INTRODUCTION
The purpose of this memorandum is to recommend Amendment #3 to the contract with
Saiki Design for Community Engagement, Design, Construction Management and Grant
Administration for Phase 2 of Reimagine Comiskey Park.
BACKGROUND
An RFP selection process was used to solicit qualified firms for community
engagement, design, construction management, and grant administration for the
redevelopment of Comiskey Park. The city awarded a contract to Saiki Design for
Community Engagement, Design, Construction Management and Grant Administration
for Comiskey Park redevelopment in November of 2019. The City had been awarded
an Outdoor Recreation Legacy Project grant for inclusion of specific elements of the
park. Phase 1 of Reimagine Comiskey opened June 30, 2023.
Comiskey Park redevelopment reflects the values of the community due to the quality
and diverse public participation and input essential to the process. The final plan
reflected the input received from inclusive outreach to a diverse and comprehensive
representation of the Dubuque community including traditionally under -represented
groups. The engagement was different than we had ever done before.
The results speak for themselves. Saiki Design and their subcontractors partnered well
with the city team to engage and then deliver on a design that incorporated the
community feedback received. Reimagine Comiskey is a model for future Leisure
Services projects.
DISCUSSION
The city submitted a grant application to National Park Service Outdoor Recreation
Legacy Partnership (ORLP) Program for Reimagine Comiskey Phase 2. The Council
action to approve the grant application was on March 4, 2024. The grant application
included the following:
• Construction of two full-size basketball courts;
• Development of new shaded picnic areas;
• Replacement of an older basketball court, skate spot, and tennis court with a multi-
use playing field;
• Building trails throughout the park;
• Establishment of a new park entryway;
• Creation of a 53-stall parking lot; and
• Additional landscaping including trees and native plantings.
Phase 2 development would complete the Comiskey Park redevelopment.
The work was proposed to be completed within 1 1/2 years. The City will break ground
at Comiskey Park within 1/2 year. Key project milestones include completion of final
design (December 2024, pre -agreement), permits secured (August 2025), construction
commences (June 2026), and park re -opening (July 2027). In order to break ground if
awarded the design and bid specifications work must begin. The city's commitment was
to have the design at 75% by November of 2024. This allows the above timeframes to
be met. The National Park Service outlined in the NOFO that the grant awards would
be announced in November of 2023. The consultant services outlined in this
amendment would be covered in the Phase 2 grant if awarded and can be pre -
expended prior to any grant announcement.
Continuing with the same design team that was assembled for Phase 1 is critical to the
continued success of the Reimagine Comiskey project. The consultant team is prepared
to begin work as soon as the contract amendment is executed.
BUDGET IMPACT
There is currently CDBG funding in the amount of $276,851 set aside for the specific
purpose of design and bid specifications for Phase 2. This amount will fully cover 75%
of design work by November of 2024. If the grant is received the remainder will be
covered in the grant and the remaining city match. If the grant is not received the work
is still applicable as the city has budgeted in its capital funding for FY 26 $1.697 million
in capital funding that is the match for the grant. This would mean a Phase 2 project
would be designed scaled to the funding available.
ACTION REQUESTED
I respectfully recommend authorization of Amendment #3 to the contract with Saiki
Design for Phase 2 of Reimagine Comiskey Park in the amount of up to $448,282.

