'Moved by Ald. Singvin bids be re-
ferred to City Engineer, he to report
tonight. Carried.
Petition of certain abutting property
owners along the improvement of
Grandview avenue, asking that the
grade of certain portion of said im-
provement be changed, presented.
Moved by Ald. Saul the rules be sus-
pended to permit anyone present to
address the council regarding the
change of grade. Mr. Ryan and Mr.
Sullivan addressed the council, stating
that the change asked for would in no
way interfere with the flow of water
or damage the property, but if change
was not made it would damage the
property considerably. City Engineer
Baumgartner was asked as to his opin-
ion regarding the change. He stated
the change could be made without a
great expense and the property would
be benefited thereby.
Moved by Ald. Saul that action be
deferred until next meeting and when
we adjourn we adjourn to Friday, Oct.
7, 1910. Carried.
Remonstrance of J. K. Deming et al
against laying sidewalk on Garfield
avenue, abutting Lot 2 of Mineral Lot
466, presented. Moved by Ald. Sauer
b.- referred to Committee of the Whole
and City Recorder instructed not to
advertise for bids. Carried.
Petition of The Farley & Loetscher
Sashmakers, asking permission for the
use of Armory hall on Oct. 18, 1910, for
dancing purposes presented. On mo-
tion of Aid. Saul referred to Commit-
tee of the - Whole.
Petition of John Burns asking the
city to furnish him with employment
presented. On motion of Ald. McEvoy
received and filed.
Petition of Hygiene Committee of
Women's club et al, asking that in the
event the city purchases the Olinger
property, on Jackson street, that a
part be set aside for public play
grounds presented. On motion of Ald.
Saul referred to Committee of the
Whole.
Petition of Court of Honor Indus-
trial club asking for permission to use
the Armory Hall on the 10th, 11th and
12th of November, presented. Moved
by Ald. O'Rourke be referred to Com-
mittee of the \\Thole. Amended by Ald.
Singrin the prayer of petititioners l.e
granted. Amendment carried. Motion
lost.
A waiver signed by owners of prop-
erty between Washington and Elm
streets and 'Twenty -first and Twenty-
second streets (known as Eagle Point

avenue and Lincoln avenue), waiving
all objections to errors, irregularities
or inequalities in the construction of
8 -inch tile pipe Sanitary Sewer to run
from Twenty -first street to Twenty -
second street and connect with Sani-
tary Sewer in Twenty -first street, and
agreeing to pay all assessments for
said improvement when due, present-
ed. Moved by Ald. Specht to suspend
the rules to permit anyone who de-
sired to address the council in refer -
_ence to said sewer. Carried by the
following vote:
Yeas —Alds. Apel, McEvoy, O'Rourke,
Sauer, Saul, Singrin, Specht.
Nays —None.
Mr. Phil Breithaupt addressed the
council, stating that the waiver was
signed by all but one of the property
owners, and that the sewer would pass
through private ground owned by the
signers of the waiver.
Moved by Ald. O'Rourke the prayer
be granted subject to the opinion of
the City Attorney and the Sanitary
Officer be instructed to investigate as
to the sever connection of Mr. Baum -
hover's property on Twenty - second St.
and report to the council. Carried.
Petition of Anna Dietl asking that
the taxes for the year of 1909 on the
real estate of Andreas Dietl, deceas-
ed, be remitted and cancelled. On mo-
tion of Ald. Specht prayer granted.
Petition of Catherine Blitsch asking
that the taxes on the north half of
Lot 13, in Tivoli Addition, being her
homestead, be cancelled in full pre-
sented. On motion of Ald. Sauer ac-
tion deferred until next regular meet-
ing.
Petition of Philip Klunschoedt et al
aELing that the council take some ac-
tion to prevent the C. G. W. R. R.
from laying any more tracks on Elm
street, between Twenty -fifth and
Twenty - seventh streets, presented.
Moved by Ald. Sauer the rules be sus-
pended to permit anyone present to
address the council in reference to the
petition. Carried by the following
vote:

