dinances of 1901 of the City of Du-
buque, work to be completed on or be-
fore the 31st of October, 1912.
Bidders must state price per lineal
foot for furnishing and setting curb
stone, price per sq yd. for brick pave-
ment, price per lin. ft. for resetting old
curb stone between tracks and the
price per sq. yd. of the strip including
the tracks, 9 foot in width.
Each bid must be accompanied by a
certified check of $500.00 on some Du-
buque bank as a guarantee that a con-
tract will be entered into if awarded,
check and bid in separate envelope.
The City Council reserves the right
to reject any and all bids which may
not be deemed advantageous to the
City, or to permit the railway com-
pany to improve the various 9 foot
strips containing their tracks.

Notice to Sewer Contractors.
Sealed proposals will be received at.
the Council Chamber, City Hall, by the
City Recorder, until 8:00 p. m., Thurs-
day, March 7th, 1912, for the construc-
tion of an 8 -inch tile pipe sanitary
sewer in North Glen Oak Avenue from
Vernon Street to Julien Avenue, in
accordance with the plans and speci-
fications prepared by the City Engi-
neer and now on file in the office of the
City Recorder.
It is estimated by the City Engineer
that it will require:
1235 lineal feet 8 -inch tile pipe.
7 manholes.
The work to be paid for when said
work is completed and as presented by
Chapter XXXIV. of the Revised Ordi-
nance of 1901 of the City of Dubuque,
work to be completed on or before
June 1st, 1912.
Bidder will state the price per lineal
foot of completed sewer, also state
price per manhole.
All bids must be accompanied by a

be suspended for the purpose of allow-
ing any one present to address the
Council.

Mr. Christ. Braun addressed the
Council and stated that on account of
the work done by Water Works Trus-
tees and Park Commissioners, and be-
ing unable to get steam roller during
the time he was improving Seventh
Avenue, he asked the city to allow him
the sum of $183 or the amount charged
for rolling on account of being delayed
by said persons. After discussing the
same Ald. Saul moved that the matter -
be referred to the Committee of the
Whole and the committee to view the
ground, and Mr. Braun be notified as
to the time that the Committee of 'the
Whole will view the ground.
Ald. Sauer entered at 8:55 p. m. and
took his seat.
The Mayor declared the motion car-
ried.
Mr. J. E. Voggenthaler addressed
the Council and stated that in making
out his bid it was for one fire escape
on the City Hall and made up his fig-
ure from the blue print, but found later
that the 'specifications called for two
fire escapes and that he had not been
furnished specification with blue print
from City Engineer's office. After in-
vestigating the matter Ald. J. W. Mc-
Evoy . moved that Mr. Voggenthaler be
allowed the sum of $194 in excess of
his contract. Carried.
Ald. O'Rourke moved that the bill of
Donner Bros., $95,; Clancy Transfer Co.,
$8.00; Butt Bros., $25.00, be taken from
the Committee of the Whole. Carried.
Ald. O'Rourke moved that the bills
of Gonner Bros., Butt Bros., Clancy
Transfer Co., be paid. Carried.

to accept the taxes for year of 1909 -1910
without interest.

of the petitioner be granted. Carried.
Communication from W. H. Smith,
stating he had purchased lot 2 of 1 of
1 and 2 of 6 and 7 of mineral lot 79 for
the 'sum of $250 and that it is assessed
at $800 and therefore ask that the City
Treasurer be instructed to accept
taxes on said lots for year 1911 on a
basis of $250 valuation.
Ald. O'Rourke moved that the prayer
be granted and the City Treasurer be
instructed and likewise the City Assess-
or. Carried.
Petition of Anna M. Jordan, asking
that the assessed valuation on lots 1,
2, 3 of the Sub. of lots 8, 9, 10, 11 and
12 of College Sub. be reduced to $1,200
and the City Treasurer be so instruct-
ed. On motion of Ald. Saul referred to
Committee of the Whole.
Petition of Miss Anna Smith for the
heirs of the Smith estate, asking that
a substantial reduction be made on the
valuation on lots 9, 10 and 11 of the
Sub. of mineral Iot No. 79., presented.

that the City Treasurer be instructed
to accept taxes on a basis of $1,800.00,
as they had retired from business

Petition of R. W. Kemler, asking
that the assessed valuation on City
Lot 215 be reduced from $4,500.00 to
$3,000.00 and the Treasurer instruct-

rnueller, asking that the taxes for the

endy, asking that he be relieved
from any further service in connec-
tion with the purchase of the new
motor fire engine, and that any action
which has been taken by your honor-
able body, at his suggestion, be re-

& Lacy, asking that a warrant be or-
dered drawn in their favor for the
payment of the bill of Westinghouse
Airbrake Co., for $150.75 and E. P.

