Council of the City of Dubuque.
Gentlemen: The undersigned, John
Walser, respectfully states that he is
a qualified elector of the City of Du-
buque, Dubuque County, Iowa. That
he is the purchaser, successor and as-
signee of the saloon business of George
Knockle, which said George Knockle
was engaged in the business of selling
and keeping for sale of intoxicating
liquors within the City of Dubuque,
Dubuque county, Iowa, under proper
resolution of consent heretofore grant-
ed by your Honorable Body, which
said business was conducted by said
George Knockle at 646 Clay street, in
said city. Your petitioner shows that
as such purchaser, successor and as-
signee to the business of said George
Knockle, he respectfully prays your
Honorable Body to grant him a new
permit or resolution of consent to sell
and keep for sale intoxicating liquors
in the City of Dubuque, Dubuque
County, Iowa, and that said resolution
be in renewal of the resolution here-
tofore granted said George Knockle,
and that you cause the following res-
olution to be adopted, and to become
effective July 1st, A. D. 1912.

Be It Reolved by the City Council
of the City of Dubuque, Iowa, That
consent is hereby given John Wal-
ser to sell and keep for sale in-
toxicating liquors and to deal therein

vided by law. This Resolution of Con-
sent is given in renewal of the Reso-
lution of Consent heretofore adopted
and now in force, consenting to the
sale of intoxicating liquors in the City
of Dubuque, Iowa, by George Knockle,
and this Resolution to be effective on
and after July 1st, 1912.

spectfully asks your Honorable Body
to consent to the sale and keeping for
sale of intoxicating liquors by him in
the City of Dubuque, Iowa, he having
purchased the business formerly con-
ducted by Charles Raab at 2389 Cou-
ler avenue, and he asks this consent
in renewal of the consent heretofore
granted by your honorable body to
said Charles Raab, and he further
asks that you cause the attached res-
olution to be adopted.

City Recorder Shea presented and

lishers, of the City Council's intention
to construct a sanitary sewer on Ar-
lington Street from present manhole
at the intersection of Highland Place
westerly to a point about 10 feet west
of the easterly line of Lot 796 in -Mc-
Daniel's Sum - division; also the re-
monstrance of H. B. Noyes et al.
On motion of Ald. Wallis notice and
remonstrance were referred to the
Committee of the Whole and interest-
ed parties notified to appear at the
meeting. '
City Recorder Shea presented and
read the notice, certified to by the
publishers, of the City Council's in-
tention to improve Fenelon Place from
the east line of Raymond Place to the
east line of Burch Street, also the re-

Ald. McLaughlin moved to have the

Ald. McLaughlin moved that notice
and remonstrance be referred to the

Mayor Lyons stated that a commit-
tee of ladies represnting the Hyde
Clark Post wished to address the
Council.
Ald. Wallis moved the rules be sus-
pended for the purpose of allowing the
ladies to address the Council.

Mrs. Martha Poor, in behalf of the
Hyde Clark Post, in a fitting speech
presented to the Council an American

accepted and the ladies be given a sin-
cere and heartfelt vote of thanks.

and Buildings would respectfully state
that we have examined the repairs to
the sidewalk abutting the Ninth Street
Engine House, by E. J. Schilling, con-
tractor, and would respectfully recom-
mend that said work be accepted.

respectfully report that this work is
not being done and never has been
done Witnesseth: Said Union Electric
Co., in consideration of the covenants
and agreements on the part of said
City to be kept and performed as
hereinafter stated, hereby promises to
furnish all materials and do all the
necessary work and labor in sprink-
ling with a Sprinkling Car to be oper-
ated by said Union Electric Company
upon its tracks, all of the following
parts of streets for the full width
thereof, three times daily, except the
designated parts of Main Street, Clay
Street and Couler Avenue, which shall
be sprinkled four times daily for the
full width thereof.
The parts of streets hereby agreed to
be sprinkled by said Union Electric
Company are as follows:

Sanitary Officer Lynch reported that
the stagnant water in lots on Algona
avenue was caused by the city in put–

Regular Session, July 5, 1912
Mayor Lyons moved that the Board
of Health petition the City Council to
lay a sanitary sewer in Washington
street from Twenty- second to Twenty -
fourth. Carried.
Chairman Andresen reported that
after viewing the dump on Fourth
street extension, it was found advis-
able to erect another dumping plat-
form.
Dr. Kennedy's report on butter test
and the destroying of two tuberculosis
cows was on motion of Mayor Lyons
received and filed.
R. Kolck offered the following:
Be It Resolved by the Board of
Health, that the Health Officer be and
he is hereby directed to file informa-
tions against all persons who have
failed to comply with notice in writ-
ing heretofore given them to remove
garbage, offal, manure or other offen-
sive matter from their premises, and
all garbage, offal, manure or rubbish,
from the alley back of the same. Also
to file such informations after one no-
tice in writing, against all persons,
hereafter placing or allowing any gar-
bage, offal, manure or other offensive
matter to remain upon private prem-
ises, under their control, or placing or
allowing any garbage, offal, manure or
other offensive matter, or any kind of
rubbish to remain upon any street or
alley or other public place, in front of
or adjoining their premises. That
such informations be filed under the
direction of the City Attorney and
prosecuted promptly and impartially.
On motion of R. Kolck, resolution
was adopted.

