CITY COUNCIL PROCEEDINGS
SPECIAL SESSION
The Dubuque City Council met in special session at 5:30 p.m. on July 15, 2024, in the second -
floor Council Chambers of the Historic Federal Building, 350 W. 6th Street.
Present: Mayor Cavanagh; Council Members Farber, Jones, Resnick, Roussell, Sprank,
Wethal; City Manager Van Milligen, City Attorney Brumwell.
Mayor Cavanagh read the call and stated this is a special session of the City Council called
for the purpose of conducting a work session on the Chaplain Schmitt Island Redevelopment
Plan Review.
WORK SESSION
Chaplain Schmitt Island Redevelopment Plan Review
Economic Development Director Jill Connors introduced Dubuque Racing Association
President and CEO Alex Dixon who gave a brief background on the project. Ryan
Peterson from RDG Planning & Design updated the Council on the project.
Mayor Cavanagh declared the meeting adjourned at 6:05 p.m. due to severe weather and
safety protocols requiring the need to take shelter. The presentation will be rescheduled.

CITY COUNCIL PROCEEDINGS
REGULAR SESSION
The Dubuque City Council met in regular session at 6:47 p.m. on July 15, 2024, in the
second -floor Council Chambers of the Historic Federal Building, 350 W. 6th Street. The meeting
started late due to severe weather and subsequent power outages. As a result, the meeting
could not be broadcast to the public.
Present: Mayor Cavanagh; Council Members Farber, Jones, Resnick, Roussell, Sprank,
Wethal; City Manager Van Milligen, City Attorney Brumwell.
Mayor Cavanagh read the call and stated this is a regular session of the City Council called
for the purpose of conducting such business that may properly come before the City Council.
PLEDGE OF ALLEGIANCE
PROCLAMATION(S)
1. Veterans of Foreign Wars Post 508 Recognition was accepted by Mayor Cavanagh on
behalf of the Veterans of Foreign Wars Post 508.
CONSENT ITEMS
Motion by Resnick to receive and file the documents, adopt the Resolutions, and dispose of
as indicated. Seconded by Roussell. Motion carried 7-0.

June 3, June 17, June 18, 2024. Upon motion the documents were received and filed.
2. Notice of Claims and Suits: Ross Dolphin for vehicle damage; Felderman Realty for
property damage; Hennessey Fortman for vehicle damage; Olivia Hansen for property damage;
Richard Hess for property damage; American Marine for vehicle damage; Othman Mokhantar
for property damage; Sarah Weekley for vehicle damage. Upon motion the documents were
received, filed, and referred to the City Attorney.
3. Disposition of Claims: City Attorney advising that the following claims have been referred
to Public Entity Risk Services of Iowa, the agent for the Iowa Communities Assurance Pool:
Ross Dolphin for vehicle damage; Felderman Realty for property damage; Hennessey Fortman
for vehicle damage; Olivia Hansen for property damage; Richard Hess for property damage;
American Marine for vehicle damage; Othman Mokhantar for property damage; Sarah Weekley
for vehicle damage. Upon motion the documents were received, filed, and concurred.
4. Approval of City Expenditures: Upon motion the documents were received and filed, and
Resolution No. 221-24 Authorizing the Chief Financial Officer/City Treasurer to make certain
payments of bills that must be paid and approved for payment in accordance with City
procedures was adopted.
5. Approving Fund Transfers for Capital Projects - Reimbursements in Fiscal Year 2024 —
Period 13: Upon motion the documents were received and filed, and Resolution No. 222-24
Authorizing the Chief Financial Officer to make the appropriate interfund transfers of sums and
record the same in the appropriate manner for the FY 2024 for the City of Dubuque, Iowa was
adopted.
6. Building Bridges to Employment & Equity Brochure: Upon motion the documents were
received and filed.
7. Plat of Survey of Arthofer's Skyline Addition 2 subject to waiving lot frontage for Lot 2:
Upon motion the documents were received and filed, and Resolution No. 223-24 Approving the
Plat of Survey Arthofer's Skyline Addition 2, in the City of Dubuque, Iowa was adopted.
8. Plat of Survey of Plaza 20 No. 9: Upon motion the documents were received and filed, and
Resolution No. 224-24 Approving the Plat of Survey of Plaza 20 No. 9, in the City of Dubuque,
Iowa was adopted.
9. Acceptance of Grant of Public Sanitary Sewer Easement across Parts of Lots 1-2 and 2-
2 of Pizza Ranch Place off of Radford Road in Dubuque: Upon motion the documents were
received and filed, and Resolution No. 225-24 Accepting a Grant of Public Sanitary Sewer
Easement through, under and across parts of Lots 1-2 and 2-2 of Pizza Ranch Place, in the City
of Dubuque, Iowa was adopted.
10. Agreement with Dubuque Housing, LLC — for Public Sanitary Sewer Main Construction
Serving Lots 1, 1-2, and 2-2 of Pizza Ranch Place on Radford Road associated with the EMRI
Apartment Development: Upon motion the documents were received and filed, and Resolution
No. 226-24 Approving an Agreement between the City of Dubuque, Iowa and Dubuque Housing,
LLC was adopted.
11. Pickett Street Rehabilitation Petition and Waiver Agreements: Upon motion the
documents were received and filed, and Resolution No. 227-24 Approving the Petition and
Waiver Agreements for the Pickett Street Rehabilitation Project was adopted.
12. Consultant Selection of MSA as the consultant to conduct an Analysis of Impediments to
Fair Housing and authorize the City Manager to sign the Task Order with MSA in the amount of
$25,000: Upon motion the documents were received, filed, and approved.