Dear Marie,
Thank you for inviting Saiki Design, Inc. to submit Contract Amendment No. 3 for landscape architectural
services for phase 2 of design for Comiskey Park in Dubuque, Iowa. This proposal outlines the current
understanding of the Phase 2 project scope requirements. We understand that you are pursuing an ORLP
grant, with matching City funding, to construct Phase 2 of this project. We look forward to continuing our
work with you on this next phase of the Comiskey Park Redevelopment.
We anticipate providing landscape architectural design services parallel to the scope of services provided for
the recently completed Phase 1 park redevelopment for the next phases of Comiskey Park as follows:
• Additional park amenity spaces designed and documented to 100% construction documentation
including:
o 2 full-sized basketball courts
o A multi -use playing field in the location of the former basketball court, skate spot and tennis
court;
o A hard -surfaced play area adjacent the new basketball courts;
o Concrete sidewalks connecting various park elements;
o Up to (8) new shade structures for gatherings;
o New picnic tables, some of which will be accessible;
o New grills
o New benches and integrated seatwalls to match Phase 1 site seating and amenities packages;
o A new drinking fountain, including water service extension from the existing building;
o A new park entryway at the corner of 25th and Jackson Street,
o Demolition of the existing 18-stall parking lot and design for a new 53-stall parking lot;
o Bike parking;
o Pedestrian -scale lighting for pathways and near courts and parking lots;
o Planting & landscape restoration including trees, shrubs, perennials and stormwater
management plantings, focusing on selecting native plants wherever possible.

fee schedule & hourly rates. We anticipate the following subconsultant participation:

o JDR Engineering will provide electrical and lighting selection construction documentation and

We understand that your overall schedule for this project is as follows and our fee and scope of services are
reflective of this timeline with a few minor adjustments to project timeline for reasonable reviews and
response periods:

We will provide the services listed on an hourly -not -to -exceed basis up to a maximum design contract amount
of $448,282. A summary of our fee is attached. This proposal assumes that the City of Dubuque is leading all
grant applications, communication, coordination, contracting, reporting, and/or close-out and that Saiki
Design can provide progress plans or renderings already included in the base scope of services for the City's
use in grant -related requirements. This proposal also assumes that the City of Dubuque will lead any
community engagment efforts, with the landscape architect providing graphic support. Additional services
authorized as part of this contract or a separate contract can be provided at our office's current hourly rates.
Itemized invoices are prepared by our office monthly and are due within 30 days. If you find this proposal
acceptable, please sign and return one (1) copy to Saiki Design, Inc. This proposal is good for 30 days.

Non-payment within 60 days for invoices prepared by our office may result in a pause in our ability to continue working on this project until invoices are brought to -date and paid in full.
This proposal assumes that a complete site topographic and features certified survey with information to a level of detail sufficient for design and documentation will be initiated and provided by Origin Design as part of this project proposal at the
onset of the project.
This proposal assumes the project civil engineer is preparing full grading plans with Saiki Design providing an initial set of critical spot elevations for site grades for civil engineer to further refine and integrate into grading plan.
This proposal assumes that structural engineering by design team members will not be required for any portions of the project. Structural engineering discipline can be added to the project team at the request of the City as an additional service.
Structural engineering of footings/foundations for light poles, flag poles, and/or pre -manufactured park structures is assuemed to be by the manufacturer.
Saiki Design will provide final drawings and specifications in .pdf file format, adhering to basic formatting requests made by the client whenever possible, utilizing software that optimizes our office's workflow. We will evaluate requests by clients
to utilize outside proprietary software to produce or collaborate on project deliverables and/or project communications on a case -by -case basis and reserve the right to decline utilization of any new software that requires our office to purchase
new products, license new subscriptions, and/or expend additional time and effort on product and/or project integration. A list of current software utilized in-house is available upon request.
In the event that Saiki Design is asked to prepare digital data, the Owner acknowledges that due to the limitations of software, not all elements of Saiki Design's services may be represented and any use of digital data prepared by Saiki Design
shall not relieve the Owner's consultants, contractors or other authorized recipients of their respective obligations related to the data use. Accordingly, Saiki Design will endeavor to represent all material elements of our services as accurately
and completely as possible in the Digital Data.

SITE GRADING: Site Grading Beyond 15% DD level for hand-off to project's civil engineer for further refinement and documentation at all milestones

RENDERINGS: Additional renderings and/or exhibits not specifically listed above. Saiki Design can produce additional renderings and/or models, 3-D model renderings, and/or photorealistic renderings as an additional service.
PROGRAM EXPANSION: Design, detailing, or materials selection/specification for program areas or features above and beyond those outlined in the OLRP Full Grant Submission prepared by the City of Dubuque and dated 3-8-24 (i.e. dog
runs, bocce courts, sport courts, fitness zones, pooVspa/hot tub amenity zones, production gardens, playgrounds, solar/PV panels or array areas, splash pads, nature playscapes).

