Aid. Specht moved that action on the
council proceedings for the month of
December be deferred until next meet-
ing. Carried.
Petition of Job Barnes stating that
he is an honorably discharged soldier
and asking that the treasurer be in-
structed to make deduction as provid-
ed by law on the south 25.6 feet of
City Lot 107, north 20 feet Lot 108 and
Lot 104 in Woodlawn Park presented.
Ald. E. E. McEvoy moved that the
prayer be granted. Carried.
Petition of Mrs. C. Zust that the
moneys and credits assessed against
the L. Zust estate be canceled on ac-
count of the same having been di -
vided, presented. On motion of Ald.
O'Rourke referred to the Committee
of the Whole.
Communication from Lacy, Brown &
Lacy stating that they had for collec-
tion two claims against the city, in-
curred by the old Water Works Trus-
tees, in favor of the Westinghouse Air
Brake Co. for $115.25 with interest
from Jan. 10, 1907, and E. P. Smith
Electric Contract Co. for $1340 with
interest from August 19, 1907, and de-
sired that the council take some ac-
tion on said claims. Ald. O'Rourke
moved that the council place itself on
record as waiving the statute of limi-
tation and agreeing to pay same out
of the next appropriation. Carried.

request for an opinion as to the au-
thority of your honorable body to in-
crease the salary of the clerk in the
Office of the City Treasurer, I beg to
report that, in my opinion, the clerk
in the office of the City Treasurer does
not come within the prohibition of
Section two (2) of Chapter twenty -three
(23) of the Revised Ordinances of 1901,
and the City Council is therefore at
liberty to change the salary of such

from the reports of the Police De-
partment that the total hours that 70
lamps failed to burn would equal
31/2 lamps burning for one month, or
317.50.

An Ordinance for the vacation of
the unnamed street lying between
Grace Street and the alley north of
Grace Street and running parallel
therewith, between East Street and
Louisa Street, and for the vacation
of said alley from the easterly line of
said unnamed street extended, Wes-
terly to East Street in the City of
Dubuque:
WHEREAS a petition has been
presented by The Dubuque German
College and Seminary, a religious
and educational corporation, for the
vacation of the unnamed street lying
between Grace Street and the alley
first north of Grace Street and run-
ning parallel therewith, between
East Street and Louisa Street and
for the vacation of said alley from
the easterly line of said unnamed
street. extended westerly to East
' Street in the City of Dubuque;
AND, 'WHEREAS,' it is represent-
ed in said petition that said corpora-
tion is the owner of all the land on
both sides of the said streets, and also
the property on 'both sides df`' said
alley, and that this street and alley
can be of no use to the public;
AND, WHEREAS, the 'City Council
sees no valid objection to granting
said petition and giving the use of
the land so vacated to said school
for school purposes;
THEREFORE, BE IT ORDAINED
by the City Councils of the City of
Dubuque:
Regular Session, January 4, 1912
Sec. 1 That the unnamed street
lying between Grace Street and the
alley first north of Grace Street and
running parallel therewith between
East Louisa Street, and for the va-
cation of said alley from the easterly
line of said unnamed street extended,
westerly to East Street in the City
of Dubuque, be and the same is
hereby vacated and the use thereof
granted to the said Dubuque German
College and Seminary for school pur-
poses, subject to the conditions here-
inafter named, provided, that if at
any time the said Dubuque German
College and Seminary should cease to
exist, or should cease to use said va-
cated land for school purposes, then
the land now vacated shall revert
back to the City of Dubuque, and this
Ordinance shall be null and void.
Sec. 2. This Ordinance is based on
the condition that the terms of the
acceptance hereof endorsed hereon,
be signed by the said Dubuque Ger-
man College and Seminary.
This ordinance shall be in force
and take effect from and after its
passage by the City Council and its
publication one time in the Tele-
graph- Herald and Times - Journal,
official newspapers. -

