Notice to Waterworks Bondholders.
To the Holders of Dubuque Water
Works Bonds Numbered Two Hun-
dred and Sixty -one to Three Hun-
dred, both inclusive.
The Board of Water Works Trus-
Lees has directed that Dubuque Water
Works bonds, numbered from Two
Hundred and Sixty -one (261) to Three
Hundred (300), both inclusive, dated
June 1st, 1900, be redeemed in accord-
ance with the ordinance and contract
entered into by the City of Dubuque
and the holders of said bonds.
The above bonds should be present-
ed at the City Treasurer's office, Du-
buque, Iowa, on the first day of June,
1912, for payment. All interest ceases
on above bonds June 1st, 1912.

Notice to Sewer Contractors.
Sealed proposals will be received at
the Council Chamber, City Hall, by
the City Recorder, until 8:00 p. m.
Thursday, April 18th, 1912, for the
construction of an 8 -inch tile pipe
sanitary sewer in Asbury Street, from
Delhi Street to St. Ambrose Street,
thence in St. Ambrose Street to Wil-
low Street to Rosedale Avenue,
thence in Rosedale Avenue to the
present manhole at a point about
opposite the easterly line of Lot 1 of
1 of Mineral Lot 183, in accordance
with the plans and specifications
prepared by the City Engineer and
now on file in the office of the City
Recorder.
It is estimated by the City Engi-
neer that it will require:
5,100 lineal feet- of 8 -inch tile pipe.
20 manholes and 1 drop manhole.
The work to be paid for when said
work is completed and as presented
by Chapter XS;XIV. of the Revised
Ordinance of 1901 of the City of Du-
buque, work to be completed on or
before July 15th, 1912.
Bidder will state the price per lin-
eal foot of completed sewer, also
state price per manhole and price for
drop manhole.
All bids must be accompanied by
a certified check for 9500.00 on some
Dubuque bank as a guarantee that a
contract will be entered into if
awarded.

to whom was referred the petition of
Mrs. Sarah Reilly, asking that the
special assessment levied against Lot
122 in Finley, Waples & Burton's
Addition be canceled because the en-
tire frontage of said lot is entirely
outside the city limits, would respect-
fully recommend that sad petition be
referred to the City Attorney.
Also your Committee of the Whole,
to whom was referre 1 the communi-
cation of Frank D. Scharle relative
to parties encroaching on the alley
west of Francis Street; also the peti-
tion of John P. Mettel et al asking
that the lines of said alley be per-
mitted to remain as they now are,
would respectfully recommend that
said John P. Mettel be permitted to con-
tinue the construction of the wall he
is now erecting, providing that he so
mark the same that the footing
course at the north end be made to
conform to the east end of the side-
walk now in place.
Also your Committe of the Whole,
would respectfully recommend that
on account of the date for receiving
bids for cleaning about the Market
House having been fixed by the City
Recorder as May 2nd, that the ac-
tion of the City Council in awarding
said contract on April 26th to John
Dehing be and the same is hereby
rescinded.
Also your Committee of the Whole,
to whom was referred the petition of
John J. Flynn, stating that no bene-
fit has been conferred on his property,
Lot 2 of the Sub. of City Lot 740, by
the construction of the sanitary sew-
er in West Fourteenth Street, and
asking therefore that the assessment
levied against said lot for said sewer
be reduced, would respectfully recom-
mend that the prayer of the petition-
er be granted and that the City Treas-
Urer be instructed to accept 66 2 -3
per cent of said assessment in full
settlement thereof.

to whom was referred the petition of
the Team Owners' association, asking

that the wages for teams be increased
to fifty -five cents per hour, would
respectfully recommend that said .pe-
tition be received and filed.

the alley east of Elm Street f om -25th
to 27th Street, be opened, would re-
spectfully recommend that the City
Engineer be instructed to prepare a
plat showing the lines of a proposed
alley as petitioned for

John Dehing, asking that he be ap-
pointed official alley cleaner at a
salary of $2.00 per day, would re-
spectfully recommend that said peti-
tion be received and filed.