view avenue from a point about op-
posite the south' line of Lot 2 of Min-
eral Lot 31, southerly to Southern
Avenue be improved by grading, curb-
ing and guttering with concrete com-
bination curb and gutter, and macad-
amizing said portion of said street in
accordance with the plans and spec-
ifications for such improvement pre-
pared by the City Engineer and now
on file in the office of the City Recor-
der, and be it further
Resolved, That said improvement
shall be completed on or before the
first day of October, 1912, and shall
be paid for in the manner prescribed
by Chapter XXXII. of the Revised Or-
dinance of the City of Dubuque for
the payment of the cost of street im-
provements.
The proposals for doing said work
shall be acted upon by the Council on
the 22nd day of July, 1 91'2, and the

Mt. Pleasant Avenue, and the kind of
material to be used, and an estimate
of the entire cost thereof, and the
amount and cost of sucn improvement,
and the amount assessable upon any
railway or street railway company, the
amount and cost thereof, to be paid
by the city, if any, and the cost there-
of and amount assessable upon each
lot or parcel of land adjacent to or
abutting upon such improvement per
front foot, and to file such plat and
estimate in the office of the city re -_
corder; that after the filling of said
plat and estimate in- his office, the city
recorder shall publish in three con-
secutive issues of a newspaper pub-
lished in this city, a notice stating that
such plat and estimates are on file,
the location and nature of the im-

constructed in Twentieth street from
the present sewer at the intersection
of the alley between Jackson and
Washington Streets, easterly to a point
about ten feet east of the westerly
line of lot 9 in East Dubuque Addi-
tion, according to the plans and spec-
ifications of said sewer prepared a
the City Engineer and now on file in
the office of the City Recorder, and be
it further
Resolved, That said sewer shall be
completed on or before the first day
of September, 1912, and shall be paid
for at the time and in the manner
prescribed by Chapter XXXIV. of the
Revised Ordinances of 1901 of the City
of Dubuque for the payment of the
cost of constructing sewers. The pro-
posals for doing such work will be
acted upon by the Council on the
day of 1912, and the

Resolved, That said improvement

by Chapter XXXII. of the Revised Or-

bidders for both the improvement
and constructing sewer in Wooten
Avenue.

Bros, be awarded the contracts, they
being the lowest bidder. and their
bond be placed at 1 -4 the amount of
the contract. Carried.
City Engineer Baumgartner re-
ported that Wilmer Cook was the
lowest bidder for improving Valeria
Street.

bond be placed at 1 -4 the amount of

Ald. Frith moved that the Mayor
be appointed a committee of one to
consult with the Water Works Co. to
ascertain the reason why water has
not been turned into the water mains
at the Brunswick - Balke - Collender

Attorney be instructed to report at
the next Council meeting what pow-
er the Council has over the Water

Public Grounds and Buildings be giv-

AN ORDINAN CE Prohibiting Children
from Being Abroad on the Streets,
Alleys, Public Grounds and Other
Public Places of the city of Du-
buque, Iowa, During Certain Hours.
Be it ordained by the City Council of
Dubuque, Iowa:
Section 1 —That it shall be unlawful
for any boy or girl under the age of
sixteen years to be abroad in or upon
the streets, alleys, public grounds, pub-
lic buildings, or other public places, of
the City of Dubuque, between the hours
of 9:15 p. m. and 4:30 a. m. unless ac-
companied by his or her parent or
guardian, having said boy or girl in
chare'e, or unless upon some absolutely
necessary errand by permission or di-
rection of his or her parent or guard-
ian, or - unless the employment permitt-
ed by the state laws of such boy or
girl makes it necessary that said boy
or eirl be upon said streets, alleys, or
other public places after the said speci-
fied hour.
Section 2 —It is hereby made unlawful
for any parent or guardian or other
person having the legal care and cus-
tody of any boy or girl under sixteen
years of age, to allow or permit such
child, ward or other person under such
age, while in his legal custody to go or
be unaccompanied upon any of the
streets, alleys, or other public places in
said city within the time prohibited in
section 1 of this ordinance unless as
provided for in the exceptions mention-
ed in section 1.
Section 3 —It shall be the duty of each
member of the police force to take into
custody any violator of section 1 of this
ordinance, and shall take home said boy
or girl, or see that he or she is taken
home by some other member of the
force. Such violation of section 1 by
any boy or girl shall make said parent
or guardian liable to a fine of not less
than $6 nor more than $10 for each
offense.
Section 4 —It shall be the duty of the
member of the police force who takes
into custody any violator of section 1 to
report to the Justice of Police the name
of the party subject to fine, as desig-
nated in section 3, and bring said party
before said justice for trial.
Section 5 —It shall be the duty of the
mayor to arrange with some manufact-
uring plant or plants to have their
whistles sounded for a duration of
twenty seconds or more beginning at
the hour of nine each evening, said
whistles to provide sufficient volume of
sound to he heard throughout the city.
Section 6 —All ordinances or parts of
ordinances conflicting with this ordi-
nance are hereby repealed.
Section 7 —This ordinance shall be in
effect on and after its passage by the
City Council and its publication one
time in the Dubuque Telegraph- Herald
and Times - Journal newspapers.

