Petition of Chas. J. Young, asking
to have the rules suspended in order

read.
Ald. Singin moved to have the
rules suspended for the purpose of
allowing Mr. Young to address the
Council.

Petition of T. E. Rhomberg, asking
to have the personal tax of the Rich-
ardson Shoe Mfg. Co. for the year
1904 canceled, and to allow him to
pay the taxes on the lots for 1904 and
subsequent years with 6 per cent per
annum interest, presented and read.

asking to have lot 4 in G. R. West's
Add. exempted from taxation begin-

from a point opposite the line dividing
Lot 4 and 5 in Hughe's Sub. westerly
to the present sewer in Grandview
Avenue, C. B. McNamara & Co., con,
tractors, and would recommend that
said work be accepted and that the
City Engineer be instructed to prepare
a special assessment against the lots
'or parcels Of :real estate subject to
assessment for said improvement and
file the same in the office of the City
Recorder who will thereupon publish
'the notice of said assessment as re-
quired by ordinance

Ald. Heim moved the adoption of
the report of the Committee on Sew-
ers. Carried.
Your Fire Committee would report
that, in accord with the power granted
it, it has purchased 1,000 feet of fire
'hose from the Dubuque Rubber &
Belting Co. at 85 cents a foot.
We would further state that we
have examined the Majestic theater
and find conditions entirely satis-
factory as regards fire protection and
means of exit.
We would further report that, in ac-
cordance with power granted us, we
have ordered a cement wash rack in-
staled in the Central Engine House,
on the northwest corner (entrance on
Ninth street) and have decided to place
the auto fire engine in the central
stall of the Iowa Street side, for the
present.
Your Fire Committee has examined
the Grand Opera house and would
recommend, for the better protection
c: the patrons of this theatre, that the
center aisle on the first floor be ex-
tended to immediately in the rear of
the second row of seats (necessitating
the removal of fifteen seats), that the
part of the aisle so created be altered
so as to be free of steps; we also rec-
ommend that a door be built on the
landing between the balcony and the
gallery, on the east gallery exit, and
that a fire escape approved by the
Fire Chief be constructed leading
from this door to the sidewalk on
Eighth street. We further recommend
that the Chief of the Fire Department
be instructed to give the owners of
the building immediate notice of these
orders, informing them that the
changes must be completed within
sixty days.

Chief be instructed to stop the erec-
tion of the frame building in rear of
Dreamland Theatre. Carried.

Street Sprinklers be housed in the
pond for the winter and all valuables
stripped from them and stored in the
basement of the City Hall. Carried.
Ald. McLaughlin moved that the
City Electrician be instructed to re-
move broken pole at the corner of
Cardiff and West Third Street. Car-
ried.
Ald. Frith moved that the City
Electrician be instructed to find out
the reason why the arc light at the
corner of Twenty - eighth and Wash-
ington Street has not been burning.

Gentlemen: I herewith submit my
report of defective lights for month of
November, 1912. I find from the re-
port of the Police Department that
the total hours that 37 lamps failed
to burn would equal 2 lamps burn-
ing for one month, or $10.00.
Ald. Andresen moved that the re-
port be received and the City Auditor
be instructed to deduct $10.00 from
the Union Electric Co.'s bill. Carried.
The monthly report of Wm. Foley,
- sidewalk inspector, for November,
1912, was presented and read and on
motion of Ald. Saul the report was re-
ferred to the Committee of the Whole.

Alderman Heim offered the follow-
ing:
Whereas, As is usual at the present
time of the year, it has become neces-
sary to borrow money in anticipation
of the taxes now due in order to meet
the current expenses of the city and
the payment of the interest becoming
due at this time; therefore,
Fe it Resolved by the City Council
of the City of Dubuque, that the Fin-
ance Committee be and is hereby au-
thorized to borrow $20,000.00, for a
period of not to exceed sixty clays, in
anticipation of the payment of said
taxes, and that loan warrants in said
amount be ordered drawn on the City
Treasurer, in favor of the German
Trust and Savings Bank, to cover said
loan.

instructed to prepare a special assess-
ment against the lots or parcels of
land subject to assessment against
the lots or parcels of land subject to
assessment for said improvement and
file the same in the office of the City
Recorder, who will thereupon publish
the notice of said assessment as re-
quired by ordinance.