PROJECT DURATION EXTENSION: Extended timeline beyond timeline outlined in phased scope breakout included in base scope of services and/or the project schedule outlined in the OLRP Full Grant Submission prepared by the City of
Dubuque and dated 3-8-24 (page 17) and as detailed in the phased break-outs above.
CONSTRUCTION ADMINISTRATION EXTENSION: Extended involvement in the project's construction administration and close-out phase to cover communication, meetings, reviews, site visits, punchlist item curing and enforcement of the
Contract Documents and/or other services above and beyond those outlined in the base scope of services as a result of project installations that do not meet the quality or technical standards set forth by the Contract Documents.
WITNESS TESTIMONY: Any witness testimony services required by insurance companies, owners, or other parties based on interpretation or regulation of the conditions of the Contract Documents. Note that expert witness testimony
involvement will be invoiced at negotiated industry -equivalent rates for expert services, NOT at our office's standard design rates.
VALUE ENGINEERING (VE): Participation in or documentation of VE efforts at any time after the design development stage to address client -driven changes, contractor -identified cost savings or any other VE measures pursued by the project
will be tracked and invoiced separately.
SUSTAINABILITY DOCUMENTATION: LEED, Well, Fit -Well, or other sustainability metric evaluation, documentation, contribution to credits or coordinated reviews.
IRRIGATION: Irrigation design and documentation (via subconsultant to Saiki Design), including review or design for water harvesting, tank storage, and/or re-claimed water re -use for irrigation.
INTEGRATED ART: Art piece procurement, design and/or detailing (general siting of a pre -manufactured piece is included; footings and reinforcement, lighting and/or plumbing by others).
BRANDING, DONOR SOLICITATION, AND GRANTS: Coordination, design effort, and/or production of any materials or items for branding, donor solicitation, and/or grant procurement.
MAINTENANCE AND MANAGEMENT: Coordination, preparation, or oversight of any vegetation, pavements, site furnishings, custom assemblies, railings, and/or other site or landscape features or systems maintenance or management plans
or documents.
SPECIALTY SITE FEATURES: Design, detailing or materials selection/specification for any specialty site features above and beyond those included in base scope of service descriptions listed in the Notes section above and as outlined in the
OLRP Full Grant Submission prepared by the City of Dubuque and dated 3-8-24 for Phase 2 work, including, but not limited to overhead structures, gateway features, water features, boardwalks, monument signage, fire features, pergolas,
arbors, raised vegetable production beds, greenhouses, storage structures, playground equipment or surfaces, fitness equipment or surfaces, splash pad equipment, pedestrian or vehicular bridges.
EXCLUSIONS (Items listed below are specifically excluded from this proposal)
PERMITTING OR RE -ZONING: Preparation of life safety plans and/or coordination for DNR, DSPS, Army Corps of Engineers and/or other entity coordination, plan development, reviews, and/or permitting. Coordination and/or preparation of
any documents for re -zoning.
SITE INVESTIGATIONS: Survey, geotechnical investigation, contamination examination, EIS process, historic asset assessment, etc.
ARCHITECTURAL ASSESSMENT & INTEGRATION: Condition assessment, restoration, or design/detailing of historic architectural relics (i.e. historic architectural pieces) into project.
CONTAMINATION REMEDIATION: Assessment, coordination, permitting, and/or materials handling and disposal associated with potentially contaminated sites and/or groundwater.
VEHICULAR PAVEMENT DESIGN AND DETAILING: Station+offset, roadway alignments, roadway layout, roadway pavement markings and/or signage, plan & profile drawings), pavement cross sections and/or details.
HEATED PAVEMENTS: Research, coordination, design, detailing, and/or specification of heated pavements or heated pavement systems at -grade or on rooftops.
MODELING: 3-D/BIM/REVIT modeling for coordination or drawing production.
COST ESTIMATING: Cost estimating coordination or services.
TRAFFIC ANALYSIS: Traffic analysis coordination or services.

