INTRODUCTION
The purpose of this memo is to request City Council approval of changes to the policies
and procedures related to the Public, Educational, and Governmental (PEG) Access
Equipment Grant Program and guidelines for Dubuque's PEG channels. Dubuque's
Cable Television Commission approved these changes at its Nov. 20, 2024, meeting
BACKGROUND
Currently, five PEG channels are offered on the Mediacom cable system. The City of
Dubuque operates the local government access channels (CityChannel Dubuque and
CityChannel Graphics) and the public access channel, the Dubuque Community School
District operates the public education access channel, and Loras College operates the
shared education access channel. The City assumed operation of the public access
channel following Mediacom's decision to stop managing the channel, effective Dec. 8,
2023.
The City's previous municipal cable television franchise agreement with Mediacom
required Mediacom to contribute funds to support a grant program for the purchase of
equipment with which to produce local public, educational, and governmental (PEG)
programming. Individuals and qualified organizations may apply for funding from this
program. The fund has been used by a variety of organizations over the years and has
funded significant purchases by the three organizations operating the PEG channels.
Mediacom is no longer contributing to the fund and its current balance is approximately
$1.3 million.
DISCUSSION
When the City assumed operations of the public access channel, staff identified the
need to provide guidance to community members interested in producing content for
playback on Dubuque's PEG channels. Staff are unaware of an existing document and
believe it's in the benefit of the City and programming producers to have a formal policy
for reference. In response, staff drafted the Dubuque Cable Access Policy and
Procedures Guideline. Based on research and review of policies used by other

communities, the document outlines policies and procedures for submission of
programming for local PEG channels as well as program content and restrictions, as
well as enforcement.
Several factors contributed to staffs proposal to revise the City's current PEG
Equipment Grant Program. Recent applications indicated a lack of understanding of
grant program details, process, and recipient agreement. These challenges, along with
the application structure and recipient agreement, are impacting staffs ability to
efficiently and effectively manage requests while performing day-to-day department
duties. This evaluation prompted restructuring the grant with the goal to better inform
applicants about the program, process, and expectations, increase potential for
utilization, and improve efficiency for staff managing the program.
Highlights of the recommended changes include the creation of two separate
processes, one for community members and one for PEG channel operators. Other
details for community member applications included the conversion of the process to an
annual grant cycle, a maximum number of grants awarded per year and maximum grant
amounts. Additionally, clarification for both programs regarding required programming
for grant recipients, eligible equipment, and ownership of equipment.
For more details on the Dubuque Cable Access Policy and Procedures Guidelines and
the PEG Equipment Grant Program revisions, please refer to the attached documents,
which have been reviewed by Senior Counsel Barry Lindahl and approved unanimously
by the Cable TV Commission. REQUESTED ACTION
I respectfully request City Council approval to implement the PEG Equipment Grant
Program revisions and the Dubuque Cable Access Policy and Procedures Guideline as
attached.

I. PEG ACCESS PROGRAMMING
The City of Dubuque defines types of programming for Public, Educational, and Governmental (PEG)
Access Channels as follows:
A. PUBLIC ACCESS:
1. Any member of the public may produce and/or submit a program for broadcast, by
completion of a broadcast request form and provider agreement form.
a. Each program must identify the producer (an individual or organization) of the
program being submitted for broadcast. The program's producer must reside within
Dubuque city limits or be sponsored by an individual/organization within city limits.
2. Requires disclaimer and identification of producer or sponsor:
a. A DISCLAIMER (which is the DISCLAIMER referred to throughout this text) will be
added by City staff:
"THE VIEWS EXPRESSED IN THE FOLLOWING VIDEO PRESENTATION ARE THE SOLE
RESPONSIBILITY OF THE PRODUCER(S) AND THUS DO NOT NECESSARILY REPRESENT THE
VIEWS OR OPINIONS OF THE CITY OF DUBUQUE, THE MAYOR, CITY COUNCIL, OR CITY
STAFF".
b. City staff will add a graphic before or following the program to identify the producer
or sponsor, if not already included in the program.
3. Public Access programs will be scheduled at the discretion of City staff based on the following
ranking of priority, from highest to lowest:
a. Programs with timely subject matter
b. Series program
c. Programs of any subject matter
4. Each program submitted for local public access shall be shown a minimum of two times.
B. EDUCATIONAL ACCESS:
Dubuque has two educational access channels, neither are operated by the City of Dubuque.
1. Programming produced or supplied by a recognized representative of an educational
institution, public or private, such as:
a. Dubuque Community School District
b. Holy Family School District
c. Clarke University
d. Emmaus Bible College
e. Loras College
f. University of Dubuque

