read the printed notice certified to by
the publishers of the Council's inten-
tion to improve Sixth street from Clay
street to Main street. No remon-
strance being filed and no one in the
room objecting to the improvement of
said street, was on motion of Ald.

intention to construct a sanitary sew -
er in alley between Couler Avenue and
,Lemon street, from Millville Road to
Thirty- second street, thence on Thir-
ty- second street to alley known as ,
White street. No remonstrance being
.filed and no one in the rom objecting
to the improvement of said street, was
•on motion of Ald. Specht received and
filed.

drawn for various amounts, and the
report he referred back to the Finance
committee and the recorder instructed
to record the deed. Carried.
Honorable Mayor and City Council.
Gentlemen: There expires on April
1, 1911, refunding. improvement
bonds 248, 249 and 250, each of the
denomination of $500.00, dated April
1, 1904. There has been paid in on
the improvements covered by these
bonds about $750.00. I redeemed
bond No. 248, but some arrangement
must be made to take care of the
other two bonds. • It three new re-
funding bonds of $250.00 each were
issued the balance in the fund would
take care of the other 3250.00. Early
action is necessary, as the bondhold-
ers will wish to know what action the

To the Honorable Mayor and City
Council of the City of Dubuque:
Gentlemen: The undersigned, com-
mittee on claims and City Attorney,
beg to report that on the 20th day of
April, 1910, Kate Daugherty brought
'an action against the City of Dubuque
to recover the sum of $2,000 as dam-
ages for personal injuries sustained by
her, resulting from a fall on the wood-
en platform leading from the sidewalk
to the street and covering the gutter
on the south side of Second street, on
the 17th day of February, 1910, she
claiming that said apron was allowed
to remain covered with ice in a rough,
rounded and uneven condition, and by
reason of the fall the bones of the
wrist of her right arm were fractured
and she claimed permanent injury.
Plaintiff has offered to accept in full
settlement of all claims against the
City, of every kind and nature, the
sum of One Hundred Seventyfive dol-
lars ($175) and court costs. Believing
it to be to the interest of the City to
accept the proposition thus made, we
therefore recommend that the City At-
torney be instructed to effect a settle -
men on that basis, and further recom-
mend that a warrant be ordered drawn
in favor of the Mayor in payment of
the same and also a warrant to cover
the costs of court.

plans and specifications of the sewer
connections contemplated to be made
with an estimate of the cost thereof
by the City Engineer, which plans and
specifications and estimate, together
with a report of the action of said
Board in ordering said sewer con-
nection, shall be submitted to the
City Council for approval, and if ap-
proved by said Council, the Council
shall by resolution, order the same
tc be done by contract in accordance
with such plans and specifications,
and for that purpose shall advertise
in the official papers of the City for
three times within a period of ten
days for proposals for constructing
said connection of sewers ;said work
to be done under the supervision of
the City Engineer and Committee on
Sewers, and the City of Dubuque shall
have the right by its officers or em•
ployees to go upon the premises for
the purpose of making such connec-
tions, and upon the completion of
Sale work and acceptance thereof by
the City Council the City Engineer
shall report to the Council the cost
thereof, including the cost of the esti-
mates, notices, inspection and prepar -'
ing the assessment and plat. and the
City Council shall levy an assessment
against the specific property of the
owner thereof, in an amount equal to
said costs and expenses in the manner
thereinafter stated, and the same
had from the time said work is done
be a lien upon the real estate upon
which such expenditures are made or
expenses are incurred, and such as-
sessment may be collected as other
special assessments and the lien en-
forced by civil action in any court
of competent jurisdiction.
SECTION 5. The Council shall
then direct the Recorder to give ten
days' notice either by three publica-
tions in the two official newspapers,
or by mailing a notice to the own-
ers of the property that the proposed
assessment is to be made, stating the
amount and for what cause the ex-
pense was- incurred, and that objec-
tions may be made in writing and
filed with the Recorder during said
ten days,.and the council having con-
sidered such objections shall by reso-
lution levy the special assessment as
herein above provided.
SECTION 6. All ordinances and
parts of ordinances in conflict here-
with are hereby repealed.
SECTION 7. This ordinance shall
be in force and effect from and after
its passage and publication in the Du-
buque Telegraph - Herald and Times -
Journal, the official newspapers of
he City of Dubuque, Iowa.

