ing the City to open a street to con-

1905, in the sum of $50.00 each, in
favor of Ernestine Lavery. These
warrants were recently so badly dam-
aged by fire that they can not be han-
dled, nor interest indorsements made
thereon.
On August 15, 1912, your honor-
able body instructed me to accept
from Michael Kearney the principal,
without interest, for the special as-
sessment levied against his property
in 1904 for the construction of a
sewer. As the property was sold at
tax sale in 1907 for the collection of
this special tax, and bought in by the
City, the tax sale certificate for same
amounts to $94.37, which amount rep-
resents that much cash to the City
Treasurer. In order that I may de-
liver the tax sale certificate to Mr.
Kearney, it will be necessary for your
honorable body to have a warrant
drawn in my favor in the sum of
$14.82, which amount includes inter-
est and costs taxed by the City Treas-
urer when the property was sold.
The special assessment amounted to
$79.55.
Please have a warrant dr -wn in
sum of $136.80 on special bonded
paving fund, in my favor, to pay for
City's share of Kniest Street sewer,
$101.30, and Middle Avenue sewer,

Gentlemen: I herewith return the
petitions of the Dingman Ball estate,
Jacob Welty and Nicholas Glab, in
each of which petitions the petitioner
objects to a special assessment levied
against their respective properties for
the construction of sanitary sewers
and in each case the petitioner con-
tends that there has been levied and
paid special assessments against the
same property for the construction of
other sewers abutting the same.
Under the law as it exists at this
time, special assessments can only be
levied according to the benefits con-
ferred upon the property by the im-
provement. It is my opinion that a
second sewer abutting any particular
lot would confer no additional benefit
thereon providing the sewer first con-
structed was still in working order,
serviceable and properly drained the
territory through which it ran. Eacn
instance of this character, however,
must be governed by the facts in the
particular case.
Referring to the petitions returned
herewith, if the Council is satisfied
that the sewer for which an assess-
ment was levied and paid is still in
working order, a second assessment
for a sewer running along another
side of the respective lots would in
my opinion confer no benefit upon
them, and the prayers of the petition-
ers should be granted. If, however,
from long usage they have become
worn out, defective or insufficient and
a new sewer was constructed because
of such fact, then the second assess-
ment would be legal and proper.

of the City of Dubuque:
Gentlemen: I herewith return the
petition of the Illinois Central Railroad
Company, which was presented to the
Board of Review of the City of Du-
buque, and wherein they complain and
object to the assessment returned by
the City Assessor against what is
known as The Banana Cooling Plant,"
located within the city limits of Du-
buque.
Under Section 1334 of the Code of
1897, it is made the duty of the Exe-
cutive Council of the State of Iowa to
assess all the property of railway cor-
porations in the state excepting lands,
lots and other real estate belonging
thereto not used in the operation of a
railway, and excepting railway bridges
across the Mississippi and Missouri
rivers, and excepting grain elevators.
The property of such corporations is
not subject to assessment by the local
authorities except as above indicated,
and it is my opinion that if the con-
tention of the railroad company as ex-
pressed in their petition, that the
warehouse which is constructed within
the limits of the city Is exclusively
used in the operation of its railroad,
for the purpose of storing or taking in
fruit which has been shopped upon or
over the line of said company, is,borne
out by the facts, then the assessment
as returned by the City Assessor is er-
roneous and invalid and should be can-
celled as prayed in the petition. If,
however, the lessee, the Fruit Dispatch
Company uses the premises for any
other than railroad purposes, then it
would be subject to local taxation and
the assessment would stand providing
the sum for which it is assessed is not
excessive.
I have made some Investigation id
an attempt to ascertain the true facts
regarding the matter and from the in-
formation I receive it appears that the
sheds are used exclusively for the
purposes stated in the petition, and are
not used in any manner which would
authorize the levy of a local assess-
ment against the property.