lowing:
AN ORDINANCE CREATING A
BOARD OF PUBLIC WORKS
WITHIN THE CITY OF DU-
BUQUE, AND DEFINING ITS
DUTIES.
Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That there is hereby cre-
ated within the City of Dubuque, a
Board of Public Works, the members
of which Board shall consist of one

commissioner appointed by the Mayor,
with the approval of the Council, the
City Engineer and the Street Commis-
sioner, as associate members.
The members of said Board shall be
residents and qualified electors of the
City of Dubuque, and shall serve with-
out extra compensation, for the period
of one year from the time of their ap-
pointment and until their successors
have been duly appointed.
Sec. 2. The appointment of the
members acting on said Board shall
be made by the Mayor on or before
the first day of Jangary in each year,
beginning with the first day of Jan-
uary, 1912.
Sec. 3. The duties of said Board
shall consist in rendering such service
and assistance to the Levee Improve-
ment Commission of the City of Du-
buque, as may be required by said
commission from time to time.
This Ordinance shall be in force and
effect from and after its passage and
its publication one time in the official
newspaper of said City.

reading just had be considered the
first reading. Carried.

rules be suspended for the purpose of
reading the Ordinance by its title.

The matter of improving the accom-
modations in the City jail discussed.
Ald. Saul moved that the matter be
left with the Committee on Police and
Light, they to report back to the Com-
mittee of the Whole their recommend-
ations. Carried.
Your Committee of the Whole would
respectfully recommend that beginning
January 1st, 1912, the salary of Louis
Kolfenbach, the Clerk in the office of
the City Treasurer, be fixed at $75.00
per month.
Your Committee of the Whole, to
whom was referred the bill of J. F.
Brown for $37.50 for extra work on
the West Fourteenth Street sewer oc-
casioned by the discovery of gas,
water and sewer pipes in the original
location of the trench, would respect-
fully recommend that said bill be al-
lowed and that a warrant in said
amount be ordered drawn on the City
Treasurer in settlement of the claim
Your Committee of the Whole, to

whom was referred the bill of Tibey
Bros. for $143.00 for macadamizing the
intersection of Delhi and Asbury
Streets, would respectfully recommend
that said bill be allowed in full in the
sum of $110.32 and that a warrant in
said amount be ordered drawn on the
City Treasurer in settlement of the
claim.
Your Committee of the Whole, to
whom was referred the communica-
tion of the League of Iowa Munici-
palities asking for the payment of the
first assessment toward defraying the
expenses in the suit brought by the
league against the State Executive
Council to compel it to assess railroad
property at its full value, would re-
spectfully recommend that a warrant
in the sum of Fifty Dollars be ordered
drawn on the City Treasurer in favor
of B. P. Hoist, Boone, Iowa, treas-
urer of the special committee of the
league. We would further recommend
that the Mayor and City Attorney be
instructed to secure from said commit-
tee, full reports regarding the progress
of the suit and the expenditure of the
money raised to prosecute the same.

had examined the sewer in Mt. Pleae-
ant avenue and West Locust street.
' After discilssion as to 'the contractor's
liability for any damages and. a verbal
report from City Attorney Lyon the
58 26 rules were suspended by unanimous
vote. Mr. Hassett addressed the
' Council, claiming that he was not in
any way liable for damages. The fol-
lowing motion was offered. by Aid. Sin-
grin: That the.,sewer be accepted with
the distinct understanding that the
58 26 city waives no rights against the con -
tractor because of any liability arising
from the claims filed for damages aris-
ing from the accident happening on
West Locust Street on or about the
14th day of November, 1911. Carried.
58 26 Ald. Singrin moved that the City En-
gineer be instructed to prepare a
special assessment for the construction
of Mt. Pleasant Avenue sewer. Car -
ried.
The Committe of the Whole report to
58 26 allow 'Kenety & Lee the sum of $190.00
in full for their bill of $240.00 was read.
The Street Commissioner was asked
as to the rolling of Tenth, • Twelfth and
Fifteenth Streets and he stated that the
city Steam roller tolled the sub -base
58 26 of said streets. The City Engineer re-
ported that it was the contractor's
place to roll the top course. The origi-
nal plans and specifications were call-
ed for.
Aid. Saul stated that there was
58 26 about $3,000.00 available for the county
road fund and moved that $700.00 be
expended In the First ward. Carried.
3 48 Ald. E. E. McEvoy moved that the
sum of $300.00 be expended in the
Fourth ward. Carried.
Ald. Specht moved that the sum of
$386.00 he expended in the Fifth ward.