amined the following street improve-

would respectfully recommend that
the same be accepted:
Grandview Heights, Victoria Ave-
nue, Driveway connecting Grandview
Heights and Victoria Aveue and Lin-
den Boulevard, all in Grandview Ad-
dition, Grandview Avenue from a
point opposite the southerly line of
Lot 2 of Mineral Lot 31, southerly to
Southern Avenue.
We further recommend that the
City Engineer be instructed to pre-
pare a spcial assessment against the
lots or parcels of real estate subject
to assessment for said improvement
and file the same in the office of the
City Recorder gho will thereupon
publish the notice of said assessment
as required by ordinance.

respectfully recommend that the com-
bination cement concrete curb and
permission, in the extension of its
present side track leading to the Eagle
Point pumping station, to lay down
an I .operate a track over and across
Ninth Avenue and to confirm said per-
mission by the adoption of an accom-
panying ordinance, would respectfully
recommend that the prayer of the
petitioner be granted and that said
ordinance be adopted.

whom was referred the petition of the
Dubuque Boat & Boiler Works ask-
ing for space during the coming win-
ter months on the river front, would
respectfully recommend that said peti-
tion be referred to the Committee on
Harbors with power.

Your Committee of the Whole, to
whom was referred the petition of the
Dubuque Motor Boat Club, asking that
in addition to the space allotted it on
the northside of the ice harbor for a
landing place for launches, it be grant-
ed a space on the outer levee, north of
the ice harbor, for the purpose of con-
structing and maintaining ways there-
on, would respectfully recommend that
the prayer of the petitioner be grant-
ed, and that it be allowed a space for
said purpose, eight feet wide, measur-
ed from the north side of the large
boat house now on the river bank near
the entrance to the ice harbor, and
that the City Engineer be instructed
to prepare a plat showing the location
of both grants.

Alderman Frith offered the follow-
ing:
Whereas, It appears that traffic on
the westerly side of Elm Street, be-
tween Twenty- fourth and Twenty -fifth
Streets is rendered impassable by ob-
structions placed in said Street by the
Chicago Great Western Railroad Com-
pany, therefore
Be it Resolved by the City Council
of the City of Dubuque, that the Street
Commissioner be and he is hereby in-
structed to notify the proper author-
ities of said railroad company to re-
move the crossing gate post now at
Twenty - fourth and Elm Streets to a
position more suitable for public
travel, also to remove the switch
stand in said Elm Street immediately
north of Twenty- fourth Street, and to
lower the tracks and plank the space
between the rails on the switch lead-
ing to Morrison Bros. boiler shop, and
also to construct a drain under its
right of way on Elm Street on the
northerly side of Sanford Street.

Be it Resolved by the City Council
of the City of Dubuque, That it is
deemed necessary and advisable to
improve Cooler Avenue from the
northerly lot line of Twenty- second
Street to a point fifty feet north of,
the north line of Peru Road, and it is
hereby proposed to grade to sub- grade,
curb and reset curb where necessary,
and pave said portion of said street
with creosoted blocks on a concrete
foundation with sand cushion and
pitch filler, except where said street,
is already paved with brick, and to
assess the cost of said grading, curb-
ing or resetting curb, paving, founda-
tion, cushion and filer against the
abutting property.
Ald. Frith moved the adoption of
the resolution.

Be it Resolved by the City Council
of the City of Dubuque, That the City
Engineer be and he is hereby directed
to prepare a plat showing generally
the location, nature and extent of the
proposed improvement on Couler
Avenue from Twenty- second Street to
a point fifty feet north of the north
line of Peru Road, except where al-
ready paved with brick, and the kind
of material to be used, and an esti-
mate of the entire cost thereof, and
the amount and cost of such improve-
ment, and the amount assessable upon
any railway or street railway com-
pany, the mount and cost thereof, to
be paid by the city„ if any, and the

ulations bearing on the use and oper-
ation of said track.
SECTION 7. The City of Dubuque
hereby reserves the right to revoke
the privilege hereby granted any time
after twenty years from the time this
ordinance becomes operative, or soon-
er in case said track shall not be need-
ed for commercial purposes.
SECTION 8. That this ordinance
shall take effect and be in force from
and after its passage and publication
one time in the Dubuque Telegraph -
Herald and the Dubuque Times -Jour-
nal, official newspapers of said City,
and written acceptance thereof on the
part of said Chicago, Milwaukee & St.
Paul Railway Company duly endorsed
hereon.

