CITY COUNCIL PROCEEDINGS
SPECIAL SESSION
The Dubuque City Council met in special session at 5:15 p.m.
on August 19, 2024, in the second -floor Council Chambers of
the Historic Federal Building, 350 W. 6th Street.
Present: Mayor Cavanagh; Council Members Farber, Jones
(arrived at 5:18 p.m.), Resnick, Roussell, Sprank, Wethal;
City Manager Van Milligen (arrived at 5:18 p.m.), City
Attorney Brumwell.
Mayor Cavanagh read the call and stated this is a special
session of the City Council called for the purpose of
conducting work sessions on the Regional Workforce Landscape
and Imagine Dubuque.
WORK SESSIONS
1. Regional Workforce Landscape and Other Initiatives
Rick Dickinson, President and CEO of Greater Dubuque
Development Corporation, and Nic Hockenberry, Director of
Workforce Programming, presented information on the regional
workforce landscape and initiatives, and addressed a question
about essential amenities for workforce attraction.
The work session initially concluded at 6:01 p.m. but was
reopened after the Imagine Dubuque Update session ended.
2. Imagine Dubuque Update
Planning Services Director Wally Wernimont and Assistant
Planner Jason Duba presented an update on the comprehensive
plan: Imagine Dubuque 2037: A Ca11 to Action.
This work session concluded at 6:19 p.m.
Due to additional time remaining after the Imagine Dubuque
Update work session, Mr. Dickinson presented on broadband
initiatives from 6:20 p.m. to 6:24 p.m.
There being no further business, Mayor Cavanagh declared the
meeting adjourned at 6:24 p.m.

REGULAR SESSION
The Dubuque City Council met in regular session at 6:30 p.m.
on August 19, 2024, in the second -floor Council Chambers of
the Historic Federal Building, 350 W. 6th Street.
Present: Mayor Cavanagh; Council Members Farber, Jones,
Resnick, Roussell, Sprank, Wethal; City Manager Van Milligen,
City Attorney Brumwell.
Mayor Cavanagh read the call and stated this is a regular
session of the City Council called for the purpose of
conducting such business that may properly come before the
City Council.
PLEDGE OF ALLEGIANCE
City Clerk Breitfelder announced that Item Set for Public
Hearing #3 was removed from the meeting.
PRESENTATION(S)
1. Iowa 2024 Community of Character Award Presentation:
Scott Raecker, Executive Director of The Robert D. and Billie
Ray Center at Drake University, presented the Iowa 2024
Community of Character Award. A video was also shown.

Motion by Resnick to receive and file the documents, adopt
the resolutions, and dispose of as indicated. Seconded by
Farber. Motion carried 7-0.
1. Minutes and Reports Submitted: Airport Commission of
April 23, 2024; Arts and Cultural Affairs Advisory Commission
of June 25, 2024; City Council Proceedings of July 29 and
August 5, 2024; Housing Commission of January 23, 2024;
Resilient Community Advisory Commission of April 4 and July
11, 2024; Zoning Advisory Commission of July 2, 2024; Proof of

Upon motion the documents were received and filed.
2. Notice of Claims and Suits: Josh Heisdorf for vehicle
damage; Jeff Jones for vehicle damage; Tishana Suiter for
vehicle damage. Upon motion the documents were received,
filed, and referred to the City Attorney.
3. Disposition of Claims: City Attorney advised that the
following claims have been referred to Public Entity Risk
Services of Iowa, the agent for the Iowa Communities Assurance
Pool: Camille Baker for vehicle damage; Julianne Geraghty for
property damage; Richard Powers
for vehicle damage; William Sand Jr. for property damage;
Tishana Suiter for vehicle damage. Upon motion the documents
were received, filed, and concurred.
4. Approval of City Expenditures: Upon motion the documents
were received and filed, and Resolution No. 253-24 Authorizing
the Chief Financial Officer/City Treasurer to make certain
payments of bills that must be paid and approved for payment
in accordance with City procedures was adopted.
5. Authorized Depository Institutions: Upon motion the
documents were received and filed, and Resolution No. 254-24
Naming Depositories was adopted.
6. Application to ECIA for Brownfields Assessment Funds for
Newt Properties: Upon motion the documents were received,
filed, and approved.
7. Radio Dubuque and Dubuque Jaycees Fireworks Request 2025:
Correspondence from Perry Mason, General Manager for Radio
Dubuque, requesting approval for Radio Dubuque and the Dubuque
Jaycees to conduct a fireworks display on July 3, 2025 from
9:00 p.m. to 10:30 pm. in conjunction with the closure of
indicated streets and use of A.Y. McDonald Park as part of a
special event request. The rain date is July 4. Upon motion
the documents were received, filed, and approved.
8. Rob McDonald Fireworks Permit: City Manager recommended
City Council approval to issue a permit to Rob McDonald for a
fireworks display on September 14, 2024, at his private
residence, 3399 Roosevelt Street. Upon motion the documents
were received, filed, and approved.
9. New Ladder Truck - Static Display: City Manager
transmitted that Fire Department staff plan to display the new
2024 Pierce ladder truck before the Tuesday, September 3rd
City Council meeting starting at 5:45 p.m. in front of the
Historic Federal Building on 6th Street. Upon motion the
documents were received and filed.
10. 3000 Jackson Dubuque Brewing and Malting Project Update:
Upon motion the documents were received and filed.
11. Signed Contract(s): Dubuque Community Schools for Before
and After School Programming; Strand Associates, Inc for the

