Ald. Haas moved that the Council
Proceedings for the month of March,
1909, be approved as printed. Car-
ried.
Bill of W. Lillie, services assisting
Market Master for the month of
March, 1909, for $43.20, was approved
and on motion of Ald. Singrin war-
rant was ordered drawn in favor of
W. Lillie.
Bids for constructing Bee Branch
sewer in Washington Street from the
end of the present sewer north about
320 feet to the north line of Twenty -
seventh Street, were presented and, on
motion of Ald. Frith, were ordered
opened, as follows:

O'Farrell Contracting Co., per lineal
foot, $18.00.
Eisbach & Andre, per lineal foot,

Street & Steuck, per lineal foot,

On motion of Ald. O'Rourke con-
tract for constructing Bee = 3ranch
sewer was awarded to Tibey Bros. and
their bond placed at $1,500.00.
Bids for constructing reinforced
concrete storm sewer in West Locust
Street from present sewer to Alta Vis-
ta Street were presented and read and,
on motion of Ald. Rand, were ordered
opened, as follows:
M. Tschirgi & Son, 48 -inch rein-
forced sewer, per lineal foot, includ-
ing manholes, $3.74; 30 -inch lateral
sewer, per lineal foot, including head-
wall, $2.59.
O'Farrell Contracting Co., 48 -inch
sewer, $3.20 per lineal foot; 30 -inch
lateral sewer, per lineal foot, $2.20.
Eagle Point Lime Works, 48 -inch

On motion of Ald. O'Rourke the
contract for storm sewer in West Lo-
cust Street was awarded to O'Farrell
Contracting Co. and their bond placed
at $500.00.
PETITIONS AND COMMUNICA-
TIONS.
Communication from the Standard
Lumber Co , stating that an error had
been made by the City Assessor in the
assessment of their taxes for the year
1908 and asking that the City Treas-
urer be instructed to deduct $323.80
from the amount of their taxes for
the year 1908, was, on motion of Ald.
Singrin, referred to the Committee of
the Whole.
Petition of Nicholas Jarrett, stating
that he is an honorably discharged'
union soldier and asking that the
taxes on his homestead, Lot 1 of the
sub- division of the north 150 feet of
Lot D in Cooper's Sub., be exempted
to the amount of $800.00, was, on mo-
tion of Ald. Singrin, referred to the
Delinquent Tax Committee.
Petition of. Mary K. De Lorimier,
asking that the taxes on her home-
stead be exempted, was, on motion of
Ald. Rand, referred to the Delinquent
Tax Committee.
Petition of Pitts - Thompson Foun-
dry Co., asking that the taxes now
standing against said company be can-
celed, was, on motion of AId. Singrin,
referred to the Committee of the
Whole.
Petition of Mrs. Elizabeth S. Hea-
cock, asking that the assessment of
taxes on Lot 196, Union Add., for the
year 1908 be reduced from $800.00 to
$500.00, was, on motion of Ald. Saul,
referred to the Commitee of the
Whole.
Petition of Frank Lonergan et al,
asking that the gutter on Oak Street,
between Rising Avenue and the first
street west be repaired, was, on mo-
tion of Ald. Saul, referred to the
Street Commissioner.
Petition of A. J. Parker and L. C.
Bissell, asking that they be granted
the privilege of tapping the Eighth
Street high pressure water main,
making connection with same and
running in the alley east of Iowa
Street from Eighth Street to the south
line of lot 230, for the purpose of in-
stalling the sprinkling system in their
Iowa Street property, was, on motion
of Ald. Rand, referred to the Com-
mittee of the Whole.
Petition of the Spahn Rose Lum-
ber Co., asking that the alley between
Eighth and Ninth and Jackson and
Washington be improved, was, on mo-
tion of Ald. Singrin, referred to the
Committee of the Whole to view the •
grounds.
Petition of the Trustees of the Odd
Fellows' Temple, asking that the City
Treasurer be instructed to accept taxes
on their property, lot 633, for the
year 1908 on the basis of $10,000.00
valuation, was, on motion of Ald.
Frith, referred to the Committee of
the Whole.
Communication from the Iowa Pub-
lishing Co., asking that a committee
be appointed to confer with them in
relation to the purchase of additional
city maps, was, on' motion of Ald.
Haas, referred to the Committee on
Supplies, to report to the Committee
of the Whole.
Petition of J. J. Nagle, asking that
the storm sewer from Jefferson Street
to Julien Avenue be completed, was,
on motion of AId. Saul, referred to the
Committee of the Whole.
Petition of Philip Pier et al, ask-
ing that the Council authorize the
Board of Supervisors to improve the
road from Russell Street to Rock Cut,
was, on motion of Ald. Saul, referred
to the Committee of the Whole.
Petition of David McDonald et al,
asking that Eighteenth Street be
opened before the petition of the Du-
buque Packing Co. is granted, was, on
motion of Ald. Singrin, referred to the
Committee of the Whole.
Petition of the Chicago, Milwaukee
& St. Paul Railway Co., asking that
the city vacate and annul Twentieth
Street from the westerly line of
Hickory Street, Marsh Street from the
northerly line of Nineteenth Street to
Twentieth Street and the alley from
Nineteenth Street to Twentieth Street
through Block Twenty -one in Rail-
road Addition to the City of Dubuque,
Iowa, and grant the permanent use
thereof to them, was, on motion of
Ald. Singrin, referred to the Commit-
tee of the Whole to view the grounds.
Petition of the Chicago, Milwaukee
& St. Paul Railway Company, asking
that the Council adopt a proper
ordinance granting it the right to for-
ever maintain use and operate the
railroad storage track it now has on
the northerly side of its main track
across Third, Fourth, Fifth, Sixth,
Seventh and Eighth Avenues and
across Garfield Avenue between Sev-
enth and Eighth Avenues and in the
alley between Garfield Avenue and
Peosta Street from Second to Fourth
Avenues and across the alley, situated
southerly of Garfield Avenue from
Sixth to Seventh Avenues, and grant-
ing them the right to construct and
forever maintain an additional rail-
road track in Nineteenth Street from
the westerly line of Sycamore Street

to the easterly line of Ash Street, was,
on motion of AId. Singrin, referred to
the Committee of the Whole to view
the grounds.
Petition of Hugh R. Markey, ask-
ing that the Council order a warrant
drawn in the sum of $357.00 in his
favor for salary claimed to be due
him, was, on motion of Ald. Rand, re-
ferred to the Committee of the
Whole.
Petition of Ed. Rider, asking that
'the Council adopt a resolution grant-
ing him consent to operate a retail
liquor store in the city, was presented
and read and, on motion of Ald. Stn.
grin, was granted.
Whereupon the following resolu-
tion was offered:
Be it Resolved by the City Council
of the City of Dubuque, That con-
sent is hereby given Ed. Rider to sell
and keep for sale intoxicating liquors,
and deal therein, in the City of Du-
buque, Iowa, as provided by law.
Communication from John Ma-
honey, asking that he be appointed
Sidewalk Inspector; John Varhoof,
Peter Kien and H. Schoenbeck, asking
that they be appointed Park Custo-

On motion of Ald. O'Rourke matter
was referred to the City Attorney to
confer with the railroad company.
City Attorney Lyon presented his
report giving a statement of fees due
witnesses in the Kassler, Becket and
Post damage cases, amounting to
$93.70, and asking that warrants be
ordered drawn in his favor to pay
said witnesses. On motion of Ald.
Haas, the report of the City Attorney
was referred to the Committee of the
Whole.