PERMISSION TO CONSTRUCT,

SIDE TRACK ON THE SOUTH-
EASTERLY SIDE OF ITS PRES-
ENT MAIN TRACK AND SUB -
STATIALLY PARALLEL THERE-
WITH ACROSS NINTH AVENUE
IN THE CITY OF DUBUQUE, AND
REGULATING THE CONSTRUC-
TION, USE AND MAINTENANCE
THEREOF.
Be it Ordained by the City Council
of the City of Dubuque:
SECTION 1. That Permission be
and the same is hereby granted to the
Chicago, - Milwaukee & St. Paul Rail-
way Company, its successors and as-
signs, to lay, operate and maintain a
side track on the southeasterly side of
its present main track and substanti-
ally parallel therewith, across Ninth
Avenue in the City of Dubuque, for
the purpose of extending the length
of its present side track leading to
the Eagle Point Pumping Station and
affording trackage facilities to the
lumber yard and plant of the Du-
buque Lumber & Coal Company.
SECTION 2. That the laying down
of said side track shall be done under
the supervision of the City Engineer
and Committee on Streets of said City.
SECTION 3. That in the laying
down and operation of said track the
same shall be so constructed and
maintained as to create the least pos-
sible obstruction to ordinary .travel
and the use of the street crossed. That
cars shall not be allowed to stand on
the side track in such manner as to
unnecessarily interfere with the use
thereof, and said track shall at all
times be used in accordance with all
lawful regulation's now or heretofore
enacted by said City.
SECTION 4. That said side track
shall be laid to the established grade
of the street on which it runs and
should the grade be changed at any
time said track shall be changed to
conform with such change in grade at
the expense of said Company without
any claim against said City.
SECTION 5. That said Company
shall keep the space between the rails

Gentlemen: The undersigned, to

C. B. McNamara & Co., relative to an
agreement with the Illinois Central,
Chicago, Milwaukee & St. Paul and
Chicago, Burlington & Quincy roads,
covering the railroad crossing on
Third Street, respectfully reports that
I have taken the matter up with the
various railroad companies and have
been advised by the Chicago, Burling-
ton & Quincy and the Illinois Central
railroads that they stand ready to pay
according to the agreement, and that
a voucher covering the same will be
ready for delivery in a short time.
The Superintendent or the Chicago,
Milwaukee & St. Paul Railway com-
pany reported that his company was
prepared to pay their proportion of
the expense incurred by McNamara
& Co. for the concrete blocks, upon re-
ceipt of proper information showing
the exact cost, or receipted bill for

Iowa:
Gentlemen: The undersigned, Com-
mittee on Claims and City Attorney,
respectfully report, that at the March
term of the District Court, Dubuque -
County, an action was commenced
against the City of Dubuque by Joseph
Weitz, claiming $2,500 damages for
personal injuries sustained by him on
January 20th, 1912, resulting from a
fall on a sidewalk on the north side
of Kaufman Avenue, near the intersec-
tion of Couler Avenue therewith, and
along side of a store building at said
place, and alleging that the sidewalk
was permitted to be and remain in a
defective condition, in that it was cov-
ered with an accumulation of ice and
snow which had become full of de-
pressions, hillocks and humps, and
was rounded, uneven, slippery and
dangerous. That he sustained a frac-
ture to the lower third of the left
tivia.
That the attorney representing the
said Weitz have offered and agreed
to accept in full settlement for all
claims against the city arising out of
said injury, the sum of $400, and, be-
lieving it to be to the best interests
of the city to accept the proposition
made by said attorneys, we therefore
recommend that the City Attorney be
authorized to settle and adjust said
cause for the sum of $400, such sum to
be paid during the month of March,
1913.

