to compromise
said action for the sum of $275. That
in the judgment of this committee it
is to the best interests of the City
that said offer of compromise be ac-
cepted, and we would therefore rec-
ommend that the .Aty Attorney be
authorized to settle and adjust said
action on that basis and that a war-
rant be ordered drawn in favor of
the Mayor for such sum.

17,208 Law, asking $20,000 all of said
actions being brought to recover dam-
ages for injuries sustained by the re-
spective parties in an accident that
occurred on West Locust Street, on
the 14th day of November, 1911, as a
result of a carriage in which the
plaintiffs were riding being over-
turned by coming in contact with a
pile of earth and rocks in the high-
way, and not protected by the proper
signal lights. The obstruction was
permitted to remain in this condition
by the contractor, T. J Hassett, who
was at the time constructing a sani-
tary sewer upon and along said street.
The attorneys representing the
plaintiffs in said actions have offered
to receive in full settlement of all of
said actions the sum of twelve hun-
dred and fifty dollars ($1250). That
the attorney representing the con-
tractor, Hassett, who was notified by
the City to appear and defend in said
actions, has agreed to a settlement
upon that basis, and further agrees
to contribute the sum of $750 to-
wards the payment of such sum, pro-
vided the City will pay the remain-
ing five hundred dollars thereof.
There is one other action pending
in the District Court arising out of
the same accident, which action is
now pending upon a motion for a
new trial, the case having been tried,
and the verdict being rendered in fa-
vor of the City, being the case of
George W. Raine versus the City.
Your committee would therefore
recommend that the three cases first
above mentioned be settled for the
sum of twelve hundred and fifty dol-
lars, and further recommend that the
City pay towards such settlement the
sum of five hundred dollars. such
sum, however, to be paid in the man-
ner hereinafter suggested.
The City is now owing said T. J.
Hassett several thousand dollars for
work performed by him under con-
tract, and we recommend that the
amount of the settlement above pro -
vided for be paid out of the sum due
said Hassett, and after deducting such
sum of $1250, that the balance then
remaining due said Hassett upon his
contract for the sewer on West Lo-
cust Street and Mt. Pleasant Avenue
be then paid to him, and after the
final disposition of the case of George
W. Raine versus the City, if finally
disposed of without further expense
to the City, that City the pay to said
Hassett the sum of five hundred dol-
lars, the amount to be contributed by
the City towards the settlement above
provided for, it being understood that
we only recommend that the City
contribute the sum of $500 towards
the settlement of the four cases here -
inbefore mentioned, and we further
recommend that a warrant in the
sum of $1250 be ordered drawn in fa-
vor of the Mayor to cover such set-
tlement, said warrant to be ordered
drawn on the funds in the hands of
the City owing and due said T. J.
Hassett and a further warrant be or-
dered drawn in favor of T. J. Hassett
for such sum as may be found due
him under said contract for said
sewer on West Locust Street and Mt.
Pleasant Avenue, after deducting said
sum of twelve hundred and fifty dol-
lars.

We consider the proposition of Mr.
Jaeggi as being very fair and would
recommend that the same be ac-
cepted. Those of Messrs. Steiner and
Wanderscheid we deem rather too
high and would, therefore, respectful-
ly, recommend that a jury be put on
to appraise the damage to the prop-

with brick blocks on a concrete base
with sand filler, and to assess the cost
of said brick paving, base and filler
against the abutting property.

cost of such improvement, and the
amount assessable upon any railway
-or street railway company, the
amount and cost thereof, to be paid
by the city, if any, and the cost there-
of and amount assessable upon each
lot or parcel of land adjacent to or
abutting upon such improvement per
front foot, and to file such plat and
estimate in the office of the City Re-
-corder; that after the filing of said
plat and estimate in his office, the
City Recorder shall publish in three
consecutive issues of a newspa - 9er
published in this city, a notice stating
that such plat and estimates are on