Zwack Permission to Lay and Main-
tain a Private Sewer in Ries Street,
in the City of Dubuque, to Connect
Lot 21, Oscar Taylor's Sub., with the
Sanitary Sewer in Windsor Avenue,
and Regulating Such Permission.
Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That permission be and
the same is hereby granted Anton
Zwack, of the City of Dubuque, Iowa, .
to lay a private sewer, consisting of
6 -inch tile pipe, along Ries Street, con-
necting Lot 21, Oscar Taylor's Sub.,
with the sanitary sewer now in Wind-
sor Avenue, in said City.
Sec. 2. Said sewer shall be laid un-
der the direction and supervision of
the City Engineer and Committee on
Sewers of said City.
Sec. 3. The City of Dubuque does,
not assume any obligations to repair
or maintain said sewer, but all ex-
penses incident to such repair or main-
tenance shall, at the option of the
City, be chargeable to the said Anton
Zwack, and should the City at, any
time find it necessary or advisable to-
order a new sewer in said Ries Street,
consent to the laying of the private
sewer herein referred to shall not he
deemed to be a waiver or estoppel on_
the part of said City of the right to
make assessment for said new sewer in
any lawful manner.
Sec. 4. Said Anton Zwack shall. by
accepting the terms thereof, at all
times hold said City safe and harm-
less from any damages, costs or ex --
penses to which the City may be sub-
jected, in any manner whatsoever, by
reason of the existence and mainten-
ance of the said sewer herein referred
to.
Sec. 5. The City of Dubuque may at
any time grant the right to any other
person or company to connect with
said sewer, upon the latter paying to
the said Anton Zwack the proper pro-
portion of the cost of construction and
maintenance of said sewer then due,
any parties making subsequent con-
nections to reimburse, in turn, the said
Anton Zwack and parties having made
prior connections in accordance with
the just proportions then due the said
Anton Zwack and parties having made
such prior connections, the intention
hereof being to reimburse those hav-

AN ORDINANCE Requiring the Mak-
ing of Connections with Sanitary
Sewers and Repealing all Ordi-
nances and Parts of Ordinances in
Conflict Herewith.
BE IT ORDAINED by the City
Council of the City of Dubuque:
SECTION 1. That whenever it
shall appear to the Board of Health
that any property owner, whose
property is situated - within two hun-
dred (200) feet of any public sewer,
has failed, neglected or refused to
make proper and necessary house
connections therewith, said Board
may by resolution order such sewer
connections to be made by such prop-
erty owner, and said resolution shall
state the name of the owner or-
owners of the property to be thus.

tions shall be made, • and that the
general regulations and specifications.

SECTION 2. Every owner of any

or any part thereof is situated within
two hundred feet of any public sewe, ,
shall within thirty days from the
time of receiving notice from the
Board of Health to make such con-
nections, as provided in Section 3
hereof, connect such house, tene-
ment, or outbuilding with such sewer,.
by a proper branch sewer construct-
ed in accordance with the require-
ments of the Board of Health, and to
the satisfaction and approval of the
City Engineer, both as to pipes and
material, as well as work of construct-
ing, and to use such sewer for alL
proper purpose as required by the
Board of Health.
SECTION 3. A copy of said reso-
lution referred to in section 1 hereof,
duly attested by the City Recorder,
shall forthwith be served upon such
property owner or owners, or his or
their duly authorized agent or attor-
ney; the service thereof shall be
made by the City Chief of Police or -
Sanitary Officer, who must endorse
thereon his return and file the same
with the City Recorder. Whenever
it appears that such property owner
or owners are non - residents and have -
no duly authorized agent or attorney
upon whom service can be made, then
the City Recorder shall give ten days
notice thereof by publishing same in
tine official papers of the city of Du-
buque for three consecutive times,
and the service of the copy of said
resolution as herein provided by pub-
lication, shall be deemed sufficient to
require such property owner to make
said sewer connections.
SECTION 4. Whenever any prop-
erty owner who has been duly served
with notice to make such sewer con-
nections as hereinafter provided,
shall neglect or refuse so to do in
accordance with the notice in the
time therein stated, then and in that

ing paid for the cost of said sewer in
such just and fair proportions as the
then total number making use_ of said
sewer bears to the cost of the sewer,
no one to be reimbursed, however, in
an amount in excess of the actual ex-
pense advanced.
Sec. 6. The said Anton Zwack shall
be entitled to the benefit of the pro-
visions contained in Section 5 hereof
only on his written acceptance of the
terms of this ordinance, and on filing,
within 20 days from the time of the
completion of said sewer, in the office
of the City Recorder of said City, an
itemized sworn statement of the ac-
tual cost of the construction of said
sewer. Failure to file such statement
-shall be deemed to constitute a waiver
of said benefits, and shall entitle any
person or company to make connec-
tions with said sewer without cost,
proNided due consent to such connec-
tions be first obtained from said City.
Sec. 7. This ordinance shall be in
force and effect from and after its
passage by the City Council and its
publication one time in the Times=
Journal and Telegraph- Herald, officia,
newspapers of said City, and its writ-
ten acceptance, duly indorsed herein,
by the said Anton Zwack.

