Ald. Singrin moved that the action
in the approval of the Council Pro-
ceedings for the month of April, 1909,
be deferred until the next meeting of
the Council. Carried.

Petition of Mary J. Corbett et aI.,
asking that Bennett Street be im-
proved from the line of the present
improvement west as far as the east
line of Lot 18, Ann O'Hare's Sub., was
on motion of Ald. Rand referred to
the Committee of the Whole.
Communication from Union Elec-
tric Co., asking that the Council ar-
range for a water service connection
in the new car barn addition, also that
the Council arrange to have the water
connection now located at Kniest Street
and Rhomberg Avenue changed to a
point west of Kniest Street near the
center of the switch, so that they can
furnish better sprinkling service, was
on motion of Ald. .Martin referred to
the Sprinkling Committee to take the
matter up with the Water Works
Trustees.
Petition of Jacob Schwietering et
al., asking that a retaining wall be
erected on Stafford Avenue and that
the necessary grading be done so that
they can have a sidewalk laid in front
of Sub. 3 and 4, Stafford's Add., Lot
1, was on motion of Ald. Frith re-
, ferred to the Street Committee with
power. -
Petition of Catherine Bannon, ask -
ing that the taxes on N. 1 -5 of City
Lot 55,6 be cancelled for the year
1908, she being a widow in poor cir-
cumstances and unable to pay same,
was on motion of Ald. Saul granted
and Treasurer to be instructed ac-
cordingly.
Petition of Dubuque Team Owners
Association, asking that the City pay
50 cents per hour for all teaming done
on city work, was on motion of Ald.
Frith, referred to the Committee or
the Whole.
Petition of Peter Kien et al., asking
that street sweepings be dumped on
Seventeenth Street; between Sycamore
and Lynn Streets, in order to get said
Street to grade, was on motion of AId.
Haas referred to the Alderman of the
Third Ward with power,
Petition of Mary Bisanz, asking
that the taxes on N. 1 /2 of Lot 2, Myr-
tle Add., be cancelled for the year
1908, was on motion of Ald. Haas re-
ferred to the Delinquent Tax Com-
mittee.
Petition of Wm. Heitzmann, asking
that a grade line be established on
Davenport Street and that said street
be graded so that he can rebuild his
house, was on motion of Ald. Haas
referred to the Committee of the
Whole.

Petition of C. F. Reifsteck, submit-
ting plat of proposed subdivision of
Lot 2 of Mineral Lot 106 and of the
subdivision of Lot 2 of 2 of Mineral
Lot 106, of which City is a part own-
er, and asking that the Council take
proper action toward giving consent
to subdivisions as contained in said
plat, was on motion of Ald. Frith re-
ferred to the Committee of the Whole
to view the grounds.
Petition of Charles Stevenson et al.,
asking that Bonson Avenue be graded
in order to prevent further damage to
their property from the water from
said Avenue, was on motion of Ald.
Saul referred to the .Committee of the
Whole and the City Engineer to be
instructed to give the lines of said
Avenue.
Petition of Wm. Heitzmanr, et al.,
residents and property owners on
Park Hill, asking that they be given
suitable fire protection, was on motion
df Ald. O'Rourke referred to the
Committee of the Whole.
Petition of George Harker et al.,
asking that additional electric lights
be placed on Burden Avenue, was on
motion of Ald. Singrin, 'referred to the
Committee of the Whole.
Petition of Jas. H. Smith, asking
that he be refunded •$- 20.00, the unused
portion of the amount paid by him
for license to operate 'a retail liquor
store at Second and Main Streets, Was
an motion of Ald. Saul granted and
a warrant in the sum of $20.00 or-
dered drawn in favor of James Smith.
Petition of the Dubuque and La
Crosse Transportation Co., asking that
they be granted the privilege of using
200 feet of river, front for the pur-
pose of a landing dock for live stock,
was on motion of Ald. Haas referrea
to the Committee of the Whole to
view the grounds.
Petitions of Albert Kuhn et al, ask-
ing that a grade be established for
the continuation of Louisa Street from
Grace to Bennett Street; also that said
Louisa Street be improved as quickly
as possible; also that a new grade be
e, tablished on Bennett Street that will
not injure the adjoining property,
were read and, on motion of Ald.
Eand. rules were suspended to grant
Mr. Albert Kuhn permission to ad-
dress the Council, after which the pe-
titions were referred to the Commit-
tee of the Whole to view the grounds.
Communication from the Chicago,
Milwaukee & St. Paul Railroad Com-
pany, asking that the Council adopt
an Ordinance granting them permis-
sion to lay a sidetrack for use of the
McFadden Coffee & Spice Co. through
the alley and across First Street, was,
on motion of Ald. Saul, referred to
the Committe of the Whole.
Notice of claim of Thomas P.
McLaughlin, of $15,000.00 damages
claimed to have been sustained by
falling on a sidewalk in front of
Bassler's shoe store, 2142 Couler Ave-
nue, was, on motion of Ald. O'Rourke,
referred to the City Attorney.
Petition Of W. J. Thorpe, stating:
that he was willing to have the street
between Grace and Bennett Streets
closed and was willing to pay for the
25 feet frontage by 150 feet deep pro-
vided City gives him a deed to the
land on said street, was, on motion of
Ald. Frith, referred to the Commit-
tee of the Whole.
Petition or Andrew Wieser et al,.
asking that Stoltz Avenue be im-
proved from Lemon Street to Daven-
port Street, was, on motion of Ald.
Frith, granted and the proper reso-
lution to be .prepared.
Petition of M. D. McMahon, asking
that the Council have the Couler
Creek in the rear of his lot rip -
rapped to prevent further damage to
his property, was, on motion of Ald.
Frith, referred to the Committee of
the Whole.
Communication from the General
Committee of the G. A. R. and Aux-
iliary 'Societies, asking that the Coun-
cil make the usual appropriation of
$200.00 to help defray the eatpenses•
of Memorial day ekercises, was read
and, after considerable discussion, pe-
titioh was, on motion, granted, pro-.
vided the City Attorney finds it legal'
to make the appropriation.
Petition of S. D. Ryan et al, remon-
strating against the granting of the
petition of the Peter J, Seippel Lum-
ber Co. for permission to establish a
lumber pulling station in front of the
property situated on Block 27, Du-
buque Harbor Co.'s Add., was read.
Ald. Frith then moved that report
of the Committee of the Whole on
the Peter J. Seippel Co. petition be
read. Carried.
Report is as follows:
Your Committee of the Whole
would respectfully recommend that
the P. J. Seippel Lumber Co. be grant-
ed permission for a period of ten years
to use a space on the river front be-
ginning at a point opposite the north
line of Railroad Avenue and extend-
ing northerly a distance of 240 feet
therefrom for the purpose of con-
structing a platform thereon to be
used in connection with its lumber
pulling and loading operations. -