tion on Lots 41 and 42 in Blake's Add.
had been erroneously placed at $1,-
150.00 and also through an error he
is assessed $100.00 personal proper-
ty, asking that said errors be correct-
ed and the valuation of said lots be
fixed at $680.00, would respectfully
recommend that the City Treasurer
be instructed to accept the taxes for
the year 1911 on said lots on a basis
of $750.00 valuation and to cancel
the personal property tax.
Alderman Frith offered the follow-
ing:
Be It Resolved by the City Coun-
cil of the City of Dubuque, That the
City Engineer be and he is hereby
directed to prepare a profile showing
a proposed grade on Pine Streets
from the end of the present im-
provement northerly to 32nd Street
and to submit the same to the City
Council at its next regular session.
Ald. Frith moved the adoption of
the resolution.

Be It Resolved by the City Coun-
cil of the City of Dubuque, That it
is deemed necessary and advisable to
construct a sanitary sewer in Couler
Avenue as follows, to -wit: An eight -
inch tile pipe sanitary sewer in the
west side of said Couler Avenue from
the end of the present sewer at 25th
Street, northerly to 32nd Street, and
to assess the cost of said sewer
against the abutting property.
Ald, Frith moved the adoption of
the resolution.

Be It Resolved by the City Coun-
cil of the City of Dubuque, That the
City Engineer be and he is hereby
directed to prepare a plat and speci-
fications for an eight -inch tile pipe
sanitary sewer in the west side of
Couler Avenue from the present
manhole at 25th Street, northerly to
32nd Street, showing the locations
and general nature of such improve-
ment, the extent thereof, the size and
kind of material to be used, and to
prepare an estimate of the cost there -
_of and the amount assessable upon
each lot or parcel of land adjacent
to or abutting thereon per front feet
or square feet in area and to file
such plat, specifications and estimate
in the office of City Recorder.
That after such plat is so filed, the
City Recorder shall cause to be pub-
lished notice of the intention of the
Council to make such improvement,
which notice shall be published in
three consecutive issues of the official
paper of the City of Dubuque, stat-
ing that such plat is on file, and gen-
erally the nature of the sewer, its lo-
cation, size and kinds of material to
be used, and the estimate of its cost,
and fixing the time before which ob-
jections can be filed, which time shall
not be less than five days after the
Last publication of said notice, and
after the completion of the publica-
tion of such notice, he shall at its
next session, notify the Council there-
of in writing with a printed copy of
such notice accompanying the same.

pipe sanitary sewer from a point
about opposite the center of Lot 15
in Marsh's Dubuque, northerly to
West Fourteenth Street, thence wes-
terly in West Fourteenth Street to
North Glen Oak Avenue, and to as-
sess the cost of said sewer against
the abutting property.

for an eight inch tile pipe sanitary
sewer in North Booth Street from a
point about opposite the center of Lot
15 in Marsh's Dubuque, northerly to
West Fourteenth Street, thence west-
erly in West Fourteenth Street to
North Glen Oak Avenue, showing the
locations and general nature of such
improvement, the extent thereof, the
size and kind of material to be used,
and to prepare an estimate of the cost
thereof and the amount assessable
upon each lot or parcel of land ad-
jacent to or abutting thereon per
front feet or square feet in area, and
to file such plat, specifications and
estimate in the office of the City Re-
corder.
That after such plat is so filed, the
City Recorder shall cause to be pub-
lished notice of the intention of the
Council to make such improvement,
which notice shall be published in
three consecutive issues of the official
paper of the City of Dubuque, stating
that such plat is on file, and gener-
ally the nature of the sewer, its loca-
tion, size and kinds of material to be
used, and the estimate of its cost, and
fixing the time before which objec-
tions can be filed, which time shall not
be less than five days after the last
publication of said notice, and after
the completion of the publication of
such notice, he shall at its next ses-
sion, notify the Council thereof in
writing with a printed copy of such
notice accompanying the same.