STRUCTURAL DESIGN: Design and detailing for footings, connections to buildings/structure, bridges, overhead structures, CIP walls with footings, and/or site walls over 2-feet in height.
INTERIOR PLANTSCAPES: Greenhouse, solarium, winter garden, and/or conservatory design, detailing or integration including structure and/or interior plants, hardscapes or landscapes.
SITE PAVEMENTS: Detailing or specifying for standard site pavements (concrete, asphalt, HD pavements, curbs & gutters, truck aprons, curb ramps/tactile plates, etc.)
POOLS AND SPAS: Design, detailing and/or integration of pools, spas, and/or hot tub features. Saiki Design will only locate and coordinate general location on plan assuming features were part of pre -determined list of specialty site features to

Project Description
This project consists of the construction of Phase 2 of the Comiskey Park project. Phase 2 includes
removal of the existing parking lot, creation of a new larger parking lot, removing existing basketball
court, removal of existing tennis court, addition of two basketball courts, a picnic area, drinking
fountain water/sewer laterals, multiple gazebos, and a lawn playing field. This includes construction of
proposed trails within the facility and stormwater management.
Scope of Services
The following list of services will be provided by or under the direct personal supervision of a
Professional Engineer licensed to practice in the State of Iowa.
Topographic Survey
1. Complete a topographic survey of the project site. This would also include the location of
the adjacent curb and gutter, Phase 1 improvements, sidewalks and utilities. Existing
utilities within the same area will be identified as located by third party locating company
via the Iowa One -Call program.
2. Prepare a base map of the site for use in the subsequent phases of the project.
Engineering Services - Design through 75% CD's
1. Prepare a Site Plan per the requirements of the City of Dubuque Minor Site Plan submittal
checklist. This includes locations (horizontal and vertical) and dimensions of the proposed
parking, drive areas, trails, basketball courts, grass playing field, drinking fountain
water/sewer laterals, picnic areas, and pads for gazebos. This also includes design of
storm sewer collection system and storm water management system. The site plan will
reference City of Dubuque SUDAS supplemental specifications.
2. Attend design coordination meetings. Assumes one meeting per week for six months.
3. Submit the 75% site plan to the Client for review and comment. Revise the plan if
necessary.
Engineering Services - Final Design through Construction Administration
1. Submit plan to the City Planning for their review and attend Development Review
Committee meeting.
2. Revise the site plan, if necessary, per the City Review comments and resubmit the site plan
to the City for approval.
3. Prepare notice of storm water discharge and publish in one newspaper.
4. Prepare Storm Water Pollution Prevention Plan.
5. Prepare "Notice of Intent for NPDES Coverage".

• JDR will prepare book specifications based on JDR Engineering, Inc. master specifications formatted to match Clients

• Site lighting fixtures shall mimic the Phase 1 specifications.
• Includes design of additional electrical services to the site, as required.
• This proposal includes a Final Review (90%) submission to the Owner's representatives for review and comment prior
to the final issue of Construction Documents.

Construction Administration Services shall include the following:
• Review shop drawings/product submittals for compliance with the contract documents.
• Prepare addenda, construction bulletins, and respond to contractor RFI's.
• Attend project meetings once construction begins.
o All meetings are assumed to be held virtually via Teams/Zoom or conference call.
• One (1) construction site visit shall be completed at 100% (approximately) construction.
o Visit will include a written field report/punchlist submitted to Saiki Design, Inc. for distribution.
• Review all closeout materials and test reports for final occupancy and compliance.
The following elements are not included:
• Commissioning services shall be provided by others, including measurement and verification services.
• All printing beyond that required for coordination and internal design shall be furnished by others. This shall include
contractor bid sets, owner sets, etc.