g. Northeast Iowa Community College
2. Programming should include identification of sponsorship and producer responsibility.
3. Each program submitted for local educational access shall be shown a minimum of two
times.
C. GOVERNMENT ACCESS:
1. Programming supplied or produced by local government agencies.
2. City of Dubuque's Public Information Office (PIO) staff shall ensure that the following public
meetings are routinely broadcast live and/or recorded for showing on local PEG access
channel. Priority in taping and scheduling shall be in this order, as department resources
allow:
a. City of Dubuque City Council
b. City of Dubuque Zoning Advisory Commission
Programming should include identification of sponsorship and producer responsibility.
4. Each program submitted for local government access shall be shown a minimum of two
times.
II. PROGRAM CONTENT AND RESTRICTIONS
All programs being broadcast live or played back on PEG access channels must be in accordance with
federal, state and local law. A program being broadcast live or played back on the PEG channel may not
discriminate or include gambling, advertising, copyrighted materials, and other restricted materials as
defined by the FCC. If PIO staff believes herein that a program may violate the guidelines stated, staff
will remove the program in question from broadcast pending further evaluation of the content.
PROGRAM RESTRICTIONS:
A. GAMBLING. No program may promote or conduct any commercial lottery, raffle, contest or
game involving prizes awarded in whole or in part by lot or chance.
B. SOLICITATION. The program may not solicit funds or other property of value from viewers.
C. ADVERTISING. The program may not be designed to promote the sale of commercial products
or services.
D. OBSCENITY. Channel operators may not control the content of programming on public access
channels with the exception that the operators may refuse to transmit a public access program,
or a portion of the program, which the channel operator reasonably believes contains obscenity.
E. PRODUCTS OR SERVICE. The program may not discuss or show products or services made
available by persons, corporations or institutions which have a commercial interest in the
subject of the programs. It may, however, identify underwriters providing grants or
contributions to defray the cost of programs. An acceptable identification format could include
the following:

F. COMMERCIAL IDENTIFICATION. The program may not promote, or make reference to any
products, service, trademark or brand name in any manner which does not in some way
correlate with the message being brought forth in the program on the access channel.
G. MISREPRESENTATION. The program may not contain any material intended to defraud the
viewer or designed to obtain money by false or fraudulent pretenses, representation or
promises.
H. ILLEGALITIES. The program may not contain any material which constitutes libel, slander,
defamation, invasion of privacy or publicity rights, unfair competition or violation of trademark
or copyright or which may otherwise violate any local, state or federal law.
I. PROGRAM DISCLAIMER. The DISCLAIMER will appear preceding every public program that is
submitted for broadcast.
J. APPROVALS, CLEARANCES. Producers must obtain in writing, and be able to produce upon
request, all necessary approvals, clearances, licenses, etc. for the use of any program material to
be broadcast. This includes, but is not limited to, approvals by broadcasting stations, networks,
sponsors, music licensing organizations, copyright owners, performers' representative, and all
persons featured in the program material, and any other approvals that may be necessary to
transmit the program via public access channel.
I. POLITICAL GUIDELINES. Legally qualified candidates for public office desiring to use the PEG
access channel must adhere to the following:
1. For municipal, state, and county offices, material is broadcast after the last official
deadline for filing candidacy papers has passed, and ending at 6:00 p.m. the Saturday
before the election.
2. The total amount of time allotted to any one candidate from public office to appear
on the PEG Access Channel is one hour per month, excluding panel discussions or
candidate forums.
III. VIDEO LABELING
All programs submitted for broadcast must be accurately timed and labeled on media face and storage
case with the following:
A. Producer's name.
B. Producer's telephone number
C. Producer's email.
D. Series or program title.
E. Program submission date.
F. Program total run time.
IV. FORMAL GRIEVANCE POLICY AND PROCEDURE