of the City of Dubuque, That a sani-
tary sewer of eight inch tile pipe be
constructed in West Fourteenth
Street from the alley first west of
Mount Pleasant Avenue, westerly to
Wood Street, thence northerly in
Wood Street to Rosedale Avenue,
with all necessary manholes, accord-
ing to the plans and specifications of
said sewer prepared by the City En-
gineer and now on file in the office
of the City Recorder, and be it fur-
ther
Resolved, that said sewer shall be
completed on or before the 15th day
of August, 1912, and shall be paid for
at the time and in the manner pre-
scribed by Chapter XXXIV. of the
Revised Ordinances of 1901 of the
City of Dubuque for the payment of
the cost of constructing sewers. The
proposals for doing such work will be
acted upon by the Council on the 16th
day of May, 1912, and the City Re-
corder is hereby ordered to give ten
days' notice by publication, asking
for proposals as provided by ordinance.

neer be and he is hereby directed to
make a plat and survey of such pro-
posed improvement, showing the land
or lots through or over which the
same is proposed to be made, the
names of the owners thereof, and the
quantity of land proposed to be taken,
and file such plat in his office for
public inspection; that after such plat
is so prepared and filed, said City En-
gineer shall give the owners of the
property through or over which such
improvement is proposed to be made,
notice as prescribed by Section 2 of
Chapter 31 of the Ordinances of the
City of Dubuque.

to prepare a list one year before the
same shall become outlawed, showing
the names of the owners as far as
practicable of all property against
which special assessments for any
purpose may have been levied, the de-
scription of the property, the purpose
for which the assessment was levied
and the amount thereof. That such list
when so prepared, he snail transmit
without delay to the City Attorney, who
shall thereupon immediately proceed
to enforce the collection of such as-
sessments, and if necessary bring suit
for the collection thereof.

Your Committee on Police and
Light would respectfully report that,
owing to difficulties experienced with
the present police call boxes, we
made arrangements with the Iowa
Telephone Co. whereby it will assume
the care and maintenance of the boxes
under the present contract with the
Dubuque Telephone Company and at
the same rate of compensation. It
has heretofore been impossible to re-
call a patrolman to the box after he
had once hung up the receiver. In
order that this trouble might be
overcome, buzzers will be installed in
all boxes, so that the desk sergeant

dition of the Bee Brancr sewer north
of Twenty- seventh Street is a con-
tinual source of expense to all the re-
sidents along the course of the same
by reason of their cellars being filled
with water after every flood, and
Whereas, the filling of said cellars
constitutes a menace to the health of
that portion of our city, and
Whereas, the present method of con-
structing said sewer by piecemeal is
costing the city a great deal more tnan
if the contract were let for the entire
improvement in one letting, therefore
Be it Resolved by the City Council
of the City of Dubuque, that the com-
pletion of the Bee Branch sewer from
27th Street to the northerly end there-
of be let in one contract, and that the
City Engineer be instructed to pre -
pare Flans, and specifications and an
estimate of the total cost of the work,
and be it further
Resolved, that to pay for the cost of
such improvement, the Finance Com-
mittee be instructed to negotiate for
the issue of bonds in such an amount
as may be necessary as determined by
the bids submitted.

proposed improvement on Angella
Street from West Locust to a point
about 150 feet east of Catharine Street,
and the kind of material to be used,
and an estimate of the entire cost
thereof, and the amount and cost of
such improvement, and the amount
assessable upon any railway or street
railway company, the amount and cost
thereof, to be paid by the city, if any,
and the cost thereof and amount
assessable upon each lot or parcel of
land adjacent to or abutting upon such
improvement per front foot, and to
file such plat and estimate in the office
of the city recorder; that after the
filing said plat and estimate in his
office, the city Recorder shall publish
in three consecutive issues of a news-
lions brought against it by reason of
the negligence of said Company, its
officers, employes, or agents, said
Company shall pay and fully dis-
charge same.
SECTION S: Nothing in this ordi-
nance, nor any privi'ege3 granted
thereby, shall be construed to pre-
vent the proper authorities of the
City of Dubuque from hereafter mak-
ing improvements which may be nec-
essary upon said Seventh Avenue,
but such work must be done so as to
offer as little obstruction as possible
to the operation of the cars of said
Company.
SECTION 8: Said Union Electric
Company, its successors and assigns,
shall whenever practicable have the
right to use any telephone, telegraph
or fire alarm poles or posts owned or
controlled by the City, now set or
which may hereafter be set along the
line of the track for which franchise
is hereby granted. And, whenever
practicable, the City shall have the
right to use any poles or posts which
may be set by said Company along
said line, when such posts and the
wires put thereon are used solely for
the benefit and use of the said City of
Dubuque; in either case there shall be
no compensation for such use.
SECTION 9: The cars of said street
railway shall begin running not later
each year than June 1st, and shall
cease running not earlier than Sep-
tember 1 5th, and during each day of
this period the cars shall begin run-
ning not later than 1 p. m., and shall
cease not earlier than 9:00 p. m., and
shall be run at intervals of not more
than fifteen minutes Provided, how-
ever, that if the said Park Board of
the City of Dubuque shall agree with
said Union Electric Company upon a
different schedule than the foregoing,
compliance by said Company with