The following Project related expenses will be billed as reimbursable expenses:
• Fees paid for securing approvals of authorities having jurisdiction over the Project.

AGREEMENT made this 10th day of May 2024, by and between the service provider, Impact7G,
Inc. ("Impact7G") and Saiki Design ("Client").
WHEREAS, the Client intends to engage the services of Impact7G to: provide environmental
project management services for the above referenced property (the Property).
WHEREAS, Impact7G agrees to provide said services pursuant to the terms of this Agreement.
NOW THEREFORE, the parties agree as follows:
1. Project
Impact7G understands that the Client is supporting the City of Dubuque with Phase II Construction
Activities at Comiskey Park. Impact7G agrees to provide environmental project management services
for the Property.
2. Scope of Services
Environmental Project Management
A portion of the Phase II construction area contains a vacated section of Washington Street and Parcel
Identification Number 1013451018, areas of which are contaminated with lead in soil above statewide
standards. The Property will be enrolled in the Iowa Department of Natural Resources (DNR) Land
Recycling Program (LRP), (funded by the City of Dubuque's current Environmental Protection Agency
Multipurpose Grant) and Phase II Construction of Comiskey Park will serve as a partial remedial action
for soil contamination.
Impact7G agrees to provide environmental project management services including but not limited to,
coordinating Phase II construction activities within the framework of the DNR LRP, providing special
provisions sections for construction documents, providing a Soil and Groundwater Management Plan,

and attending up to ten regular virtual project meetings and one in -person pre -bid meeting.
3. Impact7G Responsibilities Impact7G hereby agrees to:
Provide the professional services as set forth in this Agreement; and
Perform said services in a manner consistent with that degree of care and skill ordinarily
exercised by members of the same profession currently practicing at the same time and
in the same or similar locality.
4. Owner Responsibilities Owner hereby agrees to:
(i) Provide a knowledgeable representative of the Property, who will be available to
coordinate all on -site work; and
(ii) Provide unrestricted access to the Property for Impact7G to perform the services; and
(iii) Provide copies of any previously completed reports that may be pertinent to this Project.
5. Schedule
The Project will commence immediately upon receipt of the executed Professional Services Agreement
(PSA) from the Client.
6. Project Cost, Payment and Termination
The Client shall pay Impact7G the estimates cost of Seven Thousand Dollars ($7,000.00) on an Hourly
Not to Exceed, Including Reimbursables basis for the performance of this Agreement. Direct costs such
as communications, postage, routine printing and copying are not invoiced separately, but are included
to streamline the accounting process and reduce overhead costs.

Invoices for Impact7G's services will be submitted every 30 days or upon project completion if
project completion is less than 30 days. Invoices shall be due and payable upon receipt. If any invoice
is not paid within 30 days, Impact7G may, without waiving any claim or right against the Client, and
without liability whatsoever to the Client, suspend or terminate the performance of services. Time and
material costs will be adjusted annually in accordance with rate increases paid to personnel, inflation,
and market conditions.
7. Work Product All field notes, laboratory test data, calculations, estimates and other documents
including all documents on electronic media prepared by Impact7G as instruments of service and/or
used in the preparation of the final project deliverables shall remain the property of Impact7G.
All project documents including, but not limited to, plans and specifications furnished by
Impact7G under this project are intended for use on this project only. Any reuse, without specific written
verification or adoption by Impact7G, shall be at the Client's sole risk, and Client shall defend, indemnify
and hold harmless Impact7G from all claims, damages and expenses including attorney's fees arising
out of or resulting therefrom.

