McLaughlin moved that Eu- gene Adams be added to the Com- mittee and that the report of. the Mayor be approved. Carried. To the Honorable Mayor and City Council of the City of Dubuque. Gentlemen: In the matter of the levy of a special assessment against the Chicago Great Western Railroad Company for the improvement of Elm Street, I find from the facts as re- ported by the City Engineer, that the macadamized portion of the street in question does not extend beyond a foot outside the rails of said Com- , pany; the Company would be assess- able for any paving between the rails :and for a foot outside the rails, but if the paving in question does not cover this space no assessment can be levied. Code, Sec.. 968, provides for the as- sessment of the easement or right of 181 way (which assessment probably may in no event exceed special benefits con- ferred), but under the definition and limitation contained in said section i do not believe the action would be held to give power of assessment for a mere franchise over a street. This statute has not yet been passed ai pon by our Supreme Court, but the rule above set out seems to be the general holding in other states where the question has arisen. Respectfully submitted. E. H. WILLGING, Assistant City Attorney. Ald. Frith moved that the report of the Assistant City Attorney be an- proved. Carried.