Ald. Frith moved that rules be sus-
pended to grant remonstrators per-
mission to address the council. Car-
ried.
Mr. S. D. Ryan and L. H. Kuehnle,
manager of Iowa Oil Co., then ad-
dressed the Council.
Ald. Frith moved that the prayer
of the remonstrators be granted and
the report of the Committee of the
Whole on the Peter J. Seippel peti-
tion be referred back to the Commit-
tee of the Whole.
Ald. O'Rourke stated that Mr.
Thomas Hill wished to address the
Council in reference to the laying of
a sidewalk on Bennett Street abutting
on his property and moved that the
rules he suspended to grant him per-
mission to address the Council. Car-
ried. Mr. Hill then spoke, remon-
s *ating against the laying of a four -
foot walk on Bennett Street. On mo-
tion of Ald. Frith matter was re-
ferred to the Committee of the Whole
and the City Engineer to be instructed
to survey Mr. Hill's property.
Ald. Martin moved that the matter
of extension of wafer mains in Ben-
nett Street to Louisa 'Street be re-
ferred to the Sprinkling Committee.

REPORTS OF OFFICERS.
Mayor Schunk stated that the of=
'fivers of the'Duh'uciiie,'Base Ball Asso-
ciation had extended a cordial invi-
tation to the members of the Council
tc participate in the parade on Satur-
day afternoon and to be the guests
of the association at the opening of
the :base hall season at the ball park,
and , that carriages for the members
of the Council would be in waiting at
the corner of Seventh and Locust
Streets.
On motion of Ald. Saul the invita-
tion was accepted with - thanks and
the Council to attend in a body.

lice Department that the total hours
that 72 lamps failed to burn would
equal 2% lamps burning for one

On motion of Ald. Naas the profile
showing grade of the alley was ac-
cepted and referred to the Ordinance
Committee to prepare Ordinance
adopting said grade.
Sidewalk Inspector Lynch presented
certified copies of notices served on
Mary Flechsig, owner of Lot 13, Glen-
dale Addition, ordering sidewalks lain
on west side of Washington Street be-
tween 31st and 32nd Streets, also on
north side of Thirty -first Street be-
tween Jackson and Washington
Streets. No remonstrance being filed
and no one in the room objecting to
the laying of said sidewalks, the no-
tices were, on motion of Ald. Frith,
received and filed.
Sidewalk Inspector Lynch also pre-
sented certified copies of notices serv-
ed on Mrs. Elizabeth Buehler, owner
of Lot 22, in Cook's Add., ordering
'sidewalks laid on the easterly side of
Rhomberg Avenue between Johnson
Avenue and Windsor Avenue, also on
the southerly side of Windsor Avenue
between Rhomberg Avenue and Gar-
field Avenue. Remonstrance of Mrs.
Elizabeth Buehler against proposed
improvement, asking for further time
to lay said sidewalk was then read
and, on motion of Ald. Frith, the re-
monstrance and the notice were re-
reived and filed.
Sidewalk Inspector Lynch also pre-
sented and read certified copy of no-
tice served on Joseph Palen, adminis-
trator of Franciska Wagner, owner of
Lot 1, of O. S. Langworthy's Sub., or-
dering a sidewalk laid on the north
side of 24th Street between Washing-
ton and Elm Streets. No remon-
strance being filed and no one in the
room objecting to the laying of the
sidewalk, the notice was ordered re-
ceived and filed.
City Recorder Linehan presented
and read the certified copy of the no-
tice of the Council's intention to con-
struct a sanitary sewer in West
Fourth Street and Paulina Street from
Alpine Street to West Fifth Street. Re-
monstrance of J. W. Manson et al, re-
monstrating against the levying of any
assessment against their property for
the construction of a sanitary sewer

in Paulina Street was then read and,
on motion of Ald. O'Rourke, the
prayer of the remonstrators was
granted and the notice received and
filed.
City Recorder Linehan also pre-
sented and read certified copy of the
notice of the Council's intention to im-
prove O'Neill Avenue from Burden
Avenue to Sheridan Street. No re-
monstrance being filed and no one in
the room objecting to the improve-
ment of said street, the notice was, on
motion, received and filed.
Sanitary Officer Flynn reported as
follows:
To the Honorable Mayor and City
Council,
Gentlemen: -- Your undersigned
Sanitary Officer begs to report that
the following named property owners
have failed to comply with the or-
ders of the Board of Health, requir-
ing them to connect their, property
with the sanitary sewer within thirty
days, and, respectfully. recommend
that your honorable body take fur-
ther action 'in regard to them.

