City Engineer Gus Psihoyos is recommending authorizing the award of the public
improvement construction contract to the qualified bidder and to release payments for
project for their work on the remediation of the Comiskey Park Property so that the
condition of the grant payment is fully complied with for the E 24th Street Site
Contaminated Soil Removal Project, authorizing the expenditure of over $100,000 as
required by state law. The final construction contract is estimated at $123,000 with total
project costs, including contingency, engineering design, and administration, estimated
at $155,595.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The attached resolution authorizes the award of the public improvement construction
contract to the qualified bidder and to release payments for project for their work on the
remediation of the Comiskey Property so that the condition of the grant payment is fully
complied with for the E 24th Street Site Contaminated Soil Removal Project.
BACKGROUND
Over the past 19 years, city supported redevelopment efforts have made significant
headway in mitigating site specific contamination risks which has led to many sites having
their economic viability restored. Three specific sites were selected to be cleaned up as
part of this grant. The sites are the eastern half block expansion of Comiskey Park, and
the former Sinclair Oil and Dodd's Terminal sites in the South Port. The USEPA
Brownfields Multipurpose grant provides funding for community outreach and involvement,
environmental assessments, reuse planning, and site remediation and clean-up.
DISCUSSION
The E 24th Street Site Contaminated Soil Removal Project (Comiskey Park Property)
will provide for the removal and replacement of contaminated soil material. This includes
relocation of non -contaminated stockpile.
BIDS
The City will be soliciting bids for the E 24th Street Site Contamination Soil Removal Project.
Sealed informal bid proposals are scheduled to be submitted on the 6th day of September
2024 and shall be awarded to the lowest responsive, responsible bidder for the project and
shall release payments to the selected contractor for their work on the remediation of the
Comiskey Property so that the condition of the grant payment is fully complied with.
RECOMMENDATION
I recommend awarding the construction contract for the E 24th Street Site Contamination
Soil Removal Project to the lowest responsive bidder.

REQUESTED ACTION
I respectfully request that the City Council award the Public Improvement Construction
Contract to the lowest responsive, responsible bidder for the E 24th Street Site Contaminated
Soil Removal Project and to release payments for project for their work on the remediation
of the Comiskey Property so that the condition of the grant payment is fully complied with
through adoption of the attached resolution.

RESOLUTION NO. 274-24
AWARDING PUBLIC IMPROVEMENT CONSTRUCTION CONTRACT AND
AUTHORIZING PAYMENT FOR THE USEPA BROWNFIELDS MULTIPURPOSE
GRANT E. 24TH STREET SITE CONTAMINATED SOIL REMOVAL PROJECT
WHEREAS, the City of Dubuque is the recipient of a USEPA Multipurpose
Brownfields grant (the Grant); and
WHEREAS, pursuant to the Grant the City must expend funds on eligible projects;
and
WHEREAS, City staff have identified eligible project work under the Grant to
complete the E. 24th Street Site Contaminated Soil Removal Project (the Project); and
WHEREAS, sealed informal bid proposals are scheduled to be submitted by
contractors for the Project on the 6th day of September 2024; and
WHEREAS, said sealed proposals shall be opened and read on the 6th day of
September 2024; and
WHEREAS, City staff shall select the lowest responsive, responsible bidder for the
Project; and
WHEREAS, the City Manager is authorized to award and execute contracts and
to authorize work to proceed under contracts for public improvement projects up to the
threshold for competitive bidding as provided by Iowa Code chapter 26.
WHEREAS, the final contract of the Project work is estimated at $123,000.00; and
the City Manager is authorized to execute contracts up to $500,000 pursuant to
Resolution 286-17; and
WHEREAS, pursuant to Iowa code 380.4, a resolution must be passed to spend
public funds in excess of $100,000 on a public improvement project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. A Public Improvement Construction Contract for the Project shall hereby
be awarded to the lowest responsive, responsible bidder for the Project and the City
Manager is hereby directed to execute a Public Improvement Construction Contract on
behalf of the City of Dubuque for the Project.
Section 2. The Chief Financial Officer is hereby directed to pay to the Contractor for
its completed work upon receipt of invoice as provided in Iowa Code chapter 573.13.