Well No. 11 Source Water Project. Upon motion the documents
were received and filed.
12. Stone Cliff Winery, Inc. Lease Agreement Approval: City
Manager recommended City Council approval of a 2 + year lease
agreement with the Stone Cliff Winery, Inc for a portion of
the Alliant Amphitheater for an outdoor service patio. Upon
motion the documents were received, filed, and approved.
13. Approval of Retail Alcohol Licenses: Upon motion the
documents were received and filed, and Resolution No. 255-24
Approving applications for retail alcohol licenses, as
required by City of Dubuque Code of Ordinances Title 4
Business and License Regulations, Chapter 2 Liquor Control,
Article B Liquor, Beer and Wine Licenses and Permits was
adopted.
14. Approval of Retail Tobacco, Alternative Nicotine, and
Vapor Product Permit Application: Upon motion the documents
were received and filed, and Resolution No. 256-24 Approving
applications for retail permits to sell Tobacco, Tobacco
Products, Alternative Nicotine Products, and Vapor Products,
as required by Iowa Code ?453A.47A was adopted.
ITEMS SET FOR PUBLIC HEARING
Motion by Roussell to receive and file the documents, adopt
the resolutions, and set the public hearings as indicated.
Seconded by Wethal. Motion carried 7-0.
1. Setting a Public Hearing for a First Amendment to
Development Agreement by and between the City of Dubuque, Iowa
and CARich Properties, LLC to Redevelop Property at 1706
Central Avenue: Upon motion the documents were received and
filed and Resolution No. 257-24 Fixing the date for a public
hearing of the City Council of the City of Dubuque, Iowa on a
First Amendment to Development Agreement by and between the
City of Dubuque, Iowa and CARich Properties, LLC, including
the proposed issuance of urban renewal tax increment revenue
obligations relating thereto, and providing for the
publication of notice thereof was adopted setting a public
hearing for a meeting to commence at 6:30 p.m. on September 3,
2024 in the Historic Federal Building.
2. Keymont Drive Pavement Rehabilitation Project: Upon
motion the documents were received and filed and Resolution
No. 258-24 Keymont Drive Pavement Rehabilitation Project:
preliminary approval of plans, specifications, form of
contract, and estimated cost; setting date of public hearing
on plans, specifications, form of contract, and estimated
cost; and ordering the advertisement for bids was adopted
setting a public hearing for a meeting to commence at 6:30
p.m. on September 3, 2024 in the Historic Federal Building.
3. Water Department Operations SCADA System Upgrade Project
- Project Initiate and Set the Public Hearing: This item was
removed from the meeting.
BOARDS/COMMISSIONS
Applications were reviewed for the following Boards and
Commissions. Applicants were invited to address the City
Council regarding their desire to serve on the following
Boards/Commissions.
1. Historic Preservation Commission: Two, 3-Year terms
through July 1, 2027 (Vacant At -Large terms of Cassill and
Doyle). Applicants: Bill Doyle, 1591 White St.; Cole Hansen,
408 Burch St.; Heidi Pettitt, 3116 Central Ave.
2. Housing Commission: Two, 3-Year terms through August 17,
2027 (Expiring terms of Janes and Kehoe). Applicants: Ross