reported as follows: Pay roll for lobo
during the month of December, 1911,
on streets leading into county, the cost
thereof to be paid from the F flh
ward's apportionment , of the county
road - fund. Total due, '859.95.
Aid. Saul moved that the pay roil
be received and various amounts be
paid and pay roll and report be re-
ferred back to the Committee on
Streets. Carried,
City Engineer Baumgartner reported
as' to the proposed grade and cut or
tunnel through Grandview avenue and
submitted plans covering the construc-
tion of same. Ald. J. W. McEvoy
moved that the report and plan be
referred to the Committee of the
Whole, City '-Engineer and Board of
Supervisors and the Committee of the
Whole to meet with the Board of Su-
pervisors on some date fixed by said
Supervisors and said - -Board be noti-
fied of the action of the Council. Car-

Your Committee of the -Whole, to
whom was referred the bill of Kenety
& Lee for extra work done and ma-
terial furnished in the improvement of
Tenth, Twelfth, Fifteenth and Bluff
Streets and for, the amount deducted
by . the City from the Tenth street
contract, amounting in total to $244.00,
would respectfully recommend .. that
the charge for spreading macadam
for, trench made by plumbers and ,for
the rolling of the same be not allowed,
and that' a warrant in the sum of
$108.00 be ordered drawn on the City
Treasurer in full settlement of the
claim.
Street Commissioner Mahoney ad-
dressed the Council and stated that
the City done the rolling in accord-
ance to the specifications, and both
rollers worked on the street, and h!_
time book would show the person In
charge of roller and the time on said
street.
City 'Attorney Lyon stated that in
his opinion it was the duty of con-
tractor to roll the street and remove
the old curb. City Engineer Baum-
gartner stated that the specifications
were the same as generally used and
that it was the duty of the contractor
to remove the old curb. Ald. O'Rourke
moved that part of the bill for ma-
cadam, $12.00, be allowed and the
Street Commissioner to collect the
same from the plumber or as much of
said amount as possible. Carried.
Ald. J. W. McEvoy moved that por-
tion of the bill for $86.00 be allowed.
Ald. O'Rourke amended. That since
the bill has been referred to the City
Attorney and the conractor has
brought suit that it remain as it is.