Whereas, a proposition has been
made by the owner of Lots 1 and 2
of 11, Wullweber's Sub., agreeing to
take $1,250.00 for the land necessary
for such proposed opening over his
said lots, which proposition has been
accepted by the City Council, and
Whereas, The owners of Lots 4 and
5 in said W'ullweber's Sub., are ask-
ing a price for the land that will be
required from them for such propos-
ed opening that is, in the opinion of
the City Council. in excess of the
value thereof, and it accordingly be-
comes necessary to condemn the
same, therefore
Be it Resolved by the City Council
of the City of Dubuque, Iowa, That
the City Engineer be and he is here-
by directed to make a survey and plat

John W. Lawlor be appointed Re-

of the meeting was to take action on
the petition of John Krayer, asking
that the permit heretofore granted
Frank Krayer to sell and keep for
sale intoxicating liquors and deal
therein in the City of Dubuque, be
transferred to him as the purchaser,
successor and assignee of said Frank
Krayer.

Gentlemen: The undersigned John.
J. Krayer respectfully states that he is
- a qualified elector of the City of Du-
buque, Dubuque County, Iowa. That
he is the purchaser, successor and as-
signee of the saloon business of Frank
Krayer, which said Frank Krayer
was engaged in the business of sell-
ing and keeping for sale of intoxicat-
ing liquors within the City of Du-
buoue. Dubuque county, Iowa, under
proper resolution of consent hereto-
fore granted by your Honorable Body,
which said business was conducted by
said Frank Krayer at Southern Hotel
in said City. Your petitioner shows
that as such purchaser, successor and
assignee to the business of said Frank

second street from the easterly prop-
erty line of Couler Avenue to the
westerly rail of the Chicago Great
Western Railway track be improved
by grading to sub - grade, curbing or
resetting curb where necessary, and
paving said portion of said street with
brick blocks on a macadam , foundation
with sand cushion and asphalt filler,
in accordance with the plans and spe-
cifications for such improvement pre-
pared by the City Engineer and now
on file in the office of the City. Re-
corder, and be it further
Resolved, that said improvement
shall be completed on or before the 1st
day of August, 1913, and shall be paid
for in the manner prescribed by Chap-
ter XXXII. of the Revised Ordinance
of' the City of Dubuque for the pay -
ment of the cost of street improve-
ments.
The proposals for doing said work
shall be acted upon by the Council on
the, 1st day of. May, 1913, and. the City
Recorder is hereby ordered to give ten
days' notice by publication asking for
proposals as provided by ordinance.

Mayor Lyons stated this meeting is
called for the purpose of canvassing
the vote for the Special Election for
the extension of the West Locust
street car line, and making provisions
for the purchasing of property neces-
sary for the opening of street from
Alpine street to Alta Vista street and
any other business that might come
before a regular meeting of the City
Council.
Ald. Singrin moved that the Coun-
cil proceed to canvass the vote of the
Special Election held April 22, 1913.
Carried.