REPORTS OF COMMITTEES.
Ald. Martin, chairman of the Com-
mittee on Ordinance, presented and
read an Ordinance granting James
Levi & Co. the right to construct and
operate a high pressure water main
for fire protection in the alley between
Main and Iowa Streets from Seventh
to Eighth Streets, and regulating the
same, and moved that the reading
just had be considered its first read-
ing. Carried.
Ald. Martin moved that the rules
be suspended for the purpose of read-
ing the Ordinance by its title for the
second time.

The Ordinance follows:
AN ORDINANCE.
AN ORDINANCE granting to James
Levi & Company, their successors
and assigns, the right to construct
and operate a high pressure water
main for fire protection in the al-
ley between Main and Iowa Streets,
from Seventh to Eighth Streets,
and regulating the same.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That James Levi & Com-
pany, their successors and assigns, are
hereby authorized to construct, main-
tain and operate a high pressure water
main, six inches in diameter, to be
laid in the alley between Main and
Iowa Streets from a connection with
the water main on Eighth Street, in
the City of Dubuque, to a connection
with their dry goods store at Seventh
Street, for the purpose of providing
sufficient and adequate water pressure
for fire protection in said store, to be
used for fire protection only.
Said line of water pipe shall be con-
structed, maintained and operated at
the expense of said James Levi &
Company, and shall be constructed un-
der the direction and supervision of
the City Engineer and the Superin-
tendent of the Water Works Depart-
ment of the City of Dubuque.
Section 2. In the construction of
;.aid water pipe line, the streets and
alley shall not be unnecessarily ob-
structed. All obstructions and exca-
vations made in the streets and alley
shall be properly barricaded and light-
ed, and in any action for damages
caused by such construction or exca-
vation, the said James Levi & Com-
pany, in consideration hereof, shall ap-
pear and defend the same, and shall
pay any judgment rendered against
the City of Dubuque therein.
Section 3. The City of Dubuque
may at any time grant the right to
any other person or company to con-
nect with said high pressure water
main, for fire protection purposes
only, upon paying to the said James
Levi & Company a share of the cost
of construction and maintenance of
said line, to be estimated in the fol-
lowing manner: The payment to be
made the said James Levi & Com-
pany is to be in the proportion which
the distance of the point of connec-
tion (running from Eighth Street
south) bears to the total distance of
the line. Any person or company con-
necting at a point south of the most
southerly point of connection (north
of the connection of said James Levi
& Company,) shall pay said James
Levi & Company only in the propor-
tion which the proposed connection
bears to the total distance lying be-
tw een the said prior point of connec-
tion and the connection of said James
Levi & Company. Any person or com-
pany desiring to make a connection
al a point north of the last point of
connection, shall pay to the person or
company connected at the point next
south in the proportion of the distance
south which said proposed new con-
nection bears to the total distance be-
tween the two connections intermedi-
ate to which the said new connection
is to be made. The intention hereof is
that no person or company construct-
ing or connecting with said pipe line
is to be reimbursed in an amount
in excess of the actual expenses ad-
vanced. The cost of maintaining said
line is to be borne equally by all per-
sons connecting with same, including
the said James Levi & Company.
Section 4. The said James Levi &
Company shall, at or before the time
of accepting the provisions of this
ordinance and its regular. publication
in the official newspapers, file with the
Recorder of the City of Dubuque a
proper bond, in the sum of one hun-
dred dollars, to be approved by the
Mayor of said city, obligating the said
James Levi & Company to keep the
streets and alley in which excavations
are made in pursuance of the laying
of the pipe in question in good con-
dition and repair whereever such ex-
cavations have been made, for a
period of one year after the comple-
tion of the work, and that they will
restore said alley and streets to the
same condition in which they were
prior to the commencement of said
work, all of which is to be done to
the satisfaction of the Street Commis-
sioner and the Committee on Streets
of said city.
Section 5. On completion of the
laying of the main as herein provided
for, the said James Levi & Company
shall file with the City Recorder of
said city a sworn statement, showing
the exact cost of said main and of in-
stalling the same, which statement is
to be itemized. Failure to file such
statement shall preclude the said
James Levi & Company from the
right of collecting from any person or
company making connection with said
line the proportionate amount due
the said James Levi & Company un-
der Section 3 of this Ordinance.
Section 6. This Ordinance shall be
in force from and after its passage by
the City Council and its publication
one time in the Dubuque Telegraph -
Herald and the Times - Journal news-
papers, and its acceptance in writing
by said James Levi & Company.

Ald. Martin, chairman of the Com-
mittee on Police and Light, stated that
the side door of the Patrol House
building was in need of repairs and
moved that the matter of having same
repaired be referred to the Commit-
tee on Public Grounds and Buildings
and Police and Light Committee. Car-
ried.
Ald. Singrin, chairman of the Com-
mittee on Sewers, reported as follows:
Your Committee on Sewers, to
whom was referred the bill of J. & P.
Sullivan for harness and supplies for
the Sewer Department, would respect-
fully recommend that said bill be al-
lowed and that a warrant in the sum
of $5.15 be ordered drawn on the City
Treasurer in settlement of the same.

Ald. Singrin moved the adoption of
the report of the Committee on Sew-
ers. Carried.
Ald. Martin stated that the fire
alarm boxes were in bad shape and
moved that Committee on Fire be em-
powered to have the boxes painted,
the Chief of the Fire Department to
detail men to do the work and the
city to furnish the paint. Carried.
Ald. O'Rourke, chairman of the
Committee on Sprinkling, stated that
the sprinkling of the streets had not
been commenced, but would be as
soon as the committee thought it was
necessary.
Ald. Martin, chairman of the Board
of Health, reported as follows:

