PETITIONS AND COMMUNICA-

Petitions and Communicationb.
Petition of Albert Hanning asking
that Spring street be graded and the
Engineer instructed to give the prop-
erty owners along the street the grade,
also asking that Martha street be grad-
ed so that surplus material from said
street could be used on Spring street,
was, on motion, granted and the Engi-
neer to be instructed to prepare plat
and profile.
Petition of John Thill asking that
taxes on lots 8 and 9 of undivided lot
712 Quigley's Subdivision be reduced
for the years 1906 and 1907 buildings
on said property having been entirely
destroyed by fire was on motion re-
ferred to the committee of the whole.
Petition of the Dubuque Packing
Company asking that the taxes on their
property be canceled excepting the tax
on its land, in accordance with the
agreement made that taxes be canceled
for a period of ten years was on mo-
tion referred to the committee of the
whole.
Petition of Elizabeth Dearborn ask-
ing that the taxes on the south one -
half of Lot 498 for the year 1907 be re-
duced, she being a widow with four
minor children to support was on mo-

Petition of Herman Mauer et al. ask-
ing that an electric light be placed at
the intersection of Park Hill avenue
and Davenport street was on motion
granted and the matter referred to the

Petition of H. B. McCarten et al. ask-
ing that an electric light be placed on
the corner of Langworthy avenue and
Alpine street was on notion granted
and the matter of placing the light re-
ferred to the committee on police and
light with power.
• Petition of Peter Schneider et al.
asking that St. Ambrose street from
Asbury street to Arch street or the
alley south of Arch street be lowered to
the established grade so that they can
lay cement sidewalks was on motion
referred to the committee of the whole.
Petition of the Fifth Ward Non -Par-
tisan League by E. J. Wiedner, secre-
tary, asking that the council take
action to compel the Key City Gas
Company to remove their gas pipes
running through the storm sewer on
Kaufmann avenue, also running
through the Bee Branch sewer on 24th
street was on motion referred to the
street committee and city attorney.
Petition of the Fifth Ward Non -Par-
tisan League by E. J. Wiedner, secre-
tary, asking that the council order
sidewalks four feet wide of brick or
cement on the north side of Kaufmann
avenue, from Valeria street to Cushing
Place; also on the north side of 24th
street from Pine to Jackson street; also
on the south side of 25th street from
Washington to Jackson street, on the
west side of Washington street from
24th to 25th streets, excepting where
walks of brick or cement are already
laid was on motion referred to the side-
walk inspector to serve the proper
notices.
Petition of the Fifth Ward Non -
Partisan League asking that rumor of
the sewage from the insane hospital
running in close proximity to the water
level as to endanger the health of the
users of the city water be investigated
was on motion referred to the Board of
Health and the Water Works Trustees
to report to the council.
Petition of the Fifth Ward Non -Par-
tisan League in reference to the Bee
Branch storm water sewer in Washing-
ton street, and also the Kaufmann
avenue storm water sewer being almost
entirely filled with debris and asking

that the council take some action
toward having same cleaned out; also
asking that suitable screens be placed
at the intakings for obvious reasons
was read and on motion rules were
suspended to allow members of the
League permission to address the coun-
cil. Permission being given, Mr. Frank
Scharle and Otto F. Lange then ad-
dressed the council. Petition in refer-
ence to installing screens was on mo-
tion referred to street committee, city
attorney and street commissioner. The
matter of having the storm sewers
cleaned was on motion referred to the
committee on streets.
Aid. Thomas stated Kaufmann
avenue was in very bad shape where
the sewer was constructed last fall, on
motion the street commissioner was
ordered instructed to give Mr. Korman
2 days' notice to repair the street where
sewer was built on Kaufmann avenue
and to send the steam roller to Kauf-
mann avenue to roll said street as soon
as possible.
Claim for damages of Thomas Fitz-
simmons claiming damages of $5,000
for injuries received on Fourth street
extension was on motion referred to the
committee on claims and city attorney.
Claim of C. J. Barrett, claiming dam-
ages of $5,000,00 for injuries sustained
by falling on a defective sidewalk on
Twenty - fourth street, was on motion
referred to Committee on Claims and
City Attorney.
Original notice in the District Court
of George Becket against the City of
Dubuque for damages to the amount
of $3,000.00 was on motion referred to
the Committee on Claims and City
Attorney.
Communication from the Governor
Greys by A. T. Baumgartner, captain,
returning the lease prepared by order
of the Council and submitting another
lease for the approval of the Council,
was read and on motion accepted and
approved, provided clause is inserted
that building would be rented to pri-
vate parties only by permission of the
City Council.

each $25.00.