AN ORDINANCE GRANTING THE
UNION ELECTRIC COMPANY, A
CORPORATION OF DUBUQUE,
IOWA, ITS SUCCESSORS AND AS-
SIGNS, THE RIGHT TO ERECT,
MAINTAIN AND OPERATE A
CERTAIN LINE OF E I'REET
RAILWAY TO CONNECT WITH
ITS PRESENT LINES, SUCH LINE
TO BE CONSTRUCTED, MAIN-
TAINED AND OPERATED UPON
THE STREETS OF THE CITY OF
DUBUQUE, IOWA, HEREIN-
AFTER SET OUT AND PROVID-
ING FOR SUBMISSION OF SAME
TO THE VOTE OF THE ELECT-
ORS OF SAID CITY.
Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That there is hereby grant-
ed to the Union Electric Company, a
corporation organized under the laws
of the state of Iowa, its successors and
assigns, for the term of twenty -five
years from the adoption hereof and its
acceptance by said company, the right
and authority to lay a single or double
track for street railway purposes, with
the necessary switches and turn -outs,
hereinafter to be determined and
agreed upon, along and the fol-
lowing streets, to -wit: Commencing
at the intersection of Thirteenth and
Main streets, thence west along the
center line of Thirteenth street to Lo-
cust street, thence north along the
center line of Locust street to Six-
teenth street, thence north and west-
erly along the center line of West
Locust street to Arch street, thence
westerly along the center line of Arch
street to St. Ambrose street, thence
south along the center line of St. Am-
brose street to Asbury street, thence
southeasterly along the center line of
Asbury street to a connection with the
end of the present track now on Delhi
street, with the right to operate cars
thereon, subject to and in accordance
with the following restrictions and
conditions.
Section 2. For the purpose of con-
structing and maintaining and oper-
ating said street railway line, said
Union Electric Company, its succcess-
ors and assigns, shall have the right
and authority to go upon said streets
and parts of streets and make such
excavations therein as may be neces-
sary for the construction, completion,
operation and maintenance of said
railway line, and shall have the fur -'
ther right and authority to make track
and overhead wire connections at in-
tersections and with car barns and
power house, and to construct all
necessary side- tracks, turn -outs and
switches, and shall also have the right
to erect, construct and maintain such
overhead wires and poles as may be-
necessary to conduct electrical power
over said wires from the power station
to and along said line of railway.
Section 3. maid Union Electric
Company shall, after making such ex-
cavations in said streets as may be-
necessary for the proper construction
of said track and within a reasonable
time, restore and leave them in as
good condition as they were when
such work was begun, and shall re-
move any refuse, debris, or other en-
cumbrance resulting from said work.
Said company shall also repair all
damages which may be done to said
streets by the construction or main-
tenance of said track during the life
of the franchise hereby granted.
Before commencing any construc-
tion or repairs under authority of Sec-
tion 2, or this section, which may in
any -way affect the streets, alleys or
public places of the city, said Union
Electric Company, its successors and
assigns shall in writing apply to the
Mayor of the city, stating the nature
of the work, the time and place where
the same is proposed to be done, and
thereupon the Mayor shall permit or
refuse to permit the work to be done
by issuing . a written statement of his
decision to the said Union Electric
Company, its successors or assigns.
Section 4. The said street railway
line shall be constructed upon the es-
tablished grade of the .streets which
are now improved, and upon the
grades which shall be established
when the streets at present unim-
proved shall be improved by the City
of Dubuque, such improvement to be
complete before said track shall be
constructed thereon. The tracks, poles
and other structures shall be raised or
lowered from time to time without ex-
pense to the city to correspond with
changes that may be made in the
grade of said streets. The gauge of
said railway track shall be that known
as the standard guage. to -wit: four
feet, eight and one -half inches, and
the center line of the space between
the tracks or rails of said line shall
coincide as nearly as practicable with
the center line of said streets and
parts of streets whereon said track
or tracks are located.
Section 5. Said Union Electric
Company, its successors or assigns,
shall repair all damages that may be
done to said streets by the construc-
tion or maintenance of said railway,
shall also keep the space between
said railway tracks and one foot on
each side thereof, in good repair at
all times, provided that in the case
of double track, when the distance
between the centers of said track is
more than ten feet, the rule requiring
a foot on each side shall prevail. The
Official-Notices
City Council shall have the right to
determine the necessity for repairs,
and whenever said company, its suc-
cessors or assigns, shall refuse or ne-
glect to make the same within a rea-
sonable time after being notified
thereof in writing, the City Council
shall have the right to make such
repairs at the expense of said Union
Electric Company, its successors or
assigns.
Section 6. Said Union Electric
Company, its successors or assigns,
shall, whenever practicable, have the
right to use any telephone, telegraph
or fire alarm poles or posts owned or
controlled by the city, now set or
which may herafter be set along the
line of the track for which franchise
is hereby granted. And, whenever
practicable, the city shall have the
right to use any poles or posts which
may be set by said company along
said line, when the posts and wires
put thereon are used solely for the
benefit and use of the said City of
Dubuque; in either case there shall be
ii-o compensation for such use.
Section 7. Said Union Electric
Company, its successors or assigns,
shall be liable to any person injured
by reason of its negligence in the con-
traction, maintenance or operation of
said street railway, and should any
action be commenced or prosecuted
against the City of Dubuque, upon
any claim for damages based upon
any act or negligence of said com-
pany, said Union Electric Company,
its successors or assigns, shall upon
being notified of such suit, defend the
same; and should any judgment be
rendered against the city in any such
action, said company shall fully pay
and fully discharge the same.
Section 8. The tracks of said rail-
way shall not be elevated above the
surface of the street, and shall be so
laid that carriages and vehicles can
easily, and with the least obstruction
possible, cross the same. During the
winter, in the event of heavy snow,
said Union Electric Company, its suc-
cessors, or assigns, shall not obstruct
said streets by the removal of snow
from its tracks, but shall remove any
excess of snow which may be necessary
to render said street passable for vehi-
cles. Any excess of snow thrown from
said street railway tracks, and which
is not removed within ten hours there-
after, may - be removed by the city at
the expense of said Union Electric
Company, its successors or assigns.
Section 9. The cars of said railway
shall begin running not later than six
A. M., and shall cease not earlier than
eleven thirty P. M., and shall run, in
each direction, at intervals of not
more than twenty minutes. Operation
on Sundays may begin one hour later.
Section 10. The provisions of an
ordinance passed by the City Council