$17.00, presented. Ald. O'Rourke
moved that the prayer of the peti-

Communication from the A. Y.
McDonald Mfg. Co., stating that they.
are going to erect a new .building ad-
joining their factory, the dimensions
of same to be approximately 250 feet
long by 100 feet wide, three stories
and basement, and asking that for a
term of ten (10) years from date tax-
able value of the following described
property, including buildings, , im-
provements and contents, be fixed at
$2,500.00: The west 100 feet of Lot
1, Sub. of Mineral Lots 96, 97 and
98, formerly known and described
as Lots 267, 268, 269, 270 and 271 in
East Dubuque No. 2, presented. On
motion of Ald. Saul, referred to the
Committee of the Whole.
Communication from Frank G.
Pierce, stating that the temporary
tax commission would meet in Des
Moines, Iowa, on March 21 and 22
and asking that the City send a rep-
resentative to this meeting, presented.
Ald. Saul moved that the prayer be
granted and the appointing of a rep-
resentative be left with the Mayor
and Mr. Pierce informed of the action
taken. Carried.
Claim of Geo. Klein, claiming
$48.00 injuries to his horse and for
lost time, presented. On motion of
Ald. Singrin, referred to the City At-
torney and City Veterinarian.
City Recorder Geiger presented and
read the notice, certified to by the
publishers, of the City Council's in-
tention to construct an eight -inch
tile pipe sanitary sewer in Kniest
Street, Eagle Point Avenue and
Prince Street. No remonstrance be-

REPORTS OF OFFICERS.
Honorable Mayor and City Council,
Gentlemen: In the matter of the
suit of Mary Dempsey vs. City of Du-
buque, 14, 624 Lan', I beg to report as
follows:
This action was originally brought
for the May term, 1905, in the sum of
$10,000 for a broken leg and other
serious personal injuries alleged to
have been sustained on a sidewalk on
Julien avenue, in January of that
year.
The case has been tried four times
in the District Court and was ap-
pealed once to the Supreme Court
successfully to the defendant. At the
last trial had at the October Term,
1911, a verdict was returned and judg-
ment given thereon in the sum of $750.
In accordance with report thereon
made to your honorable body, and af-
ter full consideration of the matter,
we determined that it would be im-
practicable to continue the litigation
in this matter and instructed against
an appeal.
There has been appropriated by this
council an amount sufficient to adjust
this claim and others now filed, and
accordingly I ask that you direct a
warrant to issue in favor of the
Mayor, in the sum of $1200, which will
be ample to pay this judgment with
interest and costs, some of the costs
having already been advanced from
time to time and during previous ad-
ministrations, in payment of defend-
ant's witnesses. Any balance which
may remain in the adjustment of this
matter of costs, will be held by me
for application an any other claim,.
which your honorable body may order
paid, and a report of the total amount
paid will be made by me later.

I desire to report further that in
the suit of Sarah Blumenthal vs. City
of Dubuque, 16,527 Law, in the sum
of $15,000. The action was called for
trial at the January, 1912, Term, and
after some progress had been made in
the trial, an adjustment was effected
in the scum of Four Hundred Dollars
in full, plaintiff paying all costs. This
is an action for personal injuries sus-
tained from a runaway alleged to •
have been caused by the operation of
the steam roller on Washington street,
said accident resulting in serious in-
jury to plaintiff's skull, scalp and her
body generally.
I ask that a warrant be ordered
drawn in favor of the Mayor in the
sum of Four Hundred Dollars in full
settlement of said matter.
I also ,report in the actions of Stein -
berger vs. City of Dubuque, 16,362
Equity, Anna M. Utt, vs. City, 16,363
Equity, Virginia Robinson vs. City
of Dubuque, 16,364 Equity and
Thomas Hill vs. City of Dubuque,
15,680 Equity, which were all actions
brought to quiet title as against liens
for special assessments, and which
were bound to be barred by limita-
tions and in which the City could have
asserted no further claims, the costs
amount to $108.80, and I ask that a
warrant be ordered drawn in favor of
the Mayor in said amount so that
these items may be paid.