Any person may present a formal written grievance related to PEG programming to the PIO, in person or
by mail and email. Copies will be forwarded to the Cable TV Commission. All formal written grievances
require the following information in order to be processed:
A. Name of all persons participating in filing of the grievance, or identification of a single
"contact" person to whom the response should be presented by an individual in the event that a
person claims to represent a group or organization.
B. The current address of all persons participating in the filing to the grievance or of the
designated "contact" person.
C. Current name and phone numbers of all persons participating in the filing of the grievance or
of the designated "contact" person.
D. An indication of the time of day and location at which persons filing the grievance and/or the
designated "contact" person can most likely be reached.
E. The nature of the grievance clearly stated with relevant details as follows:
If the grievance is based on a policy or procedure, or program content, it must be filed
within 10 working days of the last program air date, and it should include:
a. An explanation of which policy or procedure is in question.
b. The nature of the grievance against the policy or procedure.
c. The recommendation(s) for change in policy or procedure that is believed
needed.
d. The date and the time of day of the grievance incident.
e. The location where the grievance incident occurred.
f. Once the grievance is received, PIO staff will attempt to make an initial
contact with the person(s) filing the grievance, or with the designated "contact"
person.
g. If the party reporting the grievance is not satisfied with the PIO's decision, the
filing party can then appeal to the Cable TV Commission. Appeal must be made
within 10 working days of notice of PIO staff's decision. If not satisfied with the
Cable TV Commission, an appeal may be made to the City Manager. The City
Manager's decision will be final and conclusive.
h. Failure to follow the grievance policies and procedures as stated above may
result in a delayed response to any grievance. Successive failure to follow
grievance policies and procedures will relieve the City from any responsibility to
respond to the grievance.
V. DIGITAL BULLETIN BOARD

A. Members of the public and representatives of local non-profit organizations may use the
public access channel's digital bulletin board free of charge for the purpose of promoting any
non-commercial service or event.
B. Information to be posted on the digital bulletin board should be submitted to the PIO by
email.
C. PIO staff reserve the right to edit materials to be posted for length, formatting and content.
D. Messages should be submitted no later than two weeks prior to any timely event or
promotion. PIO staff shall use their best efforts to post Digital Bulletin Board announcements
within five business days of receipt.
E. Messages from the public will be displayed through the event or for 60 days, whichever
comes first.
F. There will be a limit of 10 public items on the digital bulletin board at any given time. These
will be allotted on a first -come, first -served basis.
VI. GUIDELINES FOR ENFORCEMENT PROCEDURE
A. When the PIO staff determines that there has been an apparent violation of any of the
guidelines that have been previously mentioned in this document, staff:
1. Shall notify the user of the alleged violation and advise the user of her/his right to
meet with PIO staff before a final determination, including possible sanctions, is made.
This notification will also be sent to the Cable TV Commission. The user shall be advised
that her/his request for a meeting must be made to PIO staff orally or by mail/email
within two weeks of the date of the letter of notification.
2. May immediately suspend broadcast of a program, provided that the program
contains alleged violations of procedures previously stated in these guidelines, or
provided that continued broadcast of the program would create clear and substantial
risk of legal liability for the PEG Access Channel. In the event of suspension of broadcast,
the user shall be sent written notification of the alleged violation within 48 hours of the
suspension. Copies of that notice shall be sent at the same time to all members of the
Cable TV Commission. All other procedures for processing alleged violations, indicated
in the following section, shall also apply.
B. After meeting with the user, or, if no meeting is requested, after two weeks from the date the
user was notified of the infraction, P10 staff may take no action or may take one or more of the
following actions:
1. Suspend for a period, or revoke, in whole or in part, the user's right to use the PEG
Access Channel.
2. Take such other action as is fair, reasonable, and equitable.