Regular Session, July 18, 1912
this matter has not been decided un-
der the statutes of our state, but the
supreme court of the state of Illinois
has held expressly that a special as-
sessment under these circumstances is
valid and that the benefits conferred
are sufficient even though the prop-
erty owner has not the extra advan-
tage of water connection with the city
mains. The court there holds that the
sewer may be used nevertheless for
different sanitary purposes and it may
be made available for all purposes by
private plumbing construction.
It is likely that if this question
reaches our supreme court they would
be apt to reason along this line and
sustain the assessment where the im-
provement had been ordered in good
faith and in- the exercise of good judg
ment on the part of the City Council.

ma M. Hawe for One Thousand Dol-
lars ($1,000) for personal injuries
sustained by her as a result of a fall
on the llth day of March, 1912, on a
sidewalk on the north side of West
Fifth street, abutting the property
known as the Con Collins es-
tate, which sidewalk she claims was
in a defective condition, in that it was
allowed to become covered with a
quantity of rough, rounded, uneven
and slippery ice and snow, and that
by reason of the negligence in so al-
lowing such condition to exist she sus-
tained a fracture of her left wrist and
various other injuries, would respect-
fully recommend that the claim be al-
lowed in the sum of One Hundred
Dollars ($100) and request that a
warrant be drawn for such sum.

Gentlemen: In response to your in-
quiry directed to me at your session
of the 5th inst., in relation to the
power vested in the City Cbuncil in
the matter of the conduct of the
Water Works, I beg to report that in
conformity with the verbal opinions
given you from tii'ne to tine in the
past, the City Council has no control
of the water department in so far as
its actual management and operation
is concerned.
The legislature under the provisions
; of section 1056 Al of the Supplement
' of 1907 to our Code, expressly vested
this control in the board of water
works trustees, and it must have been
the evident intention that this control
should be exclusive so that the ef-
ficiency of the conduct of the depart -
ment should not be interferred with
by conflicting or co- extensive juris-
dictions.
As the law now stands the City
Council cannot claim the right to as-
sist in or exercise direct over the
operation or management'bf the de-
partment.

question of the legality of the special
assessment for the construction of san-
itary sewers in streets in which the
city water has not been extended, re-
ferred to me at your session of July
5th last, I find on examination that

ty and is one in which the plaintiff
claims the sum of one thousand dol-
lars for personal injuries sustained by
her on the 7 3th day of January, 1911,
while walking along the sidewalk in
front of No. 47 Eighth street, the said
walk at the time being covered with
an accumulation of snow and ice,
which caused her to fall and as a re-
sult of said fall she sustained severe
injuries to her knee joint and nervous
system, which incapacitated her from
filling her vocation, that of school
teacher.
Your committee believes it to be to
the interest of the city to accept the
offer made by the plaintiff and there-
fore recommends that a settlement be
had with her upon that basis, and
that a warrant be drawn for the sum
of one hundred fifty dollars.

