J. Schill- ing et al. Ald. Frith moved to sus- pend the rules for the purpose 'of al- lowing the 'interested parties to ad- dress the council. Carried by the following vote: • Yeas —Aids. A. Putnam et al. On motion of Ald. - Wallis the notice and remonstrance were received and filed. Petition of T. J. Conlin relative to the assessment levied against his property for the improving of West Eleventh Street presented and read. On motion of Ald. Wallis the peti- tian was referred to the Committee of the Whole. Petition of C. H. Reynolds, Agent, relative to being granted permission to erect an ash receptacle in the rear of the Model Wall Paper Co. presented and read. On motion of Ald. Saul the petition was referred to the Committee of the Whole to view the grounds. Petition of Chris. Capretz relative to changing' the arc lamp from Lin - coln' Avenue east of the railroad tracks to the corner of Lincoln Avenue and Lime Street presented and read. Ald. Frith moved that the petition be referred to the Committee of the Whole. Carried. Ald. Frith moved that the council advertise for bids for gas lights where needed. Ald. Andresen amended Ald. Frith's motion to refer the matter of gas lighting to the Committee of the Whole and notify the representative of the Gas company to be present. Carried. Petition of J. C. Erpelding relative to being granted permission to the re- moval of his saloon businless from 1420 Clay Street to the northeast corner of 14th and Clay Street presented and, read. On motion of 'Ald. Singrin the prayer of the petitioner was granted. Petition of J. Diebold relative to the damages caused by blasting by the C. B. Wallis the prayer of the petitioner was granted and the City Auditor instructed accordingly. Petition of Mrs. Mary Bisanz rela- tive to the canceling of her taxes on the north 1 -2 of Lot 2 in Myrtle Add. presented and read. On motion of Ald. Frith the petition was referred to the Delinquent Tax Committee. Petition of the Sterilization Co. of Newark, N. J., relative to the disposal of the sewerage of City presented and read. On motion of Ald. McLaughlin the petition was referred to the Com- mittee of the Whole. Ald. McLaughlin moved that Dr. Kennedy be instructed to notify the S. P. Wadley & Co. to discontinue hauling their refuse to the dump and dispose of their refuse. Carried. Petition of the sewer men relative to an increase in salary presented and read. On motion of Ald. Saul the pe- tition was referred to the Committee of the Whole. Petition of F. Coates relative to the improving of 14th Street in front of his property presented and read. On motion of Ald. Frith the petition was referred to the Committee of the Whole to view the grog ds, Petition of Mar R. Lucas relative to having her assessment placed on, City Lot 566 and 10 feet of Lot 567 placed at $4,000.00 presented and read. On motion of Ald. Frith the petition, was referred to the Board of Equaliza- tion. Petition of E. B. Lyons, secretary of the Vestry, St. John's P. E. church, relative to damages caused by the steam roller to the curbing and fence around the Rectory of St. Jonn's Epis- copal church presented and read. On motion of Ald. Frith the petition wa; referred to the Street Commissioner to have necessary repairs made. Petition of the property owners in the block which I. C. Chamberlain wishes to build a garage consenting to the erection of same presented and read. On motion of Ald. Wallis the petition was made a matter of record. On motion of Ald. Frith the follow- ing hills were ordered paid and the amount deducted from the bill of F. Scharle: W. Maher, $7.80; W. Engels, $27.30; T. Bannon, $14.10. To the Honorable Mayor and City Council. McLaughlin moved to refer to the Committee of the Whole the Or- dinance establishing a grade on Edina Street from Alta Vista Street to the alley first west thereof. Carried. Ald. McLaughlin offered the follow- ing: AN ORDINANCE GRANTING PER - MISSION TO CONSTRUCT A SAN- ITARY SEWER IN DELHI STREET WEST FROM MANHOLE IN CEN- TER' OF LOUISA STREET, A DIS- TANCE OF 120 FEET AND GOV- ERNING CONNECTIONS THERE - WITH. Be It Ordained by the City Council of the City of Dubuque: Section 1. That permission be and the same is hereby given to John Schromen to construct at his own ex- pense a six -inch tile pipe sanitary sewer in Delhi Street in the City of Dubuque, from the manhole in the center of Louisa Street westerly a dis- tance of not to exceed one hundred and twenty (120) feet. ' Section 2. The laying of said sewer shall be under the supervision of the City Engineer and Street Commission- er and in accordance with plans and specifications furnished by City En- gineer. Section 3. The said John Schromen shall agree by the written acceptance of the terms of this 'Ordinance to keep the street properly guarded dur- 396 Regular Session, Oct. 2, 1913 rug the construction of such sewer; to guard against any accident or damage to which the city might he subject by reason of such work; and further, that he will keep said street where such sewer is constructed in proper condi- tion for travel for a period of at least one year from the completion of the work and the permission hereby grant- ed is condition on his furnishing a bond to be approved by the City At- torney, for the faithful executicn of the conditions