C. No person shall have user rights suspended or revoked unless PIO staff determines that the
user's conduct is an aggravated infraction of any PEG Access Channel rules and regulations. In
determining whether an infraction is aggravated, PIO staff shall consider whether:
1. The user has been involved in previous infractions.
2. The infraction reflects a serious disregard by the user of the personal or property
rights of others.
3. The infraction was intentional or demonstrated a willful disregard for these rules and
procedures.
D. PIO staff shall notify the user of a decision to impose sanctions as soon as possible. If PIO staff
suspends or revokes user rights and if PIO staff determines that the user's conduct seriously
endangered the person or property of others, the notice shall so state, and the revocation or
suspension shall take effect immediately. Otherwise, sanctions shall not take effect until 20 days
after the user is notified of PIO staff's decision. The Cable TV Commission and City Manager shall
be sent a copy of any notice required by this section. If the party is not satisfied with PIO staff's
decision, they may appeal the decision is in accordance with Section IV of this policy entitled,
Formal Grievance Policy and Procedure.
E. Upon receipt of an appeal from a user, the Cable TV Commission shall include the matter in its
agenda, granting priority over all the other agenda matters except for the appeals made under
this section. That portion of a Cable TV Commission meeting at which an appeal is heard shall be
open to the public and shall be recorded. At the meeting, PIO staff shall describe any sanctions
imposed and the basis for alleging a violation of the PEG Access Channel's rules. The user shall
then be entitled to respond regarding the alleged violation and any sanctions. Both user and PIO
staff may present witnesses or evidence related to the alleged violation. Public comment will be
taken at the discretion of the commission.
F. If the Cable TV Commission determines that there is sufficient basis to justify PIO staff's
determination of a violation of the Public Access Channel's rules, then that determination shall
be affirmed. The Cable TV Commission may modify PIO staff's determination, or any sanctions
imposed or may make a new determination or impose new sanctions. If the Cable TV
Commission determines there was no violation of the PEG Access Channel's rules, the Cable TV
Commission shall remove any sanctions.
IX. CHARGES FOR COMMUNICATIONS DEPARTMENT SERVICES
A. There will be no charge for playing videos over the channel.
X. OFFICIAL USE AND AVAILABILITY OF DUBUQUE PUBLIC ACCESS PROGRAMMING
A. At the discretion of PIO staff, public meetings, special events, and programs that may be
deemed of significant importance maybe digitally archived by the City of Dubuque. PIO staff will
determine the length in which a program will be digitally retained on a program -by -program
basis.

COMMUNITY PEG ACCESS EQUIPMENT GRANT DETAILS
The Community PEG Access Equipment Grant is dedicated to supporting the creation of video
programming for the City of Dubuque's public, educational, and governmental (PEG) access channels on
local cable television systems. Through this opportunity, equipment is funded to up to 5 individuals
and/or organizations each year with an interest in producing content for one of Dubuque's PEG channels.
ELIGIBILITY AND PROCESS OVERVIEW
The Community PEG Access Equipment Grant is open to local individuals and organizations with an
interest in developing PEG programming. Those interested must meet eligibility and application
requirements.
WHO CAN APPLY: Applications for grant funds may be submitted by a City of Dubuque resident or a
qualified organization — those with a principal place of business within City limits or a principal regular
meeting place within City limits.
Applicants may only receive a grant once every 3 years. Awarded applicants can apply for funding again
as long as 3 years have passed, and all requirements and reporting of past funded requests have been
met.
WHAT CAN BE REQUESTED: Production equipment related to the creation of proposed public access
programming is applicable for this request. Applicants must complete the application process which
includes a description for proposed public access programming, a list of requested equipment,
justification for the requested equipment, and a minimum of three vendor quotes for the requested
items.
Computers, laptops, and subscription -based software are not applicable through the Community PEG
Access Equipment Grant.
The total requested amount for the Community PEG Access Equipment Grant per applicant per
application may not exceed $10,000.
Requests under $5,000 will be required to produce a minimum of 5 programs with a cumulative total run
time of 30 minutes. Requests of $5,000 or above will be required to produce a minimum of 10 programs
with a cumulative run time of 60 minutes. If a request to deviate from these requirements is submitted
and approved, the approved changes will become the new required guidelines. The request to deviate
must be included in the original application and outlined in proposal for programs.
BY WHEN: Community PEG Access Equipment Grant applications are open once a year and will be
reviewed and considered by the Cable TV Commission for funding. The application deadline for the next
review will be at a date determined by the Cable TV Commission.
Up to 5 selected applicants will be invited by the Cable TV Commission to a meeting, during which
commissioners will consider their support and approval of the requests.
CONSIDERATION PROCESS: Commissioners will vote to either recommend funding, partial funding, or
not funding the Community PEG Access Equipment Grant requests based off the following criteria:
• Eligibility requirements