O'Farrell Contracting Co., eight inch

On motion, contract for constructing
sanitary sewer in Alta Vista street was
awarded to O'Farrell Contracting Co.,
and their bond placed at $100.00.
Ald. Stumpf, chairman of the com-
mittee on sewers, reported as follows:
Your committee on sewers, to whom
was referred the petition of P. Regan
asking that the city pay the bill of
Mullen Bros. amounting to $13.00, be-
cause the work for which this bill was
contracted was done on the city's sew-
er, would respectfully state that the
men on the sewer gang report that
water flowed freely through the city's
sewer, and that therefore the stoppage
must have been in the private connec-
tion; we would therefore recommend
that said petition be received and filed.

the report of the committee on sewers.

Ald. Clancy, chairman of the commit-
tee of the whole, reported as follows:
Your committee of the whole, to
whom was referred the petition of the
A. R. Flick Box Co. asking that on ac-
count of the large expense it has in-
curred in establishing its factories and
also because of the employment it gives
to a large force of men, the taxes on its
personal property and improvements
be cancelled for a period of five years,
would respectfully recommend that the
prayer of the petitioner be granted, and

that the taxes of said firm for a period
of five years, beginning with the tax of
1907, be placed on a basis of $3,000.00
valuation.
We further recommend that . the
Treasurer be instructed to cancel the
tax for the year 1907 on the foregoing
basis.
Also, your committee of the whole,
to whom was referred the petition of
Otto Frenzel, asking that the valuation
on the north one -half of city lot 311 be
reduced to $1,000,00, would respectfully
recommend that said petition be re-
ceived and filed.
Also, your committee of the whole,
to whom was referred the petition of
the Dubuque Altar Mfg > Co., asking
that the exemption granted it in 1900,
be extended for an additional five years,
would respectfully recommend that the
prayer of the petitioner be granted,
said exemption to commence with the
taxes for the year 1906.
We would further recommend that
the City Treasurer be instructed to can-
cel the taxes on all machinery, per-
sonal property and improvements not
including real estate, levied against
said company for the years 1906 and
1907.
Also, your committee of the whole,
to whom was referred the petition of
C. J. Peterson and P. S. Slocum, ask-
ing that when grading Grandview ave-
nue the city cause to be filled the
ditches which were washed out through
the sidewalk and across certain lots
belonging to them by reason of water
flowing thereon from the street, would
respectfully recommend that said side-
walk be filled and that any surplus ma-
terial not needed by the city, be used
for the purpose of filling the ditches on
said lots.
Also, your committee of the whole,
to whom were referred the bids for fur-
nishing 1,500 feet of 2 1 -2 inch cotton
jacket rubber lined hose, would re-
spectfully recommend that the contract
be awarded to the Dubuque Rubber and
Belting Company at eighty -three cents
per foot coupled. Said hose to be
guaranteed for a period of five years
and to withstand a pressure of four
hundred pounds per square inch.
Also, your committee of the whole,
reporting on the within petition of the
Dubuque and East Dubuque Ferry Co.,
for a fifty foot space in the ice harbor
for a ferry landing, would respectfully
recommend that the prayer of the pe-
titioner be granted and that such loca-
tion as may be selected by the harbor-
master and committee on harbors be

City Attorney Kintzinger reported
as follows:

Gentlemen: —I would respectfully
recommend that the action taken by
the City Council in referring the bill
of M Tschirgi and Son against the
C. G. W. Railroad company for con-
structing storm sewer in Ninth street,
to the City Attorney for collection be
reconsidered and the matter referred
to the Street Committee, City Engin-
eer and City Attorney.