center line of said streets and parts
of streets whereon said track or tracks
are located. -
Section 5. Said Union Electric Cotn-
,pany, its successors or assigns, shah
repair all damages that may be done
to said streets by the construction or
!maintenance of said railway, shall
also keep the space between said rail-
way tracks and one foot on each side
thereof, in good repair at all times,
provided that in the case of double
track, when the distance between the
centers of said track is more than ten
feet, the rule requiring a foot on each
side shall prevail. The City Counci'
shall have the right to determine the
necessity for repairs, and whenever
said company, its successors or as-
signs, shall refuse or neglect to make
the same within a reasonable time af-
ter being notified thereof in writing,
the City Council shall have the right
to make such repairs at the expense
of said Union Electric Company,
successors or assigns.
Section 6. Said Union Electric Com-
pany, its successors or assigns, shall,
whenever practicable, have the right
to use any telephone, telegraph or fire
alarm poles or posts owned or con-
trolled by the city, now set or which
may hereafter be set along the line of
the track for which franchise is here-
by granted. And, whenever practic-
able, the city shall ,!have the right to
use any poles or posts which may be
set by said company along said line,
when the posts and wires put thereon
are used solely for the benefit and use
of the said City of Dubuque; in either
case there shall be no compensation
for such use.
Section 7. Said Union Electric Com-
pany, its successors or assigns, shall
be liable to any person injured by.
- reason of its negligence in the con-
struction, maintenance or operation
- of said street railway, and should any
action be commenced or prosecuted
against the City of Dubuque, upon
any claim for damages based upon
any act or negligence of said com-
pany, said Union Electric Company, its
successors or assigns, shall, upon be-
ing notified of such suit, defend the
same; and should any judgment be
rendered against the city in any such
action, said company shall fully pay
- and fully discharge the same.
Section 8. The tracks of said rail
way shall no be elevated above the
surface of the street, and shall be so
laid that carriages and vehicles can
easily, and with the least obstruction
- possible, cross the same. During the
winter, in the event of heavy snow,
said Union Electric Company, its suc-
cessors, or assigns, shall not obstruct
said streets by the removal of snow
- frhm its tracks, but shall remove any

excess of snow which may be neces-
sary to render said street passable for
vehicles. Any excess of snow thrown
from said street railway tracks, and
;which is not removed within ten,
hours thereafter, may be removed by
the city at the expense of said Union
Electric Company, its successors or
assigns.
Section 9. The cars of said railway
shall begin running not later than six
A. M., and shall cease not earlier than
eleven thirty P. M., and shall run, in
each direction, at intervals of not
more than twenty minutes. Operation
on Sundays may begin one hour later.
Section 10. The provisions of an
ordinance passed by the City Council.
of Dubuque, March 6, 1902, approved
March 13, 1902, and accepted on said
March 13, 1902, are hereby applicable
to and a part of this ordinance so far
as the same are contained in the fol-
lowing sections of said ordinance, to-
wit: Section 4, relating to paving and
macadamizing; Section 12, relating to
other electric lines crossing or using
tracks; Section 13, relating to cars,
trailers, lights and crossi1Cs; Section
15, relating to poles and posts; Sec-
tion 17, relating to special assess-
meats; Section 18, relating to fares
and transfers; and Section 19, relating
to transportation of policemen and
firemen.
Section 11. The new lines of rail-
way herein authorized to be construct-
ed, shall be completed and in opera-
tion within one year from the data
of the passage of this ordinance on
such streets as are now graded and
improved, and on those not at present
graded and improved, within one year
from the time said streets are graded
and improved. If not so completed
and in operation, the City Council
may, at its option, declare a fortfeit-
ure of all rights and privileges grant-
ed said Union Electric Company un-
der this ordinance.
Said Union Electric Company, its
successor or assigns, shall maintain
and operate, in accordance with the
provisions of this franchise, such lines
as are provided for herein, and shall
operate same with adequate equip-
ment and provide adequate and reas-
onable service on said lines; and said
Union Electric Company, its success-
ors or assigns, shall not abandon any
part of said lines unless permitted so
to do by the City Council.
If said sompany shall abandon any
part of the lines herein provided for,
or shall fail to operate said lines in
accordance with this ordinance, the
City Council may, at its option, de-
clare a forfeiture of all rights and
privileges granted said Union Elec-
tric Company under this ordinance.
Provided, however, that failure to op-
erate because of strikes, fires, or other

stating 'that it was impossible for it
to accept the proposed ordinance for
the West Locust street extension as re-
vised by your commitee, would re-
spectfully report that at a meeting
subsequently held with the officers of
said company, the accompanying re-
vision of said ordinance was agreed to,
.and we respectfully recommend that
said ordinance as so revised be ap-
proved, and that the same he adopted
after the completion of the publication
of said ordinance as required by law.