Gentlemen: The undersigned, City
Attorney and Committee on Claims,
respectfully report that they have
taken up for consideration and inves-
tigation the following claims.
Irving Boxleiter, claim for $500 for
sprained ankle; fell on sidewalk on
north side of Eleventh street, on the
12th day of January, 1911. In this mat-
ter we recommend settlement in the
sum of $50 in full.
John Burke, broken leg sustained in
a fall on South Locust street on the
9th day of February, 1911. The injury
still continues and has rendered Mr.
Burke a cripple. Settlement is recom-
mended in the sum of $250, in payme• •t
of expense reported by him in his
statement to this Council on March
8th, 1911.
George Collett, who sustained a
fracture of the wrist by a fall on a
sidewalk on White street. We recom-
mend the payment of $150 in full, cov-
ering expense and loss of time.
Theodore Ruprecht, broken wrist
sustained from a fall on a crossing
stone on Nineteenth street on Jan.
lath, 1911 We recommend adjustment
of this claim in the sum of $75 for ex-
pense and loss of time.
Ellen Frith, who sustained a broken
foot, about a year ago and is still suf-
fering from the injury. We recom-
ment settlement in full in this case in
the sum of $250 covering expense in-
curred. Suit is now pending in the
sum of $10,000.00.
We ask that warrants be ordered
drawn, payable to the City Attorney
in the various amounts named, for ad-
justment of these claims.

fee. 1. Whereas, the Chicago, Mil -
waukee & St. Paul Railway Company
is about to erect a two -story office
' and storehouse to be ,used in connec
tion with the railway shops of Said
company in the City of Dubuque; and,
Whereas, there is not sufficient
room on their property south of their
engine -room between Sycamore and
Ash Streets, for the erection of a
building of the size contemplated;
Thenerere, the City Cpun {ail 06 the
City of Dubuque hereby vacates and
annuls the north 11.06 of 19th street,
between Sycamore 454 Ash Streets,

and the said Chicago, Milwaukee & St.
Paul Railway Company, their succes-
sors or assigns, are hereby permitted
and authorized to improve and use
that part of said sheet so vacated in
connection with the said railway shops

fectually as the City Council has the
power to grant the same.
Sec. 2. The portion of the street so
vacated whenever discontinued for the

to construct a sanitary sewer in Queen

contract to construct a sanitary sewer
in Kniest Street be awarded to O'Far-
rell Contracting Co. and bond be placed
at 25 per cent of contract prices.

A1.d. Singrin moved that the action
of the City Council heretofore taken in
relation to the cancellation of the
taxes of F. Donath be understood to
mean all back taxes against him, and
that the City Treasurer be so notified.

Ald. Sauer stated that there had been
nothing done as to the repairing of the
steam roller and hiring an engineer for
said roller.
Ald. Singrin moved that the matter
be referred to the Committee of the
Whole. Carried.
Ald. E. E. McEvoy moved that the
City Engineer and Street Commission-
er be instructed to measure macadam
and report at the adjourned meeting.

Ald. E. E. McEvoy moved that the
Mayor be instructed to notify the prop-
er parties to enforce the ordinance for
the removal of obstructions in alleys.
Carried.
Ald. J. W. McEvoy moved that the
Ordinance Committee and City Attor-
ney be instructed to amend the Ordi-
nance providing for the removal of all
dirt, filth, ashes, manure, etc., so as to
compel the property owner to have a
proper receptacle to receive ashes, etc.
Carried.
Ald. J. W. McEvoy moved that when
we adjourn we adjourn to Friday,

• AN ORDINANCE.
AN ORDINANCE in Relation to the
Licensing of Transient Merchants,
Providing for a Penalty for the Vio-
lation Thereof, and Repealing All
Ordinances or Parts of Ordinances
Heretofore Adopted Bearing on
That Subject.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. • No traveling or transient
merchant, or other temporary dealer
in goods, wares or merchandise,
whether a resident of Dubuque or not,
shall sell or offer for sale any goods,
wares or merchandise within the
limits of said city without first pro-
curing a license therefor, for which
license such person shall pay the sum
of twenty -five dollars per day.
Provided, however, that if any per-
son who shall have paid such license,
shall 'thereafter be taxed by said city
on account of the goods, wares or
merchandise kept by him for sale un -.
der such license, he shall be entitled
to credit upon such city taxes for the
amount' of license tax so, by him,
and the balance, if any, shall be re-
funded. .
.Every person,: whether owner, agent
or employee who' shall temporarily
place any goods, , wares, or merchan-
dise in any boat, car; building, tent,
:or ' other , erection in, the said 'city . for
the purpose of sale• thereof or there-
from, shall be construed and consid-
ered a transient. merchant within the
meaning of this ordinance. - ,.
Section 2. Any person .violating the
pr?ovisions,pf this ordinance, ,shall up-
on, cenvietion. fined .not ore than
940 .hundred dolla and-be:imprisori-
ed until such fine and costs are paid,

not exceeding thirty days.
Section 3. All ordinances or parts
of ordinances heretofore adopted in
conflict herewith are hereby repealed.
Section 4. This ordinance shall be
in force and take effect from and after
its passage by the City Council and its
publication one time in the official
newspapers of the city.
Ald. Singrin moved the reading just
had be considered the first reading.