City Recorder Linehan presented and
read the printed notice, certified to by
the publisher, of the council's intention
to improve Louisa street from the south
side of Delhi street to the north side
of Grace street. No remonstrance being
filed and no one in the room objecting
to the said improvement, the notice
was, on motion, received and filed.
City Recorder Linehan also present-
ed and read the printed notice, certi-
fied to by the publisher, of the council's
intention to improve Pleasant street
from Stafford avenue to the east line
of Viola street. No remonstrance being
filed and no one in the room objecting
to the said improvement, the notice
was, on motion, received and flied.
City Recorder Linehan also presented

intention to improve Hennepin street
from Windsor avenue to Stafford ave-
nue. No remonstrance being filed and

Sidewalk Inspector Mahoney reported
as follows:
To the Honorable Mayor and City
Council:
Gentlemen: —I wish to report that I
have notified the property owners along
5th avenue from Rhomberg avenue to
the end of the macadamized street, and
find that said property will stand the
assessment. I have also notified prop-
erty owners along the west side of
Windsor avenue from Burden to Davis
avenue, also owner of lot 15, McCra-
ney's 2nd addition, also owners on both
sides of Garfield avenue from the C.
G. W. R. R. tracts to Tiniest street and
Johnson avenue, except where walks
have already been laid.

granted to said company for a period of
five years.
Also, your committee of the whole,
to whom was referred the bill of Peter
Eisbach for $2,903.00, balance due on
the Bee Branch sewer, would respect-
fully recommend that he be allowed the
sum of $170.00 with $399.00 interest on
warrant for $1,663.75 due said Peter
Eisbach and which the city has had the
use of for the past four years, and that
a warrant in the sum of $569.00 be or-
dered drawn in favor of the Mayor to
be paid said Peter Eisbach upon his
giving a receipt accepting said amount
in full settlement of the claim.
Also, your committee of the whole
would respectfully recommend that the
action of the City Council in ordering
the bill of A. A. Cooper Wagon and
Buggy Co. paid, be reconsidered, and
that $17.95 per wagon, the contract
price, be paid for the painting of said
wagons. Also that a deduction of $4.00
per wagon be made in the charge for
the two extra coats inside the tanks
because one coat of oil was provided
for in the original contract price, leav-
ing the net amount due $232.00, for
which amount we would recommend
that a warrant be ordered drawn on
the City Treasurer in full settlement of
the claim.

Ald. Clancy moved the adoption of
the various reports of the committee
of the whole. Carried.
ILayor Schunk stated that the re-
port had been made that the painting
on the inside of the sprinkling wagons
was defective, and, on motion, action
of the committee of the whole order-
ing the bill of A. A. Cocper as cor-
rected, was reconsidered and the mat-
ter referred to the committee of the
whole for invstigation.
Ald. Thomas stated that the vault at
the Rhomberg avenue engine house was
in bad shape, and moved that the City
Engineer be instructed to prepare plans
and specifications for constructing
sanitary sewer in Reed avenue from the
engine house to the manhole in the
alley between Rhomberg and Lincoln
avenues, and the Recorder advertise for
bids for constructing sewer and present
bids to Council at the meeting to be
held April 9th. Carried.
Ald. Clancy stated that the fire de-
partment were badly in need of a fire
horse, On motion, the committee clerk
was instructed to advertise for bids for
the purchase of a fire horse.
Ald. Closs moved that the City Elec-
trician be instructed to have the tele-
phone pole on Rhomberg avenue about
25 feet from Reed avenue, removed, as
said pole is not necessary. Carried.
Ald. Clancy moved to adjourn to
Thursday evening, April 9th, 1908. Car-

avenue and Hennepin street, be graded
and macadamized, was , on motion,
granted and the proper resolutions to
be offered at next meeting of the Coun-
cil.
Petition of E. J. Lancaster asking
that he be granted the right of way on
the south bank of the ice harbor on
Jones street one hundred feet east of
the coal bin of T. J. Mulgrew Company,
and that the Council request of the
Chicago, Burlington and Quincy Rail-
way Company the right and general
use of said strip of land, was, on mo-
tion, granted and the matter referred
to the agent of the C., B. & Q. R. R. Co.
to extend the tracks.
Petition of Eugene Anderson et al
asking that the gutter on the north side
of Julien avenue from Walnut street
to the west line of lot 9 of out lot 738,
be reconstructed with cement and pav-
ing brick, was, on motion, granted and
the present Street Commissioner to
carry out the provisions of said pe-
tition.
Petition of the Fifth Ward Non -
Partisan League asking that several

Northern District of Iowa, notifying
the city that the Key City Gas Co. had
commenced injunction proceedings to
enjoin City of Dubuque from enforcing
90c gas ordinance recently enforced,