Trustees for the quarter ending March
31st, 1909, was presented and, on mo-
tion of Ald., O'Rourke, was .referred
to the Special Water Works Auditing
Committee.

ket Master Katz and City Electrician
Hipman for the year 1909 were pre-
sented and, on motion, were referred
to the Committee of the Whole.
REPORT OF COMMITTEES.
Ald. Martin, chairman of the Com-
mittee on Ordinances, presented and
read an Ordinance establishing 'a
grade on the 'alley between Jackson
and Washington Streets. from Eighth
to Ninth Streets and moved_ that - the
reading' just had be considered its first
reading. Carried.
Ald. Martin then moved that the
rules be suspended for the purpose of
reading the Ordinance by its title for
the second reading.

Be It Ordained by the City Council
of the city of Dubuque:
Section 1. That a grade on the al—
ley between Jackson and Washington
Streets from Eighth to Ninth Streets -
in the City of Dubuque, Iowa, 'be and
the same is hereby • adopted and es-
tab.lished as shown by the profile, of
said grade prepared by the City En-
gineer and accepted by ,the ;Cify
Council on the fith day of May, 19b9,_
being No. 662, and marked "Profile
showing grade of 'alley 'east of :Jack- -
son Street between Eighth and Ninth
Streets, 'b. m. water table 'Farley -
Loetscher building, northwest 'corner -

Railway Company, 'where the same
intersects and crosses Charter Street
just Easterly of the East line of Lot
Nine (9) in Block Fourteen (14),
and , Lot One (1) in Block Nineteen
(19), Dubuque Harbor Company's
Addition to the City of Dubuque,
Easterly One Hundred (100) feet
from said point herein described.
WHEREAS, The Illinois Central
Railroad Company has petitioned the
City Council of the City of Dubuque
for the vacation and annulment of
Charter Street from a point where the
Fourteen (14), and Lot One (1) in
Block Nineteen (19), Dubuque Har-
bor Company's Addition to the City of
Dubuque, Easterly a distance of One
Hundred (100) feet, and,
WHEREAS, Notice of the intention
of the City Council to vacate said
street has been published in the of-
ficial paper's of the City of Dubuque,
as required by law, and,
WT-IEREAS, By direction of the
City Council of the City of Dubuque,
the City Engineer has made a Plat of

the City of Dubuque:
Section 1. That Charter Street
from a point East of the Easterly side
of the Chicago, Milwaukee & St. Paul
Railway Company's tracks and just
east of the easterly line of Lot Nine
(9) in Block Fourteen (14), and Lot
One (1) in Block Nineteen (19), Du-
buque Harbor Company's Addition to
the City of Dubuque, easterly One
Ilundred (100) feet be, and the same
is hereby vacated and annulled and
the permanent use there of is hereby -
granted to the Illinois Central Rail-
road Company.
Section 2. Should said Illinois Cen-
tral Railroad Co. cease to use said
portion of said Charter Street herein- -
before described for fruit sheds for a
period of one year, then said portion
of said street so vacated shall revert
to the City of Dubuque and this Ordi—
nance shall become null and void.
Section 3. This Ordinance shall be
in force and take effect from and after -
its passage by the City Council and its
publication one time in the Daily
Times - Journal and Telegraph - Herald,
the official newspapers of the City of
Dubuque, Iowa.

Ordinance providing for the widening -
and improvement of a part of Iowa
Street and First Street and for the
exemption of certain property of
McFadden Coffee & Spice Company.
On motion, Ordinance was referred
to the Committe of the Whole.
Ald. Rand, chairman of the Com—
mittee on Claims, reported as follows;
Your Committee on Claims, re-
spectfully reports that they have thor-
oughly investigated the matter of the
claim of Mrs. Emma M. Wilkinson
and have succeeded in securing an ad-
justment of her claim on the basis -
of three hundred and fifty dollars
($350.00) and costs, and they would
recommend that 'settlement on that

basis he accepted by the Council and
that a warrant in the sum of three
hundred and fifty dollars be ordered
drawn in favor of the Mayor to set-
tle said claim.

Ald. Rand moved the adoption of
the report of the Committee on
Claims. Carried.
Ald. Frith, chairman of the Com-
mittee on Fire, stated that an invita-
tion had been extended to the Chief
of the Fire Department by the Com-
mittee on Arrangements for the Me-
morial Day exercises to have the Fire
Department participate in the Me-
morial Day parade, and moved that
the Chief of the Fire Department be
empowered to have the Fire Depart-
ment participate in the parade as in
,former years. Carried.
Ald. Martin, chairman of the Com-
mittee on Police and Light, reported
. follows:
Your Committee on . Police and
Light, to whom was referred the bills
of W. B. Schneider for supplies fur-
nished the Patrol House, amounting
to $24.95, would respectfully report
that we have examined into said
claim .and find the same to be correct
and would respectfully recommend
that a warrant in the sum of $24.95

Gentlemen: —Your Board of Health
respectfully reports that at a meeting
held April 30th, 1909, the Mayor was
'empowered to enter into a contract
-with the United States government for
taking, care of - sick seamen suffering;
from contagious disease, the City of
Dubuque to be paid the sum of $2.50
per day for said services.
AIso, your Board of Health begs to
report that we have appointed Mr.
Frank Flynn Sanitary Officer for the
ensuing year; also that we have ap
pointed Dr. Charles Palen Health
Physician for the ensuing year, .which'
_appointments we submit to your hon -'
orable body for approval.
Also, your Board of Health would
respectfully recommend that warrants,,
be drawn in the sum of $39.00 in fa
vor of E. P. Peryon and Edward'
McEvoy, rspectively, for acting, as
members of the Board of Health from
May 1, 1908, to May 1st, 1909.
Also, your Board of Health respect-
fully recommends to your honorable
body that a six -inch sanitary sewer
be constructed in Hayden's Lane from
Bluff Street to a point about 270 feet
west thereof, in order to improve the
sanitary condition of the abutting
property.
Also, your Poard of Health begs to
report that at their meeting held April
30th resolutions ordering property of
the following named parties connected
with the sanitary sewer were unani-
mously adopted, which we submit to
your honorable body for approval.