mittee of the Whole, reported as fol-
lows:
Your Committee of the Whole, to
whom was referred the petition of Ot-
to M. Schmid, asking for further time
to comply with the order of the City
Council to lay a cement sidewalk on
the west side of lot 101 in East Du-
buque Addition, would respectfully
recommend that the Committee Clerk
be instructed to notify said petitioner
that the time for the completion of
said walk has been extended to May
1, 1909.
Also, your Committee of the Whole,
to whom was referred the bill of
Mullen Bros. for supplies and plumb-
ing at the central engine house, would
respectfully recommend that said bill
be allowed and that a warrant in the
sum of $56.46 be ordered drawn on
the City Treasurer in settlement of
the claim.
Also, your Committee of the Whole
would respectfully recommend that
the sewer gang be placed entirely un-
der the jurisdiction of the Sewer In-
spector and that he be given full
power to discharge any man employed
in such work in case of insubordina-
tion or neglect of duty.
Also, your Committee of the Whole
respectfully recommend that George
E. Davis be given ten days to pay the
wharfage charges now due and in
case of failure so to do, that he va-
cate the space now occupied by him.
We would further recommend that
the Harbormaster be instructed to
compel the enforcement of the fore-
going action,
Also, your Committee of the Whole,
to whom was referred the remon-
strance of J. M. Keppler against the
special assessment levied for the con-
struction of a sanitary sewer in Col-
lege Avenue against Lot 21 in New-
bury and Hale's Sub., would respect-
fully recommend that said remon-
strance be received and filed.
Also, your Committee of the Whole,
to whom was referred the bill of
James Gregory for carpenter work at
the Central Engine House, would re-
spectfully recommend that said bill
be allowed and that a warrant in the
,sum of $39.50 be ordered drawn on
the City Treasurer in settlement of
the claim.
Also, your Committee of the Whole,
to whom was referred the petition of
E. B. Piekenbrock & Sons, asking that
they be granted permission to connect
with the high pressure mains for the
purpose of installing an automatic
sprinkling system in their building,
would respectfully recommend that
said firm be permitted to lay the nec-
•essary pipes to•make the proper con-
nections, provided the same is done
=in accordance with an ordinance
which the City Attorney and Ordi-
nance Committee are hereby instruct-
ed to prepare.
Also, your Committee of the Whole,
to whom was referred the petition of
Henry G. Young, asking that he be
granted permission to operate a com-
pressed air house cleaning machine on
the streets of the city, would respect-
fully recommend that the prayer of
the petitioner be granted.
Also, your Committee of the Whole,
to whom was referred the petition of
the Morris- Johnson -Brown Co., asking
that it be granted the exemption from
taxation accorded it by the action of
the City Council of March 8, 1904,
would respectfully recommend that
the prayer of the petitioner be grant-
ed and that the City Treasurer be in-
structed to cancel all taxes on per-
sonal property and improvements of
•said firm for the year 1908.

Park board in reference to paying the
$2,500.00 appropriated for Eagle
Point Park. Carried.
Ald. Frith moved that the Commit-
tee Clerk investigate as to whether the
Union Electric Co. have the right to
tear up the streets of the city with-
out first notifying the city and to re-
port to the Committee of the Whole.

Ald. Martin stated that the cross-
ings on North Main and Leibnitz
Streets were in bad shape and moved
that the Street Commissioner be in-
structed to put same in shape.
Ald. Frith moved as an amendment
that the matter be referred to the
alderman of the Fifth Ward and the

Ald. Frith moved that the Commit-
tee Clerk be instructed to write the
Taroid Company in Chicago in refer-
ence as to what arrangements can be
made with said company to use their

follows:
Your Committee of the Whole, to
whom was referred the petition of
Elizabeth Heacock, a widow, asking
that she be granted a reduction in the
valuation of her homestead, Lot 196,
Union Addition, would respectfully
recommend that the prayer of the pe-
titioner be granted and that the City
Treasurer be instructed to accept the
taxes on said lot on a basis of $500.00
valuation and to cancel the balance.
Also, your Committee of the Whole,
to whom was referred the petition of
the Schmid Manufacturing Co., ask-
ing that the taxes on its personal
property and new factory building be
canceled for a period of five years,
would respectfully recommend that
said petition be received and filed.
Also, your Committee of the Whole,
to whom was referred the petition of
the I. O. O. F., asking that the taxes
on the Odd Fellows temple be accept-
ed on a basis of $10,000.00, would re-

regulating the use of picture ma-

asking that they be granted the right
to extend the high pressure main
through the alley between Iowa and
Clay Streets from Eighth Street to the -

visions of an ordinance which the -

to whom was referred the petition of
J. J. Nagle, asking that the storm
sewer from Jefferson Street to Julien
Avenue be extended and that tiling be
used in the construction of said sewer,

the said petition be referred to the •

Also, your Committee of the Whole,
to whom was referred the petition of
the Dubuque Sand & Gravel Company,
asking that it be granted permission
to use a space on the river front be -
ginning fifty feet north of the old
Ryan barn and extending two hundred
feet northerly therefrom, would re-
spectfully recommend that the prayer
of the petitioner be granted provided
it clears the ground, constructs a
driveway from the river to the present
roadway under the direction' and su-
pervision of the Street Commissioner
and lays the proposed sidetrack to the
proper grade with plank between the
tracks and one foot outside thereof,
where the same crosses the roadway,
so that vehicles may easily pass over
the same.
The permission herein granted is
subject to the decision of the City At-
torney as to the rights of the City
along this part of the river front,
which decision he is hereby directed
to prepare, and is also subject to re-

special committee appointed to pre-
pare resolutions of respect on the
death of Mr. Henry Tropf, Sidewalk
Inspector, presented and read the fol-
lowing:
Whereas, Death has called Henry
Tropf —an efficient and esteemed of-
ficial —who in the past year rendered
signal service to the City, who was
ever faithful in the discharge of his
duty, whose life -time residence in this
community endeared him to a large
circle of admiring friends, and who
withal was ever a kind and loving
husband and father; therefore,
Be it Resolved, That we tender to
the bereaved family our heartfelt sym-
pathy and profound regret in their
great bereavement, and we sincerely
hope that the grief we know they
must feel be assuaged by the consol-
ing thought that after long and pa-
tient suffering, he rests in peace, and
be it further
Resolved, That as a mark of re-
spect for the deceased, these resolu-
tions be spread upon the records of
the City Council and that the City Re-
corder is hereby instructed to furnish

Ald. Martin moved the adoption of
the resolution. Carried unanimously.
Alel. Frith stated that the owner of
the property on the south side of Da-
vis Avenue had made objections to
- him for being assessed for curbing
and guttering the street abutting his
property as contemplated and inquir-
ed what arrangements, if any, had
been made with the Board of Super-
visors regarding the improvement.
Ald. Haas stated that the property
owner in question had informed him
that he was satisfied to pay for the
curbing and guttering, providing the
cost would not be i.00 great, and that
the Supervisors were satisfied to have
the improvement made as contem-
plated and that the work be done un-
der the direction of the City Engi-
neer.
The Mayor and other members of
the Council then expressed themselves
as being desirous of having Davis
Avenue curbed and guttered, as well
as being macadamized, without hav-
ing any more delay. After much dis-
cussion definite action in the matter
was deferred until the next session of
the Council.
Ald. O'Rourke asked the City Attor-
ney if he was prepared to give the
Council an opinion as to the powers
or control of the City Council over
the Water Works Trustees.
Assistant City Attorney Willging
presented the following report of City
Attorney Lyon:
In answer to the question asked by
Ald. O'Rourke of the City Attorney,
as to what, if any powers or control,
the City Council had over the Board
of Water Works Trustees, the City At-
torney stated that in his opinion the
management and control_ of the Water
Works was wholly within the hands
of the Water Wrorlcs' Trustees.
That under Section 1056 -A -1 of the
Supplement of the Code, which
creates the Board of Trustees for
special charter cities, it is provided
that the Water Works shall be man-
aged and operated by a Board of
Water Works Trustees, and under
Section 1056 -A -2 of said supplement it
is provided that the revenue of the
Water Department shall be paid out
only on the written order of the
Board of Water Works Trustees, who
shall have full and absolute control of
the application and disbursement
thereof. Ainong other things, includ-
ing the payment of all indebtedness
arising in the maintenance, operation,
betterment and extension of said
Water Works.
Alds. Martin, O'Rourke and Frith
then spoke, giving it as their opinion
that if the City Council had no con-
trol or power over the Water Works
Trustees that then the City Council
were under no obligation to pay the
bills incurred by the Water Work
Department.