Therefor.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That any person who is
a minor, drunkard, or is intoxicated,
or who has taken any of the so- called
"cures for drunkenness," or any per-
son whose wife, husband, parent,
child, brother, sister, guardian, ward
over fourteen years of age, or em-
ployer has by written notice forbid
sales of intoxicating liquors to such
person, who shall enter any place
where intoxicating liquors are kept
for sale by any person or persons op-
erating and keeping a place for sale
of intoxicating liquors under the pro-
visions of the mulct law, in the city of
Dubuque, Iowa, or who shall loiter
therein, or who shall solicit or ask,
or attempt in any way to procure in-
toxicating liquors from the keeper or
any other person in charge of said
place where intoxicating liquors are
kept for sale under the provisions of
the mulct law of the state of. Iowa,
the same being Chapter Six, of Title
Twelve of the Code of Iowa, and
'amendments thereto, shall be deemed
guilty of a misdemeanor and upon
conviction thereof shall be fined in a
sum not less than One ($1.00), nor
more than One Hundred ($100.00)
Dollars, and be imprisoned until such
fine and costs are paid; provided,
however, such imprisonment shall not
exceed thirty (30) days; or may be
punished by imprisonment not to ex-
ceed thirty (30) days.
Section 2. Any person in charge of
a place in the City of Dubuque where
intoxicating liquors are kept for sale
under the so- called mulct law of the
State of Iowa, and which law is known
as Chapter Six (6) of Title Twelve
(12) of the Code of 1897, and amend-
ments thereto, either as owner, agent,
or clerk of keeper thereof, who shall
knowingly permit any of the persons
specified in Section 1 hereof, to loiter
in such place of business, or who shall
knowingly give to any of the persons
designated in Section 1 hereof, any
intoxicating • liquors either by gift or
purchase, shall he deemed guilty of a
misdemeanor and upon conviction
thereof shall be punished as provided
in Section 1 hereof,
Section 3. This Ordinance shall be
in force and effect from and after its
passage by the City Council, and pub-
lication one time in the official news-
papers of said city.

children can render financial assist-

he had notified the railroads in ac-
cordance to Section 3 of Chapter
YLVI. of the Revised Ordinances of
the City of Dubuque of 1901 of the

Ald. Saul stated that Mr. Stapleton,
superintendent of the C., M. & St. P.
R. R., has requested that the Council
set a date when he and other officers
could meet with them and be shown
as to where the gates are to be placed.

cerned that a special assessment as
provided by law will be levied at a
session of the City Council to be held
Feb. 1, 1912, to pay for the con-
struction of a sanitary sewer in
West Locust Street, Rosedale Ave-
nue, North Glen Oak Avenue, Vernon
Street- and Mt. Pleasant Avenue, by
T. J. • Hassett, contractor.
Amount of special assessment,
$6,107.65, same to be assessed against
the abutting property upon and along
said street.
And that there is a plat and
schedule on file in the office of the
City Recorder of said City of Du-
buque, showing the street in which
said sewer was constructed, and the

Sealed proposals will be received at
the Council Chamber, City Hall, by, the
City Recorder, until 8:00 p. m., Thurs-
day, February 1, 1912, for the con-
struction of an 8 -inch tile pipe sani-
tary sewer in Nevada Street, from a
point about seventy -three feet south
of the south property line of Lang -
worthy Avenue, southerly, to Dodge
Street, in accordance with the plans -
and specifications prepared by the City
Engineer and now on file in the office
of the City Recorder.
It is estimated by the City Engineer
that it will require:
900 lineal feet 8 -inch tile pipe.

The work 'to be paid for when said
work is completed and as presented by
Chapter XXXI'V. of the Revised Ordi-
nance of 1901 of the City of Dubuque,
work to be completed on or before
June 1st, 1912.

Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That any person who is a
minor, drunkard, or is intoxicated, or
who has taken any of the so- called
"cures for drunkenness," or any per-
son whose wife, husband, parent,
Child, brother, sister, guardian, ward,
over fourteen years of age, or emp'oy-
er has by written notice forl.id sales'
of intoxicating liquors to such person
Who shall enter any place where in-
toxicating liquors are kept for sale by
a ny person or persons operating and
'keeping a place for sale of intoxicating
'liquors under the provisions of the
'Mulct law, in the City of Dubuque.
Iowa, or who shall loiter therein, or
who shall solicit or ask, or attempt i:,
any way to procure intoxicating
'liquors from the keeper or any person
in charge of said place where intoxi
eating liquors are kept for sale under
the provisions of the mulct law of the
State of Iowa, the same being Chapter
Six, of Title Twelve of the Code of
Towa, and amendments thereto, shall
be deemed guilty of a misdemeanor
and upon conviction thereof shall be
fined in a sum not less than One
($1.00) Dollar, nor more than One Hun-
dred ($100.00) Dollars, and be impr_s-
oned until such fine and costs are
paid; provided, however, such impris-
onment shall not exceed thirty (30)
days; or may be punished by impris-
onment not to exceed thirty (30) days.
Section 2. Any persons in charge of
any place in the City of Dubuqu°
where intoxicating liquors are kept
for sale under the so- called mulct law
of the States of Iowa, and which law
is known as Capter Six (6) of Title
Twelve (12) of the Code of 1897, and
amendment thereto, either as owner.
agent, or clerk or keeper thereof, who
shall knowingly permit any of the per-
sons specified in Section 1 hereof, to
loiter in such place of business, or
who shall knowingly give to any of
the persons designated in Section 1
'hereof, any intoxicating liquors eithe"
-by gift or purchase, shall be deemed
guilty of a misdemeanor and upon
conviction thereof shall be punished
as provided in Section 1 hereof.
Section 3. This Ordinance shall be
in force and effect from and after its
passage by the City Council, and pub-
lication one time in the official news-
papers of said City.