AN ORDINANCE Providing for the
Removal of All Dirt, Filth, Ashs,
Manure, Offal and Other Offensive
Matter, or Other Nuisance, Accumu-
lated Upon the Streets, AlleYS or Va-
cant Lots Within the City of Du-
buque, and for the Assessment of the
Cost Thereof to the Property Re-
spectively Liable.
Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That it shall be the duty
of the owners of property within the
City of Dubuque, respectively, to' re-
move from vacant lots by them owned,
and from one -half of that portion of
any street or alley upon which their
property may abut and which portion
lies in front of and contiguous to said
property, all accumulations of dirt,
filth, ashes, manure, offal, and other
offensive matter, or other nuisance.
Sec. 2. The accumulations in the
foregoing section referred to shall in-
clude all garbage, including all decay-
ed or spoiled fruit, fish, meat and
vegetables, and all tin cans containing
any decayed or spoiled fruit, fish, meat
and vegetables, unless such accumu-
lations, as defined in this section. are
contained in pails, cans or other se-
cure receptacles practical for handling
by the regular garbage collector auth-
orized to make collections under con-
tract with said City.
Sec. 3. In the event of the failure
of such respective owners of property
to make such removals, it shall be the
duty of the Street Commissioner to
cause the same to be made and to be
hauled to the City Dump.
Sec. 4. Said Street Commissioner
shall, as soon as practical after making
such removals, make a report to the
City Council of the cost of the work,
showing the date of the performance
of the same, the description of the re-
spective pieces of real estate affected
by such removals, together with the
names of the respective owners of such
property and the amount chargeable
to each. The council shall thereupon,
by resolution, levy a special tax upon
the respective pieces of property liable
therefor, for the amount of the total
cost attaching to such removal, includ-
ing the expense incident to the levy-
ing of the assessments, which special
tax shall be a lien on the property un-
til paid.
Sec. 5. Said special tax shall forth-
with be placed in the hands of the City
Treasurer for collection, and shall draw
the same interest and be collected at
the same time and in the same !Wanner
as other city taxes.
Sec. 6. Nothing contained in this or-
dinance shall be construed as repeal-
ing or in any way modifying the pro-
visions of any part of Chapter XXXVI.
of the Revised Ordinances of 1901 of
said City.
Sec. 7. This ordinance shall he in
force and effect May 1st, 1911, and af-
ter its publication in the Times -
Journal and Telegraph- Herald, official
newspapers of said City.

traffic, and regulating the use of the
streets, alleys and public places of
the City of Dubuque by carts, drays,
hackney coaches, omnibuses, car -
rhg.es, wagons, motor vehicles, and
all other vehicles, and providing a
- penalty for the violation thereof.
Be It Ordained by the City Council
of the City of Dubuque:

