Proposed Parking Lot Improvements on Hawthorne Street
INTRODUCTION
This memo provides information regarding the platting and acceptance of additional right
of way on Hawthorne Street near its intersection with Kerper Boulevard pursuant to a
development agreement and subsequent Right of Way Dedication Agreement between
the City of Dubuque and Union at the Marina, LP. Union at the Marina, LP is a subsidiary
of The Annex Group.
BACKGROUND
Union at the Marina, LP recently purchased 5.25 acres Dubuque at 1860 Hawthorne
Street from the City. Union at the Marina, LP plans to use the site to construct its latest
housing development. The project will create 201 affordable rental units in the North End
of the Greater Downtown Area. The project is anticipated to begin in August of 2025.
The approved site plan includes a proposed public parking lot on the Hawthorne Street
Right of Way that partially encroaches onto the Union at the Marina, LP property. Per the
attached Right of Way Dedication Agreement, the City of Dubuque and property owner
Union at the Marina, LP entered into an agreement on this project. As part of that
agreement, Union at the Marina, LP agreed to sell and dedicate to the City the additional
right of way needed to accommodate the proposed public parking lot improvements on
Hawthorne Street. Per the agreement, the City is responsible for the surveying and
platting of the proposed division of the property. The City and Union at the Marina, LP
closed on the 5.25-acre property in November of this year.
DISCUSSION
In accordance with the agreement, the additional right of way on Hawthorne Street needs
to be platted. The platting of this additional area has been coordinated with the property
owner, Union at the Marina, LP, and they have signed and consented to the plat.
The City of Dubuque Engineering Department has prepared the attached acquisition plat
to provide the right of way area. The area being platted will be dedicated to the public for
street and utility purposes.

RECOMMENDATION
I recommend that the City Council approve the Acquisition Plat of Lot A of Lot 1-2 of Block
2 in River Front Subdivision No. 3, in the City of Dubuque, Iowa, which provides additional
right of way needed to accommodate the proposed public parking lot improvements on
Hawthorne Street by the adoption of the attached resolution.
ACTION TO BE TAKEN
I respectfully request approval of the Acquisition Plat to accommodate the proposed
public parking lot improvements on Hawthorne Street, and acceptance of the dedication
of said lot for Right of Way for street and utility purposes, through the adoption of the
enclosed resolution.

APPROVING THE ACQUISITION PLAT OF LOT A OF LOT 1-2 OF BLOCK 2 IN
RIVER FRONT SUBDIVISION NO. 3, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, an Acquisition Plat dated November 18, 2024 prepared by The
City of Dubuque Engineering Department describing Lot A of Lot 1-2 of Block 2 in
River Front Subdivision No. 3, in the City of Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto;
and
Whereas, upon said plat appears Lot A of Lot 1-2 of Block 2 in River Front
Subdivision No. 3, in the City of Dubuque, Iowa, which Union at the Marina, LP by
said plat has dedicated to the public forever.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated November 18, 2024, prepared by The City of
Dubuque Engineering Department, relative to the real estate hereinabove
described be and the same is hereby approved, and the Mayor and City Clerk be
and they are hereby authorized and directed to execute said plat and on behalf of
the City of Dubuque, Iowa.
Section 2. That the dedication of Lot A of Lot 1-2 of Block 2 in River Front
Subdivision No. 3, in the City of Dubuque, Iowa, for Right of Way for street and
utility purposes, as it appears on said Acquisition Plat, be and the same are hereby
accepted.
Section 3. That the City Clerk be and is hereby authorized and directed to
file said plat and certified copy of this resolution in the office of the Recorder, in
and for Dubuque County, Iowa.

RIGHT OF WAY DEDICATION AGREEMENT
This RIGHT OF WAY DEDICATION AGREEMENT (the "A reern ") is entered into this day
of November, 2024 by and between Union at the Marina, LP, an Iowa limited partnership (the "Developer"),
and the City of Dubuque, Iowa (the licit
RECITALS:
WHEREAS, a Purchase Agreement and Development Agreement, dated for reference purposes as the
166' day of October, 2023, was entered into by and between the City and Developer, as amended by that certain
First Amendment to Purchase Agreement and Development Agreement dated October 24, 2023, as Ruther
amended by that certain Second Amendment to Purchase Agreement and Development Agreement dated
December 4, 2023, and further amended by that certain Third Amendment to Purchase Agreement and
Development Agreement dated on or about November 4, 2024 (collectively, the "Agreement'); and
WHEREAS, the property to be transferred by the City to the Developer pursuant to the Agreement is
Lot 1-2 of Block 2, in River Front Subdivision No. 3, in the City of Dubuque, Iowa, according to the plat
thereof recorded as Doc ID 011154500008, File 2023-00009853, i.n the public records of the Recorder's Office
of Dubuque County, Iowa (the "Property"); and
WHEREAS, the City determined that an approximately 0.064 acre portion of the Property as shown in
the area outlined in pink on the attached Exhibit A (the "ROW Area") is needed for City right of way purposes;
and
WHEREAS, the City has agreed to prepare, for Developer's review and approval, an acquisition plat
for the ROW Area, and Developer has agreed to dedicate the ROW Area to the City following Developer's
acquisition of the Property; and
WHEREAS, Developer and the City desire to memorialize their agreement with respect to the
dedication of the ROW Area as set forth herein.
NOW, THEREFORE, for the mutual covenants and obligations set forth herein, and other good and
valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as
follows:
1. Recitals. The Recitals are incorporated into this Agreement.
2. ROW Area. The City shall prepare, for Developer's review and approval, an acquisition plat,
deed, and/or other documents necessary (the "ROW Documents") to transfer title of the ROW Area to the City
for use as public right of way. Such ROW Documents shall consistent with the requirements of Iowa Code
Section 354.4 and shall be approved by the holders of any mortgage on the Property. City and the Developer
shall cooperate in the dedication of the ROW Area to the City, and no consideration shall be due to the
Developer or the City for the dedication of the ROW Area.
3. Miscellaneous. The provisions of this Agreement shall be binding upon, and shall inure to the
benefit of, the successors and assigns of Developer and the City. This Agreement shall be construed and
enforced in accordance with the laws of the State of Iowa. This Agreement may be executed in counterparts,
all of which counterparts collectively shall constitute one agreement, binding on the parties hereto,