SECTION 10: The rate of fare,
except on chartered cars, shall not
exceed five cents for each adult pas-
senger for a continuous trip in one
direction over this and connecting
lines within the city limits. The fare
for children under twelve years of
age shall be three cents. Transfers
shall be issued when necessary to
carry out the above provision.
SECTION 11: Said Union Electric
Company, its successors and assigns,
shall transport free of charge on its
cars on said line as ordinary pas -
sengers, all policemen and firemen'
- regularly employed as such by the
City of Dubuque, when in the uniform,
•of their respective departments.

and operate a street railway line along
and upon Seventh Avenue in the City
of Dubuque, from the intersection of
said avenue with Rhomberg Aver--

sand feet therefrom, and thence from
such point on said Seventh Avenue in-
to and upon the grounds of said Eagle
Point Park:
Therefore, Resolved by the Park
Board of the City of Dubuque, Iowa,
that there is hereby granted to the
Union Electric Company, a corpora-
tion organized under the laws of Iowa,
its successors and assigns, for the
term of twenty -five years from the
date of the acceptance by said Com-
•pany of an ordinance of the City of
Dubuque, Iowa, as above contemplated,
the right and authority to construct,
operate and maintain a single or
double track for street railway pur-
poses with the necessary switches and
turnouts from a point in Seventh Ave-
nue in the City of Dubuque, approxi-
mately one thousand feet northerly
from the intersection of said avenue
with Rhomberg Avenue, through,
along and upon the grounds known as
Eagle Point Park, in a general north-
erly direction approximately one thou-
sand four hundred feet, thence in a

minating at that point in said Eagle
Point Park, subject to the provisions,
restrictions and conditions that may
be fixed by said proposed ordinance of
the City of Dubuque.
Now therefore, be it Ordained, by the
• City Council of the City of Dubuque:
Section 1. That the action of the
;Park Board of the City of Dubuque, as
embodied in the foregoing resolution, is
•hereby approved:
Section 2. That there is hereby grant-
ed to the Union Electric Company, a
corporation organized under the laws
'ef Iowa, its successors and assigns, for
`the term of twenty -five years from
the ,adoption hereof and its acceptance
by 'said Company, the right and au-