AN ORDINANCE.
AN ORDINANCE REGULATING
THE USE OF MOVING PICTURE
MACHINES AND PROVIDING A
PENALTY FOR A VIOLATION
THEREOP.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That it shall be unlaw-
ful to operate any moving picture ma-
chine or device in the City of Du-
buque, unless the same shall be
equipped as follows:
Said moving picture machine and
devices • shall be equipped with an
automatic take -up with an adjustable
roll, and said take -up and magazine
and the doors and openings thereto
shall be kept closed while such ma-
chine is in operation, and the same
shall be equipped with an automatic
fire shut -off with upper and lower fire
guards.
That the distance of the rheostat
from the floor, the wall or walls, or
other combustible materials, shall not
be less than twelve (12) inches and
that said rheostat shall be placed on
iron pedestals, securely screwed to the
floor, and shall be properly encased
and protected by a galvanized iron
case.
The said moving picture machines
and devices shall be equipped with an
automatic light shutter, such as shall
be approved by the Chief of the Fire
Department, City Electrician and
Committee on Fire.
Section 2. All the requirements of
Section 1 herein shall be subject to
the approval of the Chief of the Fire
Department, City Electrician and
Committee on Fire, and it shall be the
duty of said Chief of the Fire Depart -
meat, City Electrician and Committee
on Fire to enforce the provisions of
Sections 1 and 4 of this Ordinance,
and to inspect said moving picture
machines and devices upon the instal-
lation of the same and at least six
times each year thereafter. •
Section 3. Any person, firm or
corporation violating the provisions of
this Ordinance, or neglecting or re-
fusing to comply with the same, shall
be fined not less than twenty -five nor
More than one hundred dollars for
each offense.
Section 4. No moving picture ma-
chine or device shall be operated in
the City of Dubuque, except where the
same is enclosed in a booth and said
booth constructed according to the
following specifications:
FRAMING: Shall be made of
1 "x1 "30/e" angle iron properly braced
to secure rigidity and securely riveted
or bolted at the joints.
SIZE: To be not less than 5'x5'xG',
SHEATING: To be galvanized Iron
of not less than No. 20 B. W. gauge,
or ilk" hard asbestos board secure-
ly riveted or bolted to angle iron
frame. Booth may be constructed of
other approved fire -proof material.
FLOOR: To be of same material as
sides and roof, riveted or bolted to
iron frame, covered with a rubber or
cork matting.
DOOR: To be not larger than
2'x5' of fire -proof material and ar-
ranged to close automatically either
by means of a spring to be placed on
the exterior and riveted to frame
work, or by a metal rope and weight
attachment. Two latches of steel to
be provided and to be placed one 12"
from top and the other 12" from the
bottom of door. Latch bars to be con-
nected by metal rod, so that one oper-
ation opens both latches.
OPENINGS: (Either for operator's
view or through which pictures are
thrown) To be not Larger than
12 "x12" and provided with a gravity
door of fire -proof material, held in
position by fusible links placed in
series with fine cord, so arranged that
normally one of the links is suspended
directly over film when in slide of the
apparatus, or so arranged as to be
normally closed and held open by
pressure of the operator's foot.
SHELF: To be same construction
as booth.
VENTILATION: Booth to have an
opening for ventilation which must be
flanged to carry conductor pipe of not
less than 5" diameter for exhausting
the hot air generated in operating the
machine. An exhaust fan should be
placed at the outer end of the con-
ductor (or stove) pipe, unless con-
nection is made with the chimney.
(If possible connection for ventilation
should lead to chimney or outside
building in order to carry off explosive
gases formed by the incomplete com-
bustion of the film).
MACHINES: To be equipped with
feed and take -up reels in metal boxes,
joints of same to be riveted or flanged.
A. shutter must be placed in front of
the condenser, arranged so as to be
normally closed and held open by
pressure of the foot.
ELECTRIC WIRING: Must be in
accordance with the N. E. code and
all wire employed within the booth
must have an approved slow- burning
insulation and secured in place entire-
ly on insulated supports. No portable
cord will be permitted within the
booth unless the same is pertinent to
a proper connection to the lantern it-
self.
EXTRA FILMS: Must be kept in
a metal box with tight- fitting covers.
Section 5. This Ordinance shall he
in force and take effect from and

walk in front of Lot 42, J. L. Lang -
worthy's Add., was on motion of Ald.

to the duty imposed upon you by your

cording to the dictates of your con-
science, and for the best interests of
your constituents. Analyzed in all its
bearings your work has been solely
actuated by the public good, and the
public is aware of it. The work of all

ized by careful attention to every de-

Your Committee on Delinquent
Taxes, to whom was referred the pe-
tition of Mrs. J. P. Poor, •asking that
on account of her poverty, leniency
be shown her in regard to her
taxes and that she be given a
statement of the amount now
due by her for city taxes, would
respectfully recommend that the taxes
for the year 1908 be allowed to re-
main a lien on her property and that
the Treasurer be instructed accord-
ingly. Also that he send said pe-
titioner a statement of the amount
now due by her for city taxes.
Also, your Committee on Delinquent
Taxes, to whom was referred the pe-
tition of Mrs. Louisa Muntz, stating
that she is assessed for a house on
Lot 287 in Davis Farm Add. and that
the house on said lot was destroyed
by fire a year and a half ago and
asking, therefore, that a reduction be
made in the assessed valuation of said
lot, would respectfully recommend
that the prayer of the petitioner be
granted and that the Treasurer be in-
structed to accept the taxes on said
lot on a basis of $500.00 valuation.

Ald. Haas moved the adoption of
- the various reports of the Delinquent
'Tax Committee. Carried.
Ald. Rand, chairman of the Com-
mittee on Public Grounds and Build-
ings, reported that he was preparing
plans for changing the roof of the
Central Engine House building and
as soon as he had the plans com-
pleted, would get estimates on cost
-of the work to be submitted to the
Council.
Ald. Frith stated that excavations
were being made in the streets and
:alleys of the City by plumbers and
others without having obtained exca-
vation permits and moved that the
Chief of Police be notified to instruct
the policemen to require plumbers,
the Gas Company, Water Company
and all other persons excavating in
the streets or alleys to show their ex-
- cavation permits before being allowed
to do any excavating. Carried.
Ald. Saul moved that the matter of
•excavation permits for excavating in
the streets and alleys of the City be
- referred to the Ordinance Committee
for investigation. Carried.
Ald. O'Rourke, chairman of the
Committee of the Whole, reported as
follows:
Your Committee of the Whole, to
whom was referred the petition of B.
J. Schwind et al, owners of lots in
Tschirgi & Schwind's Sub., asking
that an annexed plat of said subdi-
vision be adopted, would respectfully
recommend that said plat be referred
hack to the petitioners for them to
procure the complete opening of Al-
gona Avenue.
Also, your Committee of the Whole,
to whom was referred the petition of
Reeder Langworthy et al, owners of
all the propertly lying along Fourth
Street between Alpine and Paulina
Streets in the City of Dubuque, Iowa,
offering to give to the City for street
purposes, a strip of land ten feet wide
along the south side and parallel to
said street for the purpose of mak-
ing said street 60 feet wide, and, ask-
ing that said street be graded, curbed,
:guttered and macadamized and that
sewer, gas and water mains be order-
ed therein—the curbing on said street
to be set out 12 feet from the lot