Gentlemen: I return herewith the
petition of the Dunleith & Dubuque
Bridge Company, directed to the
Board of Review of the City of Du-
buque where in said Company com-
plains and objects to an assessment of
the railroad bridge between Dubuque
bnd East Dubuque, as ieturned by the
City Assessor.
Under Sec. 1342 of the Code of 1897.
railway bridges across the Mississippi
river are subject to assessment and
taxation on the same basis as proper-
ty of individuals in the several coun-
ties where situated, and it is my opin-
ion that the City Assessor has a right.
to assess the property as a whole, in-
cluding the approaches thereto, with-
out specifically setting out the sepa-
rate items 'going to make up the valu-
ation placed upon the bridge, and he
Lad a right in reaching his conclusion
as to its valuation, to take into con-
sideration the fact that it was a go-
ing concern and any other facts
which would tend to give value to the
property.
I have been informed by the As-
sessor that the value placed upon this
property for the year 1911, is the same -
as was placed upon it for a number
of years in the past and is as return-
ed by a represntative of the bridge
company, and would therefore recom-
mend that the petition be received and
filed.

We further recommend that the
City Engineer be instructed to pre-
pare a special assessment against
each lot or parcel of real estate bene-
fitted by such improvements and file
the same in the office of the City Re-
corder, who will thereupon publish
the notice of said assessment as re-
quired by ordinance.

$12.60 from the bill of C. B. McNa-
mara & Co., for cleaning dirt left in
gutter after the completion of the
Couler Avenue sewer. Carried.
Ald, Andresen moved that the
wooden beds not in use by the fire-
men be donated to the St. Vincent de
Paul Society. Carried.
Ald. McLaughlin moved that the
Fire Committee purchase a gas heater
for the Delhi Street Engine House.
Carried.
Your Harbor Committee, to whom
was referred the petition of Lester
Smith, et al., would recemmend the
same be received and filed.
Your Harbor Committee would
further recommend in regard to the
Smith matter that Mr. Smith be giv-
en the privilege of erecting new steps
on the bank leading to ferry dock.
Your Harbor Committee would
recommend that in future no sub-
letting of harbor space be permitted
without formal consent of the Coun-
cil_.
Your Harbor Committee would
recommend that the Barber Master
and Chief of Police be instructed to
remove all house boats drawn up on
shore and all dwelling places on the
shore between the High Bridge and
the end of the harbor.
Your Harbor Committee would
recommend that the boat house own-
ed by Mr. Rasmussen, which is an-
chored in front of and obstructing the
bathing beach at Eagle Point Avenue
be removed elsewhere under direction
of the Chief of Police.

Petition of Mrs. Cathlerine Closs,
asking for an extension of time till
next spring to make sanitary connec-
tions, was, on motion of W. Fossel-
man, received and filed.
Petition of Mrs. Brasen, asking to
be given permission of erect a vault,
was, on motion of W. Fosselman, re-
ferred to Sanitary Officer with power.
Communication of R. Kolck asking
to have an ordinance adopted enforc-
ing the use of metal garbage cans,
was, on motion of R. Kolck, referred
to the City Attorney and Ordinance
Committee, they to draft an ordi-
nance covering the same.
Petition of J. W. Lange et al re-
latives to the collection of garbage
on Angella and Catharine streets, re-
ferred to the Board of Health by the
Committee of the Whole was read and
on motion of Ald. McLaughlin the
garbage was ordered to be collected
on said streets.

been bought by the City and paid for

amount of macadam so used, and that
the same be given the Street Corn -
missioner for immediate collection,
which is the agreement had with
said contractors, and that the amount
when collected be turned into the
City Treasurer and credited to the
Fifth Road District appropriation.

it is hereby propose d to grade, curb,
gutter and macadamize said portion
of said street and to assess the cost
of said curbing, guttering and macad-
amizing against the abutting property.