REPORTS OF COMMITTEES.
Ald. Hines, chairman of the commit-
tee on ordinances, presented and read
an ordinance repealing an ordinance

providing for the regulation of Gas
rates and meters and providing a pen-
alty for the violation thereof, and
stated that the ordinance had been read
for the first time at the meeting of the
Council March 5th, 1908, and moved
that the ordinance be adopted as read.
Ald. Closs moved as an amendment
that the ordinance be referred to the
new Council.
Ald. Clancy stated that the city had
just been served with notice of a law
suit by the Gas Company, and he did
not think the outgoing council should
allow a law suit to be brought on the
new council to defend, if it could be
avoided, and that the adoption of an
ordinance to repeal the gas ordinance
would cause the settlement of the law
suit. He then asked for an opinion
from the City Attorney.
City Attorney Kintzinger stated that
the law suit of the Key City Gas Com-
pany had already been started and he
did not think that it would make much
difference now whether the ordinance
to repeal the gas ordinance would be
adopted or not.
\Tote on amendment was then taken
and was carried by the following vote:

Carney for personal injuries received

lowed Mr. Carney, on condition that he
receive the same in full settlement of
any and all liability and claims which
he has against the city therefor.

Non - Partisan League asking that side-
walks of brick or cement be ordered on
Rhomberg avenue from First to Sev-
enth avenue, and that the storm water
sewer in Kniest street from Dee's bas-
ket factory to the C., M. & St. P. R. R.
culvert be arched and covered so as to
prevent same from being used as a
clumping ground, and also that said
Kniest street sewer be cleaned out,

Petition of the Fifth Ward Non -Par-
tisan League asking that the office of
sidewalk inspector and sewer foreman
be abolished, and the office of commis-
sioner of buildings, sewers and side-
walks be created, was, on motion, re-

Petition of George Grundy et al ask-
ing that they be granted permission to
construct a six -inch sanitary sewer in
Bennett street from Grandview avenue
westward about 240 or 250 feet was on
motion granted and the work to be done

ing that Yale street for a distance of
300 feet from Alta Vista street be grad-
ed and improved and that the sanitary
sewer be continued from the middle of

Ald. Clancy moved that all the candi-
dates receiving a majority or a plural-
ity of the votes cast be declared elect-
ed. Carried.
Aids. Clancy, Cioss and McEvoy, re-
tiring aldermen, all made a few re-
marks of their work during their term
as aldermen in their various wards.
Mayor Schunk then addressed the
retiring members of the Council as
follows :
We have come to the parting of the
way. I have no apologies to offer for
the administration now closing, but
rather claim for it a measure of suc -•
cess rarely attained for former coun-
cils. We promised a greater Dubuque,
and in the line of important improve --
ments the promise was kept. The brick
paving of that important thoroughfare,
Eighth street, was quickly followed by
similar paving of lower Iowa street,
First street, Ninth, Eleventh and Thir-
teenth streets, extensive improvements
were made in various parts of the city.
Many miles of sanitary sewers were
laid, and scores of connections of
houses with these sewers ordered and
secured.
We have tried to do our duty, and
in the calm that follows the storm of the
most strenuous campaign ever waged
in Dubuque, we will be accorded at
least a measure of justice and com-
mendation."
City Attorney Kintzinger then ad-
ministered the oath of office to the
newly elected Mayor, H. A. Schunk.
Mayor Schunk then called all the
newly elected Aldermen before the desk
of the City Recorder and administered
to them the oath of office.
The members are as follows:

Alderman -at -Large Haas of the Fifth
ward.
Ald. Saul of the First ward.
Ald. O'Rourke of the Second ward.

present fiscal year to the 15th day of
April, 1908.

Petition of Joseph Baker asking that
the city refund him $9.00, claiming he
had paid $10.00 for a license to sell

was read, and on motion received and
filed.
Petition of Mrs. J. E. Fairbanks,
President of the Art Division of the
Dubuque Women's Club, asking that
the city assist them in putting Library
park in shape and in keeping park up
during the summer, was, on motion, re-
ferred to the committee on public
grounds and buildings.
Remonstrance of T. J. Mulgrew Com-
pany, remonstrating against the grant-
ing of the petition of Capt. E. J. Lan-
caster for the extension of the Burling-
ton track along the south side of the
ice harbor, and for permission to erect
a coal chute on the harbor front, was
read.
Ald. Frith moved that the Council
rescind the action taken by the former
Council in granting the petition of Capt.
E. J. Lancaster. Carried.
Md. O'Rourke moved that the re-
monstrance of T. J. Mulgrew Company
be received and filed, and the original
petition of Capt. E. J. Lancaster be
denied. Carried.