13. Signed Contract(s): 2024 Docking Agreement with American Cruise Lines; 2024 Docking
Agreement with Celebration Belle; Independent Contractor Agreement with Denise Blakeley
Ihrig of Blakeley Water Management. Upon motion the documents were received and filed.
14. Approval of Retail Alcohol Licenses: Upon motion the documents were received and filed,
and Resolution No. 228-24 Approving applications for retail alcohol licenses, as required by City
of Dubuque Code of Ordinances Title 4 Business and License Regulations, Chapter 2 Liquor
Control, Article B Liquor, Beer and Wine Licenses and Permits was adopted.
ITEMS SET FOR PUBLIC HEARING
Motion by Roussell to receive and file the documents, adopt the Resolutions, and set the
public hearings as indicated. Seconded by Farber. Motion carried 7-0.
1. Old Mill Road Lift Station and Force Main Project - Phase I: Initiate Public Bidding Process
and Setting Date for a Public Hearing: Upon motion the documents were received and filed, and
Resolution No. 229-24 Old Mill Lift Station and Force Main Project — Phase I: preliminary
approval of plans, specifications, form of contract, and estimated cost; setting date of public
hearing on plans, specifications, form of contract, and estimated cost; and ordering the
advertisement for bids was adopted setting a public hearing for a meeting to commence at 6:30
p.m. on August 19, 2024, in the Historic Federal Building.
PUBLIC HEARINGS
1. Unified Development Code Amendment - Off -Premise Parking Lot Motion by Jones to
receive and file the documents and that the requirement that a proposed ordinance be
considered and voted on for passage at two Council meetings prior to the meeting at which it is
to be passed be suspended. Seconded by Wethal. Planning Services Director Wally Wernimont
provided a staff report. Motion carried 7-0.
Motion by Jones for final consideration and passage of Ordinance No. 44-24 Amending Title
16 of the City of Dubuque Code of Ordinances, Unified Development Code, by amending Article
16-2-3 (Definitions) by adding a definition of Off -Premise Parking Lot and by amending Articles
16-5-11 C-2 Neighborhood Shopping Center and 16-5-13 C-3 General Commercial by adding
Off -Premise Parking Lot as an accessory use. Seconded by Wethal. Motion carried 7-0.
2. Locust Street Parking Ramp Repairs Project Public Hearing: Motion by Roussell to receive
and file the documents and adopt Resolution No. 230-24 Approval of plans, specifications, form
of contract, and estimated cost for the Locust Street Parking Ramp Repairs Project. Seconded
by Farber. Transportation Services Director Ryan Knuckey responded to questions from
Council. Motion carried 7-0.
3. Public Hearing -Jefferson Park Retaining Wall Project:: Motion by Jones to receive and file
the documents and adopt Resolution No. 231-24 Approval Of plans, specifications, and
estimated cost for the Jefferson Park Retaining Wall Replacement Project. Seconded by
Sprank. Leisure Services Director Marie Ware responded to questions from Council. Motion
carried 7-0.
PUBLIC INPUT
Members of the public spoke on suicide prevention awareness and asbestos and contract
concerns regarding Action Item No. 2.
ACTION ITEMS
1. Greater Dubuque Development Corporation - Quarterly Update: Motion by Resnick to
receive and file and listen to an abbreviated version of the presentation. Seconded by Sprank.
Rick Dickinson, President and CEO of Greater Dubuque Development Corporation (GDDC)
provided an update and a 2023-2024 Annual Report booklet. Motion carried 7-0.
2. 3000 Jackson, Dubuque Brewing and Malting Building Update: Motion by Roussell to
receive and file the documents and approve the City move to open up 30th St. and assess the
developer for the costs. Seconded by Farber. City Manager Van Milligen provided a status
report and an amended recommendation to withdraw the proposal for the City to open the street
and charge the developer for the costs. This decision was based on information received just
before the meeting that the demolition crew will return to the site this week under the current
contract with the property owner. Housing and Community Development Director Alexis Steger
and City Attorney Brumwell responded to questions brought up during public input and from the
Council. Amended motion by RousselI to receive and file documents. Seconded by Farber.
Motion carried 7-0.
3. Work Session Request: Imagine Dubuque Update: Motion by Jones to receive and file the
documents and schedule the work session for August 19, 2024, at 5:30 p.m. Seconded by
RousselI. Motion carried 7-0.
COUNCIL MEMBER REPORTS
Mayor Cavanagh made remarks regarding the attempted assassination of former President
Donald Trump.
Council Member Jones reported on speaking at a Q Casino grand opening and reminded the
public to check out the time capsule in Washington Park as the anniversary of the time capsule
is approaching.
Council Member Farber reported on participating in a Federal Communications Commission
(FCC) conference at Google Headquarters with the National League of Cities. Ms. Farber
thanked the Mayor for his remarks and expressed gratitude for the Dubuque Police Department.
Council Member RousselI reported on attending a Habit for Humanities event where "Sheep
On The Go" provided a demonstration of grass mowing.
Council Member Resnick reported on attending the Tri State Wind concert.
CLOSED SESSION
Motion by Jones to convene in closed session at 8:02 p.m. to discuss Purchase or Sale of
Real Estate — Chapter 21.5(1)(j) Code of Iowa. Seconded by RousselI. Mayor Cavanagh stated
for the record that the attorney who will consult with City Council on the issues to be discussed
in the closed session is City Attorney Brumwell. Motion carried 7-0.
The City Council reconvened in open session at 9:52 p.m. stating that staff had been given
proper direction.
ADJOURNMENT
There being no further business, Mayor Cavanagh declared the meeting adjourned at 9:53
p.m.