Ald. - O'Rourke, chairman of the
Committee of the Whole, reported as
follows:
Your Committee of the Whole, to
whom was referred the bill of the
Water Works Trustees for cinders fur-
nished the road department, amount-
ing to $6.60, would respectfully rec-
ommend that said hill be paid and
that warrant in said sum be ordered
drawn on the City Treasurer in set-
tlement of the same.
Also, your Committee of the Whole,
to whom was referred the petition of
the Dubuque Investment Co., asking
that a sanitary sewer be constructed
in . Jackson Street from Milwaukee
Avenue to the alley first north there-
of, thence west in said alley to Couler
Avenue, would respectfully recom-
mend that•the prayer of the petitioner
be granted and that the proper reso-
lutions be adopted.
Also, your Committee of the Whole,
to whom was referred the petition of
the Potosi Brewing Co., stating that
for several years it had been assessed
$2,000.00 for the steamer Potosi,
which assessment is contrary to the
law, which provides that steamboats
shall be assessed where owned and
not where registered. That it has
paid the assessment on said steamer
in Potosi, where the same is owned,
and assessing it in Dubuque creates
a double assessment and asking,
therefore, that said assessment be
cancelled, would recommend that the
prayer of the petitioner be granted
and that the City Treasurer be in-
structed accordingly.
Also, your Committee of the Whole,
to whom was referred the petition of
John Keckevoet, asking that his
wharfage dues be reduced to $45.00
per annum on the ground that he is
paying more than others in propor-
tion to the space occupied by him,
Would respectfully recommend that
the Harbormaster be instructed to
measure the space occupied by Mr.
Keckevoet and by Mr. Davis and
make his report to the Committee of
the Whole at its next session.
Also, your Committee of the Whole,
to whom was referred the claim of
Byrne Bros. for $50.00 for damages
caused to one of their carriages by a
guy wire on Fourth Street Extension,
would respectfully recommend that
said claim be referred to the Union
Electric Co. for adjustment.
Also, your Committee of the Whole,
to whom was referred the profile
showing a proposed grade on the al-
ley between Iowa and Clay Streets
from Twelfth Street to the south line
of the N. M. 1 -6 of City Lot 448, and
also that showing a proposed grade
on the alley betwen Jackson and
Washington Streets from Eighth to
Ninth Streets, would respectfully
recommend that said grades be ac-
, cepted and that the Ordinance Com-
mittee be instructed to prepare Ordi-
nances legally establishing said
grades.
Also your Committee of the Whole,
to -whom was referred the petition of
C. C. Gordon, stating that he was as-
sessed on $460.00 personalty for the
year 1907 and that said amount was
included in the personalty returned
by A. L. Gordon & Co., of which he
is a member, thus creating a double
assessment and asking, therefore, that
the tax on said $450.00 be cancelled,
would respectfully recommend that
the prayer of the petitioner be grant-
ed and that the City Treasurer be in -
structed accordingly.

Also, your Committee of the Whole
would respectfully report that we
have ordered 10,000 gallons of Liquid
Asphalt 65 %, to be used for surface
treating Grandview Avenue, and 8,000
gallons of the same material 90% for
use in the Third and Fifth Wards, at
6 cents per gallon for the former and
8 cents per gallon for the latter, f.
o. b. Dubuque, including the services
of an expert to demonstrate the man-
ner of applying the same.
Also, your Committee of the Whole,
to whom was referred the petition of
Ben. Kaufman, asking that the assess-
ment levied against him be reduced
to the amount as turned in to the
City Assessor, would respectfully
recommend that said petition be re-
ceived and filed.

deemed necessary and advisable to
construct a sanitary sewer in Hay -
den's Lane between Third and Fourth'
■ Streets, as follows, to -wit: A six -inch
tile pipe sanitary sewer from the
present sewer in Bluff Street to a
point about two hundred and seventy
feet west of the west line of Bluff
street and to assess the cost of said
sewer against the abutting property.
Ald. Martin moved the, adoption of
the resolution.

cations for a, six -inch tile pipe sani-
tary sewer in Hayden's Lane from the
present sewer in Bluff Street to a
point about two hundred and seventy
feet west of the west line of Bluff
Street, showing the locations and gen-
eral nature of such improvement, the
extent thereof, the size and kind of
material to be used, and to prepare
an estimate of the cost thereof and
the amount assessable upon each lot
' or parcel of land adjacent to or abut -
ting thereon per front feet or square
feet in ' area, and to file such plat,
specifications and estimate in the of -
fice of City Recorder.
That after such plat is so filed, the

City Recorder shall cause to be pub-
lished notice of the intention of the
Council to make such improvement.
which notice shall be published in
three consecutive issues of the official
paper of the City of Dubuque, stating
that such plat is on file, and generally
the nature of the sewer, its location,
size and kinds of material to be used,
and the estimate of its cost, and fix-
ing the time before which objections
can be filed, which time shall not be
less than five days after the last pub-
lication of said notice, and after the
completion of the publication of such
notice. he shall at its next session, no-
tify the Council thereof in writing
with a printed copy of such notice ac-
companying the same.