Section 1. The owner, driver, oper-
ator or person in charge of any cart,
dray, hackney coach, omnibus, car-
riage, wagon, motor vehicle, or other
vehicle, drawn, driven or propelled up-
on the streets, alleys or public places
of the City of Dubuque, shall conform
to and comply with the following rules
and regulations:
Sec. 2. Vehicles shall be driven in a
careful manner and with due regard for
the safety and convenience of pedes-
trians, also of other vehicles.
Sec. 3. Vehicles shall keep to the
right side of the center of the street.
. Sec. 4. On a street divided longitudi-
nally by a parkway, viaduct, walk,
street railway or sunken way, vehicles
shall keep to the right of such division.
Sec. 5. Vehicles moving slowly shall
keep as close as possible to the curb
on the right, allowing more swiftly
moving vehicles free passage to their
left.
Sec. 6. Vehicles turning to the right
into an intersecting street shall pass
and turn the corner as near to the
right -hand curb as possible.
Sec. 7. Vehicles turning to the left
into an intersecting street shall pass
to the right of and beyond the center
of the street intersection before turn-
ing.
Sec. 8. Vehicles meeting shall pass
each other to the right.
Sec. 9. A vehicle overtaking another
vehicle traveling in the same direction
shall keep to the left of the overtaken
vehicle in passing.
Sec. 10. No vehicle shall back to
make a turn in any street if by so do-
ing it interferes with other vehicles,
but shall go around the block or to
a street sufficiently wide to turn in
without backing.
Sec. 11. Vehicles crossing from one
side of the street to the other shall do
so by turning to the left so as to head
in the same direction as the traffic on
that side of the street towards which
the crossing is made, and when the
street is congested with traffic such
vehicle shall go to the intersection be-
fo'•c turning. and no vehicle shall stop
with its left side to the curb.
Sec. 12. No vehicle shall remain
backed up to the curb except it be ac-
tually loading or unloading, and in
such case no longer than the actual
loading and unloading requires. The
horse or horses attached to a vehicle
backed up to thc curb shall be turned
at right angles to the vehicle and in
the direction in which the traffic upon
the street is moving.
Sec. 13. A vehicle waiting at the
curb shall promptly give place to a
vehicle about to take on or let off
passengers.
Sec. 14. No vehicle shall stop on
any street unless within two feet of
the curb, nor in such a way as to ob-

other animals to pass, and, if traveling
in the same direction, use reasonable
caution in passing such horse or other
animal, and the operator and occu-
pants of any motor vehicle shall ren-
der necessary assistance to the party
having in charge said horse or other
draft animal in so passing.
Sec. 31. That every motor vehicle
while in use on a public highway
within said City shall be provided
tivith good and efficient brakes, and
also with a suitable bell, horn, or
other signal, and be so constructed as
to exhibit, during the period from
one (1) hour after sunset to one (1)
hour before sunrise, one or more
lamps showing white light visible
within a reasonable distance in the
direction toward which such vehicle
is proceeding, and also a red light vis-
ible in the reverse direction.
Sec. 32. That every motor vehicle
within said city shall also at all times
have the number assigned to it by the
secretary of state displayed on the
back of such motor vehicle in such a
manner as to be plainly visible, the
number to be in Arabic numerals,
each not less than three (3) inches
in height, and each stroke to be of a
width not less than one -half (1/2)
inch, and also as a part of such num-
ber the initial and terminal letters of
a state's name, such letters to be not
less than two (2) inches in height.
Sec. 33. All wagons, carts and ve-
hicles of every kind and description,
except covered vehicles, used for the
hauling of garbage, manure, dead
animals, refuse and offensive offal of
every kind and description, are here-
by prohibited from using Locust,
Main, Iowa and Clay streets, between
the hours of 8 a. m. and 10 p?, m.,
providing, however, that nothing in
this section shall be so construe.' as
to prohibit the hauling of such gar-
bage, dead animals, manure, refuse
and offensive offal through the alleys
and street intersections at the time
designated herein.
Sec. 34. That the words and
phrases used in this ordinance shall,
for the purpose of the Ordinance, be
construed as follows' 1. "Motor Ve-
hicle" shall include all vehicles pro-
pelled by any power other than mus-
cular power, excepting such motor ve-
hicles as run only upon rails or tracks,
provided that nothing herein contain-
ed shall apply to traction engines or
road rollers; 2, "Closely built up por-
tions," shall mean the territory with-
in said city contiguous to a public
highway devoted to business or where
for not less than one - fourth ( of a
mile the dwelling houses on such
highway average not more than one
hundred (100) feet apart.
Sec 35. The word "vehicle" as
used in this ordinance shall be held
to include equestrians, lead horses,

carts, drays, hackney coaches, omni-
buses, carriages, wagons, motor vehi-
cles and all other vehicles used for
transporting persons or property on
the public streets, however drawn,
uuven or propelled, except street cars
anu carts, carriages or barrows, pro-
pelled by hand.
The word "horse" includes all do -
mestic animas.
The word "driver" includes the rid-
er and driver of a horse, the rider of.
wheels, and the operator of a motor
vehicle or street car.
Sec. 36. Any person violating any
of the provisions of this Ordinance,
shall be deemed guilty of a misde-
meanor, and shall be punishable by a
fine not exceeding twenty -five dollars.
($25) for the first offense and punish-
able by a fine of not less than twenty-
-five dollars ($25) nor more than fif-
ty dollars (850), or imprisonment not
exceeding thirty days (30) days, for a.
second or subsequent offense.
Sec. 37. All ordinances - or parts of
Ordinances in conflict herewith are
hereby repealed.
Sec. 38. This Ordinance being'
deemed urgent and necessary for the
immediate preservation of the public
peace, health and safety, shall be in
full force and effect from and after its-
passage and publication as required by
law.