Aid. J. W. McEvoy offered the fol-
lowing:
Be It Resolved by the City Council
of the City of Dubuque, That a san-
itary sewer of eight -inch tile pipe be
constructed in Asbury Street from
Delhi btreet to St. Ambrose Street,
thence in St. Ambrose Street to Wil-
low Street, thence in Willow Street to
Rosedale Avenue, thence in Rosedale
Avenue to the present manhole at a
point about opposite the easterly line
of Lot 1 of 1 of Mineral Lot 183, ac-
cording to the plans and specifications
of said sewer prepared by the City
Jtn.gineer and now on file in the office
of the City Recorder, and be it further
Resolved, that said sewer shall be
completed on or before the 15th day
of July, 1912, and shall be paid for
at the time and in the manner pre-
scribed by Chapter XXXIV. of the Re-
vised Ordinances of 1901 of the City
of Dubuque for the payment of the
cost of constructing sewers. The pro-
posals for doing such work will be
acted upon by the Council on the
18th day of April, 1912, and the City
Recorder is hereby ordered to give
ten days' notice by publication, asking
for proposals as provided by ordin-
ance.

consideration of the City's erecting

spectfully recommend that the offer
be accepted provided the City Attor-
ney find the statements contained in
said communication are in accord-
ance with the facts in the case, and

Ald. J. W. McEvoy reported ver-
bally the estimate from Engineer
Tschirgi that a 40 foot street, 30 feet
between curbs, would cost $34,472.00
and a 64 foot street, 30 feet between
curbs, would cost $41,647.00. Total length
of street, 5,225 feet, and the committee
have agreed to meet the I. C. officials
and learn as to what they would con-
tribute toward the building of a via-
duct over Catfish Creek at Rockdale.
And the committee requested City En-
gineer Baumgartner to work in con-
junction with Engineer Tschirgi to
which Engineer Baumgartner was very
atreeable.

day, March 21, 1912, for the construc-
tion of an 8 -inch tile pipe sanitary
sewer in Kniest Street from the pres-
ent manhole In Lincoln Avenue north-
erly in Lincoln Avenue to Eagle Point
Avenue, thence northeasterly in Eagle
Point Avenue to Prince Street, thence
northwesterly in Prince Street to San.
ford Street, thence northeasterly in
Sanford Street to the east line of
Saunders Sub. in accordance with the
Plans and specifications prepared by
the City Engineer and now on file in

It is estimated by the City Engineer
that it will require:

for members of the Police Depart --
ment of the City of Dubuque shall be
as follows:

Mayor's Office, March 18, 1912.
Notice is hereby given that the
registers of election, duly appointed
to register voters in the City of Du-
buque, Iowa, will be in attendance at
the places herein below mentioned,
for the purpose of correcting the
registry list of names of such electors
as may be entitled to vote at the
city election to be held on Monday,
•April 1st, 1912. Said registers will
meet at their respective places on
Thursday and Friday, March 21st
and 22nd, 1912, and Saturday, March
30th, 1912, at 8 o'clock a. m. and
be in session until 9 o'clock p. m. of
said days.
Said registers will thereafter meet
on Monday (Election Day), April 1st,
1912, and be in session from the time
the polls open until they close, and
register only such voters as were ab-
sent from the city during the pre-
ceding days that the board was. in
session, also such voters as did not
become citizens until Monday, April
1st, 1912.

sanitary sever in Asbury Street from

work to be completed on or before
July 15, 1912.
Bidder will state the price per lineal
foot of completed sewer, also state
price per manhole and price for drop
manhole.
All bids must be accompanied by a
certified check for 9500.10 on some Du-
buque bank as a guarantee that con-
tract will be entered into if awarded

You and each of you are hereby no-
tified that it is the intention of the
City Council of the City of Dubuque
to improve Nevada Street from Lang -
worthy Avenue to Dodge Street.
That the plat of said improvement
is now on file in the office of the City
Recorder. It is estimated by the City
Engineer that said improvement will

1200 sq. yds. macadamizing.
5570 cu. yds. cutting.

tention to improve Nevada Street
from Langworthy Avenue to Dodge
Street; also the remonstrance of John
Murphy. On motion of Ald. Saul, no-
tice and remonstrance were referred
to the Committee of the Whole and
the parties interested be notified to be
present at the Committee of the
Whole meeting.
Ald. E. E. McEvoy moved that the
petition of J. H. • Lutz be taken from
the Committee of the Whole and
acted on tonight. Carried.
Petition of J. H. Lutz presented.
Ald. E. E. McEvoy moved that the
prayer be granted and Ordinance
Committee be instructed to draft the