of Dubuque March 6, 1902, approved
March 13, 1902, and accepted on said
March 13, 1902, are hereby applicable
to and a part of this ordinance so far
as the same are contained in the fol-
lowing sections of said ordinance, to-
wit. Section 4, relating to paving and
macadamizing; Section 12, relating to
other electric lines crossing or using
tracks; Section 13, relating to cars,
trailers, lights and crossings; Section
15, relating to poles and posts; Sec-
tion 17, relating to special assess-
month; Section 18, relating to fares
and transfers; and Section 19, relat-
ing to transportation of policemen and
firemen.
Section 11. The new lines of rail-
way herein authorized to be construct-
ed, shall be completed and in opera-
tion within one year from the date of
the passage of this ordinance on such
streets as are now graded and im-
proved, and on those not at present
graded and improved, within one year
from the time said streets are graded
and improved. If _ not so completed
and in operation, the City Council
may, at its option, declare a forfeiture
of all rights and privileges granted
said Union Electric Company under
this ordinance.
Said Union Electric Company, its
successors or assigns, shall maintain
and operate, in accordance with the
provisions of this franchise, such
lines as are provided for herein, and
shall operate same with adequate
equipment and provide adequate and
reasonable service on said lines; and
said Union Electric Company, its suc-
cessors or assigns, shall not abandon
any part of said lines unless permitted
so to do by the City Council.
If said company shall abandon any
part of the lines herein provided for,
or shall fail to operate said lines in
accordance with this ordinance, the
City Council may, at its option, de-
clare a forfeiture of all rights and
privileges granted said Union Electric
Company under this ordinance. Pro-
vided. however, that failure to operate
because of strikes, fires, or other
causes beyond the control of said
company, shall not work such a for-
feiture.
Section 12. This ordinance shall
take effect and be in force on and af-
ter its passage and approval and ac-
ceptance in writing by the grantee, or
its assigns, and its publication in the
Telegraph- Herald and Times- Journal,
the official papers of the City of Du-
buque, provided that it receive a fav-
orable vote of a majority of the legal
electors of the City of Dubuque, Iowa,
voting on the question at the election
to be held for that purpose, and the
expense of such special election shall
be paid by the grantee or Its assigns.
The question whether this franchise
shall be granted and the foregoing or-

dinance take effect shall be submitted
to the legal electors of the city of Du-
buque, Iowa, to be voted upon at a
special election to be held on the 22nd
day of April, A. D. 1913. At such
election on this question the form of

AN ORDINANCE for the vacation of

owners and ten days' notice of said
proposed vacation has been publish-
ed in the official papers of the city
and the proposed action has been
submitted to the City Council at two

AND WHEREAS,- it appears that
there is no objection on the part of
any one interested in the property
benefited by said streets to the grant-
ing of said petition,
AND WHEREAS, it appears that
the vacation of said streets will be of
great commercial advantage to the
City of Dubuque, and there appears
no valid objection to said vacation
and granting the use of land 5o va-
cated to the owners of the abutting
property on said streets;