contained herein, and the said bond shall be in the sum of $ Section 4. Any person desiring to make connection with said sewer, with- in the distance specified by law gov- Erning connections with municipal sewers, may do so by making written application to the City 'Engineer fo1 permission to make such connection, which permission shall in all cases be granted by the City Council under proper conditions governing the same, and by depositing with the City Treas- urer for the .benefit of the said John Schromen, his heirs or assigns, a sum which in the opinion of the City Coun- cil shall he sufficient to compensate the said John Schromen, his heirs or assigns according to the special ben- efits which the party making such connection shall obtain from the use of such sewer, it being understood that the sewer built by said John Schromen shall cost sot to exceed seventy cents (70c) per lineal foot. G entlemen: The undersigned re- spectfully report that they have ex- amined into the facts covering the fol- lowing named cases and make recom- mendations for settlement therein: Claim of Miss Kate Miller for in- jury on a sidewalk located at the southwest corner of 10th and Main Streets on or about June 14th, 1913, resulting in a severe injury to the ankle incapacitating her from work up to the present time. She asks for two hundred dollars to cover actual expense incurred and we recommend settlement in full in the sum of Ono Hundred and Fifty dollars. The claim of Mrs. Eliza Osborn for cxuense incurred in medical treatment for an injury resulting in a broken femur bone as a consequence of a fall on Hall Street on or about the 31st day of January, 1913. In this case a total expense of doctor and hospital was asked in the sum of $444.80. We recommend settlement in full as fol- lows: For hospital bill, $56.80; for doctor bill, $75.00, and ambulance charge $6.00, or $167.80. Sept. 29, 1913. Respectfully submitted, JAS. SAUL, WM. P. Ald. Frith moved that the matter of purchasing hose for the Fire De- partment be left in the hands of the Fire Committee with power. Carried. Ald. Wallis moved that the Com- mittee on Fire and the Fire Chief in- spect all hotels in reference to fire protection. Carried. Ald. Wallis moved that the Commit- tee on Harbors he given power to ex- pend for the building of a barge for landing purposes in the harbor an ad- ditional $500.00. Ald. Frith amended Ald. Mayor Lyons stated that this meeting is called for the purpose of receiving bids for the sanitary sewer in the alley between Peru Road and Jackson Street, also for the levying of the Special Assessment to pay for the sanitary sewer in Lincoln Avenue from Middle Avenue to Dock Avenue and any other business that may properly come before a regular meeting of the City Council. Ald. Andresen moved to open the bids. Carried. BIDS. Bids for the sanitary sewer in the -alley between Peru Road and Jackson Street. Bid of G. L. Frith the bill was ordered paid and the sum of $13.40 deducted from the warrant of F. Scharle. Bill of F. Scharle 2nd estimate for $62.60 on the retaining wall on Semi- nary Street to pay the laborers' bills filed with the City, presented and read. On motion of Aid. Frith the bill was ordered paid and a warrant in the sum of $62.60 was ordered drawn to pay the bill and the City Auditor in- structed to deduct the same from the money due F. Scharle. To the Honorable City Council of the City of Dubuque, Iowa: Gentlemen: The undersigned, Du- buque Hotel Company, presents here- with the plans of the proposed new hotel building to be constructed on lots numbers five (5), six (6), and seven (7), one hundred ninety -six -a (196a), one hundred ninety -six (196) and the south twenty -one (21) feet in width of lot one hundred ninety -five (195) all in the City of Dubuque, Iowa. which is the site of the Hotel Julien. recently destroyed by fire, with some additional ground, and asks that said plans be approved and proper permit for said building issued; also that permission be given to excavate and use the space under the sidewalk on Main Street abutting said lots five (5), six (6) and seven (7) as shown on said plans; also further, that per- mission be given to excavate and use the space under the sidewalk on Sec- ond Street abutting said lot five (5) for a distance from Main Street east- erly of about forty (40) feet; also that permission be given to use the strip in the alley in the rear of said lot six (6) about six (6) feet wide easterly and westerly and about twenty -two (22) feet long northerly and southerly for the purpose of con- structing an area way from the ban- quet room exit as shown on the plans of said Hotel, and of providing suitable guard rails therefor. To the Honorable City Council of the City of Dubuque, Iowa: Gentlemen: The undersigned, Du. buque Hotel Company, 'is desirous of erecting a large hotel building, which will occupy the site of the former Hotel Julien at the northeast corner or Main and Second Streets in the City of Dubuque and some adjoining terri- tory. The Hotel Julien was built over the alley separating lot 6 from 196, the structure over the alley being carried •on an arch, and this was done under an ordinance of the City Council of this city passed August 7, 1873, which gave authority to William W. Wood- Special