And Whereas, It is deemed neces-
sary for the ,preservation of the pub-
lic health of said City that said pre-
mises be connected with a sanitary
sewer; therefore
Be It Resolved By the City Council
of the City of Dubuque, Iowa, That
Ed. Muntz, owner of Lot 46, Oxford
Heights, in the City of Dubuque,
Iowa, be ordered to connect the build-
ings located upon said described prop-

of June, 1909, and if the connections
are not so made, by the said owner
at the time herein specified, this
Council shall order such work done,
and connections made, in accordance,
with the Ordinance requiring the
making of connections with sanitary
sewers, and assess the costs, and ex-
penses thereof, against the real prop-
erty herein described, and the City
Recorder of the City of Dubuque,
Iowa, is hereby directed to cause a
copy of this resolution, duly attested
by him, to be served upon the said
Ed. Muntz, owner of the property de-
scribed, in accordance with the pro-
visions of an Ordinance of the City
of Dubuque, Iowa, entitled, An Ordi-
dinance Requiring the Making of
Connections With Sanitary Sewers,"
which took effect March 25th, 1907.

erally the location, nature arid; extent
of the proposed improvement on
Stoltz Avenue from the southwesterly
line of Lemon Street to the north-
easterly line of Davenport Street, and
the kind of, material to be used, and
an estimate of the entire cost thereof,
and the amount and cost of such im-
provement, and the amount assess-
able upon any railway or street rail-
way company, the amount and cost
thereof, to be paid by the city, if any,
and the cost thereof- and amount • as-
sessable upon each lot or parcel; of
land adjacent• to or abutting upon
such improvement per front foot, and
to file such plat and estimate in the
office of the City Recorder; that after
the filing of said plat and estimate
in his office, the City Recorder shall
publish in three consecutive issues of
a newspaper published in this city, a
notice stating that such plat and es-
timates are on file, the location and
nature of the, improvement, kind of
material to be used, and an estimate
of its cost, and the time before which
objections thereto can be filed, and
the time fixed for hearing, which time
shall not be less than five days after
the last publication of such notice,
and after such publication shall have
been made, the City Recorder shall,
at the next regular session of the City
Council, notify the Council thereof in
writing, with a printed copy of such
notice accompanying the same.

upon any railway or street rail-
way company, the amount and
cost thereof, to be paid by the city,
if any, and the cost thereof and
amount assessable upon each lot or

Ald. Frith moved that the Street
Commissioner he instructed to notify
the Fengler Company to finish the
work on the levee front at Eagle Point

Ald. O'Rourke moved that warrants
he ordered drawn in favor of A. L.
Rhomberg in the sum of $2,916.66 to
make the first payment of principal
with interest to May 1st on the pur-
chase price of Eagle Point Park. Car-
ried.
Ald. O'Rourke stated that he need-
ed some macadam for the Second
Road District and that Ald. Saul had
more macadam than he needed and
asked that he be permitted to pur-
chase about 500 yards of macadam
from the First Road District for his
Ward.
Ald. Rand moved that the Second
Road District be permitted to pur-
chase not to exceed 500 yards of ma-
cadam from the First Road District.

Ald. Haas stated that a manufactur-
ing company in this city were anxious
to have the City give them an oppor-
tunity to submit a bid to the Council
on furnishing galvanized iron pipe for
the Thirty - second Street storm water
sewer and moved that the bids for
constructing a concrete storm water
sewer in, Thirty- second Street be re-
jected and returned to the bidders un-
opened and the City Engineer to be
instructed to prepare new specifica-
tions for Thirty- second Street storm
water sewer, adding to the old speci-

Ald. Haas, chairman of the Com-
mittee on Supplies, reported that the
committee had procured all the
necessary decorations to be used in
decorating the streets of the city.
Mayor Schunk stated that the
Water Works Trustees have agreed to
install a standpipe for the sprinkling
car at the car barn, and recommended
that the city install a standpipe on
Rhomberg Avenue near Kniest Street,
and the expense of installing the
same be taken out of the expense
fund.
Ald. Frith moved that the action
of the Mayor in securing the stand-
pipe for the car barn be approved;
also that the recommendation of the
Mayor for an additional plug for
Rhomberg Avenue be approved and
standpipe to be ordered installed on
Rhomberg Avenue. Carried.
Ald. Rand, chairman of the Com-
mittee on Public Grounds and Build-
ings. reported as follows:
Your Committee on Public Grounds
and Buildings would respectfully re-
port that we have inspected the vari-
ous engine houses and the patrol
house with a view of determining
what repairs were necessary thereon
and find as follows:
The Fourth Street engine house re-
quires a new slop sink, a new bath
tub, four chimneys re- topped, gravel
roof recoated and all outside wood or

metal work repainted.
The Grandview Avenue engine
house needs all outside wood and
metal work repainted and one large
window sash and light.
The Delhi Street engine house re-
quires painting on the wood and
metal parts outside and a large size
window light put in. •
The Eighteenth Street engine house
requires painting the. outside wood
and metal work, one new sash com-
plete, , and all other sash to be
equipped with sash weights or spring
balance.
The Rhomberg Avenue house we
find. needs new doors in front, and
back doors upstairs repaired and all
outside wood and metal work re-
painted.
We also found that all the engine
houses needed painting inside, which
work can be done by the regular
men, provided the city furnish the
material.
We would further report that a
lawn mower is needed for use at the
various engine houses and would
recommend that the same be pur-
chased.
At the patrol houses we found the
rooms upstairs required painting and
papering and some minor repairs on
the inside thereof.
The foregoing report is submitted
to your honorable body for your con-
sideration.

tablishing a grade on the alley be-
tween Iowa and Clay streets from
Twelfth Street to the south line of
the N. 11I. 1 -5 of City Lot 448, would
respectfully recommend that said
ordinance be passed to its final read-
ing and adopted.
Also, your Committee of the Whole,
to whom was referred the petition of
Major O. S. Riche, asking that a
suitable length of the paved portion
of the levee south of the Diamond Jo
warehouse be set aside for the use
of individual steamboats, packets and
barges, would respectfully recommend
that the prayer of the petition be
granted and that the Chief of Police
be instructed to keep a space five
hundred feet in length from the Dia-
mond Jo warehouse south, open for
the above named purpose.