UNION ELECTRIC CO., A COR-
PORATION OF DUBUQUE, IOWA,
ITS SUCCESSORS AND ASSIGNS,
THE RIGHT TO ERECT, MAIN-
TAIN AND OPERATE A CERTAIN
LINE OF STREET RAILWAY TO
CONNECT WITH THE PRESENT
LINES, SUCH LINE TO BE CON-
STRUCTED, MAINTAINED AND
OPERATED UPON THE STREETS
IN THE CITY OF DUBUQUE
HEREINAFTER SET OUT.
Pe It Ordained by the City Council
of the City of Dubuque:
Section 1. That there is granted to
the Union Electric Company, a cor-
poration organized under the laws of
the state of Iowa, its successors and
assigns, for the term of twenty -five
years from the adoption hereof and its
acceptance by said company, the right
and authority to lay a single or double
track for street railway purposes, with
the necessary switches and turn -outs,
hereinafter to be determined and
agreed upon, along and upon the fol-
lowing streets, to -wit: Commencing
.at the intersection of Thirteenth and
Main streets, thence west along the
center line of Thirteenth street to Lo-
cust street, thence north along the
center line of Locust street to Six-
teenth street, thence north and wester-
ly along he center line of West Locust
street to Arch street, thence westerly
along the center line of Arch street
to St. Ambrose street, thence south
along the center line of St. Ambrose
street to Asbury street, thence south-
easterly along the center line of As-
bury street to a connection with the
end Qi the present track now on Delhi
street, with the right to operate ears
thereon, subject to and in accordance
with the following restrictions and
conditions.
Section 2. For the purpose of
constructing and maintaing and oper-
ating said street railway line, said
Union Electric Company, its suc-
cessors and assigns, shall have
the right and authority to go up-
on said streets and parts of streets
and make such excavations therein as
may be necessary for the construction,
completion, operation and mainten-
ance of said railway line, and shall
have the further right and authority
to make track and overhead wire
connections at intersections and with
car barns and power house, and to
construct all necessary side- tracks,
turn -outs and switches, and shall also
have the right to erect, construct and
maintain such overhead wires and
poles as may be necessary to conduct
electrical power over said wires from
the power station to and along said
line of railway.
Section 3. Said Union Electric
Company shall, after making such ex-
cavations in said streets as may be
necessary for the proper construction
of said track and within a reasonable
time, restore and leave them in as good
condition as they were when such
work was begun, and shall remove any
refuse, debris, or other encumbrance
resulting from said work. Said com-
pany shall also repair all damages
which may be done to said streets by
the construction or maintence of said
track during the life of the franchise
hereby granted.
Before commencing any construc-
tion or repairs under authority of Sec-

public places of the city, said Union
Electric Company, its successors and
assigns shall in writing apply to the
Mayor of the city, stating the nature
of the work, the time and place where
the same is proposed to be done, and
thereupon the Mayor shall permit or
refuse to permit the work to be done
by issuing a written statement of his
decision to the said Union Electric
Company, its successors or assigns.
Section 4. The said street railway
line shall be constructed upon the es-
tablished grade of the streets which
are now improved, and upon the
grades which shall be established
when the streets at present unim-
proved shall be improved by the City
of Dubuque, such improvement to be
completed before said track shall be
constructed thereon. The tracks, poles
and other structures shall be raised or
lowered from time to time without ex-
pense to the city to correspond with
changes that may be made in, the
grade of said streets. The gauge of
said railway track shall be that known
as the standard gauge, to -wit: four
feet, eight and one -half inches, and the
center line of the space between the
tracks or rails of said line shall coin-