for street railway purposes, with the
necessary switches and turn -outs, here-
after to be determined and agreed up-
on along and upon Seventh Avenue in
the City of Dubuque, from its inter-
section with Rhomberg Avenue to a
point approximately one thousand
(1,000) feet in a northerly direction,
'thence along and upon the ground
known as Eagle Point Park in the
same general northerly direction ap-
proximately one thousand four hun-
dred (1.400) feet, thence - :n an easterly
direction approximately one thousand
two hundred (1,200) feet, and termi-
nating at that point in Eagle Point
Park, also the right to operate cars
thereon, subject to, and in accordance
with the following restrictions and
conditions:
Section 3. For the purpose of con-
structing, maintaining and operating
said street railway line, said Union
Electric Company, its successors and
assigns, shall have the rignt and au-
thority to go upon said street and park
grounds and make such excavations
therein as may be necessary for the
construction, completion, operation and
maintenance of said street railway
line, and shall have the further right
and authority to make track and over-
head wire connections at intersections
and with car barn and power house,
and to construct all necessary side
tracks, turn -outs, and switches, and
shall also have the right to erect, con-
struct and maintain such overhead
wires and poles as may be necessary
to conduct electrical power over said
wires from its power station to and
along• said line of street railway.
Section 4. Said Union Electric Corn -
pany shall, after makng such excava-
tions in said street as may be neces-
sary for the proper construction of
said track, and within a reasonable
time, restore and leave it in as good
condition as it was when such work was
begun, and shall remove any refuse,
debris, or other encumorance result-
ing from said work. Said Company
shall also repair all damages which
may be done to said street by the
maintenance of said track during the
life of the franchise hereby granted.
SECTION 5: The portion of said
street railway line to be laid on Sev-
enth Avenue shall be constructed on
the present established grade thereof,
and the portion to be lai 1 in Eagle
Point Park shall be constructed on
such grade as shall be deemed best
for the operation of street railway
cars thereon. The gauge of said
track shall be what is known as the
standard gauge, to -wit, four feet,
eight and one -half inches.
SECTION 6. Said Union Electric
Company, its successors and assigns,
shall be liable to any person injured
by reason of its negligence in the
construction, maintenance or opera-
tion of • said street railway. And
should any action be commenced or
prosecuted against the City of Du-
buque, upon any such claim for dam-
ages, said Union Electric 'Company,
its successors and assigns, shall, up-
on being notified of such suit, defend
the same; and should any judgments
be rendered against the City in ac-
tions brought against it by reason of
the negligence of said Company, its
officers, employes, or agents, said
Company shall pay and fully dis-
charge same.
SECTION 7: Nothing in this ordi-
nance, nor any privileges granted
thereby, shall be construed to pre-
vent the proper authorities of the
City of Dubuque from hereafter mak-
ing improvements which may be nec-
essary upon said Seventh Avenue,
but such work must be done so as to
offer as little obstruction as possible
to the operation of the cars of said
Company.
SECTION 8: Said Union Electric
Company, its successors and assigns,
shall whenever practicable have the
right to use any telephone, telegraph
or fire alarm poles or posts owned or
controlled by the City, now set or
which may hereafter be set along the
line of the track for which franchise
is hereby granted. And, whenever
practicable, the City shall have the
right to use any poles or posts which
may be set by said Company along
said line, when such posts and the
wires put thereon are used solely for
the benefit and use of the said City of
'Dubuque; in either case there shall be
no compensation for such use. -
SECTION 9: The cars of said street
railway shall begin running not later
each year than June 1st, and shall
cease running not earlier than Sep-
tember 15th, and during each day of
this period the cars shall begin run-
ning not later than 1 p. m., and shall
cease not earlier than 9:00 p. m., and
shall be run at intervals of not more
than fifteen minutes Provided, how-
ever, that if the said Park Board of
the City of Dubuque shall agree with
said Union Electric Company upon a
different schedule than the foregoing,
.compliance by said Company with
such agreement shall be deemed to be
a compliance with this section of this
:ordinance. If said Company shall
,abandon the line herein provided for
Without consent of the City Council,
or shall fail to operate it in accord-
ance with the terms of this ordinance,
the City Council may, at its option,
.declare a forfeiture of -all. rights
,granted under this ordinance. Pro-
vided, however, the failure to operate
because of .. strikes, fires or other
causes beyond the control of said
.company,. shall ,not work such a for-
feiture.
SECTION 16: The '.rate of fare,