Janes, 2741 Muscatine St.; Renee Kehoe, 1209 Lincoln Ave. Mr.
Janes spoke in support of his application.
3. Housing Trust Fund Advisory Committee: Two, 3-Year terms
through August 17, 2027 (Expiring terms of Becwar and Holz).
Applicants: Michelle Becwar, 2115 Coates St.; Jim Holz, 3010
Indiana Crt.
4. Library Board of Trustees: One, 4-Year term through July
1, 2028 (Vacant term of Armstrong). Applicant: Tom Brennan,
3275 Cider Rdg. Mr. Brennan spoke in support of his
application.
5. Long Range Planning Advisory Commission: One, 3-Year term
through July 1, 2027 (Expired term of McGrath). Applicant:
Beth McGrath, 2385 Clarke Crest Dr.
PUBLIC HEARINGS
1. 8301 Seippel Court Rezoning Request: Motion by Jones to
receive and file the documents and that the requirement that a
proposed ordinance be considered and voted on for passage at
two Council meetings prior to the meeting at which it is to be
passed be suspended. Seconded by Sprank. Planning Services
Director Wally Wernimont provided a staff report. Motion
carried 7-0.
Motion by Jones for final consideration and passage of
Ordinance No. 46-24 Amending Title 16 of the City of Dubuque
Code of Ordinances, Unified Development Code, by reclassifying
hereinafter described property located at 8301 Seippel Court
from CS Commercial Service and Wholesale District to C-3
General Commercial District. Seconded by Sprank. Motion
carried 7-0.
2. Peru Road Rezoning Request: Motion by Roussell to receive
and file the documents and that the requirement that a
proposed ordinance be considered and voted on for passage at
two Council meetings prior to the meeting at which it is to be
passed be suspended. Seconded by Wethal. Planning Services
Director Wally Wernimont provided a staff report. Responding
to a question from the City Council, Mr. Wernimont stated that
his department works with the engineering department on
statewide urban design and specifications (SUDAS). Motion
carried 7-0.
Motion by Roussell for final consideration and passage of
Ordinance No. 47-24 Amending Title 16 of the City of Dubuque
Code of Ordinances, Unified Development Code, by reclassifying
hereinafter described property located along Peru Road between
Walker and Toledo Street (Pins 1012183002, 1012183005,
1012183008, and 1012183007) from R-3C Moderate Density
Multi -Family Residential District with Conditions to R-3
Moderate Density Multi -Family Residential District. Seconded
by Wethal. Motion carried 7-0.
3. 405, 575, and 595 Cedar Cross Road Rezoning Request:
Motion by Jones to receive and file the documents and that the
requirement that a proposed ordinance be considered and voted
on for passage at two Council meetings prior to the meeting at
which it is to be passed be suspended for the ordinance
recommended by the Zoning Advisory Commission to rezone only
595 Cedar Cross Road. Seconded by Wethal. Planning Services
Director Wally Wernimont provided a staff report, stating that
after discussions with the applicant regarding 405 and 575
Cedar Cross Rd., the applicant has requested the withdrawal of
those properties from the rezoning consideration. Those two
properties will be brought back to the Zoning Advisory
Commission for review at a future meeting and will then be