City Council.
Gentlemen: —Your Board of Health
would respectfully report that at a
meeting held April 23rd, 1908, the con-
tract for hauling garbage and dead
animals for the season of 1908, was
awarded to E. T. Frith at $16.89 per
day during the entire season.
Also report that a contract was
entered into by the Board of Health for
taking care of sick seamen suffering
from contagious diseases, the United
States government to pay the City of
Dubuque $2.50 per day for said services.
Also, your Board of Health begs to
report that we have appointed Dr.
Charles Palen Health Officer for the
ensuing year, also that we have ap-
pointed Frank Flynn, Sanitary Police-
man for the ensuing year, the latter ap-
pointment we submit to your honorable
body for approval.
Also, your Board of Health would re-
spectfully recommend that warrants be
drawn in the sum of $39.00 in favor of
E. P. Peryon and Edward McEvoy, re-
spectively, for acting as members of
the Board of Health from May 1, 1907,
to May 1, 1908.

To the Honorable Council, City of Du-
buque:
Dear Sirs: - -I herewith submit the re-
port of the committee of the whole,
adopted by motion at the last regular
session of the City Council held on
Thursday, April 16, 1908, reducing the
salaries of the various appointive city
officers.
To begin with, I believe that it is a
bad example to set to other employers
of wage earners, to have the City of
Dubuque take the initiative in wage
reduction. This is one of the strongest
objections I have to the action taken.
Further than that, and with all due
respect and courtesy to those of this
honorable body who differ with me on
this proposition, I submit that the
scale of wages it is sought to change
is not too high, but on the contrary,
appears to be eminently fair and rea-
sonable. We have competent men in
control of the police and fire depart-
ments, and should pay them the salaries
due intelligence and fitness. What we
all desire is the highest possible effi-
ciency--and that is never compatible
with low wages. The salary of $125.00
per month paid the Chief of the Police
and the Chief of the Fire Department.
is certainly not excessive in a city of
this size and metropolitan importance.
The other salaries paid are only fair in
proportion with these. When we under-
take to reduce the meagre salaries of
then getting but $45.00, $50.00, $60.00 or
$65.00 per month, we are putting the
knife into the very marrow of their ex-
istence, because, under the present high
cost of living, it will be depriving them
of the means of comfortable subsist-
ence.
The old salary list that it is sought
to restore was in effect when the cost
of living was at least twenty -five per
cent. lower than today.
I therefore return to you herewith,
the report of your committee of the
whole reducing salaries of appointive
officers, adopted on motion by this
Council at its last regular session, and
hereby veto the motion that carried
adopting the same.

NOTICE.
In Relation to Cleaning Alleys.
Section 34 of the Ordinance in rela-
tion to Offenses and Penalties reads as
follows:
No person shall cast or leave ex-
posed in any street, alley, lot, common,
or water course within the city, the
carcass of any animal, or any putrid
or unsound meat, fish, or other sub-
stance, or make use, keep, or permit,
in his, her or their dwelling house,
shop, store, factory, outhouse, cellar,
yard, lot or any other place within the
city, any noisome or offensive liquid,
or substance injurious to the health
of the citizens, or an annoyance to the
neighborhood, or throw any filth, ma-
nure, offal, or other offensive matter
in any street, alley, lot, or water course
in the city, and any person who shall
refuse or neglect to remove on being
notified by the city any such offensive
substance made, used or kept by such
person, shall be subject to a fine of
not less than one dollar nor more
than twenty dollars, and be imprisoned
until such fine and costs are paid, not
exceeding thirty days.
In accordance with the foregoing
section, you are hereby notified to re-
move all filth, ashes, rubbish, etc., from
the alley in the rear of your premises
within ten (10) days from the date of
this notice or you will be prosecuted to
the fullest extent of the law.

Absent —None.
Ald. Frith stated that in the list
of warrants issued for the month of
March and printed in the council pro-
ceedings for the month of April, 1908,
the location of the various piles of
macadam purchased in the First and
Second districts was not stated, where-
upon Ald. Frith moved that the council
proceedings for the month of April,
1908, be approved as printed with the
exception of that portion relating to
the macadam broken in the First and
Second road districts. Carried.
Ald. Frith moved that that portion
of the council proceedings for the
month of April relating to macadam
be referred to the street commissioner
and city engineer to report to the
council at their next session. Car-
ried.

Wanted —Fire Horses.
The committee on fire desire to pur-
chase two horses for the fire depart-
ment. Each must weigh 1400 pounds
and be not less than five years old,
sound of eye, wind and limb. Parties