AN ORDINANCE.

AN ORDINANCE CREATING A
BOARD OF PUBLIC WORKS
WITHIN THE CITY OF DU-
BUQUE, AND DEFINING ITS DU-
TIES.
Be It Ordained by the City Council of
the City of Dubuque.
Section 1. 1•icat there is hereby
created within the City of Dubuque a
Board of Public Works, the members
of which Board shall consist of one
commissioner appointed by the Mayor,
with the approval of the Council, the
City Engineer and Street Commission-
er, as associate members.
The members of said Board shall
be residents and qualified electors of
the City of Dubuque, and shall serve
without extra compensation, for the
period of one year from the time of
their appointment and until their suc-
cessors have been duly appointed.
Sec. 2. The appointment of the
members acting on said Board shall
be made by the Mayor on or before
the first clay of January in each year,
begining with the first day of Jan-
uary, 1912.
Sec. 3. The duties of said Board
shall consist in rendering such service
and assistance to the Levee Improve-
ment Commission of the City of Du-
buque, as may be required by said
Commission from time to time.
This Ordinance shall be in force and
effect from and after its passage and
its publication one time in the official
newspaper of said City.

and Louisa street, and for the vaca-
tion of said alley from the easterly
line of said unnamed street extended,
westerly to East street in the City of
Dubuque; and
Whereas, it is represented in said
petition that said corporation is the
owner of all the land on both sides of
the said streets, and also the property
on both sides of said alley, and that
this street and alley can be of no use
to the public; and
Whereas, the City Council sees no
valid objection to granting said peti-
tion and giving the use of the land so
vacated to said school for school pur-
poses;
Therefore, Be It Ordained by the
City Council of the City of Dubuque:
Sec. 1. That the unnamed street
lying between Grace street and the
alley first north of Grace street and
running parallel therewith between
East Louisa street, and for the vaca-
tion of said alley from the easterly
line of said unnamed street extended,
westerly to East street in the City of
Dubuque, be and the same is hereby
vacated and the use thereof granted
to the said Dubuque German College
and Seminary for school purposes,
subject to the conditions hereinafter
named, provided, that if at any time
the said Dubuque German College and
Seminary should cease to exist, or
should cease to use said vacated land
for school purposes, then the land now
vacated shall revert back to the City
of Dubuque, and this ordinance shall
be null and void.
Sec. 2. This Ordinance is based on
the condition that the terms of the
acceptance hereof endorsed hereon, be
signed by the said Dubuque German
College and Seminary.
This Ordinance shall be in force
and take effect from and after its
passage by the City Council and its
publication one time in the Tele-
graph- Herald ancl Times - Journal, of-
ficial newspapers.

The terms and conditions of the
above ordinances are hereby accepted,
and it is expressly represented that
the undersigned is the sole owner of

alley by this ordinance vacated, and
it is agreed that the validity of the
above ordinance is based on the cor-
rectness of this representation.