Under no circumstances shall delivery of electronic files for use by the Client be deemed a sale
by Impact7G, and Impact7G makes no warranties, either express or implied, of merchantability and
fitness for any particular purpose. In no event shall Impact7G be liable for indirect or consequential
damages as a result of the Client's use or reuse of the electronic files.
Because electronic file information can be easily altered, corrupted, or modified by other parties,
either intentionally or inadvertently, without notice or indication, Impact7G reserves the right to remove
itself from its ownership and/or involvement in the material from each electronic medium not held in its
possession. Client shall retain copies of the work performed by Impact7G in electronic form only for
information and use by Client for the specific purpose for which Impact7G was engaged. Said material
shall not be used by Client or transferred to any other party, for use in other projects, additions to this
project, or any other purpose for which the material was not strictly intended by Impact7G without
Impact7G's expressed written permission. Any unauthorized use or reuse or modifications of this
material shall be at Client's sole risk. Furthermore, the Client agrees to defend, indemnify, and hold
Impact7G harmless from all claims, injuries, damages, losses, expenses, and attorney's fees arising
out of the modification or reuse of these materials.
8. Project Site The Client agrees to use good faith efforts to maintain a safe Project site for
Impact7G staff and, as applicable, subcontractors and assigns. Such good faith efforts shall include,
but not exhaustive, ensuring that Project site is free and clear of any imminent hazards that pose a
direct and immediate danger to any such individual potentially affected.
9. Claims and Disputes Nothing contained in this Agreement shall create a contractual
relationship with or a cause of action in favor of a third party against either the Client or Impact7G.
Impact7G's services under this Agreement are being performed solely for the Client's benefit, and no
other party or entity shall have any claim against Impact7G because of this Agreement or the
performance or nonperformance of services hereunder. The Client and Impact7G agree to require a
similar provision in all contracts with contractors, subcontractors, subconsultants, vendors and other
entities involved in this Project to carry out the intent of this provision.
The Client shall make no claim for professional negligence, either directly or in a third party
claim, against Impact7G unless the Client has first provided Impact7G with a written certification
executed by an independent professional currently practicing in the same discipline as Impact7G and
licensed in the State in which the claim arises.
10. Limited Liability The Client agrees, to the fullest extent permitted by law, to limit the liability
of Impact7G and Impact7G's officers, directors, partners, employees, shareholders, owners and
subconsultants to the Client for any and all claims, losses, costs, damages of any nature whatsoever
or claims expenses from any cause or causes, including attorneys' fees and costs and expert witness
fees and costs, so that the total aggregate liability of Impact7G and its officers, directors, partners,
employees, shareholders, owners and subconsultants to all those named shall not exceed $50,000. It
is intended that this limitation apply to any and all liability or cause of action however alleged or arising,
unless otherwise prohibited by law.
11. Mediation In an effort to resolve any conflicts that arise during the project or following the
completion of the project, the Client and Impact7G agree that all disputes between them arising out of
or relating to this Agreement shall be submitted to non -binding mediation unless the parties mutually
agree otherwise. The Client and Impact7G further agree to include a similar mediation provision in all
agreements with independent contractors and consultants retained for the Project and to require all
independent contractors and consultants also to include a similar mediation provision in all agreements
with subcontractors, sub -consultants, suppliers or fabricators so retained, thereby providing for
mediation as the primary method for dispute resolution between the parties to those agreements.

12. Attorney's Fees If litigation arises for purposes of collecting fees or expenses due under this
Agreement, the Court in such litigation shall award reasonable costs and expenses, including attorney
fees, to the prevailing party. In awarding attorney fees, the Court shall not be bound by any Court fee
schedule, but shall, in the interest of justice, award the full amount of costs, expenses, and attorney
fees paid or incurred in good faith.
13. Controlling Law This Agreement shall be construed and enforced in accordance with the laws
of the state of Iowa.
14. Assignment Neither the Agreement nor any of the rights or obligations arising under the
Agreement may be assigned without prior written consent.
This agreement is approved and accepted by the Client and Impact7G upon both parties signing
and dating the agreement. The effective date of the agreement shall be the last date entered below.

Reimbursable Expenses
1. All materials, supplies and other direct expenses used in the performance of work will be
billed at cost plus 20%.
2. Auto mileage will be reimbursed per the standard IRS mileage reimbursement rate.
3. Charges for sub -consultants will be billed at their invoice cost plus 20%.