Charles H. Walsh, Administrator and
Trustee of the Mary N. Allison Es-
tate, stating that Senator Allison held
$9,600.00 as Trustee for Elizabeth
Neally -Utter et al., which money was
taxed by the City of Dubuque; that
in December, 1907, said amount was
invested in Dubuque Water Works
bonds, which are by resolution of the
City Council non - assessable by the
City of Dubuque, and asking, there-
fore, that the assessment against said
money be cancelled, would respect-
fully recommend that the prayer of
the petitioner be granted and that the
Treasurer be instructed accordingly.
Also, your Committee of the Whole,
to whom was referred the petition of
George E. Davis, relative to the
wharfage fee which the City Attorney
and Harbor Master have been in-

road Company has filed its petition
asking for the vacation of that por-
tion of Charter Street lying east of
the easterly line of the Chicago, Mil-
waukee & St. Paul Railway tracks
where the same intersects Charter
Street and extending easterly from
said point a distance of one hundred
feet, for the purpose of erecting fruit
sheds thereon for the use of the Fruit
Despatch Company, and represents
that their location here will bring a
large number of men to this city;

Whereas, The great cost of pav-
ing materials is a problem which de-
lays and hinders legitimate public im-
provements, and is a source of con-
tinual embarrassment to municipal
authorities • and great expense to
property c.wners, and
Whereas, The Payne Tariff Bill,
now pending before the United States
Congress, provides for an increase in
the tariff on Crude Asphalt from $1.50
per ton to $3.36 per ton, and means,
as we believe, not only an increase in
the cost of asphalt paving, but a rela-
tive increase in the cost of other
kinds of paving; now, therefore,
Be It Resolved, That we, the City
Council of the City of Dubuque, here-
by protest against any increase in
the duty on Crude Asphalt and As-
phalt Products, and urge upon our
senators and representatives our ob-
jections, and, that the property own-
ers of the City of Dubuque are hereby
requested to write or wire to Sena-
tors Dolliver and Cummins their in-

dividual protests to such increase in
duty.
Ald. Martin moved the adoption of

Ald. Frith moved as an amendment
that the resolution be referred to the

Ald. O'Rourke stated that the Y.
W. C. A. were anxious to have side -
walks laid around their property on
Sixth and Locust Streets and wanted
permission to lay a five -foot sidewalk
on the Sixth Street side of their prop-
erty and six -foot walk on Locust
Street and moved that the matter be
referred to the Committee of the
. Whole to view the grounds. Carried.
Ald. Martin stated that the stone
.steps on the east and north sides of
the City Hall building were in need
of repair and moved that the City En-
gineer be instructed to prepare plans
for new concrete steps for the east
.side of the building with an estimate
of the cost. Carried.
Ald. Haas moved that the matter
of repairing the sidewalks on the
scuth side of the City Hall and doors
leading into the basement be referred
to the Committee on Public Grounds
and Buildings. Carried.
Ald. Haas stated that the Dubuque
Malting Co. had constructed a sani-
tary sewer in Thirty- second Street and
that abutting property owners were
anxious to make connections with said
sewer, and moved that the matter be
referred to the City Engineer and City
Attorney to investigate under what
conditions said sewer was constructed
and what agreement, if any, said firm
has with the City of Dubuque relative
to said sewer. Carried.
Ald. Martin moved that the Patrol
Wagon be transferred to the Ninth
Street Engine House while repairs
are being made on the Patrol House.

Ald. O'Rourke moved that the City
Recorder be instructed to advertise
for bids for grading and sodding
Grandview Avenue Park from Dodge
Street to Delhi Street and to submit
the bids to the Council at their meet-
ing to be held Monday evening, April
26th. Carried.
Ald. Haas moved that the City En-
gineer be instructed to file the plans
and specifications for the improve-
ment of Davis Avenue in the City Re-
corder's office. Carried.

TIONS.
Petition of Byrne Bros.' Transfer
& Carriage Co., asking damages in
the sum of $50.00 for damages claim-
ed to have been sustained to one of
their carriages on Fourth Street Ex-
tension, was, on motion of Ald. Sin-
grin, referred to the Committee of the
Whole.
Petition of Nick Mannos, asking
that the City refund him $26.66, the
unearned part of the amount paid by
him for pool table license, was, on
motion of Ald. Haas, referred to the
Committee of the Whole.
Petition of John Keckevoet, asking
that he be assessed for space in the
harbor on the basis of $45.00 per
year instead of $100.00, as charged
him last year, was, on motion of Ald.
Singrin, referred to the Committee of
the Whole.
Petition of Major O. S. Riche, of
the United States Engineer's office,
asking that the City set aside 500 or
600 feet of the paved portion of the
Levee south of the Diamond Jo ware-
house. for the exclusive use of indi-
vidual steamboats, excursion boats,
packets and barges, was, on motion
of Ald. Saul, referred to the Commit-
tee of the Whole.
Petition of Mrs. Maria Fay, stating
that she is a widow and is old and
in poor health and unable to pay
taxes for the year 1908 on N. M. 1 -5
of City Lot 432, assessed to the Peter
Fay Estate, and asking that same be
cancelled, .vas, on motion of Ald
Rand, referred to the Delinquent Tax
Committee.
Petition of the Potosi Brewing Co.,
by A. Schumacher, asking that the
Treasurer be instructed to cancel the
$2,000.00 assessed against them for
the steamer Potosi for the year 1908,
same being erroneous, was, on mo-
tion of Ald. Haas, referred to the

Petition of the Dubuque Investment
Co. et al, asking that the sewer be
extended north on Jackson Street to
the alley between Milwaukee and
Diamond Avenues and west through
said alley to Confer Avenue, was, on
motion of Ald. Haas, referred to the
Committee of the Whole to view the
grounds.
Petition of Rev. August Sauter and
Mr. August Becker, asking that they
he granted permission to construct a
sewer in the alley between 31st and
32nd Streets and between Washington
and Elm Streets and that they be
given instructions as to how - and
where the sewer should be construct-
ed; also that they be given permis-
sion to connect this sewer with the
private sewer constructed by the Du-
buque Brewing & Malting Co., was,
on motion of Ald. Frith, referred to
the Committee of the Whole to view
the grounds.
Petition of Herman Woerdehoff,
asking that the taxes for the year
1909 on Lots. 347 and 348 be can-
celled; also that the City reimburse
him for 70 bushels of seed potatoes
destroyed by fire, claiming that the
water mains are not laid in Kane
Street and the lack of water facili-
ties was the principal reason that the
Fire Department could not save his
home from being entirely destroyed,
was, on motion of Ald. Haas, referred
to the Committee of the Whole.
Petition of Wm. Carter et al, ask-
ing that they be granted the use of a
strip of ground on Camp Street .fac-
ing on the river front, for their boat-
house, was read. Ald. Saul moved
that the petition be granted. Ald.
Haas moved as an amendment to Ald.
Saul's notion that the petition be
granted during the pleasure of the
Council.
Petition of J. T. Hassett et al, ask-
ing that Villa Street be graded so that
they can have sidewalks laid, was, on
motion of Ald. O'Rourke, referred to
the City Attorney and City Engineer
to report to the Committee of the
Whole.
Petition of the Columbia Camp, No.
78, Woodmen of the World, asking
that they be granted permission to
use and occupy Clay Street from 12th
to 5th Streets for carnival purposes
for the period commencing June 28th
and ending July 3rd, 1909, was read
and, on motion of Ald. Singrin, rules
were suspended to grant J. W.
Kintzinger permission to address the
Cc uncil on the subject. Ald. Saul
moved that the petition be granted,
provided the Woodmen of the World
furnish a surety bond for $5,000.00.