Mr. Philip Klunshoedt addressed the
council regarding the filling of street
between Twenty -fifth and Twenty -
seventh street and the laying of tracks
by G. W. R. R. Moved by Ald.
O'Rourke the petition of Philip Klun-
schoedt et al be referred to City At-
torney and he to report to Committee
of the Whole at his earliest conven-
ience. Carried.
Petition of Captain H. G. Higbee,
asking that the necessary repairs to
the interior of that part of the En-
gine House leased by the Governor's
Greys for Armory purposes be given
immediate attention presented. On
notion of Ald. Saul, referred to the
Committee on Public Grounds and
Buildings and they to report to the
Council.
Petition of Jas. Lynch, asking that
the special assessment against South
1/2 of Lot 588 and ,588a, City, owned
by J. Robinson Estate, for clean-
ing snow, be cancelled, as the said
work was not done. On motion of
Ald. O'Rourke, prayer of petitioner
granted.
Petition of Dubuque Brewing &
Malting Co., asking to be granted
permission to construct an overhead
bridge running from the bottling de-
partment on north side of 27th Street
to the bottle storage plant on the
south side of 27th Street, persented.
Moved by Ald. Saul prayer of peti-
tioner be granted and Ordinance
Committee draft proper Ordinance.
Amended by Ald. Apel, to be re-
ferred to Committee of the Whole
to view the ground.

Council of the City of Dubuque:
Gentlemen: The undersigned re-
spectfully state that they are the
Purchasers, successors and assignees
of the saloon business of Ned Curtis
in the City of Dubuque, Iowa, which
said Ned Curtis has heretofore held
and been granted a resolution of con-
sent by the City Council of the City
of Dubuque, Iowa, authorizing him to
engage in the sale of intoxicating
liquors in the said city, and your pe-
titioners as the successors and as-
signees of the business of said Ned
Curtis respectfully ask your honor-
able body to grant them a new reso-
lution of consent to sell and keep for
sale intoxicating liquors and deal
therein in the City of Dubuque, Iowa,
and to cause the following resolution
to be adopted, the same to be effect-
ive and in force from the 1st clay of
October, 1910.

Be It Resolved by the City Council
of the City of Dubuque, That con-
sent is hereby given to Gehl & Rus-
sell as successors, purchasers and as-
signees of the business of Ned. Cur-
tis, to sell and keep for sale intoxi-
cating liquors and deal therein in the
city of Dubuque, Iowa, as provided by
law. This resolution is to be in full
force and effect from the 1st clay of
October, 1910. -

the lowest bidder, and bond placed at

Mayor Haas stated that the meeting
was an adjourned meeting of the reg-
ular session of October 6, 1910, and
was called to take up and consider all
matters which may properly come be-
fore a regular session of the City
Council.
To the Honorable City Council:
Gentlemen: At the session of your
honorable body held September 26th,
you instructed me to appoint a com-
mittee composed of five members of
the City Council, five of the Shippers'
Association, five from the Labor
Unions of the city and five from the
employes of the Chicago Great West-
ern Railway to confer with the of-
ficers of said railway with a view of
leaving the division point retained in
this city. Acting under such instruc-
tions, I would respectfully report that
I have made the following selections:
For the City Council: Aids. Saul,
O'Rourke, Singrin, McEvoy and
Specht.
For the Shippers' Association: J. M.
McFadden, D. D. flyers, F. N. Schroe-
der, L. D. Mathes and U. G. Dabler.

Council:
Gentlemen: I beg to report as per
your instructions. I have investigated
the matter of sewer connection, with
storm sewer, known as Bee Branch
Sewer, and find that Mr. Baumhover,
at Eagle Point avenue and Sanford
avenue has four houses, and a sewer
running in rear of each, in private
alley, the same connected with Bee
Branch Sewer, all connections are in
the rear of woodshed, and are used tc,
dispose of wash water, dish water, and
rain water only.

of Jacob Mehl relative to a compromise
on the special assessment levied
against his property for the improve-

granting the German Presbyterian
Theological school of the Northwest
permission to use that portion of East
street. in the City of Dubuque, that
would otherwise be taken up with the
sidewalk on the east of said street, for
park purposes, and regulating the said
grant.
Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That section Four (4) of an
ordinance adopted by City Council of
the City of Dubuque on the 29th day
of July, 1910, and entitled an "Ordin-
inch thick composed of equal parts
Portland cement and clean finely
crushed stone or gravel.
Said sidewalk to be completed on or
before the first day of November, 1910,
and the cost of the same be taxed
aginst said premises and collected :n
the manner prescribed by law.
Bet it Further Resolved, That said
property owner be and is authorized to
construct said sidewalk at his own ex-
pense, provided he begins work there-
on within ten days after being notified
by the City Recorder of the'passage of
this resolution by the City Council, and
completes within thirty days thereafter.
Be it Further Resolved, That if said
work is not commenced within the time
named in said notice that the City
Recorder be and is hereby ordered to
give ten clays notice by two publica-
tions asking for proposals for the do-
ing of said work r contract with
the city. The proposals for the doing