By the City Council of the City of
Dubuque: -
Section 1. That all of Fourth

be and the same is hereby vacated
and the use thereof granted to the
Fischer Investment ' Company and
Fischer & Company, Incorporated,
being the abutters on said streets and
parts of streets so vacated for use in
connection with the ice, fuel and
.storage business subject to the con-
ditions hereinafter named, provided
that if at any time the said Fischer
Investment Company and Fischer &
, Company, Incorporated, or either, or
both of said companies, their suc-
- cessors or assigns or lessees, shall
cease to use said property for the
.conduct of said business or for manu-

COLLECTION AND REMOVAL.
Section 10 of the Ordinance for car-
rying into effect certain rules, regula-
tions and provisions of the Board of
Width of the City of Dubuque, Iowa,
and providing a penalty for the viola-
tion thereof, provides as follows:
"Householders, owners, lessors, les-
sees, managers and agents of any
building or tenement, restaurant or
lintel within the City of Dubuque,
where slops, kitchen offal or decaying
vegetables accumulate, shall provide,
keep and cause to'be used an iron can
with tight cover or other proper re-
ceptacle for such waste iii a conven-
ient place for removal at least twice a
week between the 1st day of May and
the 1st day of November of each
year from premises designated by the
City Council as the scavenger district,
the collecting thereof to be done by
the City Scavenger."
The penalty for violating the provis-
ions of the above section shall be a
fine not exceeding One_Hundred Dol-
lars, or imprisonment in the city jail
until such fine is paid, not exceeding

Notice to Sewer Contractors.
Sealed proposao, will be received at
the Council Chamber, City, Hall,
until 8:00 p. m. Thursday, April 17th,
1913, for the reconstruction of a 10-
inch tile pipe f•anitary Sewer in the
alley between Main and Locust streets
from First street to Eighth street, in
accordance with the plans and speci-
fications prepared by the City Engi-
neer and now on file in the office of
the City Recorder.
It is estimated by the City Engineer
that it will require:
2,200 lineal feet of 10 -inch tile pipe.
13 manholes:
60 connections to be retapped into
new sewer.
The work to be paid for when said
work is completed and as prescribed
by Chapter XXX V . of the Revised Or-
dinances of 1901 of the City of Du-
buque. Work to be completed on or
before the 15th day of June, 1913.

Section 1. That a grade on the
Angella Street switchback be and the
same is hereby established and
adopted as shown by the profile of
said street and grade prepared by the

entitled An Ordinance for the vaca-
tion of all of Fourth street from the
easterly line of Bell street to the levee,
and all of Fifth Street from the west
erly line of Tower Street, and all
of Tower Street from the northerly
line of alley in Block K in Booth's
Addition, northerly to a point forty
feet southerly from the northerly line
extended of Lot Five in Block 0 in
said Booth's Addition in the City of
Dubuque.
Be it Ordained by the City Council
of the City of Dubuque:
That the Ordinance adopted by the
City Council, of date March 20, 1913,

for the removal of garbage and dead
animals for the season of 1913 -1914,
in the City of Dubuque, as per speci-
fications on file in said office. Garb-
age to be disposed of outside of the
City Limits. Separate bids to be re-
ceived for one year and for five years.
Wagons for conveying garbage to be
non - leakable and equipped with cov-
er. Bids to be accompanied by a
certified check of $250.00 on some
Dubuque bank that a contract will be
entered into if awarded. A surety
bond of $1,000.00 for fulfillment of
contract is demanded from the suc-

Works Bonds Numbered Three
Hundred and One to Three Hun-
dred and Thirty -Five, Both In-
clusive.
The Board of Water Works Trus-
tees has directed that Dubuque Water
Works bonds, numbered from Three
Hundred and One (301) to Three
Hundred and Thirty -Five (335), both
inclusive, dated June 1st, 1900, be re-
deemed in accordance with the ordi-
nance and contract entered into by
the City of Dubuque and the holders
of said bonds.
The above bonds should be present-
ed at the City Treasurers office, Du-
buque, Iowa, on the first day of
June, 1913, for payment. All inter-
est ceases on above bonds June 1st,