Petition of Leo Butler et al, asking
that the City Council have the street
car system extended along Asbury
Street during the next month, was,
on motion of Ald. O'Rourke, referred

City Recorder Linehan presented
and read the printed notice, certified
to by the publisher of the Council's
intention to improve the alley between
Jackson and Washington Streets from
Eighth to Ninth Streets. No remon-
strance being filed and no one in the
room objecting to the improvement
of said alley, the notice ryas, on mo-
tion of Ald. Singrin, received and filed.
City Recorder Linehan also pre-
sented and read the printed notice,
certified to by the publisher, of the
Council's intention to improve the
alley between Iowa and Clay Streets
from Twelfth Street to the south line
of lot, the north 2 -5 of City Lot 457.
No remonstrance being filed and no
one in the room objecting to the im-
provement of said alley, the notice
was, on motion of Ald. Martin, re-
ceived and filed.
City Recorder Linehan also pre-
sented and read the printed notice,
certified to by the publisher, of the
Council's intention to improve the
south side of Davis Avenue from
Windsor Avenue to St. John's Ceme-
tery, by curbing and guttering same.
Remonstrance of Fred Mussehl
against paying the entire cost for the
curbing and guttering in front of his
property and offering to pay half the
cost of the improvement was read
and, on motion of Ald. O'Rourke,
remonstrance of Fred Mussehl was
granted, subject to a later opinion of
the City Attorney, and the notice was
received and filed.
Street Commissioner Dorgan re-
ported as follows:

list of macadam broken in the differ-
ent Road Districts during the month

recently given to the City by the state

REPORTS OF COMMITTEES.
Ald. Martin, chairman of the Com-
mittee on Ordinances, presented and

read an Ordinance granting to the
Illinois Central Railroad Company,
its successors and assigns, the right
to lay a sidetrack commencing at a
point on its sidetrack now located on
Cedar Street and Wall Street, across
Wall Street, Cedar Street and Pine
Street and along to alley between
Wall and Pine Street to a point con-
necting with the Chicago Great West-
ern Railway Company's tracks in
Block seventeenth (17), and regu-
lating the - construction, use and
maintenance thereof, and moved that
the reading just had be considered
its first reading. Carried.
Ald. Martin then moved that the
Ordinance be referred to the Com-
mittee of the Whole and the Civil
Engineer of the I. C. R. R. Co. to set
stakes showing lines of proposed side-
track. Carried.
Ald. Frith, chairman of the Com-
mittee on Harbors, reported as fol-
lows:
Your Committee on Harbors would
respectfully report that in the mat-
ter of space in the harbor now being
used by the Dubuque & East Du-
buque Ferry Co. we have made ar-
rangement with Mr. G. E. Davis
whereby he agrees to pay $40.00 in
full settlement- for space occupied by
him.
On motion of Ald. Frith the action
of the Committee on Harbors was ap-
proved.
Ald. Martin, of the Committee on
Police and Light, presented and read
agreement of the Dubuque Telephone
Company for twelve telephones to be
installed in different parts of the City
under the direction of the Commit-
tee on Police • and Light and moved
that the Mayor be empowered to en-
ter into a contract for a period of
five years with the Dubuque Tele-
phone Company for 12 telephones at
$1.00 per month each. Carried.
Ald. O'Rourke, chairman of the
Committee of the Whole, reported as
follows:
Your Committee of the Whole, to
whom was referred the petition of
Louisa Pitschner, stating that she
had been erroneously assessed on Lot
1, Finley Add., for the improvement
of Asbury Street and offering to pay
the sum of $206.65 in full settlement
of said assessment, provided the
same be accepted without interest,
would respectfully recommend that
the City Treasurer be instructed to
accept said amount, provided the
same be paid on or before the 1st
day of May, 1909.
Also, your Committee of the Whole,
would respectfully recommend that
all telephone companies, gas compa-
nies and all other persons, firms or
corporations whose business requires
them to make excavations in the
streets or alleys of the city, be re -
quired to take out an excavation per-
mit in each instance and also to file'
with the City Recorder a bond in
the amount of $500,00, conditioned
on the proper filling of the trenches
and repairing of the streets or alleys
where such excavations are made.
We further recommend that in the
case of all other individuals desiring
to excavate in the streets or alleys, a
permit be required and also a cash
deposit of $5.00, which amount is to
be left - with the City Treasurer for a
period of one year as a guarantee -
that the street or alley in which such
excavation is made will be properly
repaired.
Also, your Committee of the Whole,
to whom was referred the petition of
Mrs. Catharine Strahl, stating that
she is dependent on her daily labor for
the support of herself and child and
that she is now compelled to sell her
mother's homestead to meet the -
mortgage now due on the same and
asking, therefore, that the unpaid
taxes for the year 1899 to 1908 be
cancelled, would respectfully recom-
mend that the prayer of the petitioner -
be granted and that the City Treas-
urer be instructed accordingly.
Also, your Committee of the Whole,
to whom was referred the bids for
whom was referred the bids for -
sweeping the brick -paved streets,
would respectfully recommend that
the said contract be awarded to Clark
Van Wie, he being the lowest bidder,
at $17.75 per weelc. The work to be
done as per schedule and under and
at the direction and pleasure of the
Committee on Streets and Street
Commissioner.
Also, your Committee of the Whole,
to whom was referred the petition of
the Dubuque Biscuit Company, ask-
ing that its taxes be remitted for a
period of five years beginning with
the assessment for the year 1909,
would respectfully recommend that
the prayer of the petitioner be grant -
ed.
Also, your Committee of the Whole,
to whom was referred the petition of
the A. R. Flick Box Co., asking that
its taxes for the year 1908 be ac-
cepted on a basis of $3,000.00, as pro-
vided by the resolution of the City
Council of April 2, 1908, would re-
spectfully recommend that the pray-
er of the petitioner be granted and
that the City Treasurer be instructed_
accordingly.