W. Heitzman et al, asking for suit-
able fire protection for Park Hill,
would respectfully recommend that
the Fire Committee be instructed to
procure figures for the construction
of a water main 1,000 feet long on
Park Hill Avenue to be used for fire
purposes only.
Also, your Committee of the Whole
would respectfully recommend that
the Mayor be instructed to withhold
the warrants issued for the purpose
of purchasing land for the opening of
Louisa Street from Grace to Bennett
Streets until such time as all abutters
along said portion of said street sign
waivers for the improvement thereof.
Also, your Committee of the Whole,
to whom was referred the petition of
Jacob Schwietering et al, asking that
a retaining wall be built and the
necessary grading done in order to
enable them to construct a sidewalk
abutting Sub. 3 and 4 of Stafford's
Add., Lot 1, would respectfully rec-
ommend that said petition be referred
to the Street Committee with power.
Also, your Committee of the Whole,
to whom was referred the communi-
cation of W. J. Thorpe relative to the
purchase of a portion of the street
lying between Grace and Bennett

structed to enter into negotiations
with E. Muntz for the removal of the
frame building on the southwest cor-

M. D. McMahon, asking that Couler
Creek between 31st and 32nd Streets
be rip- rapped, so as to prevent fur-
ther damage to his property by rea-
son of the washing away of its banks,

the Street Commissioner be instructed
to examine into this matter and re-
port back to the Committee of the
Whole.

showing a proposed grade on West
Fourth Street from Alpine Street to

by said profile be accepted and that
the Ordinance Committee be instruct-

to whom was referred the plats show-
ing a subdivision of Lot 2 of the Sub-
division of Mineral Lot 106 and also
a subdivision of the Subdivision of

said plats be approved by the City
Council and that the same be signed

Duffy. chairman of the parade com-
mittee of Iowa State Elks' Associa-
tion, inviting the Mayor and City
Council to participate in the Elks'

Department .decorate and participate

partment participate in the parade,
was, on motion of Ald. Saul, accepted
with thanks and the prayer of the
petitioners be granted and the Police
and Fire Departments to be instruct-
ed to participate in the parade.
Petition of Henry W. Kruse, asking
that the alley between Queen and Elm
Streets from Twenty- fourth Street to
the next street north be widened, was,
on notion of Ald. Rand, referred to
the Committee of the Whole, and
Aldermen Frith and Haas to investi-
gate the matter and report to Com-
mittee of the Whole.
REPORTS OF COMMITTEES.
Ald. O'Rourke, chairman of the
Committee on Finances, stated that
there was about $15,000.00 of im-
provement bonds due June 1st and
that it would be necessary to issue re-
funding bonds to take up same. On
motion of Ald. Rand, matter of issue
of refunding bonds was referred to the
Committee on Finances with power.
Ald. Martin, chairman of the Com-
mittee on Ordinances, presented and
read an Ordinance granting to E. B.
Piekenbrock & Sons, their successors
and assigns, the right to construct and
operate a high pressure water main
for fire protection across Second
Street and in the alley between Locust
and Main Streets, and to connect with
the low pressure main in said alley,
and regulating the use of said con-
nections, and moved that the reading
just had he considered its first read-
ing. Carried.

suspended for the purpose of reading
the Ordinance by its title for the sec-
ond reading.

AN ORDINANCE
Granting to E. B. Piekenbrock &
Sons, their successors and assigns,
the right to construct and operate
a high pressure water main for fire
protection across Second Street and
and in the Alley between Locust
and Main Streets, and to connect
with the low pressure main in said
. alley, and regulating the use of said
connections.
Be It Ordained by the City Council
of the City of Dubuque:
Section 1. That E. B. Piekenbrock
& Sons, their successors and assigns,
are hereby authorized to construct,
maintain and operate a high pressure
water main, six inches in diameter, to
be laid across Second Street, between
Locust and Main Streets, to connect
with the high pressure main in said
Second Street, and also to lay a water
main in the alley between Main and
Locust Streets to their building, to
connect with the 20 -inch low pressure
main, for the purpose of providing
sufficient and adequate water pressure
for fire protection in said store, to be
used for fire protection only.
Said line of water pipe shall be
constructed, maintained and operat-
ed at the expense of the said E. B.
Piekenbrock & Sons, and shall be
constructed under the direction and
supervision of the City Engineer and
the Superintendent of the Water
Works Department of the City of Du-
buque.
Section 2. In the construction of
said water pipe line, the street and
alley shall not be unnecessarily ob-
structed. All obstructions and exca-
vations made in the street and alley
shall he properly barricaded and
lighted, and in any action for damages
caused by such construction or exca-
vation, the said E. B. Piekenbrock &
Sons, in consideration hereof, shall
appear and defend the same, and shall
pay any judgment rendered against
the City of Dubuque therein.
Section 3. The City of Dubuque
may at any time grant the right to
any other person or company to con-
nect with said high water pressure in
said alley, on paying to the said E. B.
Piekenbrock & Sons one -half the cost
of construction of said main to point
of connection with building of said
E. B. Piekenbrock & Sons, as well as
'one -half the cost of maintenance the
cost of future maintenance to be
borne equally by all parties connect-
ing.
Section 4. The said E. B. Pieken-
brock & Sons shall, at or before the
time of accepting the provisions of
this ordinance and its regular publica-
tion in the official newspapers, file
with the Recorder of the City of Du-
buque a proper bond. in the sum of
one hundred dollars, to be approved
by the mayor of said City, obligating
the said E. B. Piekenbrock & Sons to
keep the street and alley in which ex-
cavations are made in pursuance of
the laying of the pipe in question in
good condition and repair wherever
such excavations have been made, for
a period of one year after the com-
pletion of the work, and that they will
restore said alley and street to the
same condition in which they were
prior to the commencement of said
work, all of which is to be done to
the satisfaction of the Street Commis-
sioner and the Committee on Streets.
Section 5. On completion of the
laying of the main as herein provided
for, the said E. B. Piekenbrock & Sons
shall file with the City Recorder a
sworn statement, showing the exact
cost of said main and of installing the
same to point of connection with said
building, said statement to be item-
ized. Failure to file the same shah
preclude the said E. B. Piekenbrock
& Sons from the right of collecting
from any person or company hereaf-
ter connecting with said main, as
provided in Section 3 hereof.
Section 6. This ordinance shall be
in force from and after its passage by
the City Council and its publication
one time in the Dubuque Telegraph -
Herald and the Times - Journal news-
papers, and its acceptance in writing
by said E. B. Piekenbrock & Sons.