examined the sanitary sewer in Rose -
dale Avenue from the manhole first
west of the easterly line of Lot No. 1,
in Rosedale Addition No. 2, westerly
to Willow Street, thence in Willow
Street to St. Ambrose Street, thence
in St. Ambrose Street to Asbury
Street, thence in Asbury Street to its
intersection with Delhi Street, George
Korman, conractor, and would recom-
mend that said sewer be accepted,
provided the proper parties, either the
city or the contractor, make proper
arrangement to take care of the storm
water that will natuarlly flow against
manholes Nos. 4 and 5, by making a
stone water break about one hundred
and fifty feet west of manhole No. 4,
and making a trench to divert the
water . from manhole No. 5. We
further recommend that the City En-
gineer be instructed to prepare a
special assessment against the lots or
parcels of real estate subject to
assessment for said improvement and
file the same in the office of the City ,
Recorder, who will thereupon publish
the notice of said assessment as re-
quired by ordinance.

bor Committee granted to the Du-
buque Boat and Boiler Works a space
of 130 feet on the levee front. Said
grant to expire on April 1st. 1913.

Answering your queston as to what
the Park Board is paying for electric-
ity used in the electric light posts in
Jackson and Washington parks, we
pay as follows: $2.35 per post per
month. In Jackson park there are
ten posts, in Washington park eight
posts. For all the lights used .n
Jackson and Washington parks dur-
ing the month of November, for the
eighteen posts, we paid a total of
$42.30, less 5% for cash, net $40.18.
This figures net, after deducting cash
discount, $2.23 per post per month.
These posts are lighted as follows:
Every evening in the year, from sun
down, five lights on each post, until
10 o'clock p. m. From 10 o'clock P.
m. until sunrise, one large top Light
on each post. The Union Electric
company turns on all the :lights, makes
the change at 10 o'clock at night and
turns them off at sunrise. We have
the same understanding for the three
lights that are now burning in Phoe-
nix park a the foot of Main street.
If at any time the lights are burn-
ing in the day time, it is not at all at
the expense of the city, but is entirely
an affair of the Union Electric Co.
Sometimes they light them early for
it is most convenient for their man
who has to do the work, or they are
some times lighted in the middle ;f
the day to see if all the lamps are
burning, or if it is necessary to make
any repairs.
Many people have a misunderstand-
ing that the Park Board is squander-
ing money because some times some
of these lights are lighted in the day
time.
The Park Board will always gladly
explain any expense that they have
entered into. Some times a criticism
is made when all the facts and condi-
tions are not thoroughly understood.
As you asked the question, I was
glad to make the above explanation.

Avenue in the City of Dubuque, for
the purpose of extending the length
of its present side track leading to
the Eagle Point Pumping Station and
affording trackage facilities to the
lumber yard and plant of the Du-
buque Lumber & Coal Company.
SECTION 2. That the laying down
of said side track shall be done under
the supervision. of the City Engineer
and Committee on Streets of said City.
SECTION 3. That in the laying
down and operation of said track the
same shall be so constructed and
maintained as to create the least pos-
sible obstruction to ordinary travel
and the use of the street crossed. That
cars shall not be allowed to stand on
the side track in such manner as to
unnecessarily interfere with the use
- thereof, and said track shall at all
times be used in accordance with all
lawful regulations now or heretofore
enacted by said City.
SECTION 4. That said side track
shall be laid to the established grade
of the street on which it runs and
should the grade be changed at any
time said track shall be changed to
conform with such change in grade at
the expense of said Company without
any claim against said City.
SECTION 5. That said Company
shall keep the space between the rails
of said side track and space at the
end of the ties so graded that car-
riages may easily pass over the same
and shall keep such spaces properly
planked, paved or macadamized or
otherwise improved as the City Coun-
cil may direct, and shall keep any
sidewalk crossing said track properly
planked or otherwise improved as said
City may direct.
SECTION 6. That said side track
shall be so constructed and maintain-
ed as not to dam up or obstruct the
flow of drainage of water in the gut-
ters or on the surface of said street,
and shall be subject to and strictly
comply with all reasonable polloe reg-
•ulations bearing on the use and oper-
ation of said track.
SECTION 7. The City of Dubuque
hereby reserves the right to revoke
the privilege hereby granted any time
after twenty years from the time this
ordinance becomes operative, or soon-
er in case said track shall not be need-
ed for commercial purposes.
SECTION 8. That this ordinance
shall take effect and be in force from
and after its passage and publication
one time in the Dubuque Telegraph -
Herald and the Dubuque Times -Jour-
nal, official newspapers of said City,
and written acceptance thereof on the
part of said Chicago, Milwaukee & St.
- Paul Railway Company duly endorsed
hereon.