struct the free passage of the street.
Sec. 15. No vehicle shall stop or
stand within any street intersection
nor within ten feet of the line of the
intersecting street in the congested
district, nor outside of said district for
a longer period than is necessary to
load or unload, and no vehicle engaged
in heavy traffic, to -wit, hauling ice,
coal, beer, freight of all kinds, shall be
driven on Main Street from First
Street to Seventeenth Street, unless
necessary to load or unload in said
street.
Sec. 16. Traffic on east and west
streets shall have the right -of -way
over traffic on north and south streets.
Sec. 17. The driver of any vehicle
shall stop upon signal from a police
officer.
Sec. 18. The driver of a vehicle. on
the approach of a fire wagon or other
fire apparatus, shall immediately draw
up said vehicle as near as practicable
to the right -hand curb and parallel
thereto, and bring it to a standstill.
Sec. 19. The officers and men of the
Fire Department and Fire Patrol, with
their fire apparatus of all kinds, when
going to, or on duty at, or returning
from a fire, and the officers and men
of the Police Department, and all pa-
trols and ambulances shall have the
right -of -way in any street and through
any procession, except over vehicles
carrying United States mail.
Sec. 20. No vehicle shall be driven
through a procession except with the
permission of a police officer.
Sec. 21. No vehicle shall be allowed
to remain upon, or be driven through
any street of the City of Dubuque so
as to wilfully - blockade or obstruct the
said street; and no vehicle shall be so
overloaded that the horse or horses, or
motive power, shall be unable to move _
it.
Sec. 22. The driver or operator of
every motor vehicle shall give some
plainly visible or audible signal of his
approach, and the driver or operator
of nve � �.o.Ir1P �S defined herein shall
keen his vehicle not less than six feet
from the running hoard or lower step
of any street car which is stopping for
the purpose of taking on or discharging
passengers, and if, by reason of the
presence of other vehicles at the
place where such car is stopping, or by
reason of the narrowness of the street,
it is not possible to preserve a dis-
tance of six feet from such running
board as herein prescribed, then the
driver or operator of said vehicle shall
stop the same until such car shall have
taken on or discharged its passengers
and again started.
Sec. 23. Drivers or operators of mo-
tor vehicles of all kinds shall, in ap-
proaching or traversing a crossing or
street intersection, have their vehicles
under control, and shall sound their
signals in such a way as to give warn-
ing to other vehicles and to pedestrians
of their approach, and reduce the
speed of such vehicle to a rate not
greater than ten miles an hour, and
no such vehicle shall ,turn a corner
into an intersecting street at a great-
er rate of speed than six miles an
hour.
Sec. 24. No horse shall be left unat-
tended in any street or highway unless
securely fastened, or unless the wheels
of the vehicle to which he is harnessed
are securely tied, fastened or chained,
and the vehicle is of sufficient weight
to prevent its being dragged at dang-
erous speed with wheels so secured.
Sec. 25. No horse shall be unbitted
or unbridled in any street or highway
unless secured by a halter.
Sec. 26. —No one, in any street or
highway, shall remove a wheel, pole,
shaft, whiffletree, splinter -bar or any
part of a harness likely to cause ac-
cident if the horse or horses start,
without first unhitching the horse or
horses attached to said vehicle.
Sec. 27. No one shall crack'or so use
a whip as to annoy, interfere with or
endanger any person or excite any
horse or horses other than that which
he is using.
Sec. 28. No person shall drive, guide
or have the care of two or more horses
harnessed respectively to different
vehicles.
Sec. 29. That no person shall oper-
ate a motor vehicle on any street or
public highway within the City of
Dubuque at a rate of speed greater
than is reasonable and proper, having
regard to the traffic and use of the
highway, or so as to endanger the life
or limb of any person, or in any event
in the closely built up portions of the
city at a greater rate than one (1) mile
in six (6) minutes, or elsewhere in
said city at a greater rate than one
(1) mile in four (4) minutes; subject,
however, to the other provisions of this
section. Upon approaching a crossing
of intersecting public highways, or a
bridge, or a sharp curve, or a steep
descent, and also in traversing such
crossing, bridge, curve or descent, a
person operating a motor vehicle shall
have it under control and operate it
at a rate of speed less than hereinbe-
fore specified, and in no event greater
than is reasonable and proper, having
regard to the traffic then on such high-
way and the safety of the public.
Sec. 30. That any person operating a
motor vehicle within said city shall, at
request or on signal by puting up the
hand, from a person riding or driving
a restive horse or other draft or do-
mestic animal, bring such motor
vehicle immediately to a stop, and, if
traveling in the opposite direction, re-
main stationary so long as may be
reasonable to allow such horse or