whom was referred the specifications
for the improvement of Davis Ave-
nue, would respectfully recommend
that a special committee, composed of
the Mayor, the City Attorney and
Alderman Haas be instructed to call
upon the Board of Supervisors to get
their consent to the contract as
awarded.
Also, your Committee of the Whole,
to whom were referred the specifica-
tions and plans for the alley between
Iowa and Clay Streets from Twelfth
Street north to the south line of City
Lot 448, would respectfully recom-
mend that in the final clause of said
specifications, there be inserted the
provision that the Street Commission-
er have complete control of the
work, subject to the grades as estab-
lished by the City Engineer and un-
der the direction of the Committee on
Streets.

terial to be used, and an estimate of
the entire cost thereof and the amount
and cost of such improvement, and
the amount and cost thereof, to be
paid by the city, if any, and the cost
thereof and amount assessable upon
each lot or parcel of land adjacent to
or abutting upon such improvement
per front foot, and to file such plat
and estimate in the office of the City
Recorder; that after the filing of said
plat and estimate in his office, the
City Recorder shall notify said abut-
ting and adjacent property owners, as
provided by ordinance, that such plat
and estimate are on file, the location
and nature of the improvement, kind
of material to he used, and an esti-
mate of its cost, and the time before
which objections thereto can be filed,
and the time fixed for hearing, which
time shall not be less than five (5)
days after the service of such notice,

Ald. Martin, chairman of the Com-
mittee on Fire, presented and read
the following bids for furnishing the
Fire Department with a three -horse
hitch exercising cart:

Ald. Martin, chairman of the Com-
mittee on Police and Light, stated
that the Police Patrol telephones had
been installed by the Dubuque Tele-
phone Co. and moved that the Mayor
cancel the contract of the Iowa Tele-
phone Co. for telephones in Patrol
boxes.
Ald. O'Rourke stated that there
was considerable waste paper on the
streets .of the City and something
should be done to stop the practice
of throwing papers in the street.
Ald. Martin moved that the Chief
of Police notify the bill posters and
all other parties to remove all waste
paper and to stop the practice of
throwing paper on the streets or al-
leys.
Mayor Schunk reported that the
committee appointed to confer with
the Board of Supervisors in reference
to the improvement of Davis Avenue
held a meeting with the Board and
that the Board of Supervisors adopted
resolutions providing for payment for
the grading and macadamizing of
Davis Avenue according to the plans
and specifications submitted by the
special committee. Ald. O'Rourke
moved that the report of the special
committee on Davis Avenue improve-
ment be approved. Carried.
Aid. Saul moved that the City En-
gineer and City Attorney be instruct-
ed to prepare proper special assess-
ment for brick paving of Iowa and
First Streets and submit same to the
Council at their next session. Car-
ried.
RESOLUTIONS AND MOTIONS.
Alderman Saul offered the follow-
ing:
Be It Resolved by the City Coun-
cil of the City of Dubuque, That the
Board of Supervisors of Dubuque
County be respectfully requested to
repair Southern Avenue from the
south side of Grandview Avenue,
southerly to the city limits and also
to repair the North Cascade Road
wherever necessary from Simpson
Street southerly to the city limits,
such repairs to be made at a cost of
not to exceed $1,500.00.

is hereby ordered to be laid on the
north side of Seminary Street, be-
tween Harold and Keppler Streets,
and in front of the following describ-
ed premises, Lots 3 -4 -5 and the east
27 feet of Lot 6 in Littleton & Saw-
yer's Addition, composed of eight
inches of concrete and one -inch of
cement wearing surface. Said side-
walk to be completed on or - before
the 1st clay of August, 1909, and the
cost of the same to he taxed against
said premises and collected in the
manner prescribed by law.
Be It Further Resolved, That said
property owner be and is authorized
to construct said sidewalk at his own
expense, provided he begins work
thereon within ten days after being
notified by the City Recorder of the
passage of this resolution by the City
Council, and completes the same
within thirty days thereafter.
Be It Further Resolved, That if
said work is not commenced within
the time named in said notice that
the City Recorder be and is hereby
ordered to give ten days notice by
two publications asking for proposals
for the doing of said work under con-
tract with the City. The proposals
for the doing of said work shall be
acted upon by the City Council on
the 17th day of .Tune, 1909.

Ald. Martin moved that an amount
not to exceed $150.00 be appropriated
by the Council to be expended by the
Committee on Public Grounds and
Buildings in beautifying the parks of

Ald. Saul moved that the City Engi-
neer be instructed to give the Union
Electric Co. the grade stakes for the
laying of their new track from Dodge
Street to Second and Locust Streets.

Alci. O'Rourke moved that the City
Attorney prepare an opinion to be
presented to the Council at their next
session as to whether the City can
have a street improved by curb and
gutter, and later to have street ma-
cadamized. Carried.
Ald. Singrin stated that the Wood-
men of the World had changed the
date of holding their Street Carnival
from the week of June 28th to July
12th and moved that the Council grant
consent to the Woodmen of the World
to use Clay Street for holding their
Carnival during the week commencing
July 12th, 1909. Carried.
Ald. O'Rourke stated that the work
of sodding Grandview Avenue would
be completed in a few days and that
the contractors wished to have the
committee examine the work for ac-
ceptance as soon as convenient and
moved that the matter of taking care
of the park and sodding be referred
to the Street Commissioner with
power. Carried.
Ald. Martin moved to adjourn to
Thursday evening, June 3rd, 1909.