• Completion of application materials
• Requested equipment supports the production of proposed access programming
• Applicant demonstrates sufficient knowledge regarding use of requested equipment
If commissioners believe an applicant may not sufficiently meet the noted criteria, they may recommend
considering the use of the City of Dubuque's Video -Basics Public Access Production Kit in lieu of funding
a request.
Please note, the Cable TV Commission serves as an advisory commission. Their recommendations
related to Community PEG Access Equipment Grant requests will go before the Dubuque City Council for
final approval.
APPLICATION REQUIREMENTS: Submissions for the Community PEG Access Equipment Grant are open
and reviewed once a year. Applications must be received by a date determined by the Cable TV
commission to be considered for the current grant -cycle. Applications must be completed online using
the Community PEG Access Equipment Request form and will require applicants to provide:
• Public Access Programming Proposal
o Applications must include details of video programming that the applicant intends to
produce with support of the Community PEG Access Equipment Grant. Details
should include program titles, descriptions of content, approximate lengths, and
total number of programs intended to produce. Please refer to the Dubuque Cable
Access Policy and Procedures Guideline for acceptable programming.
o NOTE: Requests under $5,000 are required to produce a minimum of 5 programs
with a cumulative total run time of 30 minutes. Requests of $5,000 or above are
required to produce a minimum of 10 programs with a cumulative run time of 60
minutes. If a request to deviate from these requirements is submitted and approved,
the approved changes will become the new required guidelines. The request to
deviate must be included in the original application and outlined in proposal for
programs.
• Requested Equipment List
o An equipment list that includes a product name, model number, and quantity for
each requested item must be submitted.
• Plan for Use of Requested Equipment
o Applicants must provide a short explanation about how the requested equipment
will be used and how it will assist in the production of the applicant's proposed list
of public access programming.
• Procurement of 3 Vendor Quotes
o Quotes from 3 different vendors must be included for all items requested.

o If a vendor does not carry a specific item, applicants can instead list a similar item
from that vendor or provide an additional quote from an additional vendor for that
specific item.
• Proof of Quotes
o A proof of quote is required for each listed vendor. A proof of quote must come
directly from the vendor or the vendor's site and must show the requested item(s),
listed prices, and quantities.
o A PDF of a shopping cart is an acceptable proof of quote, however it must list each
item, cost, quantity, and clearly show that it is from the vendor's website.
TERMS OF AGREEMENT
If a Community PEG Access Equipment Grant request is supported by the Cable TV commission for
funding, the applicant must enter into an agreement with the City of Dubuque for proper use of the
equipment. A typical agreement includes, but is not limited to, the following requirement:
• Equipment is used solely for non-commercial purposes.
• A portion of the required programming is produced and aired within 6 months of receiving
equipment.
• The total required amount of programming be produced and aired within 14 months of
receiving equipment.
• A final grant report is presented within 18 months of receiving the equipment to the Cable
TV Commission which includes:
o List of access programming created, including total run times and short description
of each program.
o Video sample of programming created.
o Written report of any significant deviations from submitted programming proposal.
• Recipient commits to producing content, including all key production elements, without the
substantial use of artificial intelligence (AI) assistance.
• The awarded equipment remains property of the City of Dubuque.
• All equipment must be returned to the City of Dubuque if applicant fails to fulfill the terms
of agreement within 18 months of receiving equipment.
• When terms of agreement are completely fulfilled, terms of agreement are in void and the
City of Dubuque releases ownership of the equipment to the awarded applicant.
Non -applicable purchases: Computers, laptops, subscription -based software, and equipment
determined by the commission to not have significant value or relation to the creation of PEG
programming.