plat, specifications and estimate in
the office of City Recorder.
That after such plat is so filed, the
City Recorder shall cause to he pub-
lished notice of the intention of the
Council to make such imps ovement.
-which notice shall be published in three
consecutive issues of the official paper
of the City of Dubuque, stating that
such plat is on file, and generally the
nature of the sewer, its location, size
and kinds of material to be used, and
the estimate of its cost, and fixing the
time before which objections can be

composed of one part of Portland
cement, two parts of clean sharp sand
and four parts of broken stone, on top
of which shall he laid a wearing sur-
face one inch thick composed of equal
parts Portland cement and clean fine-
ly crushed stone or gravel. Said
sidewalk to be completed on or before
the first day of November, 1910, and
the cost of the same be taxed against

An ordinance amending an ordinance
granting the German Presbyterian
Theological School of the Northwest
permission to use that portion of East
street. in the City of Dubuque, that
would otherwise be taken up with the
sidewalk on the east of said street, for
park purposes, and regulating the said
grant.
Re it Ordained by the City Council of
the City of Dubuque:
Section 1. That section Four (4) of an
ordinance adopted by City Council of
the City of Dubuque on the 29th day
of July, 1910, and entitled an "Ordin-
tunce Granting the German Presbyter-
ian Theological School of the North-
Ave.-U. permission to use that portion of
East street, in the City of Dubuque,
that 'would otherwise be taken up
-with the sidewalk on said street, fol.
-nark purposes, and regulating said
grant," be amended-, by striking from
sale section Four the -words "Seven (7)
years," and inserting in lieu thereof
the words "Twenty (20) years."
Section 2. This ordinance shall be in
force and effect from and after its
passage by the City Council and its
publication one time in the Dubuque
Times- Journal and the Dubuque Tele-
graph- Herald, official newspapers of
said City, and the written acceptance
hereof duly indorsed hereof oy said
Theological school.

Petition of J. M. Kenety, asking the
Council's intention, in regard to the
rolling of the last course on Bluff
street between Eighth street and Six-
teenth street, was, on motion of Ald.
Specht, received and filed.
City Attorney Lyons reported as fol-
lows:
To the Honorable Mayor and City
Council of the City of Dubuque.
Gentlemen: In the matter of the
interpretation of the contract existing
between J. M. Kenety and the City of
Dubuque, for the improvement of Bluff
street between Eight and Sixteenth
street, which was referred to me for a
written opinion, I beg to report as fol-
lows:
The said contract provides, among
other things that the contractor prom-
ises and agrees to furnish all material
and do all the necessary -work and la-
bor "in the improvement of the street
in question. That by the terms of the
contract the plans and specifications
attached to said contract are made
a part thereof. That in said specifica-
tions it is required "that the sarco
maculam shall be spread in a certain
manner, over the prepared base and
shaped and well rolled with a ten ton
steam roller." It further provides
that the covering of the treated
I;._.cadam surface with gravel shall
be made -while the asphalt is still hot
and said surface shall then be rolled
with a ten ton roller," etc.
It is my opinion from the reading of
the contract and the specifications,
that it is the duty of the contractor to
do e•erything necessary for the com-
pletion of the work in question, and
that this duty includes the rolling 1i:
him of the sarco macadam surface.

Company- shall, at the direction of said
City - , make all necessary defense to
said suit and fully indemnify said City
as to any excess or outlays or liabil-
ities to -which said City may be sub-
jected because of such suit.
Section 4. Should the City of Du-
buque r.t any time deem said overhead
or the tunnel, or the pipes in such
tunnel unsafe, or for any reason deem
the removal of said pipes or tunel, or
either of then, necessary or advisable,
then said City may order the immediate
removal of pipes or tunnel, or either
of them. and the restoration of the
street question to pruner condition,
within a reasonable time from such
order, the failure or refusal of said
company to comply with such order,
said City may cause such removal to
he made, at the exnense of said.
Section 5. Said Carr, Ryder &
Co. shall, as a further condition to the
grant herein contained, file with the
City Recorder a bond in the sum of
$100.00, as a guaranty that the streets
affected by the tunnel trill be kept in
repair for one year after the completion
of the work, giving of such bond.
however. to be construed in no way
as relieving said Company the terms
and conditions of this ordinance as
heretofore set out.
Sec. 6. This ordinance shall be in
force and effect from and after the
passage by the City Council and its
publication one time in the Times -Jour-
nal and the Telegrapn - Herald, ofiiciai
newspapers, and written acc•eptanee
therefore indorsed hereon by said Carr,
Ryder & Adams Co.

Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That permission be and
the same is hereby granted H. B.
Glover & Company to make a tunnel
S feet wide and 6 feet 6 inches clear
head room, with re- inforced concrete.
from the building of said Company on
the southeast corner of Fifth and Iowa
streets, City Lots 229 and 230, to the
building of said Company on the north-
east corner of Fifth and Iowa streets.
City Lots 227 and 22S, said tunnel to be
located below all • pipes, .sewers, of
and near the line of the alley dividing
Iowa street and Clay street, City of
Dubuque, subject to the conditions
herein contained.
Section 2. Said tunnel shall be con-
structed and maintained in such man-
ner as to make travel upon and over
Fifth and Iowa streets perfectly safe,
and as to preserve the condition of said
streets as perfectly as though no such
tunnel existed.
Section 3. Said H. B. Glover Com-
pany shall agree, as a condition to the
granting of this privilege, and shall
guaranty by the acceptance of the
terms hereof, to fully protect and s -ve
the City of Dubuque harmless as to
any claims. damages or liabilities of
any kind which may arise because of
the construction and maintenance of
said tunnel, and in any suit whieh craw
arise because of said tunnel, said Com-
pany shall, at the direction of said
City, make all necessary defense to
said suit and fully indemnify said City
as to any expenses or outlays or
liabilities to which said City may be
subjected because of such suit.
Should the City of Dubuque at a
time cleenm said tunnel unsafe, or fo'
any other reason deem its removal
necessary or advisable, said City may
order the immediate removal of same
and the restoration of the streets in
question to proper condition, within a
reasonable time from such order, and
on the refusal of said Company so to
remove same, said City may do so, at
the expense of said Company.
Sec. 5. Said H. B. Glover Company
shall, as a further condition to the
grant herein contained, file with the
City Recorder a bond in the sum of
$100.00 as a guaranty that the streets
affected by the tunnel aforesaid will
be kept in repair for one year after the
completion of the work, said furnishing
of bond, however, to be in no way
construed as relieving said Company
from the terms and conditions hereof
as hereinbefore set out.

Section 1. That permission be and
the same is hereby granted the Carr,
Ryder & Adams Co. to carry certain
steam and cyclone pipes from its new
power house on Jackson street, be-
tween Ninth and Tenth streets, over
Jackson street to the main engine
station of said Company, and to lay
certain return pipes under said street
between the same two buildings, sub-
ject to the conditions and provisions
herein contained. Said overhead pipes
are to be so constructed as not to
interfere in any manner with traye,,
upon and over said Jackson stree`,
or the sidewalks thereof, and in every
way to be so maintained as not to
endanger persons or animals passing
along or under said pipes, or property
being conveyed under sane.
Section 2. The pipes conveyed under-
ground shall be enclosed in a tunnel
so constructed and maintained as to
make travel upon and over said Jack-

AN ORDINANCE GRANTING THE
DUBUQUE BREWING & MALTING
CO. PERMISSION TO CONSTRUCT
A BRIDGE ACROSS THIRTY -
SECOND STREET, IN THE CITY
OF DUBUQUE, AND REGULATING
SUCH GRANT.
Section 1. That permission be and
the same is hereby granted the Du-
buque Brewing & Malting Co. to con-
struct a bridge across what is now
Thirty- second Street, in the City of
Dubuque, for the purpose of connect-
ing its bottling' department on the
north side of said street with the bot-
tle storage plant on the south side
thereof. subject to the provisions here-
in contained. Said bridge when con-
structed to be located approximately
120 feet east of Washington Street, and
to be erected in such manner as to
leave not less than seventeen (17) feet
and (9) inches clearance from the sur-
face of said Thirty- second Street to the
lowest portion or surface of said
bridge, and in any event, in such man-
ner as not to interfere in any way
with travel upon and over said street
and the sidewalks thereof.
Sec. 2. Said bridge shall be inclosed,
and shall in all ways be so construct-
ed and maintained as not to endanger
persons or animals passing along or
under said bridge. or along or over
the street in question.
Sec. 2. Said Dubuque Brewing &
:Halting Co., as a condition to the
granting of this permission, wall
guarantee, by accepting the terns
hereof, to fully protect and save the
City of Dubuque harmless as to any
claims, daunages or liabilities of a.nv
kind which may arise because of the
construction and maintenance of the
structure aforesaid, and in any suit
which may arise against said City
because of such structure. said Com-
pany shall, at the request of said
City, make 011 necessary defense there-
to and fully indemnify the City as to
any expenses, liabilities or outlays
made necessary because of such suit.