Be it Resolved by the City Coun-
cil of the City of Dubuque, That the
city engineer be and he is hereby di-
rected to prepare a plat showing
generally the location, nature and ex-
tent of the proposed improvement on
the westerly side of Elm street from
the northerly line of Twenty - fourth
Street to the southerly line of Twenty -
seventh street, and the kind of ma-
terial to be used, and an estimate of
the entire cost thereof, and the
amount and cost of such improvement,
and the amount assessable upon any
railway or street railway company,
the amount and cost thereof, to be
paid by the city, if any, and the cost
thereof and amount assessable upon
each lot or parcel of land adjacent
to or abutting upon such improve-
ment per front foot, and to file such
plat and estimate in the office of the
city recorder, that after the filling of
said plat and estimate in his office, the
city recorder shall publish in three
consecutive issues of a newspaper
published in this city, a notice stating
that such plat and estimates are on
file, the location and nature of the
improvement, kind of material to be
used and an estimate of its cost, and
time before which objections thereto
can be filed, and the time fixed for
hearing, which time shall not be
less than five days after the last pub-
lication of such notice, and after such
publication shall have been made,
the city recorder shall, at the next
regular session of the City Council,
notify the Council therof in writing,
with a printed copy of such notice ac-
companying the same.

15th day of December, 1912, and
shall be paid for in the manne r pre-
scribed by Chapter XXXII. of the

Be it resolved, by the City Council
of the City of Dubuque:
That whereas, it appears from a
report duly made by the Board of
Health of the City of Dubuque, that
a proper resolution was passed by
said Board at its regular meeting on
July 30, 1912, ordering Nick Closs Est.,
owner of East 1 -2 of lot 37, L. H,
Langworthy Add., to connect said
property with the sanitary sewer in
alley between White and Jackson
Street, and that proper notice of the
passage of such resolution was given
to said owner as required by ordi-
nance:
And whereas, it appears from the
report of said Board of Health that
said owner has failed to make con-
nection within the time required and
in accordance with said notice, and
said Board of Health has had pre -
pared plans and specifications of the
sewer connections contemplated to be
made, with an estimate of the cost
thereof by the City Engineer, which
plans and specifications and estimate,
together with said report of the action
of the Board of Health in ordering
said sewer, have been submitted t:.
this Council for approval;
Therefore it is now ordered that
said plans and specifications and esti-
mate, together with said report of
said Board of Health, are hereby ap-
proved and said connection ordered
made by contract, in accordance with
such plans and specifications, as pro-
vided by. ordinance, and the City Re-
corder is hereby instructed to adver-
tise in the official papers of the City
for three times within a period of ten
days, for proposils for constructing
said connection with said sanitary
sewer, said work to he done under the
supervision of the City Engineer and
the Committee on Sewers, and all bids
received to be submitted at the next
regular meeting of this Council after
the expiration of said period covered
in said advertisement, said bids to
be then opened by this Council and
the contract awarded to the lowest
bidder.
Be it further resolved, that upon
the completion of said work and ac-
cetpance thereof by the City Council,
the City Engineer shall report to the
-Council the cost thereof, including the
cost of estimates, notice, inspection
and preparing the assessment and
;plat, and the City Council shall levy
an assessment against the specific
property of the owner thereof, in an
amount equal to said cost and ex-

prove Fifth Avenue, from the end of
the brick paving thereon, which is
about eight hundred and ninety -five
feet northerly from Rhomberg Ave-
nue, northerly to the north line of Lot
6 in Peil's Sub., and it is hereby pro-
posed to grade to sub -grade and pave
said portion of said avenue with brick
blocks on a macadam foundation with
sand cushion and asphalt binder and
to assess the cost of said grading,
brick - paving and macadam foundation
against the abutting property.