AN ORDINANCE GRANTING TO
THE UNION ELECTRIC COM-
PANY, A CORPORATION OF DU-
BUQUE, IOWA, ITS SUCCESSORS
AND ASSIGNS, THE RIGHT TO
ERECT, MAINTAIN AND OPER-
ATE FOR A TERM OF TWENTY -
FIVE YEARS A CERTAIN LINE OF
STREET RAILWAY TO CONNECT
WITH ITS PRESENT LINES AND
TO EXTEND INTO EAGLE POINT
PARK, DUBUQUE, IOWA, AND
APPROVING THE A.CTION OF
THE PARK BOARD OF THE CITY
OF DUBUQUE IN GRANTING
SAID COMPANY THE RIGHT TO
CONSTRUCT, MAINTAIN AND
OPERATE SUCH LINE WITHIN
THE GROUNDS OF EAGLE POINT
PARK.
Whereas, the Park Board of the City
of Dubuque, Iowa, has adopted a res-
olution as follows:
Whereas, this Board teas requested
the Union Electric Company to ex-
tend its street railway line into Eagle
Point Park, believing tnat such ex-
tension will greatly increase the pleas-
ure and benefit to be derived from said
park by the citizens of Dubuque, and,
Whereas, it is proposed to ask the
City Council of the City of Dubuque,
Iowa, to adopt an ordinance granting
to said Union Electric Company, its
successors and assigns, a franchise
for the term of twenty -five years from
the adoption of such ordinance by said
Council and its acceptance by said
Company, authorizing and empowering
said. Company to construct, maintain
and operate a street railway line along
and upon Seventh Avenue in the City
of Dubuque,_ from the intersection of
said avenue with Rhomberg Aver
to a point approximately one thou-
sand feet therefrom, and thence from
such point on said Seventh Avenue in-
to and upon the grounds of said Eagle
Point Park:
Therefore, Resolved ' by the Park
Board of the City of Dubuque, Iowa,
that there is hereby granted to the
TTnion Electric Company, a corpora-
tion organized under the laws of Iowa,
its successors and assigns, for the
,'berm of twenty -five years froth the
date of the acceptance by said Com-
pany of an ordinance of the City of
Dubunue; Iowa, as above contemplated,
the right and authority to construct,
operate and' mmi'xitaim a single or
double track for street railway pur-
poses.with the necessary switches and

turnouts from a point in Seventh Ave-
nue in the City of Dubuque, approxi-
mately one thousand feet northerly
from the intersection of said avenue
with Rhomberg Avenue, through,
along and upon the grounds known as
Eagle Point Park, in a general north-
erly direction approximately one thou-
sand four hundred feet, thence in a
general easterly 'Erection approximate-
ly one thousand two hundred feet, ter-
minating at that point in said Eagle
Point Park, subject to the provisions,
restrictions and conditions that may
be fixed by said proposed ordinance of
the City of Dubuque.
Now therefore, be it Ordained, by the
City Council of the City of Dubuque:
Section 1. That the action of the
Park Board of the City of Dubuque, as
embodied in the foregoing resolution, is
hereby approved.
Section 2. That there is hereby grant-
ed to the Union Electric Company, a
corporation organized under the laws
of Iowa, its successors and assigns, for
the term of twenty -five years from
the adoption hereof and its acceptance
by said Company, the right and au-
thority to lay a single or double track
for street railway purposes, with the
necessary switches and turn -outs, here-
after to be determined and agreed up-
on along and upon Seventh Avenue is
the City of Dubuque, from its inter-
section with Rhomberg - Avenue to a
point approximately one thousand
(1,000) feet in a northerly direction,
thence along and upon the ground
known as Eagle Point Park in the
same genera] northerly direction ap-
proximately one thousand four hun-
dred (1.400) feet, thence to an easterly
direction approximately one thousand
two hundred (1,200) feet, and termi-
nating at that point in Eagle Point
Park, also the right to operate ears
thereon, subject to, and in accordance
with the following restrictions and
conditions:
Seel" 3. For the purpose of cen-

Electric Company, its successors and .
assigns, shall have the right and au-
thority to go upon said street and park
grounds and make such excavations
therein as may be necessary for the
construction, completion, operation and:
maintenance of said street railway
line, and shall have the further right
and authority to make track and over-
head wire connections at intersections
and with car barn and power house, .
and to construct all necessary side
tracks, turn -outs, and switches, a,n&
shall also have the riglit to erect, een,-
strnct and maintain such overheat;;
wires and poles as may be necessary
to ' conduct electrical power over said
wires from its power station to. and
alone said line of street railway:
Section 4. Said Union Electric Com,