You and each of you are hereby no-
tified that it is the intention of the
City Council of the City of Dubuque
to improve Twenty - seventh street
from the east lot line of Pine street to
about 140 feet westward.
That the plat and estimate of said
proposed - improvement is now on file
in the office of the City Recorder.
It is estimated by the City Engineer
that it will require: New curb set,
242 lineal feet; brick guttering, 262
lineal feet; Telford macadam, 395
square yards; earth filling, 211.06 cubic
yards; cutting, 245.31 cubic yards, mak-
ing a total estimated cost to the abut-
ting property owners of $691.50.
Any person having objections to said
improvement is hereby notified to ap-

'Theological School of the Northwest
permission to use that portion of East

Section 1. That Section Four (4) of
an ordinance adopted by City Council
of the City of Dubuque on the 29th
day of July, 1910, and entitled an "Or-
dinance Granting the German Presby-
terian Theological School of the North -
west permission to use that portion of
East street, in the City of Dubuque,
that would otherwise be taken up

grant," be amended, by striking from
said section Four the words "Seven
(D years," and inserting in lieu there-

AN ORDINANCE GRANTING THE
CARR, RYDER & ADAMS CO. PEK-
AIISSION TO CARRY CERTAIN
PIPES ACROSS JACKSON STREET,
BETWEEN 9TH ' AND 10TH
STREETS, IN THE CITY OF DU-
BUQUE AND REGULATING SUCH
0 RANT.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That permission be aid
the same is hereby granted the Carr,
Ryder & Adams Co. to carry certain
steam and cyclone pipes from its new
Power house on JackF:on street, be-
tween Ninth and Tenth streets, over
Jackson street to the main engine sta-
tion of said company, and to lay cer-
tain return pipes under said street be-
tween the same two buildings, subject
to the conditions and provisions here-
in contained. Said overhead pipes are
to be so constructed as not to inter-
fere in any manner with travel upon
and over said Jackson Street, or the
sidewalks thereof, and in every way
to be so maintained as not to endange<
persons or animals passing along or
under said pipes, or property being
conveyed under same.
Sec. 2. The pipes conveyed under-
ground shall be enclosed in a tunnel
so constructed and maintained as to
make travel upon and over said Jack-
son street perfectly safe in every way
and as to preserve the condition of
said street the same as though no
such tunnel existed.
Sec. 3. Said Carr, Ryder & Adams
Co. shall aeree, as a condition to the.
grant of this privilege, and by way of
guaranty, to fully protect and save the
City of Dubuque harmless as to any
claims, damages or liabilities of any
kind which may arise because of the
construction and maintenance of said
pipes overhead, or the tunnel and pipes
run underground, and in any suit
which may arise because of the con-
struction of said pipes or tunnel and
the pipes in such tunnel, said company
shall, at the direction of said city,
make all necessary defense to said suit
and fully idemnify said city as to any
expenses or outlays or liabilities to
which said city may be subjected be-
cause of such suit.
Sec. 4. Should the City of Dubuque
at any time deem said overhead pipes,
or the tunnel, or the ,pipes in such
tunnel unsafe, or for any other reas-
son deem the removal of said pipes or
tunnel, or either of them, necessary
or advisable, then said city may order
the immediate removal of said pipes or
tunnel, or either of them, and the res-
toration of the street in question to
proper condition, within a reasonable
time from such order, and on the fail-
ure or refusal of said company to com-
ply with such order said city may cause
such removal to be made, at the ex-
pense of said company.
Sec. 5. Said Carr, Ryder & Adams
Co. shall, as a further condition to the
grant herein contained. file with the
City Recorder a bond in the sum of
$100.00, as a guaranty that the street
affected by the tunnel aforesaid will be
kept in repair for one year after the
completion of the work. the giving of

in no way as relieving said company
from the terms and conditions of this
ordinance as hereinbefore set out.
See. 6. This ordinance shall be in
force and effect from and after its
passage by the City Council and its
publication one time in the Times -Jour-
nal and the Telegraph - Herald, official
newspapers, and written acceptance
thereof indorsed herein by said Carr,
Ryder & Adams Co.