Ald. O'Rourke moved the adoption
of the various reports of the Com-
mittee of the Whole. Carried.
, Ald. O'Rourke, chairman of the
Committee of the Whole, also pre-
sented the following:
Your Committee of the Whole, to
whom was referred the petition of
Hurd, Lenihan & Kiesel, attorneys for
the Martin & Strelau Co., stating that
on July 21st, 1908, the District Court
of Dubuque County had rendered a
judgment for $42,715.36 with interest
at 6 per cent from July 10th, 1908,
and costs for suit, amounting to
$34.05, and asking that some ar-
rangement be made to pay the ,same,
would respectfully recommend that
said judgment be paid and that the
Finance Committee be and it is here-
by instructed to make arrangements
for the payment of the same.

Ald. O'Rourke moved the adoption
of the report of the Committee of the
Whole recommending the payment of
the Martin & Strelau coal bills. Mo-
tion seconded by Ald. Frith.
During the discussion which fol-
lowed Ald. O'Rourke stated that there
was some misunderstanding about the
appeal of the case to the Supreme
Court, that he was of the opinion the
suit should have been brought against
the Water Works Department in the
first place, that there was a doubt,
in his mind, whether or not the
action was correct, and stated that he
wanted a written opinion from the
City Attorney before taking final
action on the bills.
Ald. Martin asked if the City paid
the coal hills, whether or not a suit
could be instituted against the old
Water Works Trustees and their
bondsmen, he having been informed
that such an action could be had;
also, that no action could be taken
against them; that he was as anxious
and willing to pay the coal bills as
anyone, but would not vote to pay
same, unless a suit could be brought
against the old Trustees and their
bondsmen.
Ald. Frith stated he believed in
paying an honest bill, which he be-
lieved these coal bills were, until he
was shown otherwise; that if there is
so much evidence as there is rumored
to be, let it be brought before the
Committee of the Whole; that, as the
matter now stands, he was willing to
pay the coal bills.
Ald. Rand statecl that he voted to
pay the bills in the Committee of the
Whole with the understanding that
the bills were correct; that he had
made a personal investigation in
some matters, which would lead him
to believe the bills were about right;
he found that at the time the old
Trustees were in charge of the Water
Works it required four boilers to do
the work, while at the present time
two boilers were doing the work;
that the plant under the management
of the present Trustees used only half
the amount of coal to run the plant
that was used by the former Trus-
tees, due to the fact of more improv-
ed methods and machinery, and that
at the present time it costs about
$16,000.00 per, year for coal with but
two boilers; consequently, he was of
the opinion that with double the
number of boilers being used the
amount of coal consumed would be
about twice the amount; that with
such conditions he believed the coal
was used, and that some one had
furnished the coal.
Ald. Singrin said that he had no
cause for changing' his vote from the
way he voted in the Committee of the
Whole, stating he was not a party to
creating the dept; consequently, he
would not vote to pay the same.
Mayor Schunk then spoke, stating
that he questioned the right of the
City to pay the bills under the ex-
isting conditions; that in his mind the
suit should have been instituted
against the Water Works Depart-
ment and if a judgment had been ob-
tained against them, and if they
lacked the funds to pay same, then
they could have certified same to the
Council, who could then have made
a levy to pay the judgment; that he
wanted a written opinion from the
City Attorney whether or not the suit
was brought properly and if so,
whether or not the City could make
a levy or bond issue without consent,
of the Pater Works Trustees.
Ald. O'Rourke asked that the
Mayor endeavor to procure a state-
ment of the kind and amount of pipe,
plugs, valves, meters, etc., there was
on hand in the Water Works Depart-
ment at the time the transfer was

Ald. O'Rourke also inquired wheth-
er the Water Works Department
showed that it was self - sustaining or
not during the time the Mayor man-
aged the same, to which the Mayor
replied that it was self - sustaining and

that there was a surplus of about
$100.00 cash on hand at the time he
turned the management of the Water
Works Department over to the new
Trustees.
Ald. O'Rourke, with the consent of
Ald. Frith, who seconded his motion,
then withdrew his motion to adopt
the report of the Committee of the
Whole, after which Ald. Rand moved
that action on the report of the Com-
mittee of the Whole be deferred and
report be referred back to the Com-
mittee of the Whole and the City At-
torney be instructed to submit a writ-
ten opinion to the Council as to the
various questions asked by the mem-
bers of the City Council as soon as
possible. Carried.
City Attorney Lyon asked that
whatever questions the various mem-
bers of the Council wished answered
to submit same to him in writing as
soon as possible, so that he will be
able to make his reply at the earliest
possible date.
Alderman Haas offered the follow-
ing:
Pe It Resolved by the City Coun-
cil of the City of Dubuque, That the
south side of Davis Avenue, from the
east line of Windsor Avenue to the
east line of St. John's Lutheran ceme-
tery be improved by curbing and gut-
tering the 'same, in accordance with
the plans and specifications for such
improvement prepared by the City
Engineer and now on file in the office
of the City Recorder, and be it fur-
ther
Resolved, That said improvement
shall be completed on or before the
1st day of August, 1909, and shall be
paid for in the manner prescribed by
Chapter XXXII of the Revised Ordi-

hundred and ninety (190) inclusive.
The Board of Trustees of the Du-
buque Water Works has directed that
the Dubuque Water Works Bonds
numbered from one hundred and six-
ty -one (161) to one hundred and
ninety (190) inclusive, be redeemed in
accordance with the ordinance and
contract entered into by the Ctiy of
Dubuque and the holders of the wa-
ters works bonds.
Above bonds should be presented at
the City Treasurer's office, Dubuque,
Iowa on or before June 1st, 1909, for
redemption.
All interest will cease on above
bonds on June lst, 1909.

On Saturday, May 1, 1909, at 10
o'clock a. m. sharp, the Market Mas-
ter will rent for cash the market
stands about the City Hall to the high-
est bidder for the ensuing year.
The parties having possession of the
various stands at present will be per-
mitted to retain the same for the
same price as paid last' year, provided,
however, that the rent be paid before
May 1st.
No renter will be permitted to sub-
let the stand, nor will he be permitted
to loan the use of same to some other
party under penalty of having the

AN ORDINANCE.
AN ORDINANCE granting to James
Levi & Company, their successors
and assigns, the right to construct
and operate a high pressure water
main for fire protection in the al-
ley between Main and Iowa•Streets,
from Seventh to Eighth Streets,
and regulating the same.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That James Levi & Com-
t:any, their successors and assigns, are
hereby authorized to construct, main-
tain and operate a high pressure water
main, six inches in diameter. to be
laid in the alley between Main and
Iowa Streets from a connection with
the water main on Eighth Street, in
the City of Dubuque, to a connection
with their dry goods store at Seventh
Street, for the purpose of providing
sufficient and adequate water pressure
for fire protection in said store, to be
used for fire protection only.
Said line of water pipe shall be con-
structed, maintained and operated at
the expense of said James Levi &
Company, and shall be constructed un-
der the direction and supervision of
the City Engineer and the Superin-
tendent of the Water Works Depart-
ment of the City of Dubuque.
Section 2. In the construction of
raid water pipe line, the streets and
alley shall not be unnecessarily ob-
structed. All obstructions and exca-
vations made in the streets and alley
shall be properly barricaded and light-
ed, and in any action for damages
caused by such construction or exca-
vation, the said James Levi & Com-
pany, in consideration hereof, shall ap-
pear and defend the same, and shall
pay any judgment rendered against
the City of Dubuque therein.
Section 3. The City of Dubuque
may at any time grant the right to
any other person or company to con-
nect with said high pressure water
main, for fire protection purposes
only, upon paying to the said James
Levi & Company a share of the cost
of construction and maintenance of
said line, to be estimated in the fol-
lowing manner: The payment to be
made the said James Levi & Com-
pany is to be in the proportion which