pany shall, after makng such excava-
tions in said street as :nay be neces-
sary for the proper construction of
said track, and within a reasonable
time, restore and leave it in as good
condition as it was when such work was
begun, and shall remove any refuse,
debris, or other encurnorance result-
ing from said work. Said Company
shall also repair all damages which
may be done to said street by the
maintenance of said track during the
life of the franchise hereby granted.
SECTION 5: The portion of said
street railway line to be laid on Sev-
enth Avenue shall be constructed on
the present established grade thereof,
and the portion to be lai l in Eagle
Point Park shall be constructed on
such grade as shall be deemed best
for the operation of street railway
cars thereon. The gauge of said
track shall be what is known as the
standard gauge, to -wit, four feet,
eight and one -half inches.
SECTION 6. Said Union Electric
Company, its successors and assigns,
shall be liable to any person injured
by reason of its negligence in the
construction, maintenance or opera-
tion of said street railway. And
should any action be commenced or
prosecuted against the City of Du-
buque, upon any such claim for dam-
ages, said Union Electric Company,
its successors and assigns, shall, up-
on being notified of such suit, defend
the same; and should any judgments
be rendered against the City in ac-
tions brought against it by reason of
the negligence of said Company, its
officers, employes, or agents, said
Company shall pay and fully dis-
charge same.
SECTION 7: Nothing in this ordi-
nance, nor any privileges granted
thereby, shall be construed to pre-
vent the proper authorities of the
City of Dubuque from hereafter mak-
ing improvements which may be nec-
essary upon said Seventh Avenue,
but such work must be done so as to
offer as little obstruction as possible
to the operation of the cars of said
Company.
SECTION 8: Said Union Electric
Company, its successors and assigns,
shall whenever practicable have the
right to use any telephone, telegraph
or fire alarm- poles or posts owned or
controlled by • the City, now set or
which may hereafter be set along the
line of the track for which franchise
is hereby granted. And, whenever
practicable, the City shall have the
right to use any poles or posts which
may be set by said Company along
said line, when such posts and the
wires put thereon are used solely for
the benefit and use of the said City of
Dubuque; in either case there shall be
ho compensation for such use.
SECTION 9: The cars of said street
railway shall begin running not later
each year than June 1st, and shalt
cease running not earlier than Sep-
tember 15th, and during each day of
this period the cars shall begin run-
ning not later than 1 p. m., and shall
cease not earlier than 9:00 p. m., and
shall be run at intervals of not more
than fifteen minutes Provided, how-
ever, that if the said Park Board of
the City of Dubuque shall agree with
said Union Electric Company upon a
different schedule than the foregoing,
compliance by said Company with
such agreement shall be deemed to be
a compliance with this section of this
ordinance. If said Company shall
abandon the line herein provided for
without consent of the City Council,
or shall fail to operate it in accord-
ance with the terms of this ordinance,
the City Council may, at its option,
declare a forfeiture of all rights
granted under this ordinance. Pro-
vided, however, the failure to operate
because of strikes, fires or other
causes beyond the control of said
company, shall not work such a for-
feiture.
SECTION 10: The rate of fare,
except on chartered cars, shall not
exceed five cents for each adult pas-
senger for a continuous trip in one
direction over this and connecting
lines within the city limits. The fare
for children under twelve years of
age shall be three cents. Transfers
shall be issued when necessary to
carry out the above provision.
SECTION 11: Said Union Electric
Company, its successors and assigns,
shall transport free of charge on its
cars on said line as ordinary pas-
sengers, all policemen and firemen
regularly employed as such by the
City of Dubuque, when in the uniform
of their respective departments.
SECTION 12: This ordinance shall
take effect and shall be in force from
and after its passage and publication
in the Telegraph - Herald and Times -
Journal, the official papers of the City
of Dubuque, and upon the filing with
the City Recorder by the Union Elec-
tric Company of its written accept-
ance of this ordinance.

GRADE ON WOOD STREET
FROM ROSEDALE AVENUE TO
THE SOUTH END OF ROSEDALE
ADDITION.
Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That a grade on Wood
Street from Rosedale Avenue to the
Routh end of Rosedale Addition be
and the same is hereby established
and adopted as shown by the profile
of said street and grade prepared by
the City Engineer, being Profile No.
731, bench mark W., sill on N. side
of frame house No. 223 Wood Street,
elevation 248.52. Said grade begins
at the south curb line 155.55, west
curb line 156.75; thence to station
3+89, which is south end of Rosedale
Addition, elevation east curb 220.02.

Section 2. This Ordinance shall be