Equipment Grant Award Agreement (Agreement), dated for reference purposes the _ day of
, YEAR, is made and entered into by and between the City of Dubuque, Iowa (City)
and
(Recipient).
Whereas, the City of Dubuque provides a Community PEG Access Equipment Grant to support
Dubuque PEG channel programming; and,
Whereas, Recipient has submitted a grant application outlining plans for equipment used in the
support PEG access channel programming; and,
Whereas, City has approved the grant application on the terms and conditions set forth herein.
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN CITY AND RECIPIENT AS FOLLOWS:
1. City hereby awards a grant (the Grant) to Recipient for requested equipment in the amount of
2. The equipment purchased through the Grant must be used for the purpose(s) described in the
grant application for funding, a copy of which is attached hereto and incorporated herein.
3. All equipment purchased with the Grant shall remain the property of City.
4. Any unused portion of the Grant request shall be credited to City's PEG Access Equipment Fund.
5. Equipment purchased with the Grant shall be used solely for non-commercial purposes and
cannot be used to produce media intended for sale.
6. Recipient accepts liability of the awarded equipment and use of the equipment.
7. Recipient with an equipment request under $5,000 must produce a minimum of 5 programs
with a cumulative total runtime of 30 minutes for broadcast on the appropriate local PEG
channel. Recipient with an equipment request of $5,000 or above must produce a minimum of
10 programs with a cumulative total runtime of 60 minutes. If Recipient has previously received
approval to deviate from these production requirements, the approved deviation will remain in
effect.
8. Programs created under this agreement must include recognition to the Community PEG Access
Equipment Grant. "This program was produced with the support from the City of Dubuque
Community PEG Access Equipment Grant Program."

9. Recipient must submit a portion of the required programming within 6 months of receiving
equipment and all required programming within 14 months of receiving equipment.
10. Recipient must present a final grant report to the Cable TV Commission within 18 months of
receiving equipment which includes:
a. List of access programming created, including total run times and short description of
each program.
b. Video sample of programming created.
c. Written report of any significant deviations from submitted programming proposal.
11. If Recipient faces challenges that could affect their ability to meet the terms of this agreement,
they should promptly contact City staff to determine if potential adjustments can be made.
12. Recipient commits to producing content, including all key production elements, without the
substantial use of artificial intelligence (Al) assistance.
13. Recipient must reside in or maintain a principal place of business within the city limits of the City
of Dubuque, Iowa at times while in possession of the equipment, and agrees to promptly notify
and return the equipment should Recipient no longer meet this requirement.
14. The equipment must remain in the possession of Recipient. Possession of the equipment cannot
be transferred to any person or entity. If Recipient can no longer manage the equipment,
arrangements with City to return the equipment must be made.
15. Failure by Recipient to abide by the terms and conditions of this Agreement within 18 months
may result in forfeiture of the equipment purchased with the Grant. City shall provide written
notice to Recipient of any such failure and Recipient shall have thirty (30) days after receipt of
such notice to correct such failure. In the event Recipient fails to cure the failure within such
thirty (30) day period, Recipient shall within ten (10) days thereafter return all equipment
purchased with the Grant and the balance of any Grant funds remaining to City.
16. After the terms of the equipment grant agreement are signed and fulfilled, the City of Dubuque
releases ownership of the equipment to the awarded applicant.