Session, Oct. 29, 1913 411 worth, his heirs and assigns, to con- struct such arch for a distance of 60 feet north from the north line of Sec- ond Street, the arch to be not less than 11 feet in height from the grade of the alley to the under - side of the crown of the arch. In the building which this company proposes to erect it is desired to have said arch extend about 6 feet further north than the old arch and we find that it can t e constructed to give 'a height of 11 feet, 6 inches from the grade of the alley to the under side of the crown of the arch, teing 6 inches higher than that provided in the 'old ordinance. This company has acquired all of said land formerly held by 'said Woodworth and his rights under said ordinance, but inasmuch as it is 'de- sired to carry the arch 6 feet further north than was granted by the did ordinance atove referred to, respect- fully requests you to adopt a new ordinance granting that right. A form for such 'proposed ordinance is herewith submitted and 'we re- spectfully ask you to adopt said ordi• nance. City Engineer Daniels presented plats showing the subdivision of lot 33 of Mt. Pleasant Addition, and of Lot 9 of Marsh's Dubuque No. 2, and part of North Booth Street. On mo- tion of Ald. Wallis the plats were ap- proved and the Mayor and City Re- 412 Special Session, Oct. 29, 1913 Woodworth did construct an arch as contemplated by said ordinance and the same became and was a part of the hotel building subsequently known as the Hotel Julien, and same was continued and maintained until said building was recently destroyed by fire and the Dubuque Hotel Company have acquired said property and are about to construct a nuiei nuilding, occupying the property used by said Hotel Julien and other adjacent prop- erty, and desires to have the arch over said alley extend about 6 feet further north than the arch so previ- ously constructed and maintained and is willing further to raise said arch 6 inches higher than stated in the said ordinance granted to said Wil- liam, W. Woodworth as aforesaid. Nov, therefore, be it ordained by the City Council of the City of Du- buque: Section 1. That the Dubuque Hotel Company, its successors and assigns, are hereby authorized to build and perpetually maintain an arch over the alley between Main and Iowa Streets separating said lots 5 and 6 from city lots 196 and 195 for a dis- tance of 66 feet north from the north line of Second Street; the said arch not to be less than 11 feet, 6 inches in height from the grade of the alley to the under side of the crown of the arch on condition that said Dubuque Hotel Company, its successors and assigns, shall ever hereafter hold said city harmless from all damages that may arise or be incurred by reason of the grant of the privileges hereby made. Section 2. This ordinance shall take effect and be in force from and after its passage and publication one time in the Telegraph-Herald and the Times - Journal, official newspapers of said city. AN ORDINANCE GRANTING UNTO DUBUQUE HOTEL COMPANY, ITS SUCCESSORS- AND ASSIGNS, THE RIGHT TO ERECT AND MAINTAIN AN ARCH OVER A PORTION OF THE ALLEY BE- TWEEN MAIN AND IOWA STREETS IN THE CITY OF DU- BUQUE. Whereas, by an ordinance of this city adopted August 7, 1873, and ap- pearing at page 55 of the printed copy of the second revision of ordi- nances passed by the City Council of the City of Dubuque subsequent to Revised Ordinances of 1869 authority • was granted to William W. Wood- worth, his heirs and assigns, to build and perpetually maintain an arch over the alley between Main and Iowa Streets separating city lots 5 and 196 for a distance of 60 feet north from the north line of Second Street, the said arch not to be less than 11 feet in height from the grade of the alley to the under side of the crown of the arch, and Whereas, the said William W. Woodworth did construct an arch as contemplated by said ordinance and the same became and was a part of the hotel building subsequently known as the Hotel Julien, and same was continued and maintained until said building was recently destroyed by fire and the Dubuque Hotel Company have acquired said property and are about to construct a note' building, occupying the property used by said Hotel Julien and other adjacent prop- erty, and desires to have the arch over said alley extend about 6 feet further north than the arch so previ- ously constructed and maintained and is willing further to raise said arch 6 inches higher than stated in the said ordinance granted to said Wil- liam W. Woodworth as aforesaid. Now, therefore, be it ordained by the City Council of the City of Du- buque: Section 1. That the Dubuque Hotel Company, its successors and assigns, are hereby authorized to build and perpetually maintain an arch over the alley between Main and Iowa Streets separating said lots 5 and 6 from city lots 196 and 195 for a dis- tance of 66 feet north from the north line of Second Street; the said arch not to he less than 11 feet, 6 inches in height from the grade of the alley to the under side of the crown of the arch on condition that said Dubuque Hotel Company, its successors and assigns, shall ever hereafter hold said city harmless from all damages that may arise or be incurred by reason of the grant of the privileges hereby made.