Whereas it is deemed necessary and
expedient to improve Fifth Street, be-
tween Main and Iowa Streets, in front
of and abutting the premises herein-
after described by laying down a per-
manent sidewalk thereon composed of
cement material.
Therefore be it resolved by the City
Council of the City of Dubuque, That
the City Engineer be and he is hereby
directed to prepare a plat showing
generally the location, nature and ex-
tent of the proposed improvement on
the north side of Fifth Street, be-
tween Main and Iowa Streets, and in
front of and abutting the und. one -half
S. 21 ft. of city lot 17, and the kind of
material to be used, and an estimate
of the entire cost thereof and the
amount and cost of such improvement,
and the amount and cost thereof; to
be paid by the city, if any, and the
cost thereof and amount assessable up-
on each lot or parcel of land adjacent
to or abutting upon such improvement
per front foot, and to file such plat
and estimate in the office of the City
Recorder; that after the filing of said
plat and estimate in his office, the City
Recorder shall notify said abutting and
adjacent property owners, as provided
by ordinance that such plat and esti-
mate are on file, the location and na-
ture of the improvement, kind of ma-
terial to be used, and an estimate of
its cost, and the time before which
objections thereto can be filed, and the
time fixed for hearing, which time shall
not be less than five (5) days after the
service of such notice, and after such
service shall have been made, the City
Recorder shall, at the next regular ses-
sion of the City Council, notify the
Council thereof in writing, with a
copy of such notice accompanying the
same.

the City Engineer and Committee on
Sewers of said city, and in accordance-

sewer of such size and loca-
tion as to make the improvement prac-
ticable and serviceable for present and
future use in connection with the gen-
eral sewerage system in that vicinity.
Sec. 3. The City of Dubuque may at
any time grant the right to any other
person or company to connect with
said sewer, upon the latter paying to.
said Anton Zwack the proper propor-
tion of the cost of construction and
maintenance of said sewer then. due,
any parties making subsequent con-
nections to reimburse, in turn, the-
said Anton Zwack and parties having
made prior connections, in accordance
with the just proportions then due the
said Anton Zwack and parties having
made such prior connections, the in-
tention hereof being to reimburse those
having paid for the cost of said sewer
in such just and fair proportions as
the then total number making use
of said sewer bears to the cost of the
sewer, no one to be reimbursed, how-
ever, in an amount in excess of the
actual expense advanced.
Sec. 4. The said Anton Zwack shall
be entitled to the benefit of the pro-
visions contained in Section 3 hereof,
only on his written acceptance of the -
terms of this ordinance, and on filing,
within 20 days from the time of the -

ings and wherever repairs are need-

assigned to them by H. G. Becker, be
paid and any money due the city ands
the Water Works for taxes and water
be deducted and the same be charg-
ed to the old waterworks' debt fund.

board . on Thirtieth and Couler Ave.
removed from the sidewalk. Carried.
Moved by Ald. Singrin that the
Sidewalk Inspector be instructed to
notify the owner of the property on
lylain Street, between 11th and 12th
Street, not to repair the walk but to
lay a new one. Carried.
Moved by Ald. Specht that the City
Engineer be instructed to prepare
plans and specifications for a four -
foot sidewalk along the Eagle Point
high bridge approach. Carried.
The City Engineer stated that he
had received a letter from an Engi-
neer in Freeport, Ill., who desired to
talk over the matter of assistant en-
gineer. Moved by Ald. O'Rourke that
if he wished to come at his expense
the Engineer might have him come.