that a special assessment as provided
by law will be levied at a session of
the City Council to be held December
19, 1912, to pay for the improving of
Valeria Street from Kaufman Avenue
to a point sixteen and eight- tenths
feet westerly of the west line of Lot
4, in, Cushing's Sub., Wilmer Cook,
Contractor.
Amount of Special Assessment,

Recorder of said city of Dubuque,

cause, If any you have, why said as-

SECTION, 1. That perm•ssion be and
the same is hereby granted to the
Chicago, Milwaukee & St. Paul Rail-
way Company, its successors and as-
- signs, to. lay, operate and maintain a
spur track from a point on the south -
•erly line of Twelfth Street about one
hundred feet easterly- from Pine
Street, thence running in a northerly
direction across Twelfth Street, curv-
ing slightly easterly for the purpose
of running an additional spur track
branching off from the present track
of said Company, at a point south of
Twelfth Street and extending into the
manufacturing plant of the A. Y.
McDonald Manufacturing Company
lying northerly of said Twelfth Street.
SECTION 2. That the laying down
of said spur track shall be done under
the supervision of the City Engineer
- and the Committee on Streets of said
city.
SECTION 3. That in the laying down
and operation of said spur track the
same shall be so constructed and
maintained as to create the least pos-
sible obstruction to ordinary travel
- and the use of the street crossed.
That cars shall not be allowed to
stand in said street in such manner as
- to unnecessarily interfere with the
use thereof, and said track shall at
all times be used in accordance with
all lawful regulations now or here-
after enacted by said City.
SECTION 4. That said spur track
shall be laid to the established grade
of the street on the street which it
crosses and should the grade be
changed at any time said track shall
he changed to conform with such
change in grade at the expense of
said Company without any claim
against said City.
SECTION' 5. That said Company
shall keep the space between the rails
of said spur track and the space at
the end of the ties so graded, that
carriages may easily pass over the
same and shall keep such spaces prop-
erly planked, paved or macadamized
or otherwise improved as the City
- Council may direct, and shall keep any
sidewalk crossing said tracks proper-
ly planked or otherwise improved as
said City may direct.
SECTION 6. That said spur track
shall be so constructed and maintain-
ed as not to darn up ur obstruct the
flow or drainage of water in the gut-
ters or on the surface of said street,
and said Railway Company shall be
subject to and strictly comply with all
reasonable police regulations bearing
on the use and operation of said track.
SECTION 7. The City of Dubuque
hereby reserves the right to revoke
the privilege hereby granted at any
time after twenty year from the time
this ordinance becomes operative, or
sooner in case the said A. Y. McDon-
ald Manufacturing Company fails to
continue the operation of the plant
which said spur track continued is to
connect.
SECTION 8. That this ordinance
shall take effect and be in force from
and after its passage and publication
one time in the Dubuque Telegraph -
Herald and Dubuque Times - Journal,
official newspapers of said City, and
written acceptance thereof on the
part of said Chicago, Milwaukee & St.

Be it Resolved by the City Council
of the City of Dubuque, that from and
.after twenty days after the passage
and publication one time hereof in the
official newspapers, as required by or-
dinance, and for a period of five years
thereafter, no person, firm or corpor-
ation shall excavate in or tear up the
surface of the following named streets -
or parts of streets, to -wit: Kaufman
Avenue from Couler Avenue to Cush-
ing Place; Eagle Point Avenue from
ti■tndsor Avenue to the easterly rail
of the Chicago Great Western rail-
road tracks.
Any person, firm or corporation vio-
lating the provisions of this resolu-
tion shall be subject to a fine of $100.00
for each offense, and the City Re-
corder is hereby instructed to cause
to be published notice of the adoption,
of this resolution within twenty -four
hours after its passage.