Granting to E. B. Piekenbrock &
Sons, their successors and assigns,
the right to construct and operate
a high pressure water main for fire
protection across Second Street and
and in the Alley between Locust
and Main Streets, and to connect
with the low pressure main in said
alley, and regulating the use of said
connections.
Be It Ordained by the City Council
of the City of Dubuque:
Section 1. That E. B. Piekenbrock
& Sons, their successors and assigns,
are hereby authorized to construct,
maintain and operate a high pressure
water main, six inches in diameter, to
be laid across Second Street, between
Locust and Main Streets, to connect
with the high pressure main in said
Second Street, and also to lay a water
main in the alley between Main and
Locust Streets to their building, to
connect with the 20 -inch low pressure
main, for the purpose of providing
sufficient and adequate water pressure
for fire protection in said store, to be
used for fire protection only.
Said line of water pipe shall be
constructed, maintained and operat-
ed at the expense of the said E. B.
Piekenbrock & Sons, and , shall be
constructed under the direction and
supervision of the City Engineer and
the Superintendent of the Water
Work,$ Department of the City of Du-
buque.
Section 2. In the construction of
said water pipe line, the street and
alley shall not be unnecessarily ob-
structed. All obstructions and exca-
vations made in the street and alley
shall be properly barricaded and
lighted, and in any action for damages
caused by such construction or exca-
vation, the said E. B. Piekenbrock &
Sons, in consideration hereof, shall
appear and defend the same, and shall
pay any judgment rendered against
the City of Dubuque therein.
Section 3. The City of Dubuque
may at any time grant the right to
any other person or company to con-
nect with said high water pressure in
said alley, on paying to the said E. B.
Piekenbrock & Sons one -half the cost
of construction of said main to point
of connection with building of said
E. B. Piekenbrock & Sons, as well as
one -half the cost of maintenance, the
cost of future maintenance to be
borne equally by all parties connect-
ing.
Section 4. The said E. B. Pieken-
brock & Sons shall, at or before the
time of accepting the provisions of
this ordinance and its regular publica-
tion in the official newspapers, file
with the Recorder of the City of Du-
buque a proper bond, in the sum of
one hundred dollars, to be approved

the said E. B. Piekenbrock, & Sons to
keep the street and alley' in which ex-
cavations are made in pursuance of
the laying of the pipe in question in
good condition and repair wherever
such excavations have been made, for
a period of one year after the com-
pletion of the work, and that they will
restore said alley and street to the
same condition in which they were
prior to the commencement of said
work, all of which is to be done to
the satisfaction of the Street Commis-
sioner and the Committee on Streets.
Section 5. On completion of the
laying of the main as herein provided
for, the said E. B. Piekenbrock & Sons
Shall file with the City Recorder a
sworn statement, showing the exact
cost of said main and of installing the
same to point of connection with said
building, said statement to be item-
ized. Failure to file the same shall
preclude the said E. B. Piekenbrock
Sons from the right''of collecting
from any person or company hereaf-
ter connecting with ' said main. as
provided in Section 3 hereof.'
Section 6. This ordinance shall be

PETITIONS AND COMMUNICA-
TIONS.
Petition of Eva W. Faherty et al.,
asking that a sanitary sewer be con-
structed along Needham Place from
West Fifth to West Seventh Streets,
and in the alley between West Sev-
enth and West Fifth Streets, was on
motion of Ald. O'Rourke referred to
the City Engineer to report to the
Committee of the Whole.
Petition of J. M. Keppler, asking
that the Treasurer be instructed to
accept $66.45 without interest in full
for special assessment levied against
Lots 21, 22 and 23, Newbury & Hale's
Sub., was on motion of Ald. O'Rourke
granted and the Treasurer to be in-
structed accordingly.
Petition of Geo. Pregler, Jr., asking
that he be granted permission to lay
a sidewalk in front of his property
to correspond with adjoining proper-
ty on Sanford Avenue and Washing-
ton Streets, was on motion of Ald.
Haas, referred to the Committee of
the Whole.

Petition of the Eagle Point Lime
Works, asking that they be granted
an extension of time for 60 days to
complete the improving of Julien Ave-
nue by constructing brick gutter, was
read.
Ald. O'Rourke asked that the City
Attorney give an opinion as to
whether the Council could grant the
contractors an extension of time.
City Attorney Lyon then stated that
the matter of an extension is within
the discretion of the Council. Where
there has been reasonable grounds
for delay it is entirely within their
jurisdiction and it will not invalidate
the assessment for the work.
Ald. Saul moved that petition of
Eagle Point Lime Works be granted.
Carried.
Petition of Mrs. Catherine Rhom-
berg et al., remonstrating against the
construction of a brick gutter on Ju-
lien Avenue from Bluff Street to AIta
Vista Street and asking that the
Council have the contract of the Eagle
Point Lime Works for doing the work
cancelled was on motion of Aid. Saul
referred to the Committee of the
Whole to view the grounds.
Petition of Geo. Schumacher, also
of Edward Yunker, asking that they
be granted consent to sell and keep
for sale intoxicating liquors by
them at either or all of the sev-
eral places named in their peti-
tions, namely Lot 96, southwest
corner 19th and Washington Streets,
Lot 156, East Dubuque Add., south-
west corner 17th and Elm Street, 1689
Elm Street, 605 Rhomberg Avenue
and 797 Lincoln Avenue, were read
and, on motion of Ald. Frith, were
referred to the Committee of the
whole.
The petitions of the following re-
tail liquor dealers, asking that the
Council adopt resolutions for consent
to sell and keep for sale intoxicating
liquors in the City of Dubuque, Iowa,
were presented and read and were, on
motion, granted.
Following is the list of saloonkeep-
ers filing applications for consent of
the Council to conduct saloons:
Geo. J. Schaffhauser, City Lot 295
or City Lot 294.
T. J. Loftus, 390 Main Street.
The following resolutions were then
offered:
Be It Resolved by the City Council
of the City of Dubuque, That consent
is hereby given Geo. J. Schaffhauser

liquors, and deal therein, in the City
of Dubuque, Iowa, as provided by law.