Proposed improvement on Fifth Ave-
nue from the end of the present brick
paving thereon, which is about eight
hundred and ninety -five feet northerly
from Rhomberg Avenue, northerly to
the north line of Lot 6 in Peil's Sub.,
and the kind of material to be used,
and an estimate of the entire cost
thereof, and the amount and cost of
such improvement, and the amount
assessable upon any railway or street
railway company, the amount and
cost thereof, to be paid by the city, if
any, and the cost thereof and amount
assessable upon each lot or parcel of
land adjacent to or abutting upon
such improvement per front foot, and
to file such plat and estimate in the
office of the city recorder; that after
the filing of said plat and estimate In
his office, the city recorder shall pub-
lish in three consecutive issues of a
newspaper published in this city, a
notice stating that such plat and esti-
mates are on file, the location and na-
ture of the improvement, kind of ma-
terial to be used, and an estimate of
its cost, and the time before which
objections thereto can be filed, and the
time fixed for hearing, which time
shall not be less than five days after
the last publication of such notice,
and after such publication shall have,
been made, the city recorder shall, at
the next regular session of the City
Council, notify the Council thereof in
writing, with a printed copy of such
notice accompanying the same.

pose of a water way from Alpine
Street to Alta Vista Street; therefore,
Be it Resolved by the City Council •of the City of Dubuque, Iowa, that the
City Engineer be and he is hereby di-
rected to make a survey and plat of
such proposed improvement, showing
the land or lots through or over which
the same is proposed to tie made, the
names of the owners thereof, and the
quantity of land proposed to be taken.
When such plat is so prepared, said
City Engineer shall file the same in
his office subject to public inspection,
and shall give the owners of the prop-
erty affected, notice as provided by
Section 2 of Chapter XXXI. of the Re-

Council of the City of Dubuque, That
to provide for the cost of constructing
a sanitary sewer in West Fourteenth
Street from the alley first west of Mt.
Pleasant Avenue, westerly to Wood
Street, thence northerly in Wood
Street to Rosedale Avenue, the Mayor
be and he is hereby required to exe-
cute and deliver to the City Recorder,
to be by him registered and counter-
signed, five bonds for two hundred and
fifty dollars each and one bond for
three hundred eighty -one and 87 -100
dollars, numbered 1489 to 1494, dated
October 5th, 1912, payable on or be-
fore seven years after the date there-

The undersigned owners of all the
Property abutting on West Fifteenth
Street between Cornell Street and the
easterly line of Lots 3 and 9 in Mor-
gan's Sub. hereby petition your honor-
able body, in the improvement of said
West Fifteenth Street now being made
along said portion of said street that
the width of the roadway be made
twenty -two feet between curbs and the
sid3 walks space six feet from curbs
line to lot line, and in consideration of
the foregoing changes being made in
the plans and specifications for said
improvement, we hereby waive any
and all objections to any irregularity
or illegability that may accure thereby
and agree to pay our assessment for
said improvement when due.

the total loss of his property by fire
during the month of March, 1911, the
City accept one - fourth of the taxes
assessed against him in full for said

which such taxes are levied, the
granting of said petition would be
contrary to the intent of the law and
we would therefore respectfully re-

whioh sewer said property is conn&
ed, and asking on account of no beni-

Sealed proposals will be received at
the Council Chamber, City Hall, by
the City Recorder until 8:00 p. m.
Thursday, October 3, 1912, for the im-
provement of the following streets by
laying cement sidewalks on a found-
ation of cinders, in accordance with
the plans and specifications prepared
by the City Engineer, and now on file
in the office of the City Recorder.
A four -foot sidewalk, in front of
Lot 72 of Union Add., abutting on
south side of Dodge Street.
Also, a four -foot sidewalk, in front
of Lot 7 of E. E. Jones' Sub., abutting
on west side of Belmound Avenue.
Also, a four -foot sidewalk in front
of Lots 778 and 779 of A. McDaniels'
Sub., abutting on west side of Prairie
Street.
The work is to be paid for when
said work is completed and as pre-
scribed by the ordinance relating to the
construction of sidewalks in the City
of Dubuque, work to he completed on
or before the 15th of October, 1912.
Bidders must state price per square
foot for sidewalks laid. Each bid
must be accompanied by a certified
check of $10.00 on some Dubuque bank

cavate in or tear up the surface of
the following named streets or parts
of streets, to -wit: Grove Terrace,

ent retaining wall dividing the grades