AN ORDINANCE Prohibiting Children
from Being Abroad on the Streets,
Alleys, Public Grounds and Other
Public Places of the city of Du-
buque, Iowa, During Certain Hours.
Be it ordained by the City Council of
Dubuque, Iowa:
Section 1 —That it shall be unlawful
for any boy or girl under the age of
sixteen years to be abroad in or upon
the streets, alleys, public grounds, pub-
lic buildings, or other public places, of
the City of Dubuque, between the hours
of 9:15 p. m. and 4:30 a. m. unless ac-
companied by his or her parent or
guardian, having said boy or girl in
charge, or unless upon some absolutely
necessary errand by permission or di-
rection of his or her parent or guard-
ian, or unless the employment permitt-
ed by the state laws of such boy or
girl makes it necessary that said boy
or girl be upon said streets, alleys, or
other public places after the said speci-
fied hour.
Section 2 —It is hereby made unlawful
for any parent or guardian or other
person having the legal care and cus-
tody of any boy or girl under sixteen
years of age, to allow or permit such
child, ward or other person under such
age, while in his legal custody to go or
be unaccompanied upon any of the
streets, alleys, or other public places in
said city within the time prohibited in
section 1 of this ordinance unless as
provided for in the exceptions mention-
ed in section 1.
Section 3 —It shall be the duty of each
member of the police force to take into
custody any violator of section 1 of this
ordinance, and shall take home said boy
or girl, or see that he or she is taken
home by some other member of the
force. Such violation of section 1 by
any boy or girl shall make said parent
or guardian liable to a fine of not less
than $5 nor more than $10 for each
offense.
Section 4 —It shall be the duty of the
member of the police force who takes
into custody any violator of section 1 to
report to the Justioe of Police the name
of the party subject to fine, as desig-
nated in section 3, and bring said party
before said justice for trial.
Section 5 —It shall be the duty of the
mayor to arrange with some manufact-
uring plant or plants to have their
whistles sounded for a duration of
twenty seconds or more beginning at
the hour of nine each evening, said
whistles to provide sufficient volume of
sound to be heard throughout the city.
Section 6 —All ordinances or parts of
ordinances conflicting with this ordi-
nance are hereby repeated.
Section 7 —This ordinance shall be in
effect on and after its passage by the
City Council and its publication one
time in the Dubuque Tetegraph- Herald
and Times- Journal newspapers.

sessable upon each lot or parcel of
land adjacent to or abutting upon

the poles and I know of no rule of
law which would prevent their re-
moval by the company. I do find In
Section 34 of Chapter 30 of the Re-
vised City Ordinances of this city,
the following provision:
"Loops, wires, poles and other sup
ports no longer in use, and of which
there is no immediate prospect tor
further use shall be removed."
From the information I have at
hand this company have discontinued
the use of the wires and poles that
they are in the process of removing
and it is my opinion that they have
a legal right so to do.

improve Julien Avenue from the wes-
terly lines of Alta Vista Street to the
easterly line of Alpine Street, and it is
hereby proposed to brick - gutter said
portion of said street on a macadam
foundation and to assess the cost of
said brick- guttering and macadam
foundation against the abutting prop-
erty.

ally the location, nature and extent
of the proposed improvement on Ju-
lien Avenue from the westerly lines
of Alta Vista Street to the easterly
line of Alpine Street, and the kind of
material to be used, and an esti-
mate of the entire cost thereof, and
the amount and cost of such im-
provement, and the amount assess-
able upon any railway or street rail-

thereof to be paid by the
city, if any, and the cost
thereof and amount assesssable upon

City Recorder shall publish in three
consecutive issues of a newspaper
published in this city, a notice stating
that such plat' and estimate are on
file, the location and nature of the
improvement, kind of material to be
used, and an estimate of its cost, and
the time before which objections
thereto can be filed, and the time fix-
ed for hearing, which time shall not
be less than five days after the last
publication of such notice, and after
such publication shall have been
made, the City Recorder shall, at the
next regular session of the City Coun-
cil, notify the Council thereof in
writing, with a printed copy of such
notice accompanying the same.

Council of the City of Dubuque, That
to provide for the cost of constructing
a sanitary sewer in Nevada Street
from Langworthy Avenue to Dodge
Street, the Mayor be and he is hereby
required to execute and deliver to the
City Recorder, to be by him registered,
and countersigned, three bonds for
two hundred and fifty dollars each and
one for two hundred sixty -three and
01 -100 dollars„ numbered 1455 to 145S,
inclusive, dated August 5th, 1912, pay
able on or before seven years after the
date thereof, and bearing interest at
the rate of five per cent per annum,
payable semi- annually.

front of the Levee on the evening of
July Fourth, the Levee will be kept
clear of all vehicles after 6 p. m.

street extension and across Jones
street, on the east side of Water
street, that is the street next west of
and parallel with the Levee; also, on
Railroad avenue at west line of Levee.

2715 lineal feet combination ce-
ment curb and gutter.
2457.2 cubic yards of cutting.
879.2 cubic yards filling.
Making a total estimated cost to
the abutting property owners of
$4.032.00.
Any person having objection to
said improvement is hereby notified
to appear before the City Council at
its next regular session to be held
August 1, 1912, or to file with the
City Recorder their objection in writ-
ing on or before August 1, 1912.