Ald. Saul, chairman of the com-
mittee appointed to call on the Key
City Gas Co., reported that they call-
ed on Pres. McLean and he promised
to extend the gas mains in Grand-
view Ave, from the present mains to

mittee of the Whole to view the
ground.
Petition of Dubuque Motor Boat club
asking that they be granted the privi-
lege to erect a grandstand on the levee
beginning at a point about one hun-
dred feet south of the Diamond Jo
wharf boat and extending south about
six hundred feet, also that they be
granted the exclusive control of the
levee from the bridges south, during
the regatta the week of July 2 -8, pre-
sented. Moved by Ald. O'Rourke that
the first part of the petition be grant-
ed and if the Assistant City Attorney
deems that the City would be liable for -

ORDINANCE.
AN ORDINANCE Providing for the
Removal of All Dirt, Filth, Ashs,
Manure, Offal and Other Offensive -
Matter, or Other Nuisance, Accumu-
lated Upon the Streets, Alleys or Va-
cant Lots Within the City of Du-
buque, and for the Assessment of the
Cost Thereof to the Property Re-
spectively Liable.
Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That it shall be the duty
of the owners of property within the
City of Dubuque, respectively, to re-
move from vacant lots by them owned,
and from one -half of that portion of
any street or alley upon which their
property may abut and which portion
lies in front of and contiguous to said
property, all accumulations of dirt.
filth, ashes, manure, offal, and other
offensive matter, or other nuisance.
Sec. 2, The accumulations In the •
foregoing section referred to shall in-
clude all garbage, including all decay-
ed or spoiled fruit, fish, meat and
vegetables, and all tin cans containing
any decayed or spoiled fruit, fish. meat
and vegetables, unless such accumu-
lations, as defined in this section. are •
contained in pails, cans or other se-
cure receptacles practical for handling
by the regular garbage collector auth-
orized to make collections under con-
tract with said City.
Sec. 3. In the event of the failure
of such respective owners of property
to make such removals, it shall be the
duty of the Street Commissioner to
cause the same to be made and to be
hauled to the City Dump.
Sec. 4. Said Street Commissioner
shall, as soon as practical after making
such removals, make a report to the
City Council of the cost of the work,
showing the date of the performance
of the same, the description of the re-
spective pieces of real estate affected
by such removals, together with the
names of the respective owners of such
property and the amount chargeable
to each. The council shall thereupon,
by, resolution, levy a special tax upon
the respective pieces of property liable
therefor, for the amount of the total
cost attaching to such removal, includ-
ing the expense incident to the levy-
ing of the assessments, which special
tax shall be a lien on the property un-
til paid.
Sec. 5. Said special tax shall forth-
with be placed in the hands of the City
Treasurer for collection, and shall draw
the same interest and be collected at
the same time and in the same manner
as other city taxes.
Sec. 6. Nothing, contained in this or-
dinance shall be construed as repeal-
ing or in any way modifying the pro-
visions of any part of Chapter XXXVI.
of the Revised Ordinances of 1901 of
said City.
Sec. 7. This ordinance shall be in
force and effect May 1st, 1911, and af-
ter its publication in the Times -
Journal and Telegraph - Herald, official
newspapers of said City.

An Ordinance changing the name of
Wilde Street to Mount Loretto Ave-
nue.
Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That the name of Wilde
Street be and the same is hereby
changed to Mount Loretto Avenue.
Section 2. This ordinance shall be in
force and take effect from and after
its passage by the City Council and its
publication one time in the Dubuque
Telegraph- Herald and the Times -Jour-

ORDINANCE.
AN ORDINANCE Requiring the Mak-
ing of Connections with Sanitary
Sewers and Repealing all Ordi-
nances and Parts of Ordinances in
Conflict Herewith.
BE IT ORDAINED by the City -
Ccuncil of the City of Dubuque:
SECTION 1. That whenever it
shall appear to the Board of Health
that any property owner, whose
property is situated within two hun-
dred (200) feet of any public sewer,
has failed, neglected or refused to
make proper and necessary house
connections therewith, said' Board
may by resolution order such sewer'
connections to be made by such prop-
erty
owner, and said resolution shall
state the name of the owner or
owners of the property to be thus
connected by sewer, with a descrip-
tion of the property and fix the time -
in said order within which connec-
tions shall be made, and that the
general regulations and specifications.
as to construction of such sewers are
on file and may be seen in the City
Engineer's office, and shall also recite
that if said connections are not made
by the time specified, the Board shall
order such work and connections.
made and report the costs and ex-
penses thereof to the City Council
which shall assess the same against
the propertyy to be thus connected by
sewer, and such assessment shall be
a lien on said property, which the
City Council can enforce by the sale
of same.
SECTION 2. Every owner of any
house, tenement, or outbuilding occu-
pied or used by a person or persons,
which house, tenement, or building, .
or any part thereof is situated within
two hundred feet of any public sewe, ,
shall within thirty days from the
time of receiving notice from the
Board of Health to make such con-
nections, as provided in Section 3
hereof, connect such house, tene-
ment, or outbuilding with such sewer,
by a proper branch sewer construct-
ed in accordance with the require-
ments of the Board of Health, and to
the satisfaction and approval of the
City Engineer, both as to pipes and
material, as well as work of construct-
ing, and to use such sewer for all,