presented again at a City Council meeting. City Clerk
Breitfelder announced that input was submitted by Carol Maas,
3095 Nightengale Ln. Applicant Jule Merfeld, 10713 Cottingham
Rd., Peosta, explained that 595 Cedar Cross Rd. is currently
used as an Airbnb and that attempts to sell the property have
been unsuccessful due to its zoning and proximity to the
road's turning lane. In response to a City Council inquiry
about nearby properties in an isolated zoning area, Mr.
Wernimont noted that the Zoning Advisory Commission shared
those concerns, leading to their denial of the rezoning
requests for 405 and 575 Cedar Cross Rd. The City Council
discussed the best use for 595 Cedar Cross Rd. and its
surrounding properties. Motion carried 6-1 with Resnick voting
nay.
Motion by Jones for final consideration and passage of
Ordinance No. 48-24 Amending Title 16 of the City of Dubuque
Code of Ordinances, Unified Development Code, by reclassifying
hereinafter described property located at 595 Cedar Cross Road
from R-1 Single -Family Residential District to CS Commercial
Services and Wholesale District. Seconded by Wethal. Motion
carried 6-1 with Resnick voting nay.
4. Old Mill Road Lift Station and Force Main Project - Phase
I Public Hearing: Motion by Jones to receive and file the
documents and adopt Resolution No. 260-24 Approval of plans,
specifications, form of contract, and estimated cost for the
Old Mill Lift Station and Force Main Project Phase I.
Seconded by Farber. Motion carried 7-0.
5. Hold Public Hearing to Approve Contract with Tucktara,
LLC for Construction of a Single -Family Home on a City -Owned
Infill Lot at 2527 Washington Street: Motion by Roussell to
receive and file the documents and adopt Resolution No. 261-24
Approval of contract for construction of a single-family home
on a city -owned infill lot located at 2527 Washington Street,
in the City of Dubuque, Iowa. Seconded by Sprank. In response
to City Council questions, Housing and Community Development
Director Alexis Steger explained that program income from
housing tax increment financing (TIF) is funding the project
and that the builder has flexibility in the homes design. City
Council Members discussed whether the city should profit from
the property and how the project integrates sustainability and
equity into homeownership. Motion carried 6-1 with Resnick
voting nay.
6. Well No. 7 Rehabilitation Project 2024 - Phase 2 Public
Hearing: Motion by Jones to receive and file the documents and
adopt Resolution No. 262-24 Approval of plans, specifications,
form of contract, and estimated cost for the Well No. 7
Rehabilitation Project 2024 Phase 2. Seconded by Farber.
Motion carried 7-0.
ACTION ITEMS
1. Proposed Additional Housing Development Incentive: Motion
by Roussell to receive and file the documents and approve an
additional incentive to facilitate low- and moderate -income
housing development outside of the Greater Downtown Urban
Renewal Area. Seconded by Sprank. In response to a question,
City Manager Van Milligen explained that the number of
units would determine whether the development meets the 60%
low- and moderate -income housing requirement for the
incentive. Motion carried 7-0.
2. 2024 Police Department CALEA Accreditation Acceptance:
Motion by Farber to receive and file the documents and listen

to the presentation. Seconded by Sprank. Police Chief Jeremy
Jensen made a presentation regarding the Dubuque Police
Department being awarded the Advanced Law Enforcement
Accreditation by the CALEA board of
commissioners for the 10th time. Motion carried 7-0.
3. Work Session Request: Central Avenue and White Street
Corridor Traffic Study: Motion by Sprank to receive and file
the documents and schedule the work session for Monday,
September 30, 2024, at 6:30 p.m. Seconded by Roussell. In
response to a question about holding the work session on a
non -regular City Council meeting night, City Manager Van
Milligen explained that the session's length required
scheduling it separately. September 30th is also the earliest
date the consultants will be ready to present the data. Motion
carried 7-0.
4. Work Session Request: Smart Parking & Mobility Management
Plan: Motion by Roussell to receive and file the documents and
schedule the work session for October 7, 2024, at 5:30 p.m.
Seconded by Jones. Motion carried 7-0.
5. Water Distribution Crew Employee Feature Video: Motion by
Jones to receive and file the documents and view the video.
Seconded by Farber. Public Information Office staff showed a
video featuring Marty Kearney, a member of the City of Dubuque
Water Distribution crew. The video can be viewed at

Motion carried 7-0.
6. City Life in Marshallese Video: Motion by Roussell to
receive and file the documents and view the video. Seconded by
Wethal. Public Information Office staff showed a video
produced in collaboration with the Office of Shared Prosperity
and Neighborhood Support to promote the next City Life
sessions, which will be presented in Marshallese. The video

7-0.
COUNCIL MEMBER REPORTS
Council Member Jones reported on the recent congressional
staff visit and the Art on the River opening reception.
Council Member Farber reported on recent initiatives with
the Federal Communications Commission Committee and National
League of Cities Technology Committee.
Council Member Roussell reported on a Presentation Lantern
Center student attaining United States citizenship, learning
about the Dubuque Arboretums strategic plan, and Carnegie
Stout Public Library's Reading with Rover Program.
Council Member Wethal reported on the Dubuque Fine Arts
Festival and speaking with University of Dubuque theology
students.
CLOSED SESSION
Motion by Jones to convene in closed session at 8:11 p.m. to
discuss Pending Litigation and Purchase or Sale of Real Estate
Chapter 21.5(1)(c),(j) Code of Iowa. Seconded by Wethal. Mayor
Cavanagh stated for the record that the attorney who will
consult with City Council on the issues to be discussed in the
closed session is City Attorney Brumwell. Motion carried 7-0.
The City Council reconvened in open session at 9:28 p.m.
stating that staff had been given proper direction.
ADJOURNMENT
There being no further business, Mayor Cavanagh declared the
meeting adjourned at 9:28 p.m.