the distance of the point of connec-
tion (running from Eighth Street
south) bears to the total distance of
the line. Any person or company con-
necting at a point south of the most
southerly point of connection (north
of the connection of said James Levi
& Company,) shall pay said James
Levi & Company only in the propor-
tion which the proposed connection
bears to the total distance lying be-
tween the said prior point of connec-
tion and the connection of said James
Levi & Company. Any person or com-
pany desiring to make a connection
at a point north of the last point of
connection, shall pay to the person or
company connected at the point next
south in the proportion of the distance
south which said proposed new con-
nection bears to the total distance be-
tween the two connections intermedi-
ate to which the said new connection
is to be made. The intention hereof is
that no person or company construct-
ing or connecting with said pipe line
is to be reimbursed in an amount
in excess of the actual expenses ad-
vanced. The cost of maintaining said
line is to be borne equally by all per-
sons connecting with same, including
the said James Levi & Company.
Section 4. The said James Levi &
Company shall, at or before the time
of accepting the provisions of this
ordinance and its regular publication
in the official newspapers, file with the
Recorder of the City of Dubuque a
proper bond, in the sum of one hun-
dred dollars, to be approved by the
Mayor of said city, obligating the said
James Levi & Company to keep the
streets and alley in which excavations
are made in pursuance of the laying
of the pipe in question in good con-
dition and repair whereever such ex-
cavations have been made, for a
period of one year after the comple-
tion of the work, and that they will
restore said alley and streets to the
same condition in which they were
prior to the commencement of said
work, all of which is to be done to
the satisfaction of the Street Commis-
sioner and the Committee on Streets
of said city.
Section 5. On completion of the
laying of the main as herein provided
for, the said James Levi & Company
shall file with the City Recorder of
said city a sworn statement, showing
the exact cost of said main and of in-
stalling the same, which statement is
to be itemized. Failure to file such
statement shall preclude the said
James Levi & Company from the
right of collecting from any person or
company making connection with said
line the proportionate amount due
the said James Levi & Company un-
der Section 3 of this Ordinance.
Section 6. This Ordinance shall be
in force from and after its passage by

the City Council and its publication
one time in the Dubuque Telegraph -
Herald and the Times - Journal news-
papers, and its acceptance in writing
by said James Levi & Company.

AN ORDINANCE.
AN ORDINANCE REGULATING
THE USE OF MOVING PICTURE
MACHINES AND PROVIDING A
PENALTY FOR A VIOLATION
THEREOP.
Pe It O0ained by the City Council of
the City of Dubuque:
Section 1. That it shall be unlaw-
ful to operate any moving picture ma-
chine or device in the City of Du-
buque, unless the same shall be
equipped as follows:
Said moving picture machine and
devices shall be equipped with an
automatic- take -up with an adjustable
roll, and said take -up and magazine
and the doors and openings thereto
shall be kept closed while such ma-
chine is in operation, and the same
shall be equipped with an automatic
fire shut -off with upper and lower fire
guards.
That the distance of the rheostat
from the floor, the wall or walls, or
other combustible materials, shall not
be less than twelve (12) inches and
that said rheostat shall be placed on
iron pedestals, securely screwed to the
floor, and shall be properly encased
and protected by a galvanized iron
case.
The said moving picture machines
and devices shall be equipped with an
automatic light shutter, such as shall
be approved by the Chief of the Fire
Department, City Electrician and
Committee on Fire.
Section 2. All the requirements of
Section 1 herein shall be subject to
the approval of the Chief of the Fire
Department, City Electrician and
Committee on Fire, and it shall be the
duty of said Chief of the Fire Depart-
ment, City Electrician and Committee
on Fire to enforce the provisions of
Sections 1 and 4 of this Ordinance,
and to inspect said moving picture
machines and devices upon the instal-
lation of the same and at least six
times each year thereafter.
Section 3. .Any person, firm or
corporation violating the provisions of
this Ordinance, or neglecting or re-
fusing to comply with the same, shall
be fined not less than twenty -five nor
more than one hundred dollars for
each offense.
Section 4. No moving picture ma-
chine or device shall be operated in
the City of Dubuque, except where the
same is enclosed in a booth and said
booth constructed according to the
following specifications:
FRAMING: Shall be made of
1 "x1 "x /s" angle iron properly braced
to secure rigidity and securely riveted
or bolted at the joints.
SIZE: To be not less than 5'x5'xG'.
.HEATING: To be galvanized iron
of not less than No. 20 r3. W. gauge,
or 1 A" hard asbestos board secure-
ly riveted or bolted to angle iron
frame. Pooth may be constructed of
other approved fire -proof material.
FLOOR: To he of same material as
sides and roof, riveted or bolted to
iron frame, covered with a rubber or
cork matting.
DOOR: To be not larger than
2'x5' of fire -proof material and ar-
ranged to close automatically either
by means of a spring to be placed on
the exterior and riveted to frame
work, or by a metal rope and weight
attachment. Two latches of steel to
be provided and to be placed one 12"
from top and the other 12" from the
bottom of door. Latch bars to be con-
nected by metal rod, so that one oper-
ation opens both latches.
OPENINGS: (Either for oi.erator's
view or through which pictures are
thrown) To be not larger than
12 "x12" and provided with a gravity
door of fire -proof material, held in
position by fusible links placed in
series with fine cord, so arranged that
normally one of the links is suspended
directly over film when in slide of the
apparatus, or so arranged as to be
normally closed and held open by
pressure of the operator's foot.
SHELF: To be same construction
as booth.
Vi7NTILATION: Booth to have an
opening for ventilation which must be
flanged to carry conductor pipe of not
less than 5" diameter for exhausting
the hot air generated in operating the
machine. An exhaust fan should be
placed at the outer end of the con-
ductor (or stove) pipe, unless con-
nection is made with the chimney.
(If possible connection for ventilation
should lead to chimney or outside
building in order to carry off explosive
gases formed by the incomplete com-
bustion of the film).
MACHINES: To be equipped with
feed and take -up reels in metal boxes,
joints of same to be riveted or flanged.
A shutter must be placed in front of

the condenser, arranged so as to be
normally closed and held open by
pressure of the foot.
ELECTRIC WIRING: Must be in
accordance with the N. E. code and
all wire employed within the booth
must have an approved slow - burning
insulation and secured in place entire-
ly on insulated supports. No portable
cord will be permitted within the
booth unless the same is pertinent to
a proper connection to the lantern it-
self.
EXTRA FILMS: Must be kept in
a metal box with tight - fitting covers.
Section 5. This Ordinance shall he
in force and take effect from and
after its passage by the City Council
and its publication one time in the Du-
buque Telegraph- Herald and Tinies-
Journal newspapers.