pt'oper purposes as required by, the
Board of Health.
SECTION 3. A. copy of said reso-
lution referred to in section 1 hereof,
duly attested by the City Recorder,
shall forthwith be served upon such
property owner or owners, or his or
their duly authorized agent or attor-
ney; the service thereof shall he
made by the City Chief of Police or
Sanitary Officer, who must endorse
thereon his return and file the same
with the City Recorder. Whenever
it appears that such property owner
or owners are non - residents and have
no duly authorized agent or attorney
upon whom service can be made, then
the City Recorder :shall give ten days
notice thereof by piiblishing''sa'me in

said sewer connections.
SECTION 4. Whenever any prop-
erty owner who ha5'beeh duly served
with notice td'mai& such sewer con -
nections • as hereinbefore provided,
shall neglect or refuse so to do in
accordance with the notice in the
time therein stated, then and in that
case the Board of Health may order
plans and specifications of the sewer
•connections contemplated to be made
with an estimate of the cost thereof
by the City Engineer, which plans and
.specifications and estimate, together
with a report of the action of said
Board in ordering said sewer con-
nection, shall be submitted to,.;the
City Council for approval, and if ap
proved by said Council, the Council
shall by resolution, order the same
tc be done by contract in a.ccordance
with such plans and specifications,
and for that purpose shall advertise
in the official papers of the City
three times within a period of ten
days for proposals for constructing
said connection of sewers; said work
to be done under the supervision of
the City Engineer and Committee on
Sewers, and the City of Dubuque shall
have the right by its officers or em•
ployees to go upon the premises for
the purpose of making such connec-
tions, and upon the completion of
said work and acceptance thereof by
the City Council the City Engineer
shall report to the Council the cost
thereof, including the cost of the esti-
mates, notices, inspection and prepar-
ing the assessment and plat, and the
-City Council shall levy an assessment
against the specific property of the
owner thereof, in an amount equal to
said costs and expenses in the manner
hereinafter stated, and the same
shall from the time said work is done
be a lien upon such real estate upon
which such expenditures are made or

expenses are incurred, and such as-
sessment may be collected as other
special assessments and the lien en-
forced by civil action in any court
of competent jurisdiction.
SECTION 5. The Council shall
then direct the Recorder to give ten
days' notice either by three publica-
tions in the two official newspapers,
or by mailing a notice to the own-
ers of the property that the proposed
assessment is to be made, stating the
amount and for what cause the ex-
pense was incurred, and that objec-
tions may be made in writing and
filed with the Recorder during said
ten days, and the council having con -
sidered such objections shall by reso-
lution levy the special assessment as
herein above provided.
SECTION 6. All ordinances and
parts of ordinances in conflict here-
with. are hereby repealed.
SECTION 7. This ordinance shall
be in force and effect from and after
its passage and publication in the Du-
buque Telegraph - Herald and Times -
Journal, the official newspapers of
the City of Dubuque, Iowa.

Notice to Gardeners, Hucksters, Fish-
ermen, Etc.
On ,Saturday, May 6, 1911, at 10
o'clock a. m. sharp, the Marketmaster
will rent for cash the market stands
about the City Hall to the highest bid-
der for the ensuing year. The, parties
having possession of the various
stands at present will be permitted to
retain the same for the same price as
paid last year, provided, however,
that the rent be paid before May
1st, 1911. No renter will be permitted
to sublet the stand nor will he be per-
mitted to loan the use of same to
some other party under penalty of
having the rental of same be ennulled.
The City reserves the right to re-
ject any or all bids. Per order

and for hauling away such sweepings,
according to the specifications and
schedule on file, bids to be seperate.
Bidders will state the price of do-
ing such work by the week, and all
bids must be accompanied by a cer-

titled check for $50.00 on some Du-
buque bank as a guarantee that a
contract will be entered into if award-
ed. The city reserves the right to re-