PEG ACCESS CHANNEL OPERATOR EQUIPMENT GRANT DETAILS
The PEG Access Channel Operator Equipment Grant is dedicated to supporting the operations of the City
of Dubuque's public, educational, and governmental (PEG) access channels. Channel operations include
but are not limited to the maintenance of broadcasting equipment, scheduling of PEG programming, the
creation of PEG programming, and general daily support of PEG channel operations.
Through this opportunity, equipment is funded to organizations that operate and produce content for
one of Dubuque's PEG channels.
ELIGIBILITY AND PROCESS OVERVIEW
WHO CAN APPLY: Applications a limited to organizations that operate and manage one more of the City
of Dubuque's PEG access channels.
WHAT CAN BE REQUESTED: Production equipment related to channel operations and the creation of
PEG programming is eligible for this request. Applicants must complete application materials which
include a list of requested equipment, a proposal to how the equipment will be used to advance channel
operations and programming creation, and a minimum of three vendor quotes for the requested items.
Subscription -based software is not applicable through the PEG Access Channel Operator Equipment
Grant.
Computers and laptops may be requested; however, applicants must receive direct quotes from a
reseller or distributor. Quotes must include built specs suggested by a computer specialist based on
the video performance needs. Please include contact information and a reference number for each
quote.
WHEN: Channel Operator Equipment Grant can be submitted for review at any time, however operators
are encouraged to submit applications by a date determined by the Cable TV Commission, to be
considered during the Cable TV Commission's yearly review of Community PEG Equipment Grant
applications.
CONSIDERATION PROCESS: Commissioners will vote to either recommend funding, partial funding, or
not funding the PEG Access Channel Operator Equipment Grant requests based off the following criteria:
• Eligibility requirements
• Completion of application materials
• Requested equipment supports the production of access programming
• Applicant demonstrates sufficient knowledge regarding use of requested equipment
Please note, the Cable TV Commission serves as an advisory commission. Their recommendations
related to PEG Access Channel Operator Equipment Grant requests will go before the Dubuque City
Council for final approval.

APPLICATION REQUIREMENTS: Applications must be completed online using the PEG Access Channel
Operator Equipment Request form and will require applicants to provide:
• Requested Equipment List
o An equipment list that includes a product name, model number, and quantity for each
requested item must be submitted.
• Plan for Use of Requested Equipment
o Applicants must provide a proposal that details how the requested equipment will be
used and how it will assist in the advancement of channel operations or the creation of
video programming.
• Procurement of 3 Vendor Quotes
o Quotes from 3 different vendors must be included for all items requested.
o If a vendor does not carry a specific item, applicants can instead list a similar item from
that vendor or provide an additional quote from an additional vendor for that specific
item.
• Proof of Quotes
o A proof of quote is required for each listed vendor. A proof of quote must come directly
from the vendor or the vendor's site and must show the requested item(s), listed prices,
and quantities.
o A PDF of a shopping cart is an acceptable proof of quote, however it must list each item,
cost, quantity, and clearly show that it is from the vendor's website.
o Quotes for computers and laptops must include built specs suggested by a computer
specialist based on video performance needs. Proof of quote must include these specs
and include contact information and a reference number.
TERMS OF AGREEMENT
If a PEG Access Channel Operator Equipment Grant request is supported by the Cable TV commission for
funding, the applicant must enter into an agreement with the City of Dubuque for proper use of the
equipment. A typical agreement includes, but is not limited to, the requirement that:
• Equipment is used solely for non-commercial purposes.
• Channel operator oversees daily operations of a PEG channel.
• A minimum of 20 programs with a cumulative of runtime of 90 minutes is produced yearly.
• A year-end grant report is presented to the Cable TV Commission and includes:
o List of access programming created, including total run times and short description of
each program.
o Video sample of programming created.

• Recipient commits to producing content, including all key production elements, without the
substantial use of artificial intelligence (Al) assistance.
• All equipment is returned to the City of Dubuque if applicant fails to fulfill the terms of this

• Four years after the terms of the equipment grant agreement are signed and fulfilled, the
City of Dubuque releases ownership of the requested equipment to the awarded applicant